4. Consider an Ordinance Amending Fridley City Charter, Chapter 8, Public
Improvements and Special Assessments.
MOTION by Councilmember Bolkcom to waive the reading of the public hearing notice and

Annie Leibel, City Management and Elections Assistant, stated the amendment clarifies
language and makes sure it is consistent with State Statute. The Charter has the permission to do
this through Minn. Stat. § 410.12, Subd. 7. In Section 8.01 the Comprehensive Plan amendments
must be made in accordance with State law. Staff clarified the language so it would be
consistent with State law.
Ms. Leibel stated staff made Sections 8.02 and 8.03 easier to read. There were no substantial
changes. In Section 8.04, the language clarifies the two ways local improvements can be brought
to Council and requires that notice and hearing of local improvements and assessments be made
in accordance with the State Constitution. Previously, the Charter just said proper notice and
hearing. In Section 8.05, staff added some grammar changes, and updated old terminology.
They also clarified how property owners can bring special assessments for local improvements to
Council, and that it requires a four-fifths vote from Council for approval. The two ways it can be

brought to Council are through a Council-ordered feasibility report or by a majority of the
property owners who border the local improvement petition.
Mayor Lund stated the changes seem to be pretty straightforward.
David Ostwald, 6675 East River Road, stated he is the current Chair of the Charter Commission.
As stated in the presentation, they tried to clarify and bring the language up to date and current in
today's standards.

OLD BUSINESS:
5. Second Reading of an Ordinance Repealing and Replacing Chapter 125 of the
Fridley City Code Related to the Licensing of Massage Therapy Businesses and
Massage Therapists (Tabled June 11, 2018);
and
Adopt Official Title and Summary Ordinance.
Deb Skogen, City Clerk, stated this ordinance repeals current language that is outdated. The
City has not licensed this type of business in over 20 years. The ordinance was presented to the
City Council at a conference meeting on May 14. The first reading was held on May 29, and a
second reading was held and tabled on June 11. Council had questions for staff and asked for
additional changes.
Ms. Skogen stated one change was made as a result of the discussion about licensing and
reciprocity in other states. Section 125.05(2)(K) was changed to add two words, "whether the
applicant is currently licensed in other states or communities to perform massage therapy . . .."
Ms. Skogen stated Section 125.10(14) was changed to read, "The applicant or licensee is not the
real party having an n interest in of the enterprise."
Ms. Skogen stated in discussing the effective date and the fee, Section Two of this ordinance at
the very end was amended and the effective date was changed from August 1 to September 1.
The following sentence was also added: "Current licensees shall pay a prorated fee for the 2018-
19 license year. New licensees shall pay the full license fee when an application is made
anytime during the 2018-19 license year."

Ms. Skogen stated the Fee Schedule was changed to reflect the discussion, so it shows that the
fees are annual.
Ms. Skogen stated staff recommends Council make a motion removing the ordinance from the
table, a motion waiving and ordering the adoption of the second reading of the ordinance, and a
motion ordering adoption of the summary ordinance.
MOTION by Councilmember Saefke to remove this item from the table. Seconded by
Councilmember Bolkcom.

6. Approve Traffic Control Changes in the Report for Lucia Lane.
James Kosluchar, Public Works Director , stated subsequent to closure of a crossing and the
repurposing of the former Knights of Columbus Hall on Lucia Lane near 68th Avenue, an
increase in the neighborhood traffic has been seen affecting local streets, Lucia Lane to a greater
extent than others.
Mr. Kosluchar said the Fridley Police Department, Public Safety, and Public Works staff have
met with concerned residents from Lucia Lane and responded to some concerns with driver
feedback, signage, and added enforcement that Fridley Public Safety has taken on. Staff has also
had discussion with Lucia Lane residents and Islamic University staff about additional options
that could reduce speeds in traffic. These included traffic calming measures such as speed
humps and chokers, and closure of one or both lanes of Lucia Lane south of Islamic University,
separating the uses and traffic in this unique area.
Mr. Kosluchar stated more recently, they have seen vehicles stacking on Mississippi Street and
dangerous driving maneuvers have been observed. Limited timing of the Mississippi Street and
Highway 65 signal backs up traffic on both Mississippi westbound and Lucia Lane southbound.
People tend to make erratic moves while queued up. Public Works has collected some detailed

traffic data. They have seen increases of over 600 trips or 70 percent higher. Total traffic on
Fridays, peak days and during peak hours, they have seen three times the normal traffic both
north and south of Islamic University. Sixty-seven percent of the traffic departs Islamic
University to the south via Lucia Lane to Mississippi Avenue.
Mr. Kosluchar stated they have also collected speed data. Speeds do not appear to be affected
by the traffic, although the traffic may have a diminishing effect on speed in and of itself. The
data does not indicate a speed issue at this point although slightly elevated speeds are noted near
68th Avenue.
Mr. Kosluchar stated traffic calming measures alone will not solve the problem they see here,
and enforcement cannot be sustained, although it has been maintained in recent months. It does
strain Public Safety resources. Geometric changes such as eliminating left from southbound
Lucia may provide limited improvements, but they may be difficult to enforce.
Mr. Kosluchar stated the Public Safety Department, Public Works Department, and Community
Development Department have discussed full or partial closure of Lucia Lane just south of
Islamic University. Islamic University was receptive to this and other options that would
improve safety. Under a full closure, Lucia Lane residents would lose convenience of their
northbound access to Trunk Highway 65; therefore, staff is recommending a partial closure at
this time to see if this will mitigate the issue satisfactorily.
Mr. Kosluchar stated there will be secondary impacts of any potential access closure,
particularly on Channel Road. They expect some traffic to bleed off in Channel Road's
direction; however, they do not see where there would be a problem on Mississippi that there is
on Lucia Lane, just because of the distance that Channel Road is from Mississippi. It is over
twice the distance and so provides adequate queuing even for a slow southbound signal on
Highway 65.
Mr. Kosluchar stated the Public Safety Department and Public Works Department are
recommending that the traffic control change be approved. Notice to those in the affected area
will be provided prior to the closure. Islamic University staff haves indicated they would
provide resources for a physical solution if one or both of these aspects were found to be a
permanent solution and constructed.
Mr. Kosluchar stated the area map in the Council's packet shows a bumpout on the north which
is installed on Lucia Lane off the northeast corner of Lucia Lane Apartments, and it prohibits
southbound traffic on that sharp corner. Modular speed humps are also proposed in two
locations south of this point to basically calm traffic. This is really to keep speeds in check with
regard to northbound traffic.
Mr. Kosluchar stated the graphic on location he is presenting shows the restriction in a little
more detail. Lucia Lane Apartments are to the south. The Islamic University to the north. They
can see the parking lot on the large open space. They would have signage that would basically
prohibit entrance in the eastbound direction which leads you to southbound Lucia Lane. They
would install a restrictor with delineators and signage on a trial basis. Also, modular speed

humps would be installed. If this improvement or the modular speed humps are determined to be
effective as predicted, then physical construction of the improvements would take place.
Mr. Kosluchar stated the budget for this is actually included in the CIP. They do have some
dollars set aside for traffic issues. This would likely use just over half of those dollars for the
year. Because of the unique configuration and uses that are adjacent to one another that are not
complementary and due to the growth and success of Islamic University, and the fact that they
are seeing the impact on the local residential streets in kind of a fairly significant way, staff is
recommending City Council approve this traffic control change on Lucia Lane. If approved,
they will notify area stakeholders of the proposed changes. The City has some materials on hand
but will have to acquire some additional materials for the changes to be made.
Councilmember Varichak asked if the neighborhood has been advised of these changes and if
there was any feedback.
Mr. Kosluchar stated they have not yet sent out formal notification. They would do so after the
Council meeting if Council approves the changes. He said the changes are being implemented
on a semi-permanent basis. They could remove the improvements if there were impacts or
problems.
Councilmember Varichak stated she knows they had some traffic control mechanisms put in
another area because of poor speed control. She asked how that has worked.
Mr. Kosluchar replied they heard very little from the neighborhood, which is Third Street. In
' 2016, under the City's reconstruction project, they implemented some lane reducers. He knows
from the maintenance standpoint they are not as difficult to work around as they thought they
would be. They also did some speed analysis and speed checking, and saw a modest reduction in
speed. Staff has not heard any negative feedback. Early on they heard some positive feedback
but over long-term they have had none.
Mayor Lund stated he did sense from the discussion at the previous Council meeting that people
wanted some changes. The vast majority of people who live on that street would probably
concur with having the bumpout and restricting traffic flow.
Councilmember Bolkcom stated she thought she heard at the last meeting they were going to
send something out to the residents so they were aware of this. She asked if Council approves
this tonight and it gets sent out to the residents, how long they will have to respond and provide
feedback.
Mr. Kosluchar replied the City Manager did ask staff to get something out but they did not have
enough time to get something in the mail.
Councilmember Bolkcom asked about the cost.

Mr. Kosluchar said the City actually has the materials on hand to do the delineator choking for
the traffic restriction which is the big portion of it. They are looking at some modular speed
humps and those would be ordered shortly after and would take a little time to get in. They can
phase the project if it is going to take a long period of time. They could have the temporary
choker in around the week of the next Council meeting.
Councilmember Bolkcom stated on Third Street it really helped the neighborhood that the City
was out there and talking to them and helping them understand what was happening. They could
do that with a presentation to this neighborhood. She said she does not feel comfortable going
ahead without at least having a little bit of input. She asked if their motion was made because
this was a temporary solution. The chokers would be temporary and then at some point made
permanent.
Mr. Kosluchar replied, correct, that would be curbed and the pavement would be modified to
accommodate that.
Councilmember Bolkcom stated this is only temporary. At some point the special use permit
related to the facility that has 600 cars will be looked at. She knows they have some thoughts
about moving part of their campus elsewhere, but they also need to look at the special use permit
related to the area and whether they need to be a little stronger. The Community Development
Department is looking at that, but she asked the City Manager that they get some kind of report
back related to that and whether it makes sense to this come back before them.
Mayor Lund said there were a number of residents present at the last meeting, and they felt this
was a positive step. They did tell the residents they would have more detail at this meeting. He
did not think it substantially changed from what they had mentioned.
Councilmember Bolkcom stated they did not have anything visual for them to see at the last
meeting. She would just like the residents to have an opportunity to at least look at it and ask
questions. She does not think waiting an additional week to start this process is going to be that
big of a deal. She is not saying they are going to dislike it. Anything the City is doing is an
improvement over what is there now.
Mayor Lund stated it may not be a perfect fix but it is something and they can see over a period
of time how effective it actually is. He said he would be comfortable approving this item.
Councilmember Bolkcom stated she did not say they should not approve it. She just wanted to
make sure that maybe a part of this discussion was that the neighborhood be presented with it
and allowed to give some feedback. She asked about the cost.
Mr. Kosluchar replied the delineators they have on hand. They would have to order some other
materials. The cost would be about $6,000. The City can use those elsewhere in a similar
fashion if they ever needed to. Actually the delineators were for another project. It helps the
City out to do these on a temporary basis.
Councilmember Bolkcom asked if the whole thing would cost around $6,000.

Mr. Kosluchar replied, no, these are the modular humps. They will cost $6,000. If they
implement the entire thing it will be about $15,000.
Paul Nealy, 6610 Lucia Lane, stated the resolution sounds really good. Unofficially they have
received some communication from Ms. Stromberg from the City outlining these ideas. It has
not been presented formally to the entire neighborhood. He serves as block captain, and they
have talked to several people on the block about what has come up. If it helps, in general,
everyone is pretty cool with what has been proposed so far. He did not hear anything tonight
about a speed limit sign. It is obvious when there is a speed bump that you have to slow down.
He does not know if there is a recommended guidance as to how fast someone can go over this
hump. He suggested nothing higher than 20 would help. It is downhill. People just tend to coast
and really speed up as they get down there.
Mayor Lund stated asked if the City would put some kind of an identifier by the bumps as a
caution.
Mr. Kosluchar said there will be signage there.
Mr. Nealy asked what does CIP meant and if this was something that would not be assessed. He
asked if it was out of the current budget.
Mr. Kosluchar replied correct. CIP is an abbreviation for the City's capital investment plan.
Mayor Lund said the City would not be assessing anything.
Mr. Nealy asked if that was for the test run or ultimately if it were to progress to a permanent
fix.
Mr. Kosluchar replied that is for the temporary implementation. The final implementation is at
Council's discretion.
Councilmember Bolkcom stated if they were going to assess them they would have to have a
public hearing and provide notice to the neighborhood.
Mr. Kosluchar replied correct. The residents would be notified if that were the case.
Wally Wysopal, City Manager, asked when the street was scheduled for reconstruction.
Mr. Kosluchar said he believed Lucia Lane was slotted for resurfacing in either 2022 or 2023.
He said it could potentially be advanced if permanent construction happens.
MOTION by Councilmember Varichak to approve the Lucia Lane traffic control changes.

Mr. Kosluchar agreed. He said the City has a web helper for surveys called "Polco." If you
want to go there directly, that information should probably be up within the next couple of days.

RE: Election of Members to the Board of Trustees of the
Fridley Volunteer Firefighter's Relief Association
The Board of Trustees of the Fridley Volunteer Firefighter's Relief Association consists of 9 members
or trustees. Pursuant to Section 2 of the By-Laws, six members are to be elected by the membership
and three trustees are to be drawn from officials of the city served by the Fire Department. One of the
three trustees must be the fire chief, one must be an elected official, and one must be an elected or
appointed municipal official. Both must be designated annually by the City Council. To everyone's
best recollection, the Mayor and Finance Director have served on the Board. For 2018, staff
recommends the Mayor and the new Finance Director Dan Tienter be appointed to the Board of
Trustees. In the future, we will add these appointments to the list of Council and staff appointments
made in January of each year.
Staff recommends that Council make a motion to appoint Mayor Scott Lund and Finance Director Dan
Tienter to the Board of Trustees of the Fridley Volunteer Firefighter's Relief Association through
December 31, 2018.

Subject: Continued Public Hearing Regarding Revocation of SP#07-01 for Sam's Auto Parts
Background
At the June 11, 2018 City Council meeting,the City Council continued a public hearing regarding a special
use permit issued in 2007 to Sam's Auto Parts. The SUP is to allow an automobile recycling/junkyard use on
four lots at the corner of Central Avenue and 73rd Avenue. In 2007,the business was given four years to
complete several stipulations to be in compliant with the Zoning Code requirements. After numerous
negotiations and extensions, staff brought the unresolved situation before Council,recommending
revocation.
Since June 11,the business owner has gotten much of the outstanding work completed, including: the
customer entrance off of 73rd Avenue, new gate screening,curbing, concrete apron, and asphalt paving of the
customer parking area. The paved area still needs to be striped, but parking stall striping is planned, and the
owner plans to install an inner security fence to prohibit customer access to their parts storage area.
There is an area of the site that the property owner has left unpaved directly south of the existing building.
They have left this area unpaved as they have changed their plans for the location of a future building.Their
thought is it makes more sense to build the new building closer to the customer parking area. Staff agrees
that the new proposed building location makes more sense.There are allowances in the Zoning Code to omit
curbing where future construction is proposed.
Staff has not been able to issue a permit for the pond construction to date as there is inadequate information
provided regarding the pond installation specifications.The owner's brother, Pat Hoosline,has indicated the
pond liner installer he hired can install it in a day and they have a crew ready to work on it once they have a
permit from the City. City staff,however,needs the pond liner's manufacturer specifications and engineered
plans for properly installation.
Recommendation
Since much progress has now been made and the pond is nearing completion, staff recommends that the City
Council continue the public hearing for this matter one more Council meeting to July 23 to allow the
property owner a chance to complete the pond installation as they are now very close to completion of the
site plan and stipulations. A resolution for revocation is attached if revocation is preferred.

A RESOLUTION REVOKING SP#07-01 PERMITTING AN AUTO RECYCLING CENTER USE
AT SAM'S AUTO PARTS,GENERALLY LOCATED AT 1230-73aD AVE NE, 1240-73 %AVE
NE,AND 7340 CENTRAL AVE NE
WHEREAS,on June 11,2007,the Fridley City Council granted special use permit SP#07-01 to Sam's
Auto Parts,generally located at 1230-73`d Avenue NE, 1240-73 Yz Avenue NE, and 7340 Central Avenue
NE and legally described as Lots 16, 17, and 18, Block 2, Central View Manor, to allow an automotive
recycling center(junkyard)use in a M-1 zoning district with six stipulations; and
WHEREAS,the fourth stipulation of SP#07-01 stated that by October 15,2009,the petitioner was to
have the storm water ponding improvements installed; and
WHEREAS,the fifth stipulation of SP#07-01 stated that by July 1,2010,the petitioner was to complete
all curbing and paving according to the approve site plan in Exhibit A; and
WHEREAS,the owner of Sam's Auto Parts has failed to meet repeated extensions offered by the City
for completion of stipulation four and five associated with the 2007 permit issued by the City eleven years
ago;
NOW,THEREFORE,BE IT RESOLVED that the City Council of the City of Fridley does hereby
revoke Special Use Permit SP#07-01 as required in Section 205.05.5.H of the Fridley Zoning Code when
an owner fails to comply with any of the stipulations issued with a permit,effective September 15, 2018,
citing the following findings of fact as..just cause to revoke SP#07-01:
1. On June 11,2007,the Fridley City Council granted a special use permit, SP#07-01 Sam's Auto
Parts, generally located at 1230-73`d Avenue NE, 1240-73 '/z Avenue NE, and 7340 Central Avenue
NE,to allow an auto recycling center(junkyard)use with six stipulations. Stipulation number four
stated:By October 15, 2009, the petitioner shall have the storm water ponding improvements
installed. Stipulation number five stated: By July 1, 2010, the petitioner shall have completed all
curbing and paving according to the approved site plan.
2. On April 6,2009, City Planner, Stacy Stromberg,notified Barry Hoosline that the deadline for
stipulation three was fast approaching and that staff had not yet received proof that stipulation two,
submitting grading and drainage plans,had been complied with. In this letter,Ms. Stromberg also
notified Mr. Hoosline that he also had 18 stipulations tied to the rezoning of some of his property
that needed to be complied with.
3. On April 29,2011,Julie Jones, Planning Manager,called the owner's brother, Pat Hoosline,to
discuss unmet stipulation six,which had a June 1, 2011 deadline.
4. On April 16,2014,City staff met with Pat Hoosline,the owner's brother to discuss completion of the
remaining stipulations.Extensions were granted on several unmet stipulations.
5. On June 15,2016, City staff sent Mr.Hoosline a code enforcement letter regarding customer parking
and storage of junk vehicles that was occurring on the street due to the fact that their site plan had
not been completed,which offered space for customer parking and access off of 73rd Avenue.
6. On July 14, 2016, City and RCWD staff conducted a site inspection at Sam's Auto Parts. There was
great concern about the storm water pond state of incompletion. Owner was granted an extension to
complete the pond installation before the end of the summer.
7. On June 13,2017, City staff in determining that little progress had been made to complete several
stipulations, especially the storm water pond liner, scheduled a public hearing for the City Council to
consider revocation of SP#07-01 on August 14, 2017,and notified the owner of the impending
hearing.

8. On June 23, 2017, Barry Hoosline,Pat Hoosline,Duane Waldoch,Terrence Chastan-Davis
(RCWD), and City staff met to discuss the unmet stipulations. When progress appeared to be taking
place on proceeding with steps towards completion of stipulations, staff cancelled plans for the
public hearing.
9. On April 27, 2018, it was apparent nothing had been accomplished towards completion of the
stipulations, so City staff once again scheduled a public hearing to consider revocation of SP#07-01
and sent a letter to the owner of the upcoming hearing. Public hearing notices were mailed to nearby
property owners and advertised in the local newspaper for a June 11,201$public hearing.
10. On June 11,2018, eleven years to the original day of issue,the City Council heard from City staff
and Pat Hoosline,the property owner's brother, regarding the current situation at the property. The
City Council continued the public hearing to July 9,2018,to allow the property owner a few more
days to install the pond liner, complete paving of the lot per the site plan, and to properly screen the
73`d Avenue entrance gate.
11. On July 5,2018, Scott Hickok and Julie Jones inspected the site with the owner's brother, Pat
Hoosline, and found the 73`d Avenue entrance gate and paving complete. An area south of the
existing building was left unpaved as the owner felt this location was a better location for customer
access and would allow the storage area of the site to be secured. Staff agreed with the new building
location and that it made sense to leave the area unpaved.
12. On July 9, 2018,the Fridley City Council opened the continued public hearing regarding revocation
of SP#07-01. The storm water pond construction was not complete.Neither the owner nor a private
contractor had applied for a permit from the City to install the pond, leaving stipulation four of
SP#07-01, which was due to be complete by October 15, 2009, incomplete.

Re: Fridley Police Body-Worn Cameras—Public Input
In 2016, the Fridley Police Department started researching a Body-Worn Camera (BWC) program. Over
the two years that followed, staff researched policies,practices, and products.
In 2017, a draft BWC policy was written. The League of Minnesota Cities,the International Association
of Chiefs of Police (IACP), the MN Board of Peace Officer Standards and Training (POST), and other
police departments provided guidance in drafting our policy. The draft policy was presented to the Fridley
Department's Citizen Advisory Group, Cops and Clergy group, Block Captains, collective bargaining
units, the Fridley/Columbia Heights Kiwanis Club, Fridley Public Schools, and at the recent neighborhood
meetings.
Fridley Police Department staff researched several BWC vendors and spoke with sales representatives
from Taser/Axon, L3 Communications, Panasonic, Motorola, WatchGuard, Vievu, and Visual Labs, Inc.
After comparing the costs and features of the products on the market,Visual Labs was identified as the
product that best met the needs of our agency.
Visual Labs is a software company that utilizes Android-based smartphones as body-worn cameras. By
utilizing a smartphone as the BWC, an officer can use one device to complete multiple tasks. The
software allows an officer to take HD video, digital images, and digital statements. The phone also
provides GPS coordinates of the officer, which enhances their safety. All data that a Visual Labs BWC
captures is automatically uploaded to a secure cloud-based server. The data can be retrieved by authorized
personnel from anywhere at any time.
In May of 2018, members of the Fridley Police Department began field-testing body-worn cameras
provided by Visual Labs. The officers who field-tested the Visual Labs system supported selecting Visual
Labs as our provider.
MN State Statute 626.8473 states that a local law enforcement agency must provide an opportunity for
public comment before it purchases or implements a portable recording system. Prior to implementing our
BWC program, the Fridley Police Department would like to present our findings and provide an
opportunity for the public to provide input at the July 9, 2018 city council meeting.

Re: 1' Reading of a Proposed Ordinance Amending Chapter 8 of the Fridley City
Charter Entitled Public Improvements and Special Assessments
The Fridley home rule charter is the fundamental law which defines the powers the citizens agree
to give their city government. The Charter Commission is comprised of fifteen court-appointed
citizens who meet about eight times a year to discuss and refine the charter in response to the
needs of the community.
The Charter Commission reviewed and discussed Chapter 8 entitled "Public Improvements and
Special Assessments" in 2018 and recommended an amendment by ordinance. The amendments
to the Chapter meet Minnesota State Statute and clarifies language in the Charter.
Minnesota Statute, Section 410.12, Subd. 7. allows for an amendment by ordinance upon
recommendation of the Charter Commission. Within one month of receiving a recommendation
to amend the charter by ordinance, the city must publish notice of a public hearing on the
proposed ordinance. The public hearing must be held at least two weeks but not more than one
month after the notice is published. The City Council received this information in May and the
public hearing was held on June 25, 2018. Notice of the public hearing was published in the
Fridley SunFocus on June 8th, fulfilling the publication requirement.
At the public hearing, staff presented the changes as shown below.
In Section 8.01, The City Plan, the amended language clarifies that amendments to the
Comprehensive Plan must be made in accordance with Minnesota State Law.
In Section 8.02, Enforcement of City Plan, the amended language has no substantial
change other than to make the chapter easier to read and list items the same throughout
the chapter.
In Section 8.03, Public Improvement and Special Assessments, the amended language
has no substantial change other than to make the section consistent and easier to read.

In Section 8.04, Local Improvement Regulations, the amended language requires local
improvements and assessments be made in accordance with Minnesota State
Constitutional Requirements and clarifies the two ways a local improvement can be
brought to Council.
In Section 8.05, Public Works How Performed, the amended language fixed some
grammatical errors and made old terminology consistent with state statute. Under
Minnesota State Statute, the benefits of a special assessment may not exceed the benefits
to the property. Language regarding creation of a Public Works Department was also
removed as the department has since been created. The words "Material Person" were
also removed from the section because the terminology is no longer used in Minnesota
State Law. The wording was replaced with Minnesota State Law.
At the public hearing, Chair Ostwald and Commissioner Kranz spoke in favor of the proposed
amendment and shared their appreciation for the coordination and communication between the
City Council and the Charter Commission.
Staff recommends a motion to waive the reading and hold the first reading of an Ordinance
Amending Fridley City Charter Chapter 8 Entitled Public Improvements and-Special Assessments
as shown in Attachment 1.

AN ORDINANCE AMENDING FRIDLEY CITY CHARTER CHAPTER 8.PUBLIC
IMPROVEMENTS AND SPECIAL ASSESSMENTS
The Fridley City Charter has completed its review of Chapter 8 and has recommended an
amendment of the City Charter by Ordinance to the City Council on May 7, 2018.
The Fridley City Council hereby finds after review, examination and recommendation of the
Charter Commission that Fridley City Charter Chapter 8 related to public improvements and special
assessments should be hereby amended and ordains as follows:
FRIDLEY CITY CHARTER
CHAPTER 8. PUBLIC IMPROVEMENTS AND SPECIAL ASSESSMENTS
Section 8.01. THE CITY PLAN.
The present zoning and comprehensive plans shall be the plans for future physical development of
the City. Plans may be altered from time to time. To alter a zoning plan, the City Council shall
hold a public hearing and notice published fourteen (14) days prior to hearing with notices sent to
affected property owners. The comprehensive plan may be altered in accordance with Minnesota
state law. It The plans may include provisions for:
• zoning;
• platting and development of new areas;
• planning and location of public works of art;
• public buildings;
• parks;
• playgrounds;
• bridges;
• public transportation services and facilities;
• other public facilities;
• designing and improving streets;
• designing and improving public places; and
• other matters which may seem essential to the City plan.
Section 8.02. ENFORCEMENT OF CITY PLAN.
The Council shall have full authority, acting through the City Manager, to
enforce complete adherence mer ons to the plans adopted as provided above, and to adopt and
enforce a comprehensive zoning ordinance. The Council shall have-pewer to pass ordinances to
regulate:
• the use of private property,:,
• the height of buildings;;

• and the proportion of the area of any lot which may be built upon, and
• to establish building lines.
Such fewer authority shall be exercised to promote public health, safety, morals, welfare and
convenience.
Section 8.03. PUBLIC IMPROVEMENTS AND SPECIAL ASSESSMENTS.
The City shall have the pewer authority to make any and every type of public improvement not
forbidden by the laws of the State and to levy special assessments to pay for all such improvements
as are of a local character, in accordance with Minnesota State Statute Chapter 429, Local
Improvements, Special Assessments. The amounts assessed to benefited property to pay for such
local improvements may equal the cost of the improvements, including all costs and expenses
connected therewith,with interest,until paid,but shall not exceed the benefits to the property.
Section 8.04. LOCAL IMPROVEMENT REGULATIONS.
The City Council may prepare and adopt a comprehensive ordinance, prescribing the procedure
which shall determine all matters pertaining to the making of local improvements thereafter, and
such ordinance shall supplaRt supercede all other provisions of law on the same subject and may be
amended only by an affirmative vote of at least four (4) members of the City Council. Such
ordinance shall provide for such notice and hearing in the ordering of improvements and the making
of assessments therefore as shall be necessary to meet the state of Minnesota constitutional
requirements"to levy and collect assessments for the initiation of local improvements upon property

1. a petition signed by a majority of the owners bordering the proposed improvement; or

1. Public works including all local improvements; may be constructed, extended, repaired or
maintained either by contract or directly by day labor. Before receiving bids the City
Manager shall, under the direction of the City Council, have suitable plans and
specifications prepared for the proposed material or project and estimate of the cost thereof
in detail. The award of any contract shall not exceed the real measure of benefit which is the
increase in the market value of the land because of the improvement.

Subject: Resolution Authorizing Application for Regional Solicitation Funds
Background
Metropolitan Council is currently accepting applications for the next round of Federal Transportation grant
funding, called the Regional Solicitation. City staff was able to obtain grant writing assistance from the
County's SHIP-funded grant writing contractor.This is the same company that was successful in getting$1
million in Federal Transit Enhancement grant funds for the Main Street freeway bridge that was constructed
last fall.The consultant has been working with staff to develop an application for the Multiuse Trail and
Bicycle Facility category under the Regional Solicitation. Staff and the consultant feel that the plans for a
multiuse trail on 7th Street,as proposed in the Fridley Middle School's Safe Routes to Schools Plan,is a good
candidate for funding.Adding a trail along 57th Avenue from 7th Street to University Avenue strengthens the
grant application as it ties safe bike/ped access on 7th Street to transit and retail on University Avenue.
The desire to have a trail connection the 57th and University intersection was mentioned by some participants
in last year's neighborhood demonstration of the proposed trail options on 7th Street.The pilot demonstration
featured three design options,built to scale,with temporary materials to simulate different pedestrian and
bicycle infrastructure designs and options.During that event, staff received valuable feedback from the
participants.Participants completed dot-voting exercises where they selected the street design that they
prefer for 7th Street.Participants favored the option that would add a 10-foot shared-use trail behind the curb,
which also removes parking along the east side of 7th Street from 53rd Avenue to 59th Avenue. Most people
were not concerned about losing parking on one side of the street if it made room for a trail. Staff is currently
recording data on parked cars along 7th Street from 53rd Avenue to 59th Avenue.
Staff also received feedback at the 7th Street Demonstration that a similar trail on 57th Avenue from 7th Street
to Highway 47 (University Avenue)would help create a safe separation from traffic to get bicyclists and
pedestrians from 7th Street to Highway 47.After considering this input, staff is proposing to seek funding to
add this trail segment on the north side of 57th Avenue as part of this project.
More recently, staff sent out a POLCO survey about the project,but received only a handful of responses that
were mixed about the project. Staff believes the well-attended event last year better represents the opinions
of the neighborhood. Staff is proposing an application that follows the design most favored by the
neighborhood at the street event.

Staff has compiled the cost estimates for the project,and the total project cost is estimated to be$709,800.
Therefore,the City's 20% share of those costs will be about$128,760. The source of these funds will need to
come from the Street Reserve Funds in the 2022 Capital Investment Fund.
Recommendation
Staff recommends that the City Council authorize staff to submit the Regional Solicitation grant application
by approving the attached resolution. The grant application deadline is July 13,2018

RESOLUTION NO.2018-
RESOLUTION AUTHORIZING APPLICATION TO THE TRANSPORTATION ADVISORY
BOARD(TAB)FOR 2018 REGIONAL SOLICITATION GRANT FUNDS TO SUPPORT
CONSTRUCTION OF A MULTI-USE TRAIL ALONG 7TH STREET AND 57TH AVENUE.
WHEREAS, the Metropolitan Council and the Transportation Advisory Board have announced a
solicitation for 2022 and 2023 federal funding for motorized and non-motorized transportation projects;
and
WHEREAS,the program will fund up to 80 percent of project right-of-way and construction costs; and
WHEREAS, non-federal funds must account for the remaining 20 percent of the project costs; and
WHEREAS, an application must be submitted to the Metropolitan Council by July 13, 2018 for
consideration; and
WHEREAS, the City of Fridley has identified 7th Street NE and 57th Avenue NE as an important element
of the City and regional bicycle/pedestrian network as identified in the City's Active Transportation Plan;
and
WHEREAS, the City of Fridley strongly supports construction of a multi-use trail along 7th Street NE
between 61st Avenue and 53rd Avenue, as well as a multi-use trail along 57th Avenue between University
Avenue and 7th Street, and all associated intersection treatments for bicycle and pedestrian safety;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fridley supports seeking
Regional Solicitation Grant Funding for the construction of a multi-use trail along 7th Street and 57
Avenue.
BE IT FURTHER RESOLVED, that the City Council for the City of Fridley hereby approves the
submittal of a Regional Solicitation application for the construction of a multi-use trail on 7` Street and
57th Avenue.

REQUEST
John Allen, owner of the property located at 5601 East River Road requested and received a rezoning of
his property from C-3, General Shopping to M-2, Heavy Industrial. Approval of this rezoning occured on
March 26, 2018. :-

recommended a development agreement be required .
The Planning Commission and the City Council agreed and
a stipulation was attached stating:

Upon further examination, staff determined that where typically a Development Agreement would be
required,the conditions of the development drive that requirement for the agreement.You will recall
for example in the Pulte Patio Home Development there is a development agreement, but there are also
a combination of public and private streets within,there are public sidewalks,there are a mix of public
and private utilities, and there a nuances with the storm ponds that are spelled out in a development
agreement. By contrast,once inside the Allen Development all utilities, streets, driveways, ponds,etc.
are private. The park dedication fees are paid at the time of permits,the pond maintenance is managed
through a pond maintenance agreement between Allen and the City,and the land for the public road is
scheduled to be gifted to the City once the final plat and Torrens Property Directives are completed. A

development agreement therefore would not be required. Items can be memorialized, where necessary,
through a Letter of Understanding, rather than a Development Agreement.
By Approving the attached resolution, Council recognizes and accepts that this Letter will be sufficient in
memorializing certain details to be completed between the City and the Property Owner/Developer,
John Allen.
PLANNING STAFF RECOMMENDATION
City Staff recommends acceptance of the attached Letter of Understanding in Lieu of a Development
Agreement as specified in Rezoning Request,ZOA#18-01.

RESOLUTION ACCEPTING A LETTER OF UNDERSTANDING IN LIEU OF A
DEVELOPMENT AGREEMENT FOR DEVELOPMENT OF THE PROPERTY
GENERALLY LOCATED AT 5601 EAST RIVER ROAD NE,FRIDLEY
WHEREAS, the Planning Commission held its public hearing on February 21, 2018 regarding the property
generally located at 5601 East River Road N.E., Fridley, Minnesota, and its rezoning from C-3, General
Shopping,to M-2 Heavy Industrial;and
WHEREAS, the Planning Commission unanimously recommended approval of the rezoning from C-3,
General Shopping,to M-2,Heavy Industrial;and
WHEREAS, the Planning Commission's recommendation included a stipulation which stated: [There shall
be]A development agreement between the petitioner and the City outlining the Developer's public/private
site improvements prepared by the City and shall be signed by the petitioner prior to issuance of a
building permit for the first building. The Development Agreement shall include but is not limited to the
following: streets, utilities, landscape, the disposition of eastern private driveway when 57th Avenue is
extended, ponding needed for the 57th Avenue extension, multi-model access from the subject property,
and park dedication fees; and
WHEREAS, on March 26, 2018, the City Council held its hearing on this item and concurred with the
Planning Commission and required a Development Agreement;and
WHEREAS, this property is entirely private relative to its streets, driveways, utilities, etc. The land to be
gifted to the City for the 57th Avenue extension eliminates any public streets within the private development.
The City/County will own the street and the property beneath it. Therefore, unlike developments where a
development agreement is required,this development was deemed to not need a development agreement, but
instead a determination was made (between staff and the developer) that a letter of understanding could be
filed to outline certain aspects of what will occur when the 57th Avenue extension is completed, and other
details relative to pond maintenance,etc.; and
WHEREAS, park dedication fees are paid as part of the permit fee and do not need to be separately spelled
out in a development agreement;and
WHEREAS, the developer's approved site plan contemplates multi-modal (walkways to transit, bike racks,
etc.),and no separate language would be necessary in a development agreement;and
WHEREAS, the property located at 5601 East River Road N.E., Fridley, Minnesota, is hereby legally
described as follows:

Industrial Equities, in lieu of the Development Agreement required in the City Council's approval of

Dear Mr.Allen
Upon reviewing the scope of the East River Road Park of Commerce development and improvements to
be made therein, staff has determined that this Letter of Understanding in Lieu of a Development
Agreement would be an acceptable instrument by which to memorialize terms.
Utilities
All utilities in the Park of Commerce site are private, where utilities attach to the public system, they
must be installed in accordance with approved plans and practice. That installation shall be field
inspected by the Utility Superintendent of the Fridley Public Works Department and the Fridley Building
Official. Once connections are made the developer or designee shall call for inspection.
Roads/Driveways
All roads and driveways once on the private owned site are private, The City understands that the 57th
Avenue roadway extension, which will eventually connect to the current signalized intersection of 58th
Avenue and East River Road will be dedicated by you as right-of-way. This dedication will serve future
57th Avenue roadway purposes. It is also understood that when the 57th Avenue extension right-of-way
is improved by the appropriate jurisdictions (City/County) with bridge and retaining features; that your
easternmost private drive on and to that future right-of-way will be terminated and truck circulation will
be routed back in the direction it originally entered the site, when exiting the truck dock area.
Demolition of the easternmost driveway shall coincide with site preparation for the 57th Avenue
extension and costs of said demolition, as well as replacement of parking lot curb, amended soil and
sod, to back of curb at the edge of your parking lot will be expenses covered by the City of Fridley as
part of that street improvement project (see Exhibit B attached). No additional compensation is
anticipated to be given or received for said removal of the easternmost drive, once site preparation for
the 57th Avenue extension begins.
The City will provide the property owner notice of the City's intent to remove the easternmost driveway
and approximate date of that demolition will be given 90-Days prior to demolition.

Landscape
All landscape plant materials and the irrigation system on East River Road Park of Commerce Site shall
be installed in accordance with the Plowe Engineering Landscape Plan, originally dated 6-15-18 and
revised to reflect City staff comment changes on 6-22-18 (attached Exhibit A). All installation shall occur
within 12 months of issuance of respective Certificate of Occupancies for Building One and Building Two.
Pond Maintenance
Prior to issuing the initial Certificate of Occupancy, the developer shall: Record with the county the
maintenance agreement for the stormwater ponds and other Best Management Practices on the
property(agreement template attached as Exhibit C).
Signature on this document represents both an understanding and agreement of terms.The City Council
will have this item on their agenda (likely their consent agenda) Monday, July 9, 2018. The purpose for
Council review is to authorize this item through resolution as the substitution for a more elaborate, but
in this case likely unnecessary, full development agreement as referenced in the previous Council
approval documents for this development.

STORM WATER MAINTENANCE AGREEMENT
City of Fridley, Minnesota
THIS AGREEMENT made and entered into this day of , 20_ by and
between a Corporation,
hereinafter referred to as "Owner" of the below described property; and the City of Fridley, a Municipality
under the Laws of the State of Minnesota, hereinafter referred to as "City".
(PROPERTY DESCRIPTION HERE)
WHEREAS, the City has required the Owner to provide on-site a Storm Sewer System for the treatment
of storm water and to accommodate the rate of flow of area run-off, and
WHEREAS, the Owner agrees to furnish, install and maintain a structural storm water treatment device on
the above described property as part of such Storm Sewer System and do all relating grading, slope work
and restoration, and
WHEREAS, the owner agrees to construct storm sewer piping and storm sewer structures as part of such
Storm Sewer System to the approval of the City.
NOW THEREFORE IT IS AGREED AS FOLLOWS:
1. The Owner assumes the full and sole responsibility for the condition, operation, repair,
maintenance and management, at no cost to the City, for an on-site Storm Sewer System which

meets generally accepted engineering standards for the purpose of receiving, retaining, treating
and transporting all storm sewer water which may be collected within the system. The Storm
Sewer System shall be defined as including piping, structures (manhole, catch basin, etc.) and
structural storm water treatment device(s).
2. The City shall not under any circumstances be responsible for the on-going physical performance
of any repairs, changes or alterations whatsoever to the on-site Storm Sewer System and the City
shall not be liable for the cost thereof.
3. The owner agrees, at no cost to the City, to regularly:
a. Maintain and clean all portions of the Storm Sewer System including catch basins,
manholes, piping, structural storm water treatment device(s), outlet structure and any other
associated portion of the Storm Sewer System serving this property prior to its connection
to the City Storm Sewer System.
b. Repair or replace any deficient portion of the Storm Sewer System.
c. Remove and properly dispose of litter and debris collected by the Storm Sewer System on
an annual basis or more often if required by the manufacturer's recommendations for the
structural storm water treatment device. A report of this activity must be sent to the City
annually.
4. The Owner agrees to provide access to the Storm Sewer System at all times for inspection by City
Staff. The Owner agrees to establish an access easement to the City of Fridley for the Storm
Sewer System, including the Storm Water Treatment System. In doing so, however, the Owner
acknowledges that the Owner is the sole entity responsible for any maintenance or continued
performance of the Storm Sewer System or Storm Water Treatment System.

5. The Owner agrees to indemnify and hold harmless the City from any action and against any
damages which the Owner may sustain as a result of the construction and maintenance of the
Storm Sewer System located on the Owner's property.
6. The Owner's obligation to indemnify and hold the City harmless in paragraph 5 above also
includes an obligation on the part of the Owner to defend the City in any actions which may be
brought against the City and as to which Owner has agreed to indemnify and hold harmless the
City as set forth above.
7. In the event that the City believes that the Owner is not maintaining the Storm Sewer System
improvement in a fashion consistent with this agreement, then the City shall give written notice to
the Owner detailing the deficiency in the manner in which the Owner is maintaining the Storm
Sewer System. If ten (10) days after receipt of this notice the deficiency described in the notice
has not been corrected by the Owner, then the City may without further notice take any steps
which it deems reasonably necessary in order to correct the deficiency. The Owner agrees to
then reimburse the City within thirty (30) days of receipt of invoice for all costs incurred, to
include Administrative overhead, by the City in correcting the deficiency. If this invoice is not paid
within thirty (30) days of receipt, then Owner agrees that the City may assess the cost against the
Owner's property.
In the event that it becomes necessary for the City to assess the cost for correcting the deficiency
as provided herein, then the City is authorized to direct the County Assessor to certify this
assessment against the Owner's real property described above and the Owner waives any right to
a public hearing which may be statutorily or constitutionally provided for.
8. That any notices required under this agreement shall be sent by certified mail, return receipt
requested, or by personal service at the following address:

FURTHER, IT IS AGREED that the provisions of this agreement shall be binding upon and enforceable
against the parties hereto, their successors and assigns and all subsequent owners of the property here
described. An executed copy of this agreement shall be filed with the Anoka County Recorder's Office
and made a part of and be binding upon the above described property.
