Mr. Robert Olmstead was present. MOTION by Drigans, seconded by Langenfeld, that the Planning Commission open the Public Hearing on rezoning request, ZOA #75-05, by Robert 91mstead. Upon a voice vote, all voting aye, Chairman Harris declared the Public Hearing open at 9:00 P.M. Mr. Boardman said there was a petition to receive on this request. Mr. Harris said this was petition No. 19-1975 dated October 8, 1975 which read "We the undersigned property owners of single family dwellings and residents of the area around and adjacent to Lot 14', Auditor's Subdivision No. 129, all lying in the North'.Half of Section 12, T-30, R-24, City of Fridley, County of Anoka, Minnesota, generally located at Fireside Drive N.E. and Central Avenue N.E. , hereby petition the Planning Commission of the City of Fridley to deny the request , ZOA #75-05, to rezone the C-1S District to any zone other than R-1 . That the undersigned represent the majority of single family dwlling property owners around and adjacent to the above mentioned property and hereby voluntarily signify our objection to such rezoning requests and respectfully request the Planning Commission to eny such requests. " Mr. Harri^ said there were signatures from 15 residences in t e area. (Only six in the 350' radius of the property). MOTION by Scott, seconded by Langenfeld, that the P1ann ng Commission receive Petition No. 1975, in opposition to any rezoning excep� to R-1. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Boardman said the first request to split this lot Ws back in 1965, which subsequently was dropped. In 1976 there was a petition to sp it one lot from the commercial property and to allow this split off lot to be dev loped as R-2. At the time of this request you could construct a double bungalow o commercial property. The request was to split off 75' but when this was recorded a the County, it was recorded as 80 feet. The present lot split request was going to match up with what the County had, so there will be two 80' lots and one 90' lot. Under the present zoning ordinance, you cannot building R-2 in a commercial- area, so t is was the reason for the rezoning request. You also cannot building a double bung low on a 75' lot. Mr. Robert Olmstead said that with the lot split request they were trying to clarify the legal description once and for all . because this had become a,,mish-mosh between 'f-lanning Commission Meeting -_ October 8, 1975__*___ Pago 6 1965 and 1967. Mr. Harris said the lot split request was actually the next item on the agenda. Mr. Olmstead said that in answer to the petition against this rezoning of this property, the double bungalow that would be built on parcel 93C , the parcel closest to. the present R-1 zoning, would be a split entry type of construction, and would fit into the residential atmosphere of the area. He said they alr ady had a buyer for this parcel , and if this 'rezoning went through without a hitch he did have the financing. He said they would have to break ground before the end of the ear. Mr. Olmstead presented a picture of a split entry double bungalow that had Leen built in another area that would be the same as what they were proposing to build on this property. He also presented pictures of the property and the homes adjacent to Vis property. Mr. Olmstead said the old piano store was on this property. Mr. Harris asked if the piano store would be torn down. Mr. Olmstead said he had oral agreement that it would be. Mr. Olson said that there had been complaints on this piano store, but the structure was sound so it could not be condemned. It has been boarded up. Mr. Harris said when this was rezoned, the piano store would become a legal non-conforming use, and he -thought it should be a stipulation of the rezoning that it be removed. . Mr. Boardman said that just South of this property, the zoning was C-R1 and this was where the Planning Commission had just approved a building permit for a commercial enterprise of office and storage space. South of that was the Frontier Club. Across the street from this property it was zoned M-2 (heavy industrial ) and kitty-corner from the property was the mobile home park. He said that just North and East of this property it was zoned R-1 . Mr. Dale Hagen, 7478 Hayes Street N.E. , said he was representing the people who had signed the petition. He said his house was built in 1965 and happened to be the first house in the area. He said that subsequently the of er homes were built . and they had all been well maintained, so this was a nice area of Fridley. They all felt that single family homes were the best use of this vacant property. He also stated that the old piano store was a safety hazard to the area. He aid that although this was boarded up, it was always being broken into, and it looked ike a junk yard. He said he had talked to Judge Wargo, the owner of the property, nd also to Council . He said that both the Mayor and his Councilman, Walt Starwalt had been out to see him about this property, but so far nothing had been done. At this point there was a discussion between all members of the Planning Commission, staff present, and with Mr. Hagen, in which the following points were made: 1 . If this property wasn' t rezoned, it could be developed commercially. 2. The R-2 zoning would be a good buffer between the commercial and industrial area and the existing R-1 property. 3. The property owner was petitioning to have this property zoned R-2, not R-1 , and the Planning Commission and Council could not rezone property to a different zoning than what the property owner wanted unless they were prepared to defend that change in court. The property owner has his rights. 4. The Planning Commission kept asking Mr. Hagen if he understood their position, Nianning Commission Meeting - October 8, 1975 Pa e and the alternates, and .Mr. Hagen kept saying that he id, but he stall didn't want the property rezoned to 'anything but R-1 . Mr. Hagen asked the Planning Commission that if the neigh orhood got together and could negotiate the purchase of this property, if they coul then request that it be rezoned to R-1 . Mr. Harris said that they could, in that event. Mr. Hagen said he was disappointed that the other people who signed the p tition were not present at this meeting. They had said they would be here. Mr. Olmstead said he had talked to the people who owned he residential property closest to the property he wanted to rezone. He said he didn' hear about any opposition, they just listened and didn't give much response. Mr. Drigans asked Mr. Hagen and Mr. Olmstead what they t ought the value of their property would be valued at by the tax assessor. Mr. Ha en said the value of the homes as given by the assessor's office would be around $28,000. Mr. Olmstead said he didn't know what value the tax assessor would put on t edouble bungalow, but it would cost about $53,000 to build and the owner would live n one unit. Mr. Drigans said he didn't feel that this would be detrimental to the resi ential area, and might be more of an improvement. Mr. Hagen said he had no doubt , that these would be fine double bungalows, but single family homes would be finer. MOTION by Bergman, seconded by Scott that the Planning Commission close the Public Hearing on rezoning Tequest, ZOA #75-05, by Robert Olms ead. Upon a voice vote, all voting aye, Chairman Harris declared the Public Hearing cl sed at 10:20 P.M. MOTION by. Councilman Stnrwalt said that no .' buildings are constructed with the idea that it will become run down, but at the sante time the Council could not guarantee this; Mr. Bennett said he did like the plans better than most he has seen. APPEALS-COMMISSION 14EETING OF DECEMBER 9, 1975 J A. SHOREWOOD SHOPPING CENTER SIGNS; 6225 HIGHWAY#65 N.E. The Public Works Director explained this request is from Mr.. Max Saliterman, through his attorney for variances for signs. This would allow both roof and free standing signs at the Shorewood Shopping Center. The signs presently existing are two free- standing signs and that the King Chalet pylon and the Payless Shoe roof signs are a non-conforming use. He further stated that the staff pointed out that with the F. i removal of the pylon sign, a variance request would not be necessary. They also i pointed out that the King Chalet sign shows no useful purpose and that the owner r has been contacted and an agreement reached whereby the sign would be removed. The Board of Appeals did approve the variance for construction of three roof signs. f Councilman Fitzpatrick asked in what way were these signs non-conforming, and the - Public Works Director explained that the Ordinance states two free standing signs per structure, and that is what they have now. Councilman Fitzpatrick asked if the free standing signs were not there, could each business have a roof sign. The 3 Public Works Director said that there would be one for each business in the total construction. Perhaps seven or eight could have roof signs. Councilman Hamernik asked if they were requesting to have three signs at the present time. The Public Works Director said that three signs would take care of the businesses that need signs at this time. Other portions are not ready for • occupancy. # t Councilman Starwalt said that without a doubt there will be other signs for which application will be made. Some are vacant because of the wind storm. He stated r he believed it was good that the Appeals Commission removed the blanket request, and he would move to approve the request. (Southern Anoka Countv Assist?nce) is for a full-range information and referral service, including Fridley, Spring Lahr Park and Columbia Heights, They are asking Fridley to pick up a portion of the costs, which would amount to $500., c, which would be directly related to our community. At present, he said, the County does not have a referral service. Appendix D of the City Code of Fridley is am nded as hereinafter indicated. SECTION 2. The tract or area within the County of Anoka and the City of Fridley and described as: The Southerly 132 feet of the Westerly 267 feet of Lot 14, Auditor's Subdivision No. 129, lying in the North Half of Section 12, T-30, R-24, City of Fridley, County of Anoka, Minnesota. Is hereby designated to be in the Zoned District known as R-2 (two family dwelling areas) .
