First, we need to receive from you some photographs of buildings from other projects that you have completed that are similar to the buildings you are proposing for this project. I would appreciate receipt of these at your earliest convenience. Second, our design team is working on alternative design schemes that attempt to: 1)minimize traffic; 2)save trees; and 3)produoe a layout which is single family-like in character. Finally, I have enclosed the names and addresses of the most vocal neighbors opposed to your past project on the same site in 1983. I would highly rec=*nd that you discuss your new project with these people, address their concerns, and attempt to reach a solution that is equitable to all of those involved, prior to the public hearing on June 18, 1986. Respectfully yours, Daryl Morey Planning Assistant C-86-245 7.OA #86-01 9N Mava4 r - 40, .(0 kP rriha� A o n July 15, 1986 Dear Council Member: It is our understanding that the Fridley City Council will again consider possible rezoning of property currently zoned R-1 on Lucia Lane near Mis- sissippi Street and Highway 65, at the July 21 Council meeting. We have lived at 6533 Lucia Lane, directly across the street from the property in question since 1978 and have heard several proposals con- cerning possible development on the site, most of which were clearly inappropriate and unacceptable to the residents of the neighborhood, the Planning Commission and the City Council.' One proposal , which did not involve a change from R-1 zoning, was acceptable to residents of the neighborhood but the plan was never implemented. The most recent proposal again involves plans for a development and popu- lation density inappropriate to a neighborhood of single family dwellings. However, this time the Council will hear the request for rezoning without a recommendation from the Planning Commission. The Commission's deadlock reflects fundamental uncertainty about what should be done about this property. At least one Commission member spoke of the site as "undevelopable" and questioned whether the property could be purchased by and put to some reasonable use by the city. We believe that this action should be thoroughly investigated before final action is taken on the zoning request or that the request should be denied until it has been done. These are our reasons: 1 . The current proposed development will create serious traffic problems in the area Traffic generated by the multi-unit/multi-family complex would create serious hazards if an exit/entrance is allowed (as proposed) on Mis- sissippi Street. Traffic from the complex via an exit/entrance on Lucia Lane will flash headlights into the two homes directly across the street. Also, winter egress is difficult (slippery incline) from Lucia Lane to Mississippi Street so that those approaching the inter- section without momentum from the proposed development would black traffic under such conditions. 2. The residential neighborhood quality of Lucia Lane has already been seriously compromise People in our neighborhood cope with ever increasing sounds, hazards and inconvenience generated by Highway 65; We tolerate large traffic gluts (many late at night) at our doors on Lucia Lane when those play- ing bingo or attending other events come and go to the Knights of Columbus Building; We are subjected to the sights, sounds and activities associated with a large apartment complex. We know that accommodations to diversity are needed in any community, but we believe that we and other residents of Lucia Lane have already made more than enough such concessions. Since the owner is apparently unable or unwilling to live within the constraints of R-1 zoning, it is unlikely that an appropriate plan for use of the property will ever be presented or carried out at his in tat ve The owner's on-goinq contention that any plans consistent with R-1 zoning are "not feasible" probably means that he sees no way to realize the gains he expected from his speculative use of this property. However, free enterprize assumes losses as well as profits and neither the City Council nor the residents of the area are eblidged to guarantee his investment. His interminable petitioning for re-zoning is apparently intended to exhaust city official 's and resident's resolve to protect the integrity and liveability of the neighborhood. A resolution of this stand-off is long overdue. 4. The especially high quality of green space remaining at the site in question ought to be protected This small tract of magnificent burr Oak trees is a relic of Fridley's natural surroundings that have been altered beyond recognition or eliminated almost everywhere in the community. So long as it remains it will provide relief from the dreariness din and dirt of Highway 65 for everyone who lives near or travels along that corridor. This value will' be lost permanently if the current proposal is approved. A more complete evaluation of the tract's value as green space should b, conducted before a decision is made. We need and ask for your support to help maintain a liveable Lucia Lane neighborhood and community. The topography runs from a high point of approximately 6' above grade on the south- erly portion of Lot 7 to approximately 4' below grade on the northerly portion of Lots 5 and 6. There are numerous mature oak trees scattered on the three sites. The sites are bounded by Highway No. 65 along the west side of Lot 7, Mississippi Street on the south side of each lot, Lucia Lane on the east side of Lot 5, and developed and vacant residential properties on the north side of each lot. Lot 7 would be the least desirable site due to proximity to High- way No. 65 and a congested access area. The ac ess to this lot would be similar to that of 1132 Mississippi Street, dir ctly across the street. Lots 6 and 7 appear to be ready to be built on. Mr. Robinson stated this property was located on the northeast corner of Highway 65 and Mississippi St, and included Lots 5, 6, and 7, and the westerly half of Lot 4. The property was zoned R-1 , single family, and was in a single family neighborhood. It consisted of approx. 64,000 sq. ft. or ll2 acres. The proposal was to rezone from R-1 to R-3 in order to facilitate a townhouse development of 10 units. The proposed density was 6,400 sq. ft. per unit. The allowable density in an R-3 zone was 2,500 sq. ft. per unit. Of course, that would be to facilitate an apartment building. The 6,400 sq. ft. of lot area per unit being proposed worked out to be about 6.8 units per acre. A typical townhouse density ranged from 8 to 12, so this was described as a very low density. Mr. Robinson stated the proposal was for all two bedroom units with double garages, 1 3/4 bath, approx. 1,600 sq. ft., not including the garage. When Staff looked at the plan, they felt it was somewhat unbalanced in that there were eight units for the west portion and two units for the east portion. t -* PLANNING COMMISSION MEETING, JUNE 18, 1986 PAGE 8 ' They realized this was to minimize the impact on Lucia Lane and the single family neighborhood. However, Staff came up with some alternate plans, one in particular had some merit. It was staying with the ten units but break- ing them up so there were three clusters instead of one long linear building that had something of a barracks-type appearance--three units on the eastern portion, four units facing Highway 65, and the other three units on the northern part of the site. Mr. Robinson stated the driveway access was facilitiated by a driveway onto Mississippi , approx. 130 ft. from the intersection, and another driveway onto Lucia Lane. The developer felt the plan suggested by staff did have some merit, and he might be willing to implement the plan. Also, the plan provided some distinct green areas for privacy and play areas. It also turned a blank wall to the single family homes rather than the back of the buildings. Mr. Robinson stated Staff was recommending the following stipulations: 1 . Provide an approved landscape plan, including berming of boulevards. 2. Provide automatic sprinkling of all lawn areas. 3. Provide snow fence around all trees adjacent to construction zone; identify which trees will be removed prior to construction. 4. Obtain townhouse plat approval and record with City approved covenants prior to second reading of rezoning ordinance. 5. Provide 25 ft. street/bikeway/walkway easement along Mississippi St. 6. Provide a tot lot area with equipment prior to occupancy. 7. Park fee of $500 per unit to be paid with each building permit. 8. Provide a 6 ft. high solid wood screening fence between project and adjacent R-1 land. 9. Rezoning is for townhouse plan as proposed only. 10. Petitioner to provide an approved storm drainage plan. 11. Work with Staff to identify guest parking locations. Mr. Wellan stated that regarding stipulation #8 to provide a 6 ft. high solid wood fence between project and adjacent R-1 land, who maintained that fence? Mr. Robinson stated there would have to be a townhouse covenant and maintenance would be spelled out in that covenant. Mr. Robinson stated that in 1983 Mr. Erickson had requested a rezoning from R-1 to R-3 for 14 units so this project was scaled down from 14 to 10. Mr. Erickson stated he had no objection to the different layouts suggested by Staff. The problem, of course, was the beautiful trees, and they want to save as many trees as they can. As far as the ten units, that is the number they came up with in order to make the project financially feasible. Anything less than ten would wipe the project out. He stated the townhouses would be owner-occupied, not rentals. � 1 • PLANNING COMMISSION MEETING, JUNE 18, 1986 PAGE 9 Mr. Jack Young, 6549 Lucia Lane, stated he had lived in this location for 24 years. He stated there had been at least 4-5 proposals for this property, and each time the proposals have been shot down. He stated the neighbor- hood has a lot of traffic already, with the apartment buildings at the other end of Lucia Lane and the Knights of Columbus Hall . Lucia Lane is a one-way street for all those people, and he did not believe the traffic from this new development would use Mississippi St. as an exit. They would use Lucia Lane. With the possibility of a median down Mississippi , that would force the people to use Lucia Lane even more. He stated there were only 11 homes on both sides of Lucia Lane, and now they are proposing to put in 10 more homes in an area about 1/4 of that space. It did not make good sense. There would be ten homes with possibly twenty cars on a lot that would not even house five residential homes. Why can't the property he left as a residential district? Why do they have to go through this same thing every 2-3 years? Mr. Henry Melcher,6500 Pierce St. , asked Mr. Erickson the approx. selling price of each unit. Mr. Erickson stated the selling price was approx. $70,000 per unit. Ms. Lois Raaen, 6501 Lucia Lane, stated she would like the property to remain residential . Lucia Lane was already too busy. If they put ten townhouses on that property, there were going to be problems. She stated she has lived there 17 years, and she liked living there; but if they put townhouses in there, she was going to move. Ms. Jody Bystrom, 6533 Lucia Lane, asked why single family homes could not be built on this property. Mr. Erickson stated the back half of Lot 4 was landlocked right now. The only way to get into Lot 7 was a curb cut on Mississippi and right now the County is talking about widening Mississippi and putting in a median, so a driveway could not be put out on that corner. So, that virtually made Lot 7 useless. Lot 6 was the same way. Lot 5 could be divided in half for two residential lots. That was why he was requesting a rezoning to R-3 and proposing a townhouse development. R-1 housing was just not feasible. Ms. Joyce Swanson, 6601 Lucia Lane, stated she did not object to the con- struction or the design as much as the density. The intersection of Mississippi and Highway 65 was notorious for traffic accidents. Traffic was very heavy in the area, and putting 20 more cars onto Mississippi was going to make it worse. Mr. Joe Randall , 1210 Mississippi , stated he would like to see the property remain R-1 . He felt there were alternatives to work with landlocked lots. T1s. Elvina Timo, 6517 Lucia Lane, stated the driveway from the proposed development onto Lucia Lane would come right toward her house. She was afraid this development would depreciate the value of her home. They do have a lot of problems at night with traffic from the Knights of Columbus Hall , as well as the Lucia Lane apartments. She wanted the property to remain zoned R-1 . { yr PLANNING COMMISSION MEETING, JUNE 18, 1986 PAGE 10 Mr. Bob Bystrom, 6533 Lucia Lane, stated he felt the access from the proposed development onto Mississippi probably would be impossible. ' He doubted if eastbound traffic on Mississippi would want to turn left any sooner than Lucia Lane. Also, there was a considerable incline onto Mississippi from Lucia Lane. In the winter, in spite of maintenance, it was often difficult to make the grade the first time because of the slippery surface. It seemed to him the people who would be trying to get in and out of the proposed townhouse development would be at a real disadvantage as they would have no momentum at all trying to get onto Mississippi when Lucia Lane was slippery. He did want to say there were some things about this townhouse design that were better than previous plans. Mr. Jack Young stated he did not think families with young children would buy on this busy corner. He was afraid if these townhouses slid not sell that they would turn into rental units. Mr. Robert Haedtke, 6540 Lucia Lane, stated he felt the townhouse development would really decrease the real value of the homes in the neighborhood. What about assessments for water and sewer and the roadway? As far as the density, where would the children play? Marketability was mentioned in the request for rezoning, but it was also marketability for the people who own their homes in this area. There was too much traffic, the density was too high, and it was unjust and unfair to take away some of the real value from the people who own homes in this area. Mr. Robinson stated all utilities are in place, and there would be no additional streets. The expense of any hook-ups to utilities would be borne by the developer. Mr. Dick Berganini , 6596 Pierce St. , stated he was against the rezoning proposal . Mr. Oquist stated he had a letter addressed to Councilman Dennis Schneider from Dean Thomas, 6550 Lucia Lane, who could not be at the meeting. Mr. Thomas expressed concern that the units be owner-occupied, not rental units, he was concerned about the density and concerned about the traffic. Mr. Oquist stated this letter would accompany the minutes to the City Council . Ms. Jody Bystrom stated that if the townhouses were not sold and they became rental units, what happened to the townhouse association? Mr. Erickson stated that townhouse association documents are written so that each unit that is built has to contribute to the association, whether the units are owner-occupied or rental . Ms. Lilas Crosser, 6565 Lucia Lane, stated there were many accidents on the corner of Mississippi and Highway 65 already. It would be worse with more traffic. UPON A VOICE VOTE, ALL VOTING AYE, VICE-CHAIRPERSON OQUIST DECLARED THE PUBLIC HEARING CLOSED AT 9:03 P.M. Mr. Wellan stated he would not be in favor of the development. He felt that with the limited properties in the community, the landlocked properties could be rearranged so that single family homes could be put in. Ms. Sherek stated she had a problem with the theory that something could be done with the lots facing Mississippi St. Just looking at the intersection of Highway 65 and Mississippi made you realize it was unrealistic to expect people to have access from their front yard at that corner. She really thought the lots were not developable as R-1 zoning; and in view of the opposition of the neighbors, she did not think R-3 was all that realistic either unless something was explored with regard to making some kind of shared driveway across the backs of the properties so 3-4 homeowners could access onto Lucia Lane. She also did not think it was realistic to believe that because they plot a driveway onto Mississippi that the people living in the townhouses were going to use it to any extent--yes, if they are making a right turn onto Mississippi and a right turn onto Highway 65, but the rest of the traffic was going to go to Lucia Lane. Mr. Robinson stated that regarding Pts. Sherek's suggestion about a shared driveway,for 3-4 single family homeowners, it would have to be a private drive maintained by the homeowners, which was contrary to the city code. It was possible a variance could be granted for something like that. Mr. Oquist stated the problem with a deadend street was the servicing by emergency vehicles. Mr. Saba stated he really felt it was an injustice to the neighborhood, and he felt bad that they had to keep coming back defending their right to an R-1 zone. He had some problems with the development and problems with the traffic. Mr. Betzold stated he was sympathetic to the neighbors ' concerns, but he wondered if the concerns about traffic were not a little bit overstated. He said that because he happened to live in probably the densest area in the City of Fridley, the Black Forest Condominiums right next to the Farr Town- houses. Just in the development he lived in there were 250 different units and one driveway that comes in and exits. One would think they would be driving into one another all the time, but that doesn't seem to be happening. Mr. Betzold stated there would certainly be an increase in traffic, but he felt the concerns expressed about the traffic seemed to be primarily because of the Lucia Lane Apartments and the Knights of Columbua Hall , particularly the Knights of Columbus Hall which generates a lot of traffic at set times. 0 PLANNING COMMISSION MEETING, JUNE 18, 1986 PAGE 12 Mr. Betzold stated something was going to have to be done with this property. The Commission has to be concerned, not only with the neighbors, but also with the developer. There was going to have to be some give and take on both sides as this was too important a piece of land to have it remain as it is. Mr. Oquist stated he agreed with Mr. Betzold. He stated he has been involved with the last four proposals, and one of these times they are going to have to approve a project because this property has to be developed. They have to be concerned about the best development for this area, and he was not sure single family homes was the best development for this property. Mr. Kondrick stated he also agreed with Mr. Betzold. This was the best proposal he has seen so far. Single family homes were not feasible for this property, and it was not fair to leave the property vacant. He also wondered if the traffic concern was a little overstated. Mr. Erickson stated the main reason for the dual entrance and exit at Mississippi and Lucia Lane was for emergency vehicles. MOTION BY MP.. BETZOLD, SECONDED BY MR. Mr. Robinson stated this was a similar development to the one on ilver Lake Road across from Apache Plaza. Mr. Richard Mochinski stated he has been trying to sell thi property for some time, and he has had a number of proposals--manufact ing, storage warehouses, offices, etc. , but he had not had any luck p tting the numbers together. Then, it was brought to his attention that e best possible 'use for the land would be townhouses, one in a moderate ice range, because of Ziebart and a moving and storage company right acro s the street. He stated the property does not lend itself to commercial b use of the traffic. Mr. Mochinski stated one of the difficulties w the poor soil . The cheapest bid so far was $150,000 to take out approx. 712 ft. of bad material and replace it with granular fill , so their cost projec ons are even higher than when they originally started. Right now it was orderline with the number of units they have. Anything less than that woul make it very difficult to put the package together. Mr. Brian Peterson, 1340 64th Ave. , tated his main concern was drainage in the soil . There was a drainage di h on the south side, but what about the north side? They have all kinds water problems on the north end where the houses are. He stated he also f t a townhouse development would depreciate the value of the single family omes in the area. Mr. Kondrick explained that ne of the stipulations recommended by Staff was that the petitioner had to provide an approved storm drainage plan. Mr. Robinson statedthe eveloper would have to guarantee that run-off from the new development wo ld not exceed the rate before development. Mr. Mark Schwartz, 372 64th Ave. , stated drainage was also one of his main concerns, other t n that he was opposed to the development. It was too many units, and a tow ouse development would not fit into this area at all . It is all R-1 , si le family homes, and small businesses. He stated there was a big water p oblem right now; it was more than just getting adequate drainage on the new d velopment. Mr. Oquis stated the plan was to ensure that the problem was not any worse than it s today. The development would not improve the present situation, but it ould not make it any worse. Ms. avonne Kowski , 6391 Central Ave. , stated this property shared her back pro erty line. She was thoroughly against the proposal . There were too many un is and it would create too much traffic. She felt all their property values w,6uld go down, and she would much rather see a business go on this property. Mr. Flora stated the rezoning was presented to the Planning Commission and there was a considerable amount of negative comment received from residents in the area, and the Commission recommended denial of the rezoning request. Councilman Schneider asked what is the total area of the proposed rezoning, or how many single family homes could be located on this property. Mr. Flora stated there is space for three single family homes to be constructed on the property. Mr. Mark Haggerty, attorney representingl the developer, Mr. Erickson, stated there were a number of letters and item presented at the Planning Commission meeting which he did not attend,) and in reviewing the minutes of the Commission he noted a few items. Mr. Haggerty stated in regard to the traffic congestion, it was requested an investigation be made on what the County may do at this intersection. Mr. Flora, Public Works Director, stated the County does have plans to improve the intersection of Mississippi Street and Highway 65 by adding the right turn lanes on Mississippi Street. Mr. Haggerty stated there have been many requests in the past for proposed uses of this property. He further stated the staff recommendation regarding the traffic and access was in contradiciton to what the neighborhood wanted and the access proposed to Mississippi Street was to satisfy the residents in the area. He explained the configuration of the buildings could be changed so there would Ie less traffic on Lucia Lane. Mr. Haggerty asked about the adequacy of t e sewer line. Mr. Flora stated there is adequate capacity and this develdpment would probably actually help the sewer line. mrnrrr_ r=r; OF -IMy 11. 1983 PAGE Mr. Haggerty stated in condominium development, there is a homeowner's association and that FHA and VA have very lstringent requirements which must be met. Mr. Haggerty stated it is proposed that although this area is zoned single family, it doesn't lend itself to single family development and that it be allowed to develop into quasi-single family in order to meet the needs for some lower income housing in the City. Councilman Schneider stated he felt on of the key points was the density which was not discussed by Mr. Haggerty. Mr. Haggerty stated they have 14 units and believed there is a total of 58,000 square feet gross area and this comes within the density requirements of duplex housing in the City.l, Mr. Haggerty stated they want to be sensitive to the needs of the residents of the are and try to accomodate :eir concerns, as well as the staff's concerns regarding traffic, and tove input from the Council. He requested, therefore, for this hearing to be continued to the next meeting to give his client an opportunity to talk to the neighborhood residents and try to come up with a reasonable solution for development of this property. Councilman Schneider stated, prior to the public hearing before the Planning Conmisison, he had told Mr. Erickson this was one of the most creative developments, but had recommended he meet with the residents of the area before this item went to the P1 Commission. Councilman Schneider stated he had alsoold Mr. Erickson he would not approve the developments at the present deity. Mr. Haggerty stated Mr. Johnson, the owner of the property, has talked to the residents, however, because of the configurations of the property, rezoning proposals have been denied. He stilted the reason he is asking for a continuance is to get input from other Council members and then go to the residents and try to come up with a package that would be agreeable to. Mr. Russell Burris, 1150 Mississippi Streesubmitted a written proposal dated June 10, 1983 on what the residents would like for this area. This was read in full by Mayor Nee and stated a homeowners in- the area want the property to be built as R-1 or single amily homes as the property was purchased as R-1 property and should be de eloped accordingly. Mr. Clarence Timor 6517 Lucia Lane, stated he presented a list of objections to the Planning Commission. Mayor Nee stated the Council has the comments submitted to the Planning Commission which was made a Part of their proceedings. Mr. Timo stated he would agree with Mr. Burris' convents that the property was zoned R-1; the buyer bought it as R-lt and it should be developed as R-1. He stated, in urban planning, property should be developed in accordance with the surrounding neighborh and this spot rezoning isn't compatible with the R-1 zoning in their area. Mrs. Bystram, 6533 Lucia Lane, stated as she looks at this situation indeed something will be done on this property in the future. She stated she is certainly willing to talk and felt something should be done in terms of what is reasonable as far as traffic. Mr. Bystram, 6533 Lucia Lane, stated he wasn't involved in the discussion at the Planning Commission meeting for this rezoning, but was present at a hearing several years ago. He stated, as person who has no experience in developmental activity, he would be at, a distinct disadvantage if he was involved in a discussion without the kind of resource they need for a qualified judgment. He felt if he had trust in the people involved in the negotiations, he could benefit from discussions and there probably should be some staff input. Mr. Bystram felt the intersection at Mississippi and Lucia Lane is a problem, particularly in the winter because of the slight incline. Mayor Nee stated the problem involving staff in such discussions is that it may prejudice their objectivity. Mr. Haggerty stated they are to the point now where you are as close as you can get to single family residential usage. He stated both Mr . Johnson. and Mr. Erickson want to work with the neighbors and be honest about what they are trying to do and to also accommodate the recommendations of the staff and construct a nice development that will work with the neighborhood. He stated hE would act as an arbitrator in trying to work out something that is mutually acceptable. Councilman Schneider stated Ms. Schna el at the Planning Commission meeting had asked Mr. Erickson if he would consider reducing the number of units and he indicated he would not. tsidered, further stated, although the traffic and sewer capacity have to be he felt two crucial issues were the quality of the housing ar4 the density. Mr. Haggerty stated he felt anything isssible, however, whether it is probable or not, they would have to loo into this further. He stated they are willing to be flexible or else fie woudn't be here, but, on the other hand, there are some elements in the neighborhood that are inflexible and hopes to bridge this gap of inflexibility. Mr. Burris stated it is not feasible to put 14 units on this site. He stated he now has to back into his driveway in order to be able to get out on the street. Mr. Burris felt it would be tragic to have the access directly on to Mississippi Street and that three or four homes are the maximum that could be built on this site.', Mr. Burris stated the developer knows what the residents want for his property and yet they are still trying to force this proposal. Councilman Schneider explained, under the normal rules of procedure, the Council wouldn't take action on this rezoning this evening as it is customary to hold the public hearing and take action at the next Council meeting. M MMT, Wtjl NG OF JMY 11, 1983 PAGE 5 Mr. David Dayton, 6435 Highway 65, stated if& rezoning was approved, they/ could come in with any project they wanted and this is the reason they want it to remain as R-1. Mr. Herrick, City Attorney, felt there are some steps which can be taken to protect the residents to assure a certain development would be constructed. Mayor Nee pointed out that what the Council is now considering is the rezoning issue, and not approval of the proposed project. Mrs. Raedtke, 6540 Lucia Lane, felt 14 units was too many for this property and didn't feel the additional traffic could be handled. Councilman Barnette stated he knows everyone's feelings, but the biggest problem with this property for R-1 development is the location as he didn't feel someone would build a $100,000 ''home on this corner. Councilman Fitzpatrick stated the consideration is if the property should be R-1 or R-3 and how this fits into the total development picture. Councilman Hamernik stated he felt the density is a primary concern, but felt any dialogue between the developer and residents would have some value. He felt those lots today are not ideal single family sites. Councilman Schneider stated the density is the key issue in his mind and it would be his intention, if an agreement is reached with the residents, the rezoning would be granted for a specific project. Mayor Nee stated he didn't think a case has been made to rezone property beyond the client's interest. Councilman Schneider asked if they had looked at single family development with a shared driveway as suggested at the Planning Commission meeting. Mr. Harmsen stated it was economically impractical to construct four single family homes on this site. He stated no one would spend $120,000 to $150,00 for a hone and have a shared driveway. Councilman Schneider stated he didn't feel they had to construct $150,000 hones on this site. Mr. Harmsen stated it didn't make sense to have single family homes and looking at land costs, the trees should be saved and the only way to proceed is with a townhouse project. Mr. Jack Young, 6549 Lucia Lane, stated he felt there wasn't a person in their area that would object to taking down the trees and constructing single family homes. Councilman Schneider stated he heard the presentation at the Planning Commission meeting and felt what keeps coming up is financial considerations. He stated this is the developer's problem, not the City' s. He stated the City's concern is to maintain] reasonable land use controls. Councilman Schneider stated residents bought their homes in this area knowing this site was zoned R-1. He felt it could be developed as R-1 with some different plans and shared driveways. Mr. Young stated he bought their hone knowing this site was R-1 zoning. He stated since this time, they have had them apartments constructed to the north, as well as the Knights of Columbus Hall, which all contribute greatly to the traffic on Lucia Lane. He stated it is impossible to get out of their driveways on a bingo night at theC Hall. He felt with ten more units, there would be 20 more cars. Mr. oung stated he would like this resolved once and for all to keep the zoning as R-1. Mayor Nee stated there isn't any way to make it permanently unquestionably R-1 since it is a citizen' s right to petition for a rezoning, if he so desires. He stated the total area covered in this rezoning is about one and one-half acres for the purpose of constructing ten townhouse units. He stated it is proposed to have 6,400 square feet of lot area per unit or about 6.8 units per acre. He stated a typical townhouse density ranged frau 8 to 12 so this was a very low density. Mr. Robertson stated these units would be two bedroams with double garages, approximately 1,600 square feet. Mr. Robertson stated staff felt the plan was somewhat unbalanced because there were eight units for the west portion and two units for the east portion. He stated staff proposed an alternate plan to break the units into three clusters, instead of one long linear building. He stated with this plan, three units would be located on the east portion, four units facing Highway 65, and the other three units on the north part of the site. Mr. Robertson stated access is off Mississippi Street, with the driveway approximately 130 feet frau the intersection, and another driveway off Lucia Lane. Mr. Robertson outlined the 11 stipulations recommended in conjunction with this rezoning request. Mr. Robertson stated a large number of people attended the Planning Commission meeting and the vote by the Commission to approve this rezoning failed by a tie vote. Mayor Nee asked where the guest parking would be located. Mr. Robertson stated this could be provided in f ront of the garages. Mr. Jim Harmsen, Mr. Erickson's partner, stated he realizes the people who live in this area have seen marry different proposals for this property. He stated they have economically scaled down this project and felt it was the best kind of development for this parcel. He stated single family homes just wouldn't work, and felt there was nothing else they could do with the land. Mr. Harmsen stated Jerry Johnson was refused a curb cut off Highway 65 and Mississippi. Mr. Dick Berganini, 6596 Pierce Street, stated at the Planning Commission meeting he heard, basically, two reasons why this property should be .developed which was economics and the best plan. He submitted a petition of 60 names of persons who are opposed to this 'developnent. MJTION by Councilman Schneider to receive Petition 6-1986 in opposition to rezoning request ZOA #86-01. Councilman Schneider stated he strongly believed in a rezoning situation where everything is R-1, the zoning has to take precedence over economics. He stated it is clear the neighborhood is not in favor of this development. He stated he had suggested the developer work with the neighboring residents to try and work out a compromise, but this apparently was not done. Councilman Schneider felt he would be opposed to the rezoning and felt R-1 should prevail. Councilman Barnette felt the City Manager should explain what could be built on this parcel, without arry rezoning. Mr. Qureshi stated there are certain uses allowed in an R-1 zone, with a special use permit. He stated several uses might be a church or nursing hone. He stated it should be made clear R-1 doesn't necessarily mean single family hones, but does allow other businesses that tend to fit in with the single family type residences. Mr. Young stated, for example, a clinic would be constructed. He asked if there were any ordinances regulating the amount of parking. Councilman Barnette stated they would have to meet all the requirements of the City code. He stated he just wanted the residents to be aware that other than single family hones, something else could possibly be constructed on this site. Mr. Young asked if there is anything the Council could do to prevent rezoning requests from occuring every year. Councilman Schneider stated there really s no practical way to stop the requests for rezoning. Councilman Goodspeed stated he believed Ithe price of the land has been raised on the basis that the Council would ,some day rezone. Mr. Joe Randall, 1210 Mississippi Street, stated this land was obtained for a small mount of money and homes were (never built. Councilman Schneider stated he didn't see any particular use by the City, but perhaps if the residents wanted to share the cost to purchase this parcel, it may be a possibility. Mr. Seekon, 6450 Taylor Street, stated the hone across the street from him at 6451 Taylor Street is rented and the renters are constantly working on cars and washing motors. He stated he didn't feel this use was permitted in an R-1 zone and would like some action taken. Mr. Seekon stated Mr. Wiersma of the City staff had been out to talk to these renters, but was not able to contact the owner.
