The application will then be sutmitted to the Planning Commission for their recommendation. The Planning Commission meets on the Wednesday following the City Council meeting, which is ge_,erally the first and third Wednesdays of the month. 5. The recommendations of the Planning Commission are submitted to the City Council for final action. If a Certificate of Survey wasn't required before, it will be required for this meeting. The City Council meets on the first and third Mondays of the month. 6. The City Council approval may be subject to certain stipulations which must be compiled with by the applicant. 7. If approved, the applicant shall then have the land involved in the lot split surveyed. Upon receipt of the required Surveyor's Certificate, the Council shall pass a resolution approving the lot split. 8. After final approval, a certified copy of the resolution approving the lot split and a "Certificate of Status" form shall be attached to the notice of approval and forwarded to the applicant. The lot split, together with a certified copy of the resolution and "Certification of Status" form, shall thereafter be recorded among the records of the County within one hundred eighty (180) days after the date of the resolution, unless a 1 onge r period of time is granted and provided for r eco r di ng at the time of approval. 9. In all cases where City Council action has been sought and denied, no petition for identical action can be presented until a period of six months has elapsed. CONSIDERATION OF LOT SPLIT REQUEST, L.S. #86-01, GENERALLY LOCATED AT 5738 -7TH STREET N.E. , BY THOMAS BLOMBERG: Mr. Flora, Public Works Director, stated this is a request to combine three 44 foot lots and split them into two 66 foot lots for property located west of 7th Street and north of 57th Place. He stated the code calls for a lot area of 9,000 square feet and a lot width of 75 feet so variances would be necessary if the lot split is approved. He stated the lots would be 8 ,905 square feet and 66 feet wide, however, there were quite a few lots in the neighborhood 65 feet wide. Mr. Flora stated the Planning Commission recommended approval of the lot split with four stipulations which he outlined. MOTION by Councilman Goodspeed to approve lot split, L. S. #86-01 , with the following stipulatons: (1) Existing house to be removed prior to issuance of a building permit; (2) Park fee of $750 be paid prior to issuance of a building permit; (3) Lot split to be recorded prior to issuance of a building permit; and (4) Variances for lot area from 9 ,000 square feet to 8,905 square feet and lot width from 75 feet to 66 feet are approved with this lot split. CONSIDERATION OF LOT SPLIT REQUEST, L.S. #86-02, GENERALLY LOCATED AT 7136 EAST RIVER ROAD N.E. , BY RICHARD MALECEK: Mr. Flora, Public Works Director, stated this is a request for a lot split of the exception property to the Riverwood School plat. He stated the property is located north of 71st and west of East River Road. Mr. Flora stated the proposal is to split off the westerly 90 feet creating a new lot in excess of 10,000 square feet, with access o o "the new Riverwood Drive. Mr. Flora stated the way the property s were drawn means the front of the property is facing on neigh ring property lines. He felt if a triangular piece of property -could be provided for this lot split, there would be a front yard o 'Riverwood Drive. Mr. Malecek st he has talked to the developer, Mr. Cook, and he has a partner ij ved, as well as a builder, who would have to approve of his obta,j.ning this triangular piece of property. CDN IDERATION OF MDDIFICATON TO THE 86 COMMUNITY DEVELOPMENT BLOCK GRANT BUDGET REQUEST TO ALLOW FOR FUNDING F LOCKE HOUSING RESTORATION: Mr. Flora, Public Works Director stated the City received a request from the North Suburban Center for e Arts (NS(A) for a $10,000 contribution for restoration of Locke House on st River Road. Mr. Flora stated in Janua , 1986, the NSCA reached an agreement with the County regarding restor ion and occupancy of the Banf ill Tavern/Locke House, and a stipulatio of the agreement obligates then to raise $50,000 by January, 1987 to be us d in the historic restoration of the structure. Mr. Flora stated st f has checked with the County and received a positive response as to th appropriateness of using CDBG funds for this historic restoration proj He stated, if the Council decides to appropriate CDBG funds toward s project, it would be necessary to send an amended request to the County fore their April 8 public hearing. Mr. Harry senbaum, Chairman of the NSCA Fund Raising Drive, stated this structur is the first tavern. in the State of Minnesota still located on its origina site. He stated the building is over 100 years old and the County is al r dy starting operations to preserve it. He stated it is their hope to m e this a useful arts center. He stated they expect a good deal of 1 Farticipaton from businesses and the senior citizens. Mr. Rosenbaum ted they have already had inquiries from businesses regarding use of the roams for meetings. -4- COUNCIL MEETING OF APRIL 7, 1986 • Mr. Qureshi, City Manager, stated originally this agreement was a draft ordinance by staff and the attorney felt it didn' t conform to law. He stated the agreement now clarifies an "associate member " and adds a termination clause, as well as several other minor changes. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried -10- COUNCIL MEETIM OF L Mr. Jerry Rachel, Vice-President of Park Construction, stated they have attempted to address this issue and the most serious problem of the tailgates banging on the trucks has been controlled. He stated they are also attempting to control the alarms on the equipment by using a bell-:type alarm which is not so piercing. He stated there is now a berm between the homes and the construction area which should reduce noise levels. / stated they are over 50% complete with this project and shouldn't have to.'r-. more than 7 or 10 days. Mr. Rachel stated, if the weather warms up, ey would not work the night shift when residents would have their window open. Mr. Felt stated he appreciated the fact that Mr. Rache has tried to litigate the sound, but it hasn't been that effective. Councilman Fitzpatrick asked if the construction went over 2 a.m. Mrs. Felt stated it went on all night. Councilman Schneider stated they have the ordinan e on the books and this operation shouldn't continue if people cannot sl p in their homes. Mr. Rachel felt an alternative may be to cea operations at 11 p.m. Mrs. Felt stated there are young children in he neighborhood and if the ordinance only allows them to work until 9 p.m. , they should abide by it. Mr. Rachel stated they are working un time restraints imposed on them by the oompany they are working, for wh want their building completed by a certain time. He wondered if they uld continue operations if it was for the easterly portion of the site w ch is farthest frau the hares. Mr. Felt stated they would be w' ling to compromise for work to continue east of Beech Street only, roviding they are not disturbed by this construction. MDTION by Councilman Goods ed to allow an alternate hour work permit for Park Construction beyond he hours contained in the Construction Ordinance for preparation of the ite on 81st and University for the parcel east of Beech Street only. H ever, if any disturbances are caused to the homes west of the railroad racks, Park Construction would be immediately notified to cease constructi n operations beyond the normal working hours.
