The recommendations of the Planning Commission are submitted to the City Council for final action. If a Certificate of Survey wasn't required before, it will be required for this meeting. The City Council meets on the first and third Mondays of the month. 6. The City Council approval may be subject to certain stipulations which must be compiled with by the applicant. 7. If approved, the applicant sh al 1 then have the land involved in the lot split surveyed. Upon receipt of the required Surveyor' s Certificate, the Council shall pass a resolution approving the lot split. 8. After final approval, a certified copy of the resolution approving the lot split and a "Certificate of Status" form shall be attached to the notice of approval and forwarded to the applicant. The lot split, together with a certified copy of the resolution and "Certification of Status" form, shall thereafter be recorded among the records of the County within one hundred eighty (1.80) days after the date of the resolution, unless a 1 onge r period of time is granted and provided for recording at the time of approval. 9. In all cases where City Council action has been sought and denied, no petition for identical action can be presented until a period of six months has elapsed. In discussing the stipulations staff raised it was agreed that the hardsurface drive could be postponed until after the house is moved on site (from New Brighton) . However, the builder has since decided to orient his garage toward the unimproved alley in the rear. Therefore it would be appropriate to require the garage and drive be provided before a house moving permit is issued to the petitioner. An alternative scheme would involve the petitioner posting an $8,000 bond to cover the garage and driveway improvements which should then be completed by July 15, 1986. The attached stipulations may stand with the addition of the bond alternative if Council concurs. CONSIDERATION OF A LOT SPLIT REQUEST, L.S: #86-04, BY TERRY BARRETT: Split off the northerly 23 feet of Lot 5, Block 4, Oak Grove Addition and add to Lot 4, Block 4, Oak Grove Addition to create a separate 63 foot lot. The southerly 17 feet of Lot 5, Block 4, Oak Grove Addition will remain with lots 6 and 7, Block 4, Oak Grove Addition to create a separate 97 foot lot, the same being 6562 Anoka Street N.E. Mr. Robinson stated the property was located north of Mississippi St. on Anoka St. and consisted of four 40 ft. lots. The petitioner was requesting to split off the northerly 63 ft. of the property in order to make a location for a house which he is planning to move from New Brighton. The existing house at 6265 Anoka St. overlaps onto Lot 5 by 7 ft. With the required 10 ft. sideyard setback plus the 7 ft. , the one lot becomes 97 ft. , leaving a balance of 63 ft. for the new lot. City code requires 75 ft. width for all new lots in Fridley and 9,000 sq. ft. in lot area. The proposed lot was 8,127 sq. ft. Mr. Robinson stated most of the lots in the neighbcrhood are 80 ft. in width or greater. He stated that if this request ►vas approved, Staff would recommend the following stipulations: PLANNING CONIISSION MEETING, 11AY 7, 1936 PAGE 2 1 . Park fee of $750 to be paid prior to issuance of building permit and moving permits. 2. A new double garage compatible with house facade to be constructed and a hard surface driveway to be installed to the new garage prior to issuance of building and moving permits for the house. 3. Ms. Sherek stated that regarding stipulation #2, she would be concerned about the petitioner installing a hard-surface driveway and then moving the house which Would probably break up the driveway. tY. Oquist stated there would be a problem with backfilling if the driveway was already in place. Mr. Robinson stated an alternative could be to have the petitioner post a performance bond for the completion of the driveway after the house was in place. The petitioner, fir. He stated he believes Mr. Kazma will provide exceptional service for the City. Mr. Kazma introduced Mr. Dave Murray, Vice-President of Union Mutual Insurance Company and Mr. Cripps, shareholder in Countryside Cable, Inc. Mr. Kazma stated he entered into a contract with Storer to purchase their cable system and has sutimitted an application for transfer of the franchise. He stated they have met with Clyde Moravetz of the City staff and have sutmitted documents regarding their source of financing. Mr. Kazma stated he realizes there is a renewal coming up and it is his intention to meet with the Cable Television Commission and outline plans for the Fridley system. He stated he intends to keep the Fridley office as their main office for this system and move the billing from California to Fridley. Mr. Kazma stated Chris Wegener will join the Board of Directors and serve as General Manager. He stated he didn't see much of a change in the technical personnel and wouldn't be diminishing the staff here in Fridley. WHEREAS, the City Council approved a lot split at the May 19, 1986 meeting; and WHEREAS, such approval was to split off the northerly 22.5 feet of Lot 5, Block 4, Oak Grove Addition and add to Lot 4, Block 4, Oak Grove Addition to create a separate 62.5 foot lot. The southerly 17.5 feet of Lot 5, Block 4, Oak Grove Addition will remain with Lots 6 and 7, Block 4, Oak Grove Addition to create a separate 97.5 foot lot, the same being 6562 Anoka Street N.E. WHEREAS, the City has received the required Certificate of Survey from the owner; and WHEREAS, such approval will create a separate 62.5 foot lot in which a house is to be placed. It seems to him the Council sending a message that if you can't have it now, wait around, and a criteria on which they are judging will change. Councilman Schneider wondered if it is warrante o go up to 180 square feet, and if requests were made in the past for is size and were granted. He stated the petitioner wishes to split off the northerly 63 feet of the property in order to make a location for a hone he is planning to move from New Brighton.
