Fridley, MN 55432 Dear John: As you are aware on October 3, 1984, the planning commission approved the re--zoning of the land situated on East River Road and 61st Way. There were 4 stipulations to the re-zoning that we are currently working on to resolve ASAP. In talking with Jim Robinson it sounds as though normal re-zoning procedures could take us into the latter part of November. That could create some problems in our starting construction this fall. If there is anything that could expedite this procedure allowing us to start in early November, we would greatly appreciate it. I myself stand ready to help in any way I can. Mr. Robinson stated this property was located on the southeast corner of 61st Way and East River Road. The property was currently zoned M-1 , and the rezoning request was for C-R1 which was for a professional office-type building. The name of the proposed business was Communications and Special Software. The lot size was slightly over one acre. The building size will be 6,7.?3 �Sg3 ft. on two floors,and the lot coverage was well under the prescri e �% limit. %, PLANNING COMMISSION MEETING, OCTOBER 3, 1984 PAGE 2 Mr. Robinson stated the plan as proposed would have the building located 95 ft. back from East River Road and 35-ft. from 61st. There will be 27 parking spaces which is adquate, and there will be green space to buffer the building from both the north and the west. Mr. Robinson stated the lots to the immediate north are R-1 but are slated to be rezoned to R-3. That is the location for the Loft Homes. There is more light industrial to the south, Stevenson School to the west, and single family homes in other adjacent areas. Mr. Robinson stated the plan seemed to meet all code requirements, but Staff would recommend the following stipulations : 1 . The petitioner provide a survey of the property 2. There be a 10 ft. bikeway/walkway easement along the northern portion of the property, consistent with the bikeway/walkway plan which will tie into the County's regional trail system 3. An approved drainage plan 4. An approved landscape plan Ms. Schnabel asked the petitioner, Mr. Perlick, if he had any comments regard- ing this request. Mr. Perlick stated his business was currently located in Spring Lake Park away from the freeway system. This property was an ideal location for their building and their type of business, because it will give them easy access to the freeways and downtown areas. Their business is strictly a professional business--a computer software and hardware engineering company. They do build and design computers , but they do not do any manufacturing. He stated 50% of their staff (around 20 employees) are never in the office; they are usually at customer sites, so the need for 27 parking spaces will probably never arise. He stated there are very few visitors to the building. They feel they would provide a nice buffer zone between the proposed housing (Loft Homes) and any other light industry. Ms. Gabel asked if they would rent out any portion of the building. Mr. Perlick stated the building would be exclusively for their business. Mr. Kondrick asked if Mr. Perlick had any problem with the stipulations out- lined by Staff. Mr. Perlick stated he had no objection to any of the stipulations. Mr. Bert Slater, 128 River Edge Way, stated he did not mean to detract from this particular rezoning request, but he wondered if the Commission was aware that property was acquired from some of their properties some years ago to build a pathway to allow children access to Stevenson School , with the definite stipulation that no bikeways would come through there. If the COUNCIL HEFTING OF N94E11BER 5, 1984 a professional building in the rezoned portion of the lot. The Planning Commission did recommend to City Council approval of the lot split of the northerly 155 ft. of Lot 9, with the stipulation that the lot split be recorded with the County prior to issuance of the building permit. He would add another stipulation of the payment of a park fee of $1,001.88. Mr. Flora stated the first reading of the rezoning is on the agenda also. The petitioner has requested early notice by the City Council so he can get some concrete work in for the development prior to winter. MDTION by Councilman Fitzpatrick to concur with the recommendation of the Planning Commission and grant lot split request, L. S. #84-09, for a new building site at 6095 East River Road by Burlington Northern Railroad, with the following stipulations: 1. The lot split be recorded with the County prior to issuance of the building permit. 2. Payment of a park fee of $1,001.88 Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. 9. _CONSIDERATION OF APPOINi'NLEN'I' M COMMUNITY DEVELOPMENT COMMISSION (TABLED 10/15/84) : MDTION by Councilman Hamernik to nominate Clarence (Gene) Rezac to the Community Development Ccnmission as recommended by the Fridley Chamber of Commerce. Seconded by Councilman Fitzpatrick. MDTION by Councilman Barnette that the nominations be closed. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. MDTION by councilman Barnette to cast a unanimous ballot for Clarence (Gene) Rezac to the Community Development Commission. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. NEW BUSINESS: 10. CONSIDEPATION OF FIRS. THE E -KINGA CHA qGE IN ZONING DISTRICT FROM M-1 TO C-Rl TO ALLOW A PROFESSIONAL BUILDI14 AT 6095 EAST RIVER ROAD BY LARRY PERL I CK: Mayor Nee stated a public hearing was held at this meeting, and there were no objections. Mr. Flora stated that because the petitioner is interested in constructing a building on the lot split, rezoned parcel from M-1 to C-Rl , the first reading of the ordinance to rezone that portion M-1 to C-Rl has been added in order to allow him to prepare to do concrete work before winter. -13- QXNCIL MEETING OF NOVEMBER 5. 1984 Councilman Fitzpatrick stated he thought this was a compatible use of the area they have just dealt with immediately to the north. MOTION by Councilman Fitzpatrick to waive the first reading and approve the ordinance upon first reading. Seconded by Councilman Hamernik. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. The Council members all agreed that they had no problem with proceeding with the second reading. They felt it was a great use for the property. 11. CpNSTDERATION OF FIRST READING OF AN ORDINANCE VACATING PART OF ABLE STREET N.E. FOR TARGET, INC. : Mr. Flora stated this item was put on the agenda to confirm to Target that the City Council would be interested in vacating the street if Target was to continue in their negotiations to purchase the property west of the existing Able St. Mr. Flora stated the County, in its overall plans for Locke Park, has been interested in constructing a new boulevard driveway from the city garage, underneath the power lines, all the way back to the existing parking lot. The County does not feel there is a need for access from 73rd since they will be providing one in the near future. The City is concerned about providing some access frau the rielody Manor neighborhood to the park. Mr. Flora stated Target has shown the City at least one proposal, and based on the final plan, they can look at where a road could be or should be built and discuss at that time the costs associated with the relocation of the road, and a right of way, so it will provide a service for the community across the street and an access to the park and still allow Target to utilize the property they will be owning. Mr. Qureshi stated that if this vacation is needed for Target' s expansion, the City will get definitive access f ran 73rd to the park property somewhere through Target' s property. The level of that access depends upon the County' s plans for access from west to east parking lot. The County might want a vehicular traffic access frau 73rd to the park, or they might want more of a pedestrian or bike approach and vehicular traffic come through the west parking lot. MDTION by Councilman Hamernik to waive the reading and approve the ordinance upon the first reading. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mr. Qureshi stated the City's next step is to enter into an agreement with Target that would somehow bind Target and the City to provide an access between 73rd Ave. and Locke Park, and that Target provide the City with a comparable access. 12. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 7:50 p.m. Mr. Flora stated the property was located on the southeast corner of 61st Way and East River Road. The property was currently zoned 14-1 (light industrial) and was located across the street f rom the single residential property which has been rezoned recently to h-3 for Loft Hanes. Mr. Flora stated the proposal was to utilize the corner lot to construct a professional office-type building by Communications and Special Software. The lot size was slightly over one acre and the building will be about 6,723 sq. ft. on two floors which is well under the building limit for that size property. Mr. Flora stated the rezoning will allow a buffer between the residential property to the north and development of the industrial property to the south. Mr. Flora stated the Planning Commission did recomend approval of rezoning request ZOA #84-04, with four stipulations: 1. The petitioner provide a survey of the property. 2. There be a 15 ft. bikeway/walkway easement along the northern portion of the property. 3. An approved drainage plan. 4. An approved landscape plan. There were no comments from people in the audience. PDTION by Councilman Fitzpatrick to close the public hearing. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing closed at 7:58 p.m. 2. PUBLIC HEARING ON VACATION REQUEST SAV #84-03 , TO VACATE PART OF 731-D AVENUE, MINCO PRODUCTS, KARL SCHURR• MOTION by Councilman Hamernik to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 8:00 p.m. Mr. Flora stated this request was to vacate the portion of 73rd located between Commerce Circle West and Burlington Northern railroad tracks on 73rd. This adjoins the property which is owned on both sides by Minco. The -4- COUNCIL MEETING OF NOVEMBER 5, 1984 Mississippi and Highway 47, but now have started on Mississippi and Rice Creek Road at Highway 65. Mr. Flora stated that as far as signage, MnDOT does not believe in signs, because it has been proven that signs are not very effective as a means of deterring accidents or slowing down traffic. The City has asked for signs but has not received a positive response. Mr. Qureshi stated he would request that concerned citizens write the State Highway Department expressing these concerns. They should contact Dick Braun, State Transportation Commission, Transportation Building, St. Paul 55101. If the citizens would help by contacting the State Highway Department, it might give the City the help it needs. Mr. Saba stated there was one very important consideration that might help change the minds of the State, and that was that the City of Fridley now has one school centrally loced between Highways 47 and 65. Children living east of Highway 65 who stay after school for activities often have no way of getting home except to walk unless a parent picks them up. Motorists traveling at 55 mph are not even thinking of looking for children crossing. This is a major situation that has to be rectified. Mr Qureshi stated the Ctiy wants the speed limit as low as possible to make it safe for all cross traffic. The state wants to move the traffic as fast as possible. A citizen in the audience asked if Mr. Qureshi was saying it was hopeless to request a lower speed limit. Would a personal appeal from the citizens have any effect on this request? Mr. Qureshi stated the City alone has not been able to affect the State with what they want, and maybe they need some help from the citizens of the cemmunity. The City is doing everything it reasonably can at the city level. The basic things the City wants are better signage, better crosswalks, and a lower speed limit. Mr. Saba stated that in view of what has been said at this meeting, he would like to ask every citizen of the city, every person who cares about the safety of their youth, to write the State Highway Department, the state legislature, anyone they feel will help rectify this problem. He even appeals to the city schools to help, through petitions or whatever method that was best. He thought the citizens now have to get involved. A citizen in the audience stated that if the City wants the citizens to help, it might be helpful to include a suggested form letter along with names and addresses in the city newsletter that would aid the citizens in writing letters. Mayor Nee stated letters from citizens are more effective when they are written from the heart. However, the City could state problem and give the names and addresses of where they could write. Mr. Tim Tyson, the petitioner, stated the proposed warehouse facility would serve as a distribution center for the Midwest territory. He stated they are a regional trucking operation with warehouses in New Brighton, Arden Hills and Moundsview and deal with products sold in wholesale and retail outlets, basically, food related items. He stated the major principal occupying the facility would be Kraft Foods. Mr. Tyson stated the warehouse would not be refrigerated, as it is anticipated refrigeration would not be needed at this facility. Mayor Nee asked if there were any soil problems in the area. Mr. Flora, Public Works Director, stated there may be some soil problems, but no borings have been taken. Mr. Tyson stated what has taken place so far is discussion of the project with the City' s administration and some preliminary plans were drawn for the process of submitting the application for industrial revenue bond financing. Councilman Hamernik asked if they would be moving their other operations to this facility. Mr. Tyson stated they do not have room for expansion at their other facilities in neighboring communities, therefore, they need this warehouse in addition to the others. Mr. Tyson also explained there is a rail line access adjacent to this development which is a necessity. No persons in the audience spoke regarding the issuance of these industrial development revenue bonds. MOTION by Councilman Barnette to close the public hearing. Seconded by Councilman Hamernik. NEW BUSINESS: 3. pgESENTATION REGARDING HAZARDOUS MATERIAL RESPONSE TEAM; EMERGENCY SERVICES DIVISION, MINNESOTA DEPARTMENT OF PUBLIC SAFETY: Mr. Jim Hill, Public Safety Director, stated the State has completed an initial training program for a hazardous material response team comprised of persons from the State and local goverrments. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 7:35 p.m. Mr. Inman, City Clerk, stated this request is for the issuance of $3,500,000 in industrial revenue development bonds for the construction of a 120 ,000 square foot warehouse f acil ity.. He stated this facility would be located in an area generally bounded by Hickory Street on the east, North Park on the north, the Burlington Northern railroad tracks on the west and the westerly extension of 81st Street on the south. Mr. Inman stated it is estimated this new development would create 45 jobs with an annual payroll of over $1,000,000 per year.
