The intent was not to with- draw, but table the decision on the matter and give the petitioners additional time to answer some of the questions which were raised. The audience were informed that tabling an item was not unusual. In this case, the public hearing was closed. The members of the audience will receive notices when this request comes back on the agenda. Before Chairman Erickson returned to the chair, he addressed the audience. saying, first of all, he owns ten acres which was owned by Mr. Gardner and was about to be lost by taxes. He worked on a purchase pri a agreeable to both of them. He had not talked to any member of the Planning Commission about this item, nor would he in the future. Neither would he vote on it. They feel there has not been complete understanding between themselves and the people. They want the opportunity, to study further and the opportuni y to sit down with the people and get their views, to see if they can get together, and if the people did not change their minds, they can go ahead and vote against it. Chairman Erickson had looked at the area for some time and felt it was one of the problem areas in the City. If they cannot work cut anything satisfactory to the people, who can object, then they will try to wo k out another plan in some other way. In no case were they trying to "pull a ything", but they would like to sit down and talk about it with all the interested parties. Chairman Erickson continued -- there was a comment about the duplexes in Columbia Heights -- very bad, but he could show some pictures of some that are good. He did not think anything is slum if a man takes care of his property. He thought that restricting the size of houses was inco rect. If a man wanted to live in a house without a garage, he should be able to do so, but the City Code does not permit it any more. He did not intend to hurt anybody by his construc- tion or anybody he sold to. If anyone wanted to look at the homes he has built, he would be glad to take them around. Mr. Eyler said he understood Mr. Erickson would sit down and talk to them individually, but he .felt it should be the whole group. Mr. Erickson said that was Just what he wanted to -- sit down with all of the people. Mr. Wieland offered his basement for the meeting! 2, PUBLIC HEARING: REQUEST FOR SPECIAL USE PERMIT SP #71-01 BY ALBERT M. JOHNSON: To permit construction of a double bungalow in an R-1 District as per Fridley City Code, Section 45.051, 3D, to be located on Lot 7, Block 1, Al Rose Addition. The public hearing notice was read by Chairman Erickson. Mr. Albert Johnson said he was asking for a permit to build a double bungalow facing East River Road. He would have a contractor build the double bungalow, and he would occupy half of it. IlaBB.4a CSa5Jt&kQn Meetk& ehxuax 3,,_ 1971 Page 4 The Engineering Assistant explained that the final plat of Al Rose Addition has been approved, but Suburban Engineering has not finished the hard shell. The sketch is basically correct as far as the placing of the lots. The final plat was approved by Council last 'December. On the final plat, we are asking for a driveway easement to be provided between Lots 5 and 6 in order to have access to the street from the rear of the lot, depending upon what happens to East River Road. Mr. Johnson might want access to the rear rather than to drive out on East River Road. Ten feet would be asked from each lot. This is a condition of the. plat. The property to the North is the Eva Erickson plat and contains single family homes. To the South is the Evanoff home and also some double bungalows. Chairman Erickson asked if there was the possibility that additional right of way might be asked for East River Road. Darrel Clark nswered that it was thought, at one time, that the right of way would be taken on this side, but the County Engineer decided to take it off the railroad easement on the East side. In regard to water and sewer, they would go up the driveway easement. Mr. Zeglen asked who owned Lot 5. Mr. Johnson sai he had a purchase agree- ment to sell Lot 5 and he hoped the driveway easement would not interfere with the sale. The Engineering Assistant stated that Mr. Johnson should be encouraged to use the back road for access if it makes a nice lookinE layout. It was going to be difficult to get onto East River Road, Access to the rear would be a great advantage to him. Mr. Johnson said he plans to have the house facing East River Road and have the garage in the back of the house. He had wanted ac ess to-East River Road -- and could use his mother-in-law's driveway onto East R ver Road. Chairman Erickson informed Mr. Johnson that he could not build any closer to the street than the average setback of the houses on a they side of his lot without a variance from the Board of Appeals. He then asked Mr. Johnson if it were his desire to face East River Road and enter off East River Road? As the Commission understands it, the easement for the driveway is already granted. In answer to Mr. Fitzpatrick`s query if there was anyone in the audience interested in the request, the gentleman who lived to the North said the only reason he came was that he would like to know where Mr Johnson was putting his house and to get a general idea of what he is goin to do. He did not agree or disagree. Chairman Erickson asked Darrel Clark about the East River Road proposal relating to the median. Darrel Clark answered that the Council will have a continued hearing on Monday night, February 8th. The median will be from Inter- state 4694 to Mississippi Street with crossovers at Mississippi Street, 61st Way (Stevenson School) and the Filister Apartments. MOTION by Fitzpatrick, seconded by Minish, that t Planning Commission recommend to Council approval of the Special Use Permit, SP #71-01, by Albert M. Johnson to permit construction of a double bungalow in an R-1 District as per Fridley City Code, Section 45.051, 3D, to be located on Lot 7, Block 1, Al Rose Addition with the stipulation that its access be over an easement between Lots 5 and 6 to Alden Way. Upon a voice vote, all vot'ng aye, the motion carried unanimously. s 1 _ C n MeetebruaEy 3 1971 Pae 5 Mr. Minish wished to mention an area of concern to m which referred to the access on East River Road or the alternate of going out at the rear of the lots. At this time he did not know enough about what Mr. Johnson intends to build so that he had nothing on which-to base an opinion. When he building permit plans go before the Building Standards-Design Control Subcommittee, there would be suf- ficient opportunity for the City to study the plans. Mr. Schmedeke felt that if the easement for access to the rear of the lot were on the plat, it would be used for that purpose. Darrel Clark said the easement for the driveway was not talked about until it reached the Council in December for the final plat. At the time it came before the Planning Commission, there was no talk about improving East River Road. The easement was added by Council. Chairman Erickson said this request would not have to go before the Building Standards-Design Control Subcommittee. As long as provisions were made in the final plat for a driveway to the rear of the lot, the p oblem of an additional exit on East River Road would not be compounded. Mr. Schmedeke said he was certain the petitioner could see the safety factor of not allowing another exit on East River Road. The amount of traffic on some of the City streets, and especially East River Road, is getting to be quite a problem. i 3. PUBLIC HEARING: REZONING REQUEST, ZOA #71-01 BY SMITH FOR VIKING CHEVROLET, INC. : Rezone from M-2 (heavy industrial to C-2 (general business areas) a parcel 600 feet in depth along the centerline of proposed 83rd Avenue from right of way line of University Avenue and 1,675 feet North from centerline of proposed 83rd Avenue. MOTION by Fitzpatrick, seconded by Schmedeke, that 1he Planning Commission waive the reading of the public hearing notice. Upon a voice vote, all voting aye, the motion carried unanimously. Representatives of the rezoning request present at 1his meeting were Wyman Smith, representing the applicant, Ray Wormsbecker, inv lved in the selling, Jerry Brady, Manager of Viking Chevrolet, Inc. , and Tom Boemer of Balco Building Systems. Mr. Wyman Smith explained the rezoning request involved a parcel of about 23 acres. The Southerly boundary is at the center of what would be 83rd Avenue. Eighty-Third Avenue would be where the watermain runs W st to the railroad tracks. The City does have some dedications for utility purposes , but the South boundary of this property, of what my client is buying, comes in the center of the road where there probably will be dedication for 83rd Avenue The depth is 600 feet back from University Avenue. They were not asking for iezoning on the Western 600 feet of the original parcel -- it is to remain M-2. This property would adjoin the area which the City has acquired for park lard and, hopefully, a golf course sometime. The people he represents are in tusiness in St. Paul, but had to relocate because of the City development plan. Niking Chevrolet plans to locate in Fridley and they have the approval of the district and regional divisions and tentative approval from Detroit. They haie an option on this land until May 1st. REGULAR COUNCIL MEETING OF MARCH 1, 1971 PAGE 7 east of Central Avenue and there must be some long range plans for flood control. He too, would like to see the wildlife maintained. He felt that the suggestion by Mr. Hegstrom to get together with the Planning Departme t was a good idea, to see what could be put together. CONSIDERATION OF INSTALLING LOCiCE PARK ENTRANCE SIGNS ON PUBLIC STREET RIGHT OF WAY AND WAIVER OF THE FEES: (Request by Fridley Jaycees) The City Engineer said that the proposal is to put one sign at the new road cut into Locke Park from 73rd Avenue west of Target Warehouse, and the other one on 71st Avenue. His only recommendation is that they be iiLstalled on the property line and he said he would work with them on that. They would like approval by the City Council and the fees waived. MOTION by Councilman Liebl to approve the signs and waive the fees. Seconded by Councilman Harris. Councilman Harris asked if there was adequate parking. The City Engineer said that there were plans for developing the parking area. A member of the Fridley Jaycees said that they had checked with the Park Board and they felt that it would enhance Fridley. Over 50% of the people living in Fridley do not know where Locke Park is. Mayor Kirkham commented that he was sure that if the Jaycees were doing it, it would be a good project. Councilman Kelshaw asked if there was any sign on T.H. #65. The City Engineer said yes, a small sign. The member of the Jaycees said that this is one of their projects for this year and they hope to work out other signs for the parks in the coming years. THE VOTE upon the motion, being a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. CONSIDERATION OF REQUEST FOR EXTENDING SPECIAL USE PERMIT OR GOLF DRIVING RANGE ON 8100 UNIVERSITY AVENUE TO COVER INSTALLATION OF AN 18 H13LE MINIATURE GOLF COURSE: (Request by Roger Jones) The City Engineer explained that the applicant wishes to add an 18 hole miniature golf course on the north side of his parcel. This involves no buildings, only a fenced area. They will use the building already there for both activities. His only recommendation to the Council is that the same stipulations that were on the original permit extend to cover this activity also. The special use permit is only for three years, at the end of that time it must be reapproved annually until five years has expired. MOTION by Councilman Harris to approve the request subject to the same stipulations contained in the original permit. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. RECEIVING THE MINUTES OF THE PLANNING COMMISSION MEETING OF FEBRUARY 3, 1971: REQUEST FOR SPECIAL USE PERMIT, SP #71-01, BY ALBERT M. JOHNSON: To permit construction of a double bungalow in an R-1 District as per Fridley City Code, Section 45.051, 3D, to be located on Lot 7, Block 1, Al Rose Addition. t v C'Zv t ti REGULAR COUNCIL MEETING OF MARCH 1, 1971 PAGE 8 The City Engineer said that this request is for a special use permit on part of some property that is part of Al Rose Addition which has already been approved. The Planning Commission has held their hearing and recommended approval of the special use permit request for Lot 7 subject to his providing access off Alden Way instead of East River Road. The Planning Department tries to discourage additional direct traffic on East River Road. Council action now would be if they approve, to approve the request by a 4/5 vote. Mr. Allan C. Mattson, 6320 Riverview Terrace, said that he had sold 10 parcels to Mr. Johnson. He said at that time there was to be an easement to East River Road to get into this lot, and Mr. Mattson said fine. After submitting the plat, the access easement to Alden Way for the street reduces a 70 foot lot to 60 feet. He would not be interested in building nice homes on each side of this easement and having the cars drive between the two houses. They would have to drive within 5' of the homes. He did not feel that he could have a street going through there. He said that Mr. Johnson is no longer interested in his plans with this condition. He is in accord with everything except this. The City Engineer said that the plat did show a utility and access easement. There is a common driveway for three houses that comes out on Alden Way. He then showed the plans at the Council table. He said that these are 95' lots, and the requirement is 751 . Mr. Johnson said that he would like his access coming out on East River Road. The building would face East River Road. Councilman Liebl asked if there would be the same setback as the other buildings in the area. Mr. Johnson said that he understood that this is one of the requirements. Mr. Mattson said that he noticed on the Agenda there is a proposed Ordinance making it a requirement that there be double garages. He said that there would not be room. Councilman Harris said that he could always come before the Board of Appeals if it is a hardship case. Mr. Johnson said that he would have to have access onto East River Road or else he would not include this lot on the plat. Mayor Kirkham commented that it cquld possibly hinder the T.O.P.I.C.S. case if they were to grant another access. Toe City Engineer said that if the Council approved the easement coming onto East River Road, it would be a common driveway easement for four homes. MOTION by Councilman Liebl to approve the Special Use Permit requested by Mr. Akbert Johnson subject to Lot 7 getting an easement for the driveway between Lot 7 and Lot 8, to be used as a common driveway for two double bungalows. Seconded by Councilman Harris. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
