HADTRATH: Per Section 205.1574, Paragraph 4,-Df--the- ridley City Code, to allow the construction of a single family dwelling in a CRP-2 Zone (flood fringe) , located on Lots 13, 14, and 15, Riverview Heights, the same being 7919 Broad Ave. N.E. MOTION BY MR. OQUIST, SECONDED BY MR. SABA, TO OPEN THE PUBLIC HEARING ON SP #81-09, BY DALE V. HADTRATH. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRMAN HARRIS DECLARED THE PUBLIC HEARING OPEN AT 8:45 P.M. Mr. Deblon stated the petitioner plans to build a single family dwelling in a CRP-2 Zone (flood fringe) . The City has adopted a flood plain ordinance that allows the building in the flood fringe with a special use permit and other flood proofing measures. The major measure is to fill the property until it is one foot above the flood elevation; in this case, that elevation is 823.7 ft. Mr. Harris asked about a drainage plan. He stated his only concern is drainage out of the property. Mr. Garland Lagesse, 7951 Broad St. N.E. , stated he was concerned about the question of liability if drainage problems do exist, and he was also concerned about encroachment problems. Mr. Harris suggested that the house be shifted toward Broad St. to within 17.5 ft. of the street. Then the petitioner can fill around the whole structure and slope it so that all the water is drained off the property. This would solve Mr. Lagesse's concerns. MOTION BY MS. GABEL, SECONDED BY MR. SABA, TO CLOSE THE PUBLIC HEARING ON SP #81-09 BY DALE V. .HADTRATH. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRMAN HARRIS DECLARED THE PUBLIC HEARING CLOSED AT 9:40 P.M. Mr. Oquist stated that if a drainage plan is prepared and that plan is acceptable, this seemed like a very worthwhile and attractive home. MOTION BY MR. OQUIST, SECONDED BY MR. VACATION REQUEST, SAV #81-03, BY BURTON H. SCHERVEN: By Petition #9-1981 , to vacate 66th Avenue N.E. between Pierce Street and Lucia Lane. Mr. Deblon stated that at this time, the land is being used for gardens which is probably the best use of the land at this time. He stated that NSP has requested that the City retain 10 ft. for a utility easement, and the City is requesting about 30 ft. be retained for a drainage easement. Staff is recommending that this entire area be retained for utility and drainage easements. MOTION BY MS. GABEL, SECONDED BY MR. SABA, TO RECEIVE THE LETTER DATED SEPT. 15, 1981, FROM NSP REQUESTING A UTILITY EASEMENT. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRMAN HARRIS DECLARED THE MOTION CARRIED UNANIMOUSLY. Mr. Oquist questioned why this area isn't made into a street so that there is another way to get off Lucia Lane, rather than having to come all the way back to Mississippi St. Lucia Lane is about 2-3 blocks long. He stated there are only four people listed on the petition that are directly affected, but what about the other people in the area? Mr. Harris stated he understood what Mr. Oquist was saying, but there does not seem to be any problems. MOTION BY MR. KONDRICK, SECONDED BY MR. UPON A VOICE VOATE, ALL VOTING AYE, CHAIRMAN HARRIS DECLARED THE MOTION CARRIED UNANIMOUSLY. 250 REGULAR MEETING OF SEPTEMBER 28, 1981 PAGE 6 jl CONSIDERATION OF REQUEST FOR A SPECIAL USE PERMIT, SP #81-09 TO ALLOW CONSTRUCTION OF SINGLE FAMILY DWELLING IPJ CRP-2 ZONE, 7919 BROAD STREET, DALE HADTRATH: Mr. Flora, Public Works Director, stated the City Flood Plain Ordinance- requires that in order to build in the flood fringe, a special use permit- is required and other flood proofing measures. Mr. Flora stated, in this case, the property is to be filled until it is one foot above the flood elevation. He stated there was some concern by the Planning Commission regarding the drainage and they recommended approval of the special use permit with a stipulation that a drainage plan be provided _ to the City and the petitioner work with the City to insure proper drainage and proper placement of the house on the property. Mr. Flora stated he has received a drainage plan this evening and it appears a drainage system has been provided to satisfy this requirement. MOTION by Councilman Fitzpatrick to concur with the recommendation of the Planning Commission and grant Special Use Permit, SP #81-09 to allow construction of a single family dwelling in a LRP-2 zone at 7919 Broad Street, with the stipulation that a drainage plan be provided and that the petitioner work with the City staff to insure proper drainage and proper location of the house on the property. Seconded by Councilwoman Moses-Plartin. Mr. Lagesse, 7951 Broad Street, questioned the location of the house on the property, as he had suggested it be moved farther to the west. He felt, if this was done, it would take care of his concerns and wouldn't affect his property whatsoever. Mr. Lagesse was shown the diagram submitted by Mr. Hadtrath which indicated the location of the house on the lot. He stated, from looking at this diagram, it appears thereis room for a Swale so the water wouldn't comeback to his property. UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee declared the motion carried unanimously. RECESS: A recess was called by Mayor Nee at 9:05 p. m. RECEIVING PLANNING COMMISSION MINUTES OF SEPTEMBER 16, 1981-CONTINUED: CONSIDERATION OF VACATION REQUEST, SAV #81-03 BY PETITION #9-1981 TO VACATE 66TH AVENUE BETWEEN PIERCE STREET AND LUCIA LANE, BURTON W. SCHERVEN: MOTION by Councilman Schneider to set the public hearing on this vacation request for October 19, 1981. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. '. RECEIVING APPEALS COMMISSION MINUTES OF AUGUST 25, 1981: (q) RE UEST FOR VARIANCE TO REDUCE FRONTS SIDE AND REAR YARD SETBACKS TO ALLOW CONSTRUCTION OF AN ADDITION TO EXISTING BUILDING, 4040 MARSHALL STREET, ROY TAYLOR: Mr. Flora, Public Works Director, stated this is a request for variances to reduce the setback requirements and pointed out all these are existing setbacks which occurred when East River Road was widened. REGULAR MEETING OF SEPTEMBER 28, 1981 PAGE 5 She felt if they don't support this organization to the degree they have in the past, which is $5,000, they probably wouldn't receive the grant. Councilman Schneider felt all the organizations are well-meaning and worthwhile and pointed out there was another organization, the Family Life Center, which was not recommended by the Human Resources Commission for funding. He stated there may have been some misunderstanding between them and the Commission regarding the sliding fee scale. He stated he is not sure what to do about this since they did request the Human Resources Commission to make recommendations regarding the funding of these organizations. j MOTION by Councilman Fitzpatrick to authorize the administration to provide for a total of $10,000, at the 2nd reading of the budget ordinance, in order _ to fund the following organizations as recommended by the Human Resources Commission and concurred with by the Planning Commission: $2,500 for Southern Anoka County Assistance; $2,000 for the Well Senior Citizen Clinic; $4,000 for the Central Center for Family Resources; and $1,500 for the Creative Play Center. Seconded by Councilman Barnette. MOTION by Councilwoman Moses-Martin to amend the above motion to increase the funding to the Central Center for Family Resources from $4,000 to $5,000. MOTION FAILED FOR LACK OF SECOND. Councilman Barnette felt all the organizations have good reason and rationale for the City to support them, however, this was given to the Human Resources Commission for their recommendation and felt they used good criteria to arrive at the recommended distribution. Councilman Schneider felt if they start changing the figures, then the Family Life Center had a very persuasive argument, however, they have given the Human Resources Commission the responsibility of submitting the recommendations for funding and they should be followed. Councilwoman Moses-Martin felt family resources are hard to measure and by increasing this funding, it may save in other areas, such as the police G budget, and help reduce crime. Ms. Lucy Mickman, 1631 66-1/2 Avenue, stated she is a nurse with the Family Life Center and indicated the Central Center for Family Resources and their organization are both doing about the same kind of service to the community. She pointed out, however, they had calls from persons who couldn't afford to pay for their services and they were told to come in and they would do what they could for them. She stated they do service a lot of people in Fridley and being a resident of Fridley for 28 years and being involved, she felt she had to make a few comments. Mr. Dick Harris, Chairman of the Planning Commission, stated the Human Resources Commission labored very hard and long over their decisions for the funding and tried to stay within the budget that was designated, and felt their recommendations should be given consideration. UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee declared the motion carried unanimously. MOTION by Councilman Barnette to receive the minutes of the Planning Commission Meeting of August 19, 1981. Seconded by Councilman Fitzpatrick.
