Return completed application form with the required sketch of the property involved and the lot split fee of $100.00 for each original lot being split. 3. The application will be checked over by Staff and the owner may be r eq ui red to sutmit a Certificate of Survey containing a simple description of a part of a platted lot or registered lot, along with the new parcels created with all existing structures tied in. 4. The application will then be sutmitted to the Planning Commission for their recommendation. The Planning Commission meets on the Wednesday following the City Council meeting, which is ge,,erally the first and third Wednesdays of the month. 5. The recommendations of the Planning Commission are sutmitted to the City Council for final action. If a Certificate of Survey wasn't required before, it will be required for this meeting. The City Council meets on the first and third Mondays of the month. 6. The City Council approval may be subject to certain stipulations which must .hc comp'ii cu w ilii by the atuipl ica 1l�. 7. If approved, the applicant shall then have the land involved in the lot split surveyed. Upon receipt of the required Surveyor's Certificate, the Council shall pass a resolution approving the lot split. 8. After final approval, a certified copy of the resolution approving the lot split and a "Certificate of Status" form shall be attached to the notice of approval and forwarded to the applicant. The lot split, together with a certified copy of the resolution and "Certification of Status" form, shall thereafter be recorded among the records of the County within one hundred eighty (180) days after the date of the resolution, unless a longer period of time is granted and provided for r eco r di ng at the time of approval. 9. In all cases where City Council action has been sought and denied, no petition for identical action can be presented until a period of six months has elapsed. Lind: I recently called the Anoka County Recorder's Office to check the status on the recording of your lot split. As you know, cn February 22, 1988, the City Council approved a three month extension of your subdivison at 6076 Woody Lane. This allows you to have until May 22, 1988, to record the split at the Anoka County Courthouse. Because your property is Torrens, the recording procedures will be different than if it was abstract. Torrens property is land which has been through judicial proceedings to determine the rightul property owner. I suggest you call the Anoka County Examiner of Titles to have the procedures clarified. Mr. Buratti stated they are aware it is likely the property'will become taxable. / Ms. Sherek stated she understands the property becom s taxable at the time the use converts. He stated the permit is to allow a daycare facility; to allow parking lots for off-street parking spac9ls; and to allow a clinic. He stated the property involves the Fridley Assembly of God Church on Osborne Road, as well as two single family properties located off Osborne Road. He stated the North Suburban Hospital District is proposing to purchase the church and homes and convert the church into a clinic and daycare facility. Mr. Flora stated the code requires 207 parking stalls and 185 will be immediately provided with an option to install an additional 81 spaces in the area of the single family hares, as needed. Mr. Flora stated the Planning Commission recommended approval of this special use permit, with 13 stipulations, which he o 'lined from the minutes of the Planning Commission, pages 9 and 10. He ed staff would recommend mend another stipulation be added that the tax parcels combined into one lot upon acquisition to one owner. Mr. Buratti, Attorney for North Suburban Hosp*, 1 District, stated he talked to the City Assessor regarding the taxable status of the property. He stated whether the proprty becomes taxable ,depends on how it will eventually be used and the laws of the State. He stated if the property is used for medical and daycare purposes, it would be subject to real estate taxation. He stated if this whole plan was to be/scrapped and the Hospital District made this part of the hospital compile , it would not be taxable. Mayor Nee stated the special use it is for the day care and clinic and asked Mr. Buratti if he agreed th' s would be a taxable use. Mr. Buratti stated his opinion is it would taxable. Cbuncilman Schneider asked if the architect' s fee would be educed if the construction management approach is used. Mr. Christenson stated a meeting has been scheduled to r view items in the architect's contract that would be dine by the constru ion management firm, if this approach is used, and reduce the architect's ntract. Councilman Schneider stated the construction m nagement approach is attractive in the sense that the firm' s represen ative is on-site at all times to make sure everything is done actor g to specifications. He stated on the other side, the question is who ars the responsibility if something is not done correctly. Mr. Christenson stated the project manager d superintendent coordinate the work of the contractors in the field and hould resolve any difficulties that may arise. Mr. Christenson stated their construction management firm would work with the architect in the design staes and recommend different building systems that are the most efficien/and-e mical for the building. Mr. Herrick, City Attorneye reviewed the contracts and wrote a memo to the Cbuncil. He suld like the opportunity to review any revised contracts prior tohey are executed, as he also has some concern about the arbitratons. Cbuncilman Billings askedhappen if the project is for a longer period than the ten months over which the $78,000 would be distributed. Mr. Christenson stated the ,$78,000 fee would still be the same even if the project is for a longer period. Councilman Billings ted it is proposed to distribute the $78,000 over a ten month period, however, if the City in 60 days determines the project cannot proceed, he asked if the City would owe for two months service at $7,800 per month and if the $5,000 approved at the last meeting would apply. Mr. Christenson ated Councilman Billings was correct. councilmanBi lings stated the parking ramp is an HRA project and the remodeling and addition is a City project. He asked if provisions were made to allocate a portion of the $78,000 fee to the HRA. Mr. Robertson stated it would be 'allocated on a percentage basis. Cbuncilmay Billings stated his questions have been answered and would agree with the;'concept for a construction manager who is on the City' s team as compareto a general contractor who may or may not be on the City's side. MDTION by Councilman Schneider to authorize the City' s entering into this agreement with Bossardt Christenson Corporation for construction management services. Seconded by Cbuncilman Billings. BY GREG ASPROTH: Mr. Robertson, Community Development Director, stated this special use permit is to allow a billiard hall and arcade with a• snack bar in the Rice Creek Business enter located east of (bngneree Circle East and south of 73rd Avenue. He stated this request is made possible by a recent ordinance change making it allowable to have commercial uses in industrial zones. He stated the Rice Creek Business Genter was a multi-tenant building consisting of a large number of different office, oomm6rcial and quasi-commerical uses. Mr. Robertson stated the billiard hall and arcade would be located in the extreme northeast corner of the building. He submitted a drawing of this proposed billiard hall, arcade, and snack tar. Mr. Robertson stated there were basically two concerns, one being the parking and the other was possible misconduct by juveniles and adults at such a center. He stated the City has a development agreement with the owner of the building where they would work out the parking as space is leased. He stated 35 additional parking spaces will be provided for this business bringing the total to 125 required parking spaces to date. He stated there are presently 166 stalls provided, leaving a balance of 41 parking spaces. Mr. Robertson stated the concern about misconduct was raised by the Police Department. He stated it was found billiard halls can be well managed such as the one in GnOn Rapids, C.R. Billiards, which has not experienced any problems. (buncilman Billings stated at the Planning Commission meeting, he briefly discussed,*ith the owner, Mr. Asproth, his plans for this business. He stated t,He petitioner is going into this business with the best intentions to make' it attractive and not become a nuisance or problem for the City. He stated one area where the petitioner had a problem was the stipulation to provide two adults on staff during evening hours from 6 p.m. to closing. r -5 FRM FV CIW COUNCIL MEETING OF FEBMW 22, 1988 Mr. Greg Asproth, the petitioner, stated the problem he has with providing two adults during evening hours is he is just starting a new business and didn't know how many persons would patronize his establishment. He felt if the need arises, he would surely provide two adults. (buncilman Billings asked Mr. Asproth if it was his intention to have at least one adult present at all times. Mr. Asproth stated either he or his wife would be they when the business is open. He felt Thursday, Friday and Saturday nights 0uld be the busiest. Mr. Asproth stated they hoped to attract people from the U. S. Swim and Fitness Center, as well as softball players after their games. He stated the lounge contains a seating area with tables and chairs and snack bar and they would sell such items as popcorn, hot dogs, beverages, etc. Councilman Billings stated he understands the reason for limiting the seating is to prevent any loitering. He stated Mr. Asprtoh, as he understands, didn't plan to open this business until April and staff is requesting this special use permit be revIeaed in June. He felt at the time of review, if all is proceeding well, the stipulation limiting seating could be re-evaluated. Mr. Asproth stated he planned to have three tables with eight chairs each and the P/heelt mmission recommended the seating be restricted to 20. He felt with this business, it would probably add to the parking problem. Mr. Robertson stated it is his understanding when the parking was considered, the most intensive use was anticipated in the evening hours when other businesses in the building are not open. He stated the owner of the building a �owledges this may be in error and is the reason for reviewing this perm'tn June. (buncil Schneider stated if U. S. BY DONNA LIND: Mr. Robertson, Community Development Director, stated the petitioner for this lot split failed to record it within six months at the County and has requested an extension. He stated this request is made possible by recent ordinance change making it allowable to have commercial uses in, ndustrial zones. He stated the Rice Creek Business Center was a multi- " nt building consisting of a large number of different off ice, commercial nd quasi-commerical uses. Vx. Robertson stated the billiard hall and arca would be located in the extreme northeast corner of the buil/ngHe. ubmitted a drawing of this proposed billiard hall, arcade, and Mr. Robertson stated there were bo concerns, one being the parking and the other was possible mby juveniles and adults at such a center. He stated the Citylopment agreement with the owner of the buildi/concern they uld work out the parking as space is leased. He stated nal rking spaces will be provided for this business bringing tto 25 required parking spaces to date. He stated there are prstalls provided, leaving a balance of 41 parking spaces. Vx. Billiards, which has not experienced any problems. j Councilman Bil Ings stated at the Planning Commission meeting, he briefly discussed w' the owner, Mr. Asproth, his plans for this business. He stated the titioner is going into this business with the best intentions to make attractive and not become a nuisance or problem for the City.
