Obtain application form at City Hall (6431 University Avenue N.E. , Fridley) 2. Return completed application form with the required sketch of the property involved and the lot split fee of $100.00 for each original lot being split. 3. The application will be checked over by Staff and the owner may be required to submit a Certificate of Survey containing a simple description of a part of a platted lot or registered lot, along with the new parcels created with all existing structures tied in. 4. The application will then be submitted to the Planning Commission for their recommendation. The Planning Commission meets on the Wednesday following the City Council meeting, which is gei,erally the first and third Wednesdays of the month. 5. The recommendations of the Planning Commission are submitted to the City Council for final action. If a Certificate of Survey wasn't required before, it will be required for this meeting. The City Council meets on the first and third Mondays of the month. 6. The City Council approval may be subject to certain stipulations which must be compiled with by the applicant. 7. If approved, the applicant shall then have the land involved in the lot split surveyed. Upon receipt of the requi red Surveyor's Certificate, the Council shall pass a resolution approving the lot split. 8. After final approval, a certified copy of the resolution approving the lot split and a "Certificate of Status" form shall be attached to the notice of approval and forwarded to the applicant. The lot split, together with a certified copy of the resolution and "Certification of Status" form, shall thereafter be recorded among the records of the County within one hundred eighty (180) days after the date of the resolution, unless a longer period of time is granted and provided for recording at the time of approval. 9. In all cases where City Council action has been sought and denied, no petition for identical action can be presented until a period of six months has elapsed. He stated this parcel was rezoned from single family to C-1 to allow a single family home to be used as a gift shop. Mr. Robinson stated if the lot is split, it will be over 25,000 square feet and the code requires 20,000 square feet. He stated there is a concern that the remaining property would be landlocked, however, the petitioner has indicated they are the owners of the adjacent property and this will be added to that property. Mr. Robinson stated staff is recommending the following stipulations: (1) the southerly portion of the split parcel is to be added to Sandee's Restaurant parcel concurrently with recording of subdivision; and (2) park fee of $1,905 to be paid prior to recording lot split. Mr. Robinson stated a third stipulation was going to be added to pro- vide joint driveway easements between the gift shop and Sandee's Restaurant, but this has already been accomplished and recorded. Mr. Qureshi, City Manager, asked the plans fo Tract B. Mr. Robertson stated at this time, there ar no plans, but the petitioner has thought about using Tract B for addit 'nal parking for the apartments. He stated the types of uses that woul be allowed would come under a restrictive covenant of the rezoning a eement. Mayor Nee asked why the Council was nsidering the special use permit at this time. Mr. Robertson stated if the speci use permit is approved, it gives the developer some time to develop t use of the plans for the site and is for the convenience of the developer: Mr. Newman, Assistant City At orney, stated the reason for the special use permit is the owner of the r wash wishes to begin construction of the polishing and buffing facil ty and staff is trying to expedite the process. He stated one of staff's c ncerns was perhaps it would be beneficial to have the zoning conform to the use . He stated under the current zoning, the pizza establishment woul n't be permitted as a non-conforming use. Mayor Nee stated he understands the special use permit is not needed for the car wash because it/is a legal non-conforming use, however, if it is rezoned, the special //// use permit is needed. Mr. Olehefske statedhe is the owner of the Riverside Car Wash and wants to expand the services to allow car buffing which they now do under a canopy. He stated in applying for a building permit, it was found the zoning was not proper. He stated because of the length of time to process the rezoning, he questioned if there was some way they could begin construction and staff suggested they' apply for the special use permit. MOTION by C neilman Fitzpatrick to grant special use permt, SP #87-15 with the follow ng stipulations: ( 1 ) owner agrees to manage the car wash operation n such a way as to not require greater than 10 spaces of parking - in the vent of a shortage, parallel parking may be required on the north side of the building; (2) this special use permit is contingent upon complia ce with all stipulations outlined in the rezoning petition ZOA #87-03; (3) it is understood by the City and the petitioner that this special use permit is valid under the proposed C-2 zoning classification; (4) driveway on East River Road to be designated and signed as an exit only and ,driveway on Mississippi Street to be signed as an entrance; (5) parking and access situation to be reveiwed by staff in nine months; and (6 ) -9- COUNCIL MEETING OF AUGUST 24, 1987 disturbed when a project is half finished, items are forgotten and have to be added, TKDA comes back for additional compensation. He felt the homework upfront isn't being accomplished. He stated he would like a representative from TKDA to talk to the Council regarding some of these things which have happened in the past. Mayor Nee stated it seems the City always pays or TKDA' s mistakes. He stated he would like to see a short parag ph on each issue to see the reality of the City's experience with TKD over the last several years. Councilman Schneider stated he didn' object to a good consultant, but when there are errors, it costs every e additional money and then to compensate TKDA for errors is not right. Mayor Nee stated he f t these additional costs should be paid, but a representative of T should discuss these issues with the Council . MOTION by Coun man Goodspeed to approve the amendment to the agreement with TKDA t he Supplemental Contract for Construction Administration Services or repair of the 1 .5 MG Reservoir, Project #161 , for a total amoun of $3,750.49. Seconded by Councilman Fitzpatrick. Upon a voice vot , all voting aye, Mayor Nee declared the motion carried unanimously. 17 . RESOLUTION NO 62-1987 APPROVING A LOT SPLIT, L.S. X87-07, TO SPLIT OFF THE NORTHERLY 213 FEET OF LOT 3, AUDITOR'S SUBDIVISON NO. 88, BY MARGARET BRICKNER: Mr. Robertson, Community Development Director, stated the City received the land survey on this lot split and petitioner has agreed to the stipulations that the southerly portion of the split parcel is to be added to Sandee' s Restaurant parcel concurrently with recording of subdivison and a park fee of $1,905 is to be paid prior to recording the lot split. CONSIDERATION OF CHANGE ORDER NO. 4 FOR DEMOLIT N AND SITE GRADING PROJECT NO. 163 : Mr. Robertson, Community Development Direct , stated the HRA approved this change order at their August meeting. H stated, technically, a change order cannot be executed until it is a proved by the City Council . He stated the circumstances of this change rder, however, required the HRA to act to implement the intent of the law rather than the letter of the law. He stated if the contractor had to w 't for Council action, additional costs would have occurred and, in consult g with the City Attorney, staff was advised the change order should be rocessed in the most expedient and cost effective way. MOTION by Councilman Schneider approve Change Order No. 4, Demolition and Site Grading Project #163, wit Enebak Construction Company in the amount of $38,750 for a revised contrac amount of $1,200,863. CONSIDERATION OF AMENDING KDA AGREEMENT FOR DESIGN AND REPAIR OF 1 .5 MG RESERVOIR PROJECT N0. 161 . Mr. Flora, Public Works Director, stated the repair of the 1 .5 M3 reservoir on Johnson Street has en completed by Western Waterproofing at a cost of $78,591 . He stated he City had a contract with TKDA to conduct the inspection work for lump sum of $1,800. He stated a question was raised about the epoxy in he tank and TKDA was requested to run tests. Mr. Flora stated TKDA is req esting compensation for these tests at $1 , 146 .95 and additional compen ation for soliciting prices from other contractors at a cost of $803 .54 r a total of $1,950.49 to be added to the original contract of $1,800. Councilman S neider asked who selected the contractor for this project. Mr. Flora s ted this contractor was the low bidder and the City awarded the bid based n TKDA' s recommendation. RESOLUTION NO 62-1987 APPROVING A LOT SPLIT, L.S. #87-07, TO SPLIT OFF THE NORTHERLY 213 FEET OF LOT 3, AUDITOR'S SUBDIVISON NO. 88, BY MARGARET BRICKNER: Mr. Robertson, Community Development Director, stated the City received the land survey on this lot split and petitioner has agreed to the stipulations that the southerly portion of the split parcel is to be added to Sandee' s Restaurant parcel concurrently with recording of subdivison and a park fee of $1,905 is to be paid prior to recording the lot split. MOTION by Councilman Schneider to adopt Resolution No. 62-1987 with the stipulations attached as Exhibit A. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. This letter is just a reminder to record your lot split by Feb 19, 1988. the City Council approved the lot split on August 24, 1987. City policy requires the recording of a lot split within 180 days of approval. If a lot split is not recorded within this period of time, it is considered unapproved. Therefore, it cannot be recorded unless it is presented again to the Planning Commission and City Council and aPpr ov ed.
