He said that the garage seemed large for a residential area, and that he preferred to keep it a residential area. He said that the petitioner had too many garage sales, and that he strongly opposed the petitioner's intent to build his garage. Mir. Harris asked if there was any further discussion. Pir. Charles L. Langen, 6530 Hicks St. N.E. stated that he was not worried about Mr. Christensen's operation but out some other operation getting established on the property. Mr. Louis C.Nash, of 6509 E. R* er Rd., stated thct he had smelled odors coming from the auto-body shop. He a so complained of the Junk vehicles parked all around the area. Mrs. Linda ash complained of Mr. Christensen's being open on Saturday and that on 3 day last week he %gas open until 10:30 at night. Mro. Hughes said that it was not necesss;-y to have the petitioner here at the meeting. Mr. Boardman stated that Christensen could be tagged for illegal use of property. lie cannot expand the use of the property. In the enforcement process Mr.. THE CONTRACTING AND EXPENDITURE OF FUNDS FOR THE REPAIR , r OF WELL #8 IN THE CITY Of FRIDDEY: - _---� John Flora, Public Works Director, explained to the Council that a pipe had broken in Well #8, and the pump had fallen 145' to the bottom of the well ird gotten lodged in the rock. They had a difficult time removing the pump, d now the pump would have to be rebuilt with all pipes and control rods bei J replaced. / Mr. Flora explained that the City had negotiated with Layne Minnesota or the i repair of the well, as'they were the low bidder on the repair of Well No. 12 j which they were presently working on, and they will do the work at a same j price for Well No. 8. He explained they have already spent $10,000 to get the j pump out, and at this time, do not know what the final cost will b Councilman Schneider asked if the $25,000 mentioned in the ordin nce would be adequate, or if that was playing it too close. The Council fel that the ordinance should be changed to "not to exceed $30,000", to mak sure the costs could be covered. :...._ The City Manager explained that this was being done with an mergency Ordinance to meet the high demand for water in the. summer. Mr. Flora, Public Works Director, explained that the petitioner wants to keep using his existing attached garage as an accessory building, and the Piar%ing } CoiGuission recommends approval of the request with the stipulation that the i Special Use Permit expires in five Years The Council was concerned about the possibility of the home being sold before that time, and how to,make sure that the area was converted to living space after five years. i Mr. Herrick, City Attorney, suggested that the owner sign an agreement ment a reein 9 to convert the attached garage to living space within five years. Mr. Qureshi, City Manager, said that if these conditions are put on the Special Use Permit, and if the stipulation is not fulfilled within the five years, the Council would have cause for action on that basis. I OPEN FORUM, VISITORS: There was no response fro the audience under this item of business. OLD BUSINESS: CONSIDERATION OF ENERGY C MMISSION-POLICY STATEMENT (CONTINUED FROM JULY 7, 1980}: Mayor Nee said that the E ergy Policy Statement has been redrafted by the staff at the, request of e City Council. Councilman Schneider referred to Section 5 of the Guid lines and asked if, in fact, the City has established a centralized energy off ce. Mr. Qureshi, City Manager, said that we have ' Mary Cayan, Human Servic s Assistant in the Planning Department, and one of I her responsibilities was :to coordi=nate energy functions. She was also the staff person to the Ener y Commission. Councilman Barnette coy limented the staff on the redrafting and on coming up t with the right wording he Council wanted to convey. Mayor Nee agreed there i was a problem of style hey might want to polish up, but it was well done. MOTION by Councilman Ba vette, seconded by Councilman Schneider, to approve the Energy Commission P licy Guidelines. RECEIVING MEMO #80-02 TO JERROLD BOARDMAN FROM WILLIAM DEBLON RE: METRO COUNCIL'S RECOMMENDAIIONS ON FRIDLEY CRITICA! AREA PLAN: Mr. Qureshi, City Manager, asked Mr. Flora, Public Woos Director, if there was a time restraint on this review. Mr. Flora said .that the Minnesota Environmental Quality Board is in the process of reviewing our critical area plan for the Metropolitan Council , and the Metropolitan Environmental Quality Board does not want to move on the review until they have the City's comments on the Metro Council's suggested amendments to our-plan. Mr. Flora outlined the three areas of concern to the Metro Council, ,and the changes recommended by staff. Mr. Schneider asked what the order of procedure was, and Mr. Flora said that I the Metro Council asked the Metropolitan Environmental Quality Board to review the recommended amendments the Metro Council has made to Fridley's critical area plan, then it will go back to the Metro Council. Councilwoman Moses asked if this includes beth the Mississippi River and Rice Creek. Mr. Flora said this includes both Vice Creek and the River and trees, vegetation and runoff. Mayor Nee said he wondered what their cgncern was in the connection between j the Rice Creek West Regional Trail and the river corridor trail. Mr. Qureshi said he felt they just wanted this trai'l route shown on the map. CONSIDERATION OF ENTERING TO AN AGREEMENT WITH ANOKA COUNTY IN REGARD TO COMMUN TY BLOCK GRANT DEVELOPMENT FUNDS: Mayor Nee said the questi n is whether or not we should jcin Anoka County in applying for these funds He said this is a rather new idea and asked the Public Works Director to explain it. Mr. Flora reviewed the ity's requests for funds in the past , the use of funds we have received and the fact that we were denied funds-in 1979 and will not be able to received/ t the criteria for funds in 1980. i • j I REGULAR MEETING. Councilwoman Moses inquired whether we had any idea on how much the- City would be eligible for. . Mr. Flora said that we did not know, it woul depend on the criteria that was developed. I Councilman Schneider asked if the Anoka County Board or the noka Housing and Redevelopment Authority made the application. He wondered i they would be I prejudiced against us as they Stated it was their intent to provide assistance in particular to those communities who do not have operati g HRA Boards. He asked'if our HRA had seen this proposal. Mr. Flora said t ey had been given this for their information. Mr. Qureshi said Anoka Count# would be the one who applied for the funds directly. Mr. Flora pointed out the stipulation that if the City ins the County in their application for funds, we cannot submit an application on our own. The Council felt we should request a copy of the cooperat've agreement for further review. MOTION by Councilwoman Moses to approve-the letter o Anoka County requesting a copy of the cooperative agreQment for review reg rding the possible parti- cipation in the County's Community Development Blo k Grant Funds Application.
