Mr. Johnson presented to the Board, a no objection let er from Mr. Kupcho, property owner to the south, and a letter acknowledging re eipt of the approval from Mr. Johnson to Mr. Kupcho. MOTION by Plemel, seconded by Wahlberg, to re ive the two letters. Upon a voice vote, there being no nays, the motion carrie unanimously. Mr. Lehr said he was asking for two variances; one from 10 feet to 8 feet on the addition to the back of the house and the other from 117 feet to 102 feet for the garage. Mr. Lehr said he has talked to his neighbors and has gotten verbal approval from them. He said he does have a letter from the owner of the property 2 doors down from him giving his approval. Mrs. Wahlberg asked if he had any plans drawn up for this construction. Mr. Lehr said he has no plans drawn yet but he explained the addition will have a basement and will have quite a few windows because it faces the river. He said because of the pie shape of the lot, the variance for the addition is only needed on the one corner. Mrs. Wahlberg asked if he presently has a garage. Mr. Lehr said he' does have a single car garage that he will be converting into storage space for lawn equipment. Mrs. Wahlberg said she could see where Mr. Lehr is limited on his lot since it As 70 feet wide. She asked if there are other garages built close to the street. Mr. Lehr answered that there are two others that are built just about on the road. Mrs. Wahlberg stated his garage would not be setting a precedent then. Mr. Lehr said it would not be and added that the shorter driveway would save on the cost of a hard surface driveway. Mr. Torrey said presently they are building on a 72 foot addition toth north side of their building. He said they propose to•put this sign on the roo of that addition and it will face east Cand west to catch the sight of the freer ay traffic. He said the.sign will have the midland "M" and have the word Midla d underneath the 'W . He said the letters in "Midland" will be 1 foot high and t e total height of the sign will be 15 feet. He said the sign will be interior ill inated. He said they need the identification sign as most of their business is fro out of state and the people have difficulty in finding the building as it is har to see from the freeway. Chairman Drigans asked if the City as looked at the construction of the sign. Mr. Torrey said Darrel Clark and Je ry Boardman were over to the building and looked at the sign. Mrs. Wahlberg asked how high the ign would be. Mr. Torrey said the building .is a 2 story structure and the s' n will be on top of this roof and extend 15 feet from the roof. Mrs. Wah berg asked if this was within height limitations of the Code. Mr. Mattson said arrel Clark had mentioned that it was within the Code requirement on height. Chairman Drigans asked if the my reason for the sign was giving Midland's location from the freeway. M Torrey answered that it was. Mr. Torrey added they had ordered all the stee . for the sign because they thought there would be nothing wrong with it J 1 _ Mr'. George Barth, 101 HorizoA Drive and Mr. Floyd Knutson, 100 Crown Road, came forward to see the proposed ,isign. Mr. Barth said he would only object if this would be setting a precedent for later, on the other side of the building. He asked Mr. Torrey if there were any plans for the other side of the building as he had once heard they were going to put in a gas station. Mr. Torrey answered they have no plans to put °a sign on the other side of the building and their only plans for the building are for warehouse area. Planning Commission Meeting - April 3, 1974 Page 3 Mr. Clark_ said there was even the possibility of these two Commissions being combined. He said the Pl s & Subdivisions-Streets & Utilities, Subcommittee used to be two su ommittees , and they were combined because what they did overlapped Mr. Fitzpatrick said Parks and Recreation were two separate commissions at one time, also, and they were combined. Chairman Fitzpatrick said hewoul hate to see the schedule for appointing members to these committees disrupted after it finally was set up. Mr. Clark said the members f the Environmental Quality Commission could be plugged into th t schedule. Mr. Fitzpatrick said this Co ssion has seven members and all the other Subcommittees of the P1 nning Commission have 5. He thought if this Commission belonged with the Planning Commission it would have to eventually be a 5 man Commis ion and be brought into our schedule of appointments. MOTION by Harris , seconde by Lindblad, that the Planning Commission receive the minutes of the E vironmental Quality Commission of March 12 , 1974 and take under advisement having a member of this Commission become a permanent member f the Planning Commission . The number of people serving on the Com fission , how the appointments would be set up and an opinion from th City Attorney on the feasibility of having a six man Planning Commi sion should be determined before a recommenda- tion is made . PUBLIC HEARING: REQUEST FOR A SPECIAL USE PERMIT, SP #74-03 , KENNETH LEHR: Per Fridley City Code, Section 205. 051 , 2 , A, to allow construction of a second accessory building on Lot 9 , Block 2 , Elwell ' s Riverside Heights, the same being 168 Talmadge Way N.E. Mr. Kenneth Lehr was present. MOTION by Lindblad, seconded by Blair, that the Planning Commission waive the reading of the Public Hearing notice on the request for a Special Use Permit , SP #74-03, by Kenneth Lehr. Upon a voice vote, all voting aye , the motion carried unanimously . Mr. Clark said that Mr. Lehr has already been granted variances by the Board of Appeals and approved by Council for the front yard setback for the proposed garage, and also a side yard variance for an addition, which is not part of the consideration before the Commis- sion. There is no question that Mr. Lehr can build this second acces- sory building at the proposed location if a special use is approved. Mr. Lehr said he needed this 22 ' x 26' garage because he only has a single car garage and has two cars. He will use the present garage for storage for wood for the fireplace, a picnic table, canoe, snow • blower, lawn mower, etc . He said the garage is a little larger than normal size, but he would like to have a work bench. He said he felt this additional garage was a necessity because they needed more space. There are other garages located in front of the house in this area, so this proposal was not out of context for this neighborhood. Mr. Fitzpatrick said the neighbors had received notices on the' variance requests and for the request for a Special Use Permit and no one was here with objections . Mr. Lehr said he had a letter from a neighbor who lived a couple doors from his house who said he approved this request and had no objections . MOTION by .Lindblad, seconded by Harris , that the Planning Commission close the Public Hearing on the request for a Special Use Permit, SP #74-03 , by Kenneth Lehr. Upon a voice vote, all voting aye, the motion carried unanimously . Chairman Fitzpatrick said that all the variances have been approved so we do not have to concern ourselves with the location of this garage. Mr. Fitzpatrick asked Mr. Clar to contact General Cheeseman to see if he could be present for th' s Hearing. He said he didn't know if he should be asked to make an her presentation, but he would be able to answer any questions the audience might have on this proposal . Mr. Clark said it was possible at some things might have changed since Mr. Cheeseman made his presenta ion to the Planning Commission. MOTION by Harris , seconded by Blair, that the Planning Commission receive the letter from the Fraley DFL, dated March 13, 1974 , where they requested that a member f this organization be notified when the Public Hearing for the armory 'proposal would be held . M. PLEDGE OF ALLEGIANCE: Mayor Liebl led the Council and the audience in saying the Pledge of Allegiance to the Flag. INVOCATION: Mayor Liebl offered the Invocation. ROLL CALL: MEMBERS PRESENT: Councilman Nee, Councilman Breider, Councilman Starwalt, Mayor Liebl , and Councilman Utter. MEMBERS ABSENT: None APPROVAL OF MINUTES: REGULAR COUNCIL. MEETING OF MARCH 18, 1974: MOTION by Councilman Utter to adopt the minutes-of the Re ular Council Meeting of March 18, 1974 if no member of the Council had any addit'ons or corrections. Seconded by Councilman Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried unanimously and the minutes of the Regular Council i Meeting of May 18, 1974 adopted as presented. ADOPTION OF AGENDA: 3 MOTION by Councilman Utter to adopt the agenda as pr sented. Seconded by Councilman i Starwalt. PROCLAMATION: NATIONAL DAY OF HUMILIATION, FASTING AND PRAYER: MOTION by Councilman Utter to adopt the Proclam tion for the "National Day of Humiliation, Fasting and Prayer", to be April 3 , 1974. Seconded by Councilman Starwalt. Upon a voice vote, all voting aye, ayor Liebl declared the motion carried unanimously. VISITORS: MR. DONALD BACON, 1336 HILLCREST DRIVE N. E. FRIDLEY: Mr. Bacon addressed the Council and request d he be granted permission to paint the house numbers of the residents of Fridley the curbing in front of their homes. He said this was a project he would like t undertake to work his way through college. The City Attorney said -this is not a lice sed activity. He said he understood the proposal to be painting the numbers on th curbing and then, asking the homeowner for a donation for this servic3. Mayor Liebl said there is no formal appl cation procedure for this type of activity. Mr. Bacon thanked the Council for their consideration of his request. E., to allow the construction of a second accessory building. Seconded by Councilman Nee. Upon a voice vote, all voting ° aye, Mayor Liebl declared the motion carried Unanimously. SET PUBLIC HEARING FOR ARMORY PROPOSAL: ` I t Mayor Liebl said he would recommend that the American Legion and also the Veterans of Foreign Wars be notified about this public hearing. He said all of the other civic organizations in the City uld also be notified. The City Manager said it was the intent of th Administration to notify the I various special interest groups and also the ivic organizations. MOTION by Councilman Utter to concur in th da'te of May 8, 1974 for the Public Hearing for the armory proposal at the P1 ning Commission level and that the ' various organizations in the City be noti ied about this Public Hearing. Seconded by Councilman Nee. Upon a voic vote, all voting aye, Mayor Liebl a declared the motion carried unanimously I RECOMMENDATION TO COUNCIL ON TREE ORDINANCE (PET.ITION #4-1974): I . Mayor Liebl asked if any of the members of the Council had any questions on the proposal at the present time. ! Councilman Starwalt said the Planning Commi sion had recommended the amended j proposed ordinance be forwarded to the com ttee that had supported the original petition. He asked if the only action of he Council at this time would be to receive the amended proposed ordinance. I Mayor Liebl said the proposed ordinance s ould be submitted to the five member L sponsoring committee, allowing them time for review and asking for a reply to Council. He .said after the Council rece ves the reply, they can take the necessary steps. Councilman Starwalt referred to the en losed schedule for the events leading to the deadline. He asked if the pro sed action of receiving the amended proposed ordinance would be in line w th the time schedule. The City Manager said if the respons of the Sponsoring Committee is received before the May 6, 1974 meeting of t Council, it could be acted upon at this- date. He said the action necessary would have.,to be taken care of by May 8; 1974. He said this is the extent the 65 day limit. Mayor Liebl agreed that the Council could take action on the matter on'the 6th of May. MOTION by Councilman Starwalt to irect the.Administration to send the minutes of the Subcommittee meetings, th recommendations of the Parks and Recreation Department, Parks and Recreatio s Commission, and copies of the amended proposed ordinance to thefive members o the Sponsoring Committee, and that the Admini- stration dmini stration indicate the reply wi l be due in the City Manager's Office on the First of May, and that the material be sent by registered mail.
