PUBLIC HEARING: REVISION TO SPECIAL USE PERMIT, SP #71-09, SOCIAL DYNAMICS: To enlarge the site to include East 45 feet of Lot 3, Block 1, Oak Hill Addition to permit construction and operation of day nursery and learning center per City Code 45.051, 3-F. 3. , LOT SPLIT REQUEST: L.S. X72-01, GERRAL HERRINGER: hot 3, Block 1, Oak Hill Addition to be split in half to create one 75 foot residential lot, remainder used for slope and backyard for Learning Tree Day Care Center. 4. VACATION REQUEST: SAV #72-01, RUSSELL M. HEDGE: Vacate Madison Street lying between Blocks 1 and 2, Oak Hill Addition. Inasmuch as these Items are interrelated, Chairman Erickson directed the discussion to include all three. !MOTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission waive the reading of the Public Hearing for the Revision to the Special Use Permit, SP #71-09, by Social Dynamics. Upon a voice vote, all voting aye, the motion carried unanimously. Peter Herlofsky explained that the vacation of Madison Street affected all three requests. Because of the placement of a storm sewer on the lot that SQciAl Dynamics was going to use for their building, the plans had to be changed and move the building. When Madison Street is vacated, the Easterly 45 feet of hot 3 will be added to Lot 2 of the Social Dynamics property. This 45 feet will give the Learning Center more recreation area. Lot 3 will then have 45 feet, after giving 45 feet to Social Dynamics and the East half of vacated Madison Street which is 30 feet making a legal size lot of 75 feet. The other half of the street will go to Mr. Hedge. Chairman Erickson asked if the City saw something about the building for Social Dynamics being different from what they showed originally. Mr. Herlofsky answered that the layout would be changed somewhat. The original building was 80'x72' , but because of the storm sewer, the new dimen- sions are 86'x68'. Mr. Herringer said that at the time the State was given property for the Freeway, they also took the drainage easement. The easement was never shown on the Half Section. The original building was on the State easement and that was why Social Dynamics had to narrow and lengthen their building. Mr. Schmedeke said there were a couple of things that he felt needed sora discussion. He understands there is some kind of storm sewer pipe going tQ be under the Learning Care Center. The other thing is the Standard Oil Qogipany pipeline over the South 25 feet of the property which includes a 6 foot w4ter easement and a 10 foot utility easement on the North of the property, TIae pipe under the Day Care Center is the one that bothers him the most. Mr. Herringer said. it was necessary for drainage going from the North to the South. In order to maintain that drainage, they had two alternates, One was to run a pipe around the outside. The other was to run a cast iron pipe
