PUBLIC HEARING: REZONING REQUEST: ZOA #69-12, ROBERT V. PRITCHARD: South 2/3 of Lot 4, Auditor's Subdivision #108 Mr. Robert Pritchard was present and explained that the piece he was asking to be rezoned was adjacent to a piece of multiple land now. Directly across from his property is the Onan Plant and he understood that when the first piece was rezoned, there was quite a bit of objection to multiples. Mr. Pritchard was shown the street plan for the area which concerned the possibility of landlocked lots. Mr. Pritchard was unaware of these plans when the application was filled out and stated he would have to make some adjustments in his plans. It was unfortunate that his architect was ill at this time. Mr. Marxen, owner of the lot to the East of Lot 4, discussed with Mr. Pritchard his plans. Mr. Jensen said that the Planning Commission is committed to the street plan. The Planning Commission felt this street could be eliminated across lots 30 and 31. The design really would have an adverse effect on the neighbors by eliminating the section across this lot, Lot 4. In this case, Mr. Marxen has provided and others to the East have provided for street so the City must provide them an outlet for that street. This whole plan is effected by your lot and much thought must be given to the completion of this area. (REQUEST BY BALCO BUILDING SYSTEMS, INC. , 2801 WAYZATA BOULEVARD, MINNEAPOLIS, MINN. 55405) : The City Engineer said that this is a request for a building permit for a building just south of the Food Bonanza in Commerce Park. The Building Board recommended approval subject to their stipulations. He suggested that it should also be made subject to N.S.S.S.D. approval of the effluent. REGULAR COUNCIL MEETING OF JANUARY 5, 1970 PAGE 10 ' Councilman Sheridan questioned their not conforming to the aesthetics of the rest of Commerce Park. The other buildings are of concrete block construction. The City Attorney brought up the point that there are some restrictive covenants covering Commerce Park. Mr. Jack Jarrard of Balco Building Systems came forward with some eleva- tions to present to the Council. There followed a lengthy discussion regarding the aesthetics of the building. MOTION by Councilman Harris to approve the building permit subject to the stipulations of the Building Board and adding: 6. Subject to approval of the effluent by N.S.S.S.D. 7. That the west wall of the warehouse portion should be brick at least 5° up from the foundation and more at the builders discretion. Seconded by Councilman Samuelson. Check $12,577.00 Add $1,568.00 $628.85 The City Manager explained that there was one bid received and the alternate is for a radiator package for conversion of the unit from City water cooling to radiator cooled. The recommendation is that the alternate be included in the 1971 budget and that the City accept the base bid of $12,577.00, MOTION by Councilman Liebl to concur with the recommendation of the Administration and award the bid for an electric generator to Minnesota Onan Corp. in the amount of $12,577.00 with the altern4te to be included in the 1971 budget. They indicated that inasmuch as the Jaycees had already gone to the expense of publication of their intentions, that a permit would be granted. I IHe informed the Board that he had applied for, and was granted, the same requests iiin 1965 . He did not realize that when this was granted in 1965 that it would iexpire if he did not start construction. i Chairman Mittelstadt went over the City Council Minutes of April 1965, that concerned this property. He explained to Mr. Berry that the City Codes have changed since 1965 and some of the stipulations the Council stated then were no longer correct. This would concern the enclosed parking stalls and also off street parking. Also, it would be necessary to dedicate more land at the Northeast corner of the intersection of Hickory Drive and East River Road. Mr. Berry answered that this would be worked out with the Engineering and Inspection Departments . He stated the lot is 210 feet by 75 feet with 15,750 square feet which is more than the minimum lot area requirement. There was no current survey available to check these figures . Mr. Harris asked Mr. Berry if he could get a plot plan of the corner, showing the land to be dedicated for the corner, which will be decided by the Engineering Department. Mr. Berry said he would get one drawn up. MOTLM.-by Harris to table the two requests until the December 10, 1969 meeting, and in the meantime, the applicant should: 1. Get a plot plan showing finished corner. 2. See the City Attorney and get the papers drawn up for the dedication of land at the intersection of Hickory and East River Road. 3. Bring in an elevation of the proposed dwelling so the Board can see what will be constructed. 4 Consult with the Building Inspection Department to work out any problems that may arise at to drainage, parking required, etc. Seconded by Ahonen. Chairman Mittelstadt explained the two requests were tabled until the applicant could complete the following requests by the Board: 1. Get a plot plan showing the finished corner of Hickory Street. Action: Mr. Berry presented a plot plan to the Board. 2. See the City Attorney and get the papers drawn up for the dedication of land at the intersection of Hickory and East River Road. Action: Mr. Berry stated this had been done. He explained the Engineering Department had not decided whether they wanted the additional land, at the intersection of Hickory and East River Road, to be dedicated or whether it should be an easement. 3. Bring in an elevation of the proposed dwelling so the Board can see what will be constructed. Action: Mr. Berry presented the house plan to the Board. He said the house plan was correct except for adding another stall to the garage. He will have a 3 car garage with an additional parking stall to the side of the house. 4. I� The Minutes of the Board of Ap peals Meeting of b4pacember 10, 196 _ NOTE: The Board feels they have nothing to do with the Special Use Permit request as it is before the Planning Commission at this time. However, the Board would like to recommend to the Planning Commission that the Special Use Permit be granted when the dedication of land is completed. MOTION by Harris to recommend to the City Council, approval of the variance for the following reasons: 1. To build this dwelling, a variance would have to be acquired for either the. front yard or the back yard and granting the front yard variance would make more sense, as the dwelling would then line up with the existing dwelling to the East. 2. The former City Council approved the variance on October 18, 1965. 3. He complies with the parking requirements as written in the new Zoning Ordinance. Seconded by Minish.
