The development seemed well thought out and the units are placed well on the property. Ms. Gabel stated the development seems consistent with the housing to the north and is a better use for that property than a commercial use. The commercial areas in Fridley are too spread out as it is. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN SCHNABEL DECLARED THE MOTION CARRIED- UNANIMOUSLY. Ms. Schnabel stated that at their May 16th meeting, the City Council will set the public hearing for June 6. 2. PUBLIC HEARING: REQUEST FOR A SPECIAL USE PERMIT, SP #83-02 BY MARIE C. MOTION BY MR. KONDRICK, SECONDED BY MR. SVANDA, TO OPEN THE PUBLIC HEARING ON SP #83-02 BY MARIE C. KARN. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRWOMAN SCHNABEL DECLARED THE PUBLIC HEARING OPEN AT 8:14 P.M. Mr. Deblon stated the property is located on the corner of Hayes and Onondaga. The proposal is to put up a second accessory building, 20' x 24' . The plan shows the building located about 4 ft. from the rear and side property lines. The code minimum setback is 3 ft. Ms. Marie Karn asked if it would be possible to move the building more into the center of the lot, rather than in the far corner. Ms. Schnabel stated that because of the code, if the Karn's moved the proposed structure over so it was more in a direct line with the house next door, the structure would have to be a minimum of 3 ft. and perhaps up to 5 ft. off the property line so that 15 ft. is maintained between the proposed structure and the neighbor's structure. Ms. Schnabel asked what the purpose was for the proposed structure. Ms. Karn stated it was for storage. They have a two-car attached garage, but need another building to house lawn equipment, snowblower, boat, etc. There is no driveway proposed at this time to the new building. MOTION BY MR. C FRCM APPEALS COMISION MIN[TI'E.S OF APRIL 26, 1983: REVIEW OF VARIANCE GP,,A 'F'T� FOR A ROOF SIGN AT 8290 UNIVERSITY AVENUE N. E. RALPH VIRGILLO. RAFFAELE'S (L AST REVIEWED APRIL, 1982) : Mr. Flora, Public Works Director, stated a variance was granted to the owner of Raffaele's to keep a restaurant food sign on the roof of this establishment. He stated the owner has requested this sign be allowed to remain. Mr. Flora stated the Appeals Commission felt there was a hardship since the building is set far off University and does not have good exposure to the highway. He stated the Camiission recommended approval of the variance and that the variance be made permanent to the present owner and any subsequent owner should come before the Appeals Commission or a review of the roof sign. Councilman Hamernik questioned the fact about subsequent owners coming before the Appeals Commission, if there is a permanent hardship at this establishment. Mr. Herrick, City Attorney, felt the Council would be hardpressed to grant a variance to the present owner and deny it to a future owner, assuming the situation hadn't changed. Mr. Flora felt consideration should be given that the sign not be changed, unless it canes before the Appeals Commission. MDTION by Councilman Hamernik to concur with the recommendation of the Appeals Commission and grant the variance for the roof sign, with the COUNCIL MEETING OF MAY 16, 1983 PAGE 6 stipulation if the sign is to be changed, the owner is to come in for review by the Appeals Commission. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. VARIANCE TO REDUCE THE LOT AREA REOUIREMENr AND REDUCE_'�;F REAR YARD, SIDE YARD AND FRONT YARD SETBACK FOR THE 00NO rTMON OF A 4-UNIT BUILDING AT 5455 41H SrRFFT N. E. BY STAR HOMES, INC. : Mr. Flora, Public Works Director, stated this request for construction of a four-plex includes four variances. He stated, when presented to the Appeals Commission, they felt that portion of property which was taken for highway purposes, and since turned back to the City, might be added to this parcel to increase the lot size. He pointed out, if this was done, it would eliminate the need for the variances of the lot size and the front yard, therefore, the Appeals Commission denied these two variances. Mr. Flora stated the Appeals Commission did approve the variances for the rear and side yards, with the understanding the City work with the property owner to release the property which was turned back to the City. Mr. Flora stated the County is attempting for the first time a private sale of properties and offering these properties to adjoining property owners. He felt it might be appropriate for the City to have something similar, if they desire to transfer this property. MOTION by Councilman Fitzpatrick to reduce the lot area requirement from 15,000 squre feet to 13,790 squre feet; to reduce the rear yard setback from 32.5 feet to 5 feet; to reduce the side yard setback from the required 35 feet to 30 ft. and 7 feet; and to reduce the front yard setback from the required 35 feet to 32 feet. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mr. Herrick, City Attorney, stated there are a number of situations where there is excess property that hasn't been used and turned back to the City. He stated the mechanics of conveying the property to the adjoining owners is fairly simple, but felt the Council should take a look at what policy they want to establish. Mr. Herrick stated there probably would be some title work involved and a check with the Public Works Department to see what property was originally taken. Mr. Qureshi, City Manager, stated he felt what the Appeals Commission implied was if this property isn't needed by the City, it should be given back to the property owner so it can be put back on the tax rolls. Mr. Qureshi felt, as part of the variance, there should be a stipulation that if the city can legally provide this property to the owners, they would be willing to accept it. Mr. O'Bannon, the property owner, indicated this wouldn't be a problem and he would be willing to accept this property if the City can turn it back.
