Gentlement : This letter is to advise you that 1 do not represent Myron Heine in. his attempt to obtain a lot split . Mr. Heine asked me to represent him in the sale of his house, and also to obtain a lot split . 14hile I agreed to accept a power of attorney on the sale of his home, I told him that, beepuse I was City Attorney, I could not appear before a sub-committee of the Planning Commission . I further advised him that I did not think it would be necessary that he be represented by legal counsel . As you perhops know, Mr. Heine has accepted an overseas assignment and will be out of the country for five years. There is a pending sale on his property that is subject to the lot split . I simply point these facts out because Mr. Heine is not here to speak for himself, and because it is possible that he misunderstood my position in respect to my representing him on the lotsplit . E. , Fridley Dear Mr. and Mrs. Haedtke: I am writing in regards to the status of a subdivision for the above referenced property. Recently I have been in touch with a Wanda Eggebrecht who called regarding the special assessments for the property on Lucia Lane. Ms. Eggebrecht described your intention to sell off the easterly half of Lot 4, Lucia Lane Addition. In doing a special assessment search, it was determined that there had never been a subdivison of Lot 4, Lucia Lane Addition which has been recognized by the City. Ms. Eggebrecht was further informed that the special assessments could not be split in as much as a valid subdivison had not been obtained frau the City. In researching the file, I discovered that there was in fact an application for a lot split of this property in 1966. This lot split petition was denied by the City Council on September 6, 1966. Despite this denial , the petitioner, a Myron Heine, proceeded to convey the property and have it recorded at the County where their records indicate it was f iled on October 3, 1966. The reason for the City denial and continued reluctance to recognize this lot split is the fact that the westerly half of Lot 4, Lucia Lane Addition has no street access of its own. Therefore, the City can only recognize Lot 4 as one whole tax parcel. I believe the City's position has been clearly expressed and documented. Mrs. Nelson wished to split the lot down the center so that the two lots would face Gardena. it was noted that the existing garage had ample side yard. The Subcommittee felt there was no problem in connection with this request. MOTION by Danielson that the Plats and Subdivisions Subcommittee recommend approval of the Lot Split #66-11, Alma Nelson,, being the South portion of Lot 1, Maloland Gardens into two lots with each having equal frontage on Gardena Avenue. Upon a voice vote,, the motion carried. 4. LUT SPLIT IWUEM: L.S. #66-12�DONALD WARD: Lot 17, Clover Leaf Addition. The request would split the lot Bast and West with the existing house on the Northerly lot. It had made no difference in the . past,, but now that they were selling their ham, it had to be resolved. MOTION by Albrecht that the Plats and Subdivisions Subcommittee rid approval to split one foot off the North edge of Lot 158 Block 28 Sylvan Hills by Robert Sanborn, L.S. #66-14, and that no lot split charge be made in view of the mistake that appears to have happened when the neighbor's garage was built. The Subcommittee members were given copies of a letter from Virgil Herrick stating he was not representing Mr. Heine as originally believed. The andmrs felt it should be mentioned that their recommendation for State Aid Mileage is made as a designation only for mileage purposes, to seriously question that it will be eventually used this way. The designation should definitely be re-studied before any. impravewet is ordered to see if there are any changes that would make this an improper designation. Also recommend adding Altura Road from 53rd Avenue North to Mein Street, if more mileage is needed. For the record, these suggestions are for designation purposes only and not intended as the actual state aid route. Upon a voice vote, all voting aye, the motion carried unanimously. 4. LitC� STt93T: It was noted there ere two lot splits in this area and there are no ecaassens to the lots facing HighmW #65. The question was asked whether or not there was a possibility of the Bwy. Dept. allowing a portion of a service road to be on highway right of way. The answer was that once the highway is built, it is closed as far as encroaching on their right of way is concerned. The members felt they would like to have a meeting with the property owxmZrs and set a night, sending a letter to theme asking if they would lite to toads in to study access for the lots facing Buy. #65. Under the law, the City does not have to provide access. They felt they would like the Engin- sering Dept. to give more facts and include 68th Avenue. They asked Bngin- aering Assistant Clark to give thea a cost ectimsts for sewer, water and storm reser, and street purposes and put together a little better picture for future plan including dimensions, show specific hard surfaced roads and what is left, width and depth of lots and sewer easements. The City Manager was asked to check with the County Commissioner re- garding holding Lot 6 for possible purchase. The Subcommittee tabled the Uwia Lane Study for the March 30th m®sting. Subcorranittee - March 30, 1967 Page 4 Chairman Jensen stated lie felt the people between 60th and 61st should also be contacted for their opinion. Member Schmedeke waisted to go on record that if we had the Hodne Service Road, we would have gotten what we wanted. At the present time we have no through traffic, no cross streets any more. In a new area you could propose most anything, but this area has been here a long time and you have to lean a little bit toward the old timers. It is logical for this area to be rezoned commercial and that is why 3rd Street is the logical through street. Chairman Jensen stated there is a great deal of traffic on 3rd Street and enormous pressure for commercial zoning. The houses face 3rd Street and business road would be behind the property. A 134 foot strip does not lend itself to commercial zoning. I feel we owe it to a number of parties involved in this problem to cease studying the property and refer it to the Planning Commission. Member Schmedeke stated he would like to be at the meeting of the Planning Commission. He said this problem is important to him and the people in the area, as it is our only way out South. We need 3rd Street and are entitled to it. It surprises me that you want and are determined to send traffic down Main Street. MOTION by Schmedeke, seconded by Ylinen, that the Plats and Subdivisions Streets & Utilities Subcommittee accept the street pattern dated October 2.5, 1966 that Erickson Petroleum presented this evening for the Third Street Pattern from 57th Avenue to 58th Avenue as the best way out south, using Fridley specifications for the street and would like a roll call vote on it. Upon a roll call vote, Sclimedeke voting aye; Nagel, nay; Ylinen aye; Jensen, abstaining; and Albrecht, nay, the motion failed. MOTION by Ylinen, seconded by Albrecht, that the Plats & Subdivisions- Streets & Utilities Subcommittee pass the Third Street Pattern on to the Planning Commission for further study and without specific recommendation from this committee. Upon a voice vote, all voting aye, the motion carried unanimously. Chairman Jensen informed Mr. Zizak that he was in favor of the vacation of 572 Avenue between 3rd Street and 22 Street providing this plan is carried through. Member Schmedeke said he looked at Mr. Ziza.k's property and if the road goes through, he felt Mr. Zizak is entitled to the vacation, as it would also improve the neighborhood. 3. LUCIA LANE STUDY: Using contract prices for work the City now has under contract, Engineering Assistant Clark submitted the following figures for improve- ments on Lucia Lane: JSewer, water and a 30' service drive with concrete curb and gutter would cost $3,800 per lot. �' Eliminating curb and gutter, it would be $3,100 per lot. Plats & Subs.-Str. & Util. Subcommittee - March 30, 1967 Page 5 There were 8 new lots considered. The consensus of the Subcommittee was these would be expensive lots, and they probably would do these people a favor by leaving them the way they are, and in order to eliminate this from the future agenda, a motion was in order. MOTION by Nagel, seconded by Ylinen, that the Plats & Subdivisions- Streets & Utilities Subcommittee file the report to show we have studied the Lucia Lane problem and that the results of the report show it is not economically feasible to consider at this time. Upon a voice vote, all voting aye, the motion carried unanimously. 4. RETURN 0£ LOT SPLIT (L.S. #65-14) H. M. NYGARD: That part of Lot 14, Auditor's Subdivision #129 lying west of east 273.0 feet, ex. west 17.0 feet taken for Central Avenue, and except easement over north 30 feet for road purposes. The City Manager gave a resume of the former requests for splitting this parcel. The new request asks for a 180' parcel abutting Central Avenue and a 70' lot to the east. The Subcommittee stated that they have always avoided recommending a lot less than minimum size unless there is a hard- ship or circumstances making it inevitable:. MOTION by Ylinen, seconded by Schmedeke, that the Plats & Subdivisions- Streets & Utilities Subcommittee deny this request (March 21, 1967) of a lot split for part of Lot 14, Auditor's Subdivision #129 lying west of east 273.0 feet, except west 17.0 feet taken for Central Avenue and except north 30 feet taken for road purposes on the basis of one lot being sub- standard, but would recommend approval for the modification of the request of the lot split being 175 feet for the lot facing Central Avenue and 75 feet for the lot to the east. Upon a voice vote, all voting aye, the motion carried unanimously. 5. SETTING MEETING DATES: The next regular meeting of the Plats & Subdivisions-Streets & Utilities Subcommittee was scheduled for April 20, 1967. The Subcommittee decided to meet on Tuesday, April 11, 1967 at 7:30 P.M. in the City Hall for an informal meeting. Mr. Gerrety stated he would have no objections to signing a quit claim deed for the dedicated street (68th Avenue).- MOTION by Bergman, seconded by Hughes, that the Planning Commission would like to suggest to the Board of Appeals, that if a special use permit is granted for the parking space, that access be restricted on 68th Avenue. Chairman Kravik stated that. at the time the Lucia Lane improvement was made, the, service road on Wast and of the property was discussed and rejected by the owners of Lots 1 through 7 who stated they were not ever going to split them. Chairman Bergman of the Streets and Utilities Subcosanittee stated they were not mart of this. He stated the Streats and Utilities Sub- aommittea was approving the Lot Split #66-08, Myron Heine, but red tagging the West half of Lot 4 and all of Lots S, 6 and 7 until a study is completed to establish a street pattern which would allow the split- ting of the rest of these lots. If the owners of the lots will not sant to split them ever, or that this is too preliminary in the idea of a study, the ultimate approach would be at this time, for lack of interest by adjacent property owners, to deny the lot split. In answer to the problem of access on the West side, it was suggested to approve the lot split and then study how to got access. The purpose of splitting would be to get relief from asseseaents. It was stated that the County will split the taxes, but the City will not split &asses- ments until a lot split is formally approved and a certificate of survey Prepared. It was noted a person could sell, but a building permit would not be granted until the City requirements were met. In 1958 an attempt was made for a street pattern, including Lucia Lane, Channel Road and it wound up the way it is now. In this instance, it was explained the process of red tagging simply• says if somebody chooses to do anything with a portion of the West lot, the City won't give a building permit unless they most certain conditions. Because lot splits usually happen one at a time, all that would be necessary is for the owners of the rest of the lots to agree to an established pattern for street. The reason for the lot- split is that Mr. Heine sold the East half of Lot 4. The recommendation was based on the knowledge that this lot split would landlock the West half of Lot 4, furthermore, legally the East half could be sold, and in addition, that if the lot split is approved by the Council, whether red tagged or not, that eventually he may demand or force a road through to serve this West half. 3. =.= MANOR YAR%: Special Parks and Recreation meting of August 22, 1966. Proposed Melody Manor Park. Member Hughes brought the relief model of the proposed Park to the meeting. He stated the Parks and Recreation Commission were calling for preliminary plans and specifications for developing Melody Manor Park. The aim of the Commission is to start a more formal planning process for the parks and upgrade then in a more planned manner than in the past. They believe this procedure will avoid a masher of problems. The Commission has applied for matching funds under the Federal Land and Water Punds which will provide faderal' funds equal to what the City will put up. The amount is about $7,000 a year. The Planning .Cosmission agreed with Bergman that the model was very interesting, represents good effort and high quality on the part of the Parks and Recrsatiou Commission and thanked them. It was noted that parking area was not included, and Hughes explained that this particular area, being across the street from industrial to the South and adjoinin church area, will allow use of street parking with little difficulty. He also stated this program probably represents eight to ten years. Mr. Zizak°s request would be to close 571 Avenue and create a cul de sac at the intersection of 3rd Street. Because Mr. Zizak has sold some of his property in that area to Holiday Village North, more att-.dy will be made. Item 2: Street Pattern in Lucia Lane Addition: The original request by Myron I*ino was to split Lot 4, Lucia Lane Addition, North and South in the middle. There is no access for the lots facing Highway 465, and no service road. They are all deep lots. The Planning Commission recommended that the application be turned down because it would create a landlocked lot. There would be a continued problem in that there are four lots oversized and may bring up further requests for lot splits. There is a possibility there is no way to get a street through, but it was felt a meeting' with the people of the area should be called to discuss a road pattern, that a topog of the area should be available, but that this is not on a high priority list. Mr. Clark had talked with the Engineer in Coon Rapids who stated that 85th Avenue N.E. was going to be developed as an East-West County road, therefore Coon Rapids would not be interested in giving half a dedication for 83rd Avenue at the present time. It was agreed that there is a definite need for 83rd Avenue to be developed because the access problem to the rear of lots on Ironton Street will have to be solved at some time. It was suggested to Mr. Favre that he should apply for a building permit now, and that the City should establish a logical street pattern and consider Mr. Favre'' problem.
