Dear Mr. Malone:
You asked me to write a letter confirming that your home at 635 Ely
Stret N.E. is in conformance with the City's requirements for
structures within the Flood Fringe District of the Mississippi
River Flood Plain. The lot is legally described as Lots 5, 6, 7 ,
and 8 , Block U, Riverview Heights. The structure is located on Lot
5 and a portion of Lot 6.
The City of Fridley has adopted floodplain regulations, which are
consistent with the Federal Emergency Management Agency' s
requirements as administered through the Minnesota Department of
Natural Resources. The flood elevation of 823 .25 extends over Lots
7 and 8, but meanders through Lot 5 and 6 such that 87% of the home
is located outside the flood plain. In November 1983 , you
submitted an application to add on to your home. Because a portion
of the addition (approximately 120 sq. ft. ) encroached beyond the
823 . 25 foot elevation, a special use permit was required by the
City's zoning district.
On May 21, 1984, the City Council approved a special use permit for
construction of the addition onto your home, subject to two
stipulations: 1) Provide fill to the regulatory flood plain
elevation out 15 feet from the structure; and 2) If this
stipulation could not be worked out with the petitioner, it would
be necessary for the special use permit to go back to the City
Council.
Construction has been completed on the addition, and the elevation
of the entrance into the home exceeds the floodplain elevation of
823.25 feet by 2 feet 1 inch in compliance with the requirements
of the City's floodplain regulations. The City has therefore found

your home in compliance with the special use permit issued in 1984 ,
as well as the floodplain regulations. In fact, the elevation of
the original living area exceeds the elevation of the additon.

Mr. Robinson stated the property was on Ely St. just east of the river.
He stated because the proposed addition is in the flood fringe, a special
use permit is required. In order to build the addition, the petitioner
must be 1 .2 ft. above the 100 yr. flood plain. The 100 yr. flood plain
is 823.25, and the petitioner has indicated he would have no problem meeting

that elevation. Mr. Robinson stated the elevation of the street access
needs to be within 2 ft. of this required flood plain elevation. That is
grandfathered in at a lesser elevation and, essentially, the City will be
granting a variance for that.
Ms. Schnabel asked the petitioner if he would like to make any comments.
Mr. Michael Malone stated the entry is in the northwest corner which would
be 823.19 ft. The step into the house is 7 inches above that, at 830.19 ft.
He stated if that was not high enough, they would go with another 1 ft.
course of blocks , bringing the height of the floor up to 842.19. That was
well above what was specified.
Mr. Malone stated the addition will be in redwood siding, and all facia of
the house will be replaced with redwood so it will tie the existing structure
in with the new addition.
Mr. Robinson stated there is also an 18-inch crawl space that should be
figured into the elevations. He stated that if the Planning Commission
approves this special use permit, more accurate drawings of the floor ele-
vations should be obtained before this goes to the City Council .

Mr. Flora stated the Planning Commission recommended approval of the special
use permit with the stipulation that the petitioner meet the elevations for
the flood plain area. Mr. Flora stated this would include a fill of 15 feet
around the structure.

with the stipulations and if something can't be worked out with the
petitioner, it would be necessary to come back to the Council.
