The City Council passed this permit with 14 stipulations. Of these 14 stipulations , only two remain unfinished. whey consist of: 1. Repair the parking lot as per City Engineer's specifications and stripe nine stalls by September 15, 1987. 2. Sod area between the parking lot and planting beds by June 15, 1987. I have discussed these items with the owner of the property, Mr. Dwayne Waldoch. He states that these two items were unable to be completed due to the fact that Landscape Contractors and Asphault Contractors are booked for the rest of the season. She shortage of sod has also kept item 2 from being completed this season. Mr. Waldoch has provided the city with a bond for $5,000.00 which expires on October 1, 1988. It is my recommendation that we extend the deadline dates to May 30, 1988 for repairing the parking lot and June 6, 1988 for installing the sod where needed. Mr. Peterson believed that he was to be heard at the March 25, 1987 Planning Commission meeting and was in attendance at that time. In order to facilitate Mr. Peterson construction plans the Commission felt that Council should set the public hearing for April 20, 1987 and that the item could come before the Planning Commission on April 8, 1987. A sketch of Mr. Peterson's plans is attached. Staff sees no problems with this request. The right-of-way is 33 feet wide. One half of the property would go to the property to the west (the petitioner) and one half to the easterly property, if requested BACKGRDUND Zhe petitioner is requesting the vacation in order to add on to his single fanily hare. The vacation will eliminate the need for a side yard setback variance. Zhe right-of-way is not utilized, and is a grassy area and does not alio with the 2 1/2 Street right-of-way to the north. A gas line runs through the right-of way. RECOMMENDATION On April 8, 1987, the Planning Commission recommended approval of this request with the stipulation that a utility easement will be retained over the entire portion. Staff supports this action. The present right-of-way is 33 feet wide. One•half or 16.5 feet would go to the property to the west. BACKGROUND The petitioner is requesting the vacation in order to add on to his single family home. The vacation will eliminate the need for a side yard setback variance. Councilman Fitzpatrick stated he would like staff to determine why these two streets aren't in alignment. Mr. Herrick, City Attorney, stated it appears it is all part of City View Addition. He stated the land to the west is Block 1 and the land to the east is Block 2 and if the entire area is vacated, one-half would go to Lot 15, Block 1 and the other half would go to Lot 1, Block 2. He stated if only the west half is vacated, then the description will have to change. Mr. Peterson, the petitioner, stated there is a lot of pedestrian traffic and a path running in the other 16-1/2 feet. He stated all he needs is space to construct a garage. Mr. Jim Anderson, Administrator for Minnesota Public Affairs for Minnegasco, appeared before the Council regarding Minnegaseo's position on this proposed franchise fee and stated a letter dated May 1, 1987 has been forwarded to the Council. He stated Minnegaseo is opposed to anything that imposes taxes or fees or discriminates against its customers. He felt the proposed franchise fee discriminates against lower income groups and customers who prefer natural gas over other energy sources. He stated the fee would place Mdnnegaseo in a very serious position as the price ratio of gas to oil is only six cents difference. He stated this franchise fee would add a three percent tax which would mean an additional cost of seven cents and the difference in cost between gas and oil increases to 13 cents per gallon. He felt Minnegasco may lose some high volume customers with this 13 cents difference in cost and when large volume users are lost, this amount has to be made up by the small volume customers. Mr. Anderson felt if the City meds additional revenue, a mill levy would be more appropriate because everyone would pay rather than just the gas customers.
