Mrs . Schnabel clarified the ninth pragraph on Page 8,
the second sentence . She said it s ould read, "She said
that each of the four lots individuTily • • • -"
Mrs • Schnabel corrected a typographcal error on Page 21,
fifth paragraph . It should read "M� - Frank wanted to know if
the entire area on the drawing was oned as R-1" .
Mrs . Schnabel wanted the eighth par graph on Page 22 to
indicate that Mr . Wyman Smith was
representing Dr . Sakamoto, the owned^ of the property .
MOTION by Mr. Langenfeld, seconded by Mr. Bergman, that the

Public Hearing Rezoning Request ZOA :t 77-02, by Robert Flaten -
Upon a voice vote, all voting aye, Chairperson Harris declared
the Public Hearing open at 7 : 48 P •M-

Mr . Boardman explained that the petitioner planned to combine 1 C
Lots 41 and 42 so that he could construct a one-family residence .
Lot 42 is zoned R-1, however, Lot 41 was zoned M-1 - The request
is to rezone Lot 41 to an R-1 Lot -
Mr' Flaten said that he wanted to build a house on the Lots .
He said that when he applied for a Building Permit he had been
informed that he would have to apply for a Rezoning of Lot 41 .
Mrs. Schnabel wanted to know if he planned to live in the house
or if he planned to build it for re-sale .
Mr- Flaten indicated that he intended to live in the house .
Chairperson Harris wanted to know the frontage on the two lots -
Mr. Boardman explained that both lots were 20-foot Lots . He said
that the two lots combined would make a 60-foot Lot upon which
Mr- Flaten could construct a single-family dwelling-
Chairperson Harris wanted to know if there were any adjacent
M-1 properties -
Mr- Boardman explained where the industrial sites were located
in regards to the lots in question .
MOTION by Mr- Langenfeld, seconded by Mr. Bergman, to close the
Public Hearing Rezoning Request ZOA X77-02 by Robert Flaten -
Upon a voice vote, all voting aye, Chairperson Harris declared
the Public Hearing closed at 7 :55 P .M .
MOTION by Mr- Langenfeld, seconded by Mr - Bergman, that the
Planning Commission recommend -to the City Coiincil approval, of
the Rezoning Request ZOA 177--02, by Robert Flaten; to rezone
Lot 41, Block 12, Spring Brook Park Addition, from M-1
Il ight industrial areas} to R-1 {single family dwelling areas},
so it can be combined with Lot 42, Block 12, Spring Brook Park
Addition, {already zoned R-11, to make a residential building
site, the same being 176 Ely Street N - E -
Chairperson Harris asked Mr- Boardman if there would be any
easement problems.
Mr . Boardman indicated that there would not be any easement
problems .
UPON A VOICE VOTE, all voting aye, the motion carried
unanimously .

Mr. Dunwoody stated these plans are very preliminary and before proceeding with the project,
more complete plans would be developed for the CouncilVs approval. Mr. Dunwoody
stated the only thing under construction at this time' is the 20 x 20 foot shelter which
fits in with the natural theme of the Island.
Mr. Qureshi thanked Mr. Dunwoody for all his efforts land stated the reception center
buildingshould be as vandel roof
p as much as possibl� and hopes this is kept in mind
in the planning.
Mr. Dunwoody stated they have designed four buildingWIf r the Minneapolis Parks and
Recreation and recognizes the vandalism Problem and ill take this into consideration
in plans for the reception center building.
Mayor Nee thanked Mr. Dunwoody for appearing before �he Council and making his presentation.
Mr. Herrick, City Attorney, stated Mr. Ed Wilmes hast raised a few questions which the
Council may wish to consider at the meeting tomorrow evening. These were, the
possibility of obtaining a longer term lease, now'tht the bill was passed by the State
Legislature, and the language of the bill as it relaes to the $50,000 matching funds.

Mr. Herrick suggested this item might be discussed with the State representative as to
whether services will be counted towards the $50,000*d whether consideration will be
given to work previously done.
Mr. Lan enfeld asked if it would be s
9 possible for thelICouncil to review the plans this
evening since Mr. Dunwoodywould not be able to atte�hd the meetingtomorrow evening.

Mayor Nee felt it wasn't a question of the plans, bu what is needed .as far as funding.
Mr. Ed Wilmes stated WCCO T.V. provided coverage on �he Islands of Peace project and
the reaction from the public is proof that an effort must be made to make the public
aware of this facility. He stated many calls were rFceived from interested groups.
Mayor Nee stated he is interested in a finance plan �n the amount of funds needed
to complete the project based on the assumption that certain labor will be donated.
Mr. Dunwoody stated these figures are available and the figures in the budget were not
anticipating volunteer labor.

MOTION by Councilwoman Kukowski to receive the minut�s of the Planning Commission.
Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee

MOTION by Councilman Fitzpatrick to set the public hearing for July 11 , 1977.
Seconded by Councilwoman Kukowski. Upon a voice Vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
TEEN CENTER REQUEST FOR 5200:
MOTION by Councilman Fitzpatrick to concur with the recommendation of the Planning
Commission and approve $200 for the Teen Center. (Seconded by Councilwoman Kukowski.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously.

MOTION by Councilman Fitzpatrick to waive the reading and approve the above three
ordinances, relating to Chapter 11 of the City Code, upon first reading. Seconded by
Councilman Hamernik. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously.
Mayor Nee requested, at the time of second reading, that the four ordinances given first
reading this evening, which relate to Chapter 11 , be included in one ordinance.
AGENDA CHANGE:
MOTION by Councilman Fitzpatrick to waive the order of the agenda and consider the item
relating to the islands of Peace Project. Seconded by Councilwoman Kukowski. Upon a
voice vote, all voting aye, Mayor Nee declared the motion carried unanimously.
PRESENTATION OF THE PLANS FOR THE ISLANDS OF PEACE PROJECT:
Mr. Jim Langenfeld, President of the Islands of Peace Foundation, introduced Mr. Dunwoody,
the architect for the project.
Mr. Dunwoody presented a slide presentation outlining the accomplishments to date with
the Islands of Peace project and some of the projects planned for the future. He stated
the principal entrance to the Islands of Peace will be on Chase's Island which is owned
by the City. A reception center and parking lot is proposed for construction. He stated
a small shelter is currently under construction near the north end of Chase's Island.
The plan calls for developing Chase's Island into two areas, the south for picnicing
and the north for overnight camping.
In Mr. Dunwoody's presentation, the slides showed the design of the walkways and picnic
tables. Future plans include area for picnicing, camping, boating, fishing and
nature trails. He stated Gil Hodges Island is not scheduled to be improved, but will
be retained as a wildlife refuge. He stated maintenance of the facilities has been in
cooperation with the City and the Islands of Peace Foundation with a great deal of
volunteers cooperating in the project.
Mr. Dunwoody stated with the current grant from the State, riverfront will be acquired,
and the reception building and parking lot constructed.
Mayor Nee stated a meeting is scheduled for tomorrow night with Mr. Bill Atkins of
the State Planning Agency regarding this porject.
Councilman Hamernik questioned the construction of the building on the Hayes lots.

Mayor Nee questioned if there would be objectionslto the permit, if sanitary
conditions were correct. Mr. Stuve indicated he probably wouldn't object to
one or two rabbits, but didn't feel there shoulda any more.
Mayor Nee stated he felt they had the right to object, if the rabbits were creating
a nuisance.

Mr. Sobiech stated this is a request to rezone property from M-1 to R-1 at 176 Ely
Street. He stated the property to the East, adjacent to the railroad tracks, is zoned
j M-1 and there presently is an industrial operation) at this site.
Mr. Sobiech stated the Planning Commission recommended approval of the rezoning. He
advised the majority of the residences in the arealare single family.
Mr. Sobiech stated one of the items that was not d�scussed at the Planning Commission
meeting was the screening, which the zoning ordinance provides for between R-I and
` industrial property. He questioned Mr. Flaten if he would provide a screening fence.
Mr, Flaten stated he would put up 'the screening fence.
Mr. Herrick, City Attorney, felt, if Mr. Flaten wanted a screening fence, he would have
i to install the fence, since Mr. Flaten's property was zoned industrial and he is making
the request for it to be residential.

OLD BUSINESS:

RECEIVING REPORT ON HOLIDAY VILLAGE NORTH IN REGARD TO PROGRESS IN THEIR CLEAN-UP
AND MAINTENANCE OPERATIONS FROM MEETING OF 5116/7 :
Mr. Sobiech stated, approximately six weeks ago, representatives of the Holiday
Village North store were invited to the Council meeting to review the operations
of their store which were causing problems in the neighborhood, specifically
carts being taken from the premises and left in residential areas around the store
and the problems of litter.

j Mr. Sobiech stated, following the Council meeting, members of the staff met with
j representatives of Holiday Village. Mr. Sobiech reerred the Council to the
letters and memos dated July 6 and 7, 1977 regardin this subject in which certain
steps were outlined to try and eliminate the proble s. He noted, representatives of
Holiday have changed the operation in order to try and eliminate the cart and litter
problems.
I
He stated Holiday would just as soon not get involvd in fencing at this time, if
the problem can be resolved. They will, however, p ovide additional landscaping
around their property to help contain the litter. Additional help has been hired
to monitor the outside area and Mr. Sobiech stated the felt improvements have been
made since the Council meeting.
Mr. Tauer, 5866 2nd Street, indicated the cart situation has improved and noted
Holiday has some signs posted in the store. He stated, as far as the litter, he
would have to wait and see if the landscaping will help. He stated, if he has
any objections in the future, he will again come back to the Council.
CONSIDERATION OF PROVIDING FINANCIAL SUPPORT TO TEE CENTER:

from the kids who attend the Teen Center as well as the Teen Center Director.

i ADOPTION OF AGENDA:
Mayor Nee requested several changes in the agenda. The first was to consider Item 7,
"Consideration of Providing Financial Support to Teen Center" under "Old Business".
He also requested two letters of correspondence be added to the agenda, one from
William Scott and the other from the Springbrook Nature Center Foundation; and to
add "Consideration of License for Canterbury Pub".

OPEN FORUM, VISITORS:
Mrs. LeaAnn Sporre of the Environmental Quality Commission invited the Council to
attend their meeting on July 19, 1977 at 7:30 P.M. at the City Hall. She stated
representatives from the Minnesota Pollution Control Agency will be in attendance
at this meeting and will explain noise pollution and how it affects your health.
There also will be a discussion regarding sound abatement.
Mr. Fred Stuve, 6361 Jefferson Street, appeared before the Council to speak on behalf
of himself and his neighbors regarding an application the Council will be receiving
from a resident at 6351 Jefferson to permit the raising of rabbits. Mr. Stuve stated
there are about 10 to 14 rabbits at the premises at 6351 Jefferson and that it has
become a problem. He indicated it was not possible for him to sit in his backyard
because of the odor problems caused by the rabbits.

Mayor Nee asked if they have spoken to the resident about this and if he is aware of
the nuisance.
Mr. Stuve stated he had not spoken with the neighbor and that he probably isn't
aware of the problem.
i Mr. Sobiech, Public Works Director , stated, at this point, they have not seen the
application, but will make an inspection and report back to Council.

Councilman Schneider stated he did visit Mr. Stave's house, 6361 Jefferson Street

N.E., and checked on the situation and basically concurred with the Environmental
Officer's recommendation. He indicated the rabbilts, at that time, were unkempt.
Mayor Nee indicated the purpose of the license procedure is to ensure the rabbits
do not become a nuisance; and apparently, in thislcase, they have.
Mr. Herrick, City Attorney, stated the main purpoof the ordinance is when
a
individual situations come to the attention of th City, the Council can then determine
if a license should be granted. He stated, obviously, the kind and number of animals,
size of the lot and proximity of other people arelfactors to be considered.
Councilman Schneider questioned Mr. Pukal where hq would move the cages so they
would meet the code. Mr. Pukal stated he would put them in the middle of his lot
and then plant a row of bushes.
Mr. Pukal stated, when the Environmental Officer visited his residence, there

appeared to be little problem with the odor. Mr. IPukal stated he agreed he would
clean the area every week.
Councilwoman Kukowski questioned how old the rabbits are before they are given
away. Mr. Pukal stated eight weeks.

Mr. Stuve stated, over a weeks time, there will be enough odor accumulated to
j affect the neighbors. He also stated flies are present and feels it is a health
hazard, as well as an odor factor.
i
Councilman Schneider questioned Mr. Pukal, if the llicense was denied, if it would
create any hardship. Mr. Pukal indicated he wouldn't go broke, but has about $60
invested in the rabbits. Councilman Fitzpatrick asked how many licenses they have
issued for keeping rabbits. Councilwoman Kukowski Ifelt most people only have
one or two and immediately get rid of the young.
Councilman Schneider felt possibly limiting the number of rabbits kept; however as
i it is now, it is a nuisance to other neighbors,
Mayor Nee stated, from the petition, he gathers this must be a substantial problem.
Councilman Hamernik felt, if the area was cleaned only once a week, it would be
objectionable and create a nuisance.
I
Mr. Pukal felt he should be able to have some pets, leven if they wanted to limit
the number.
I
Mayor Nee questioned if he had room in the garage folr the rabbits. Mr. Pukal I
indicated he had, but the garage was to the property line. Councilman Schneider
indicated he hated to deprive anyone of the right tos raise rabbits, but because
of the opposition, he moved the following motion.
MOTION by Councilman Schneider to deny the livestock llicense to Mr. Pukal. Seconded
by Councilman Hamernik. Upon a voice vote, Councilman Schneider, Councilman Hamernik,
Councilman Fitzpatrick, and Mayor Nee voted in favor, Councilwoman Kukowski voted
against. Mayor Nee declared the motion carried by a14 to 1 vote.

Mayor Nee stated he regreted taking this action, butlthe reason for the ordinance
is to handle this kind of complaint. He indicated he hoped Mr. Pukal understands
their problem. He suggested Mr. Pukal could possibly negotiate with the neighborhood
i on another location and the number of rabbits. Mr. Pukal stated, if it bothers the
neighbors, he will just drop it. Even though he wound like to keep the rabbits,
he doesn't want to fight with the neighbors. i

they are not in the category of being funded by temporary funds.
Mr. Barna stated he understood the funds are temporary and most of the items he
mentioned would be funded on a temporary basis. He felt the City will have a
better chance for continued funding, if it is pointed out the money is going for

community services rather than equipment outlay.
Mayor Nee commented that actually the City does not receive much Revenue Sharing
Funds because of the formula used for taxing. j

Mr. Qureshi explained the City is penalized by the State and Federal governments
because Fridley is taxing residents at a low rate. Mr. Qureshi stated, if the
Council wished, expenditures could be taken from equipment and used for human
services. He indicated, at the public hearing of the budget, Revenue Sharing
Funds will be earmarked for certain items and then a general form will be submitted
to the government indicating the Council's intended use of these funds.
Councilman Schneider questioned, at budget time, if the Council decides to delete
or substitute items, if there would be any problem. Mr. Qureshi indicated there
would not be any problems in making changes. Mr. Qureshi explained the main
purpose of this public hearing is to comply with the requirement of holding the
hearing to obtain input from interested citizens. j

of Revenue Sharing Funds for 1978. Seconded by Councilman Schneider. Upon a

CONSIDERATION OF A LIVESTOCK LICENSE FOR MR. TOM PUKAL, 6351 JEFFERSON STREET N.E.
AND
RECEIVING PETITION NO. 13 IN FAVOR OF RAISING RABBITS IN THE BACK YARD OF THOMAS
G. PUKAL AND PETITION NO. 14 IN OPPOSITION TO RAISING RABBITS IN THE BACK YARD

Mr. Sobiech stated the Environmental Officer made inspection at 6351 Jefferson
Street N.E., after the last Council meeting, when residents on Jefferson brought
it to the Council's attention that rabbits were being kept at this residence.
Mr. Sobiech stated the Council has a report from the Environmental Officer
regarding his inspection in which he indicates, if proper means are taken to
ensure maintenance of the cages and the cages are located according to the code,
consideration should be given of the livestock license. If the license is
approved, the number of rabbits should be limited.
' Mr. Sobiech stated the property owner was requested to circulate a petition to
adjacent property owners to determine if they objected to the license.

MOTION by Councilman Schneider to receive Petition No. 13 in favor of the livestock
license. Seconded by Councilwoman Kukowski. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
MOTION by Councilman Schneider to receive Petition No. 14 in opposition to
the livestock license. Seconded by Councilwoman Kukowski. Upon a voice vote,
all voting aye, Mayor Nee declared the motion carried unanimously.
Councilman Schneider noted that one name appears on both petitions. Councilman
Schneider verified the fact that, according to the code, the cages should be j
30 feet from the property line.
Councilwoman Kukowski asked where the people resided who were in favor of the
livestock license. The two residences in favor were at 6350 and 6340 Madison, j
Councilman Schneider questioned the applicant, Mr. Pukal, what was being done
with the young rabbits.
Mr. Pukal stated so far there have been eight young and one was given away and
the others may be given away or eaten. Mr. Pukal indicated he has had the rabbits
since this spring.

FRIDLEY, MINNESOTA BY MAKING A CHANGE IN ZONING
DISTRICTS
The Council of the City of Fridley do ordain as follows:
SECTION 1 . Appendix D of the City Code of Fridley is amended as
hereinafter indicated.
SECTION 2. The tract or area within the County of Anoka and the
City of Fridley and described as:
Lot 41 , Block 12, Spring Brook Park Addition, lying
in the South Half of Section 3, T-30, R-24, City of
Fridley, County of Anoka, Minnesota,
Is hereby designated to be in the Zoned District
known as R-1 (single family dwelling areas) .
SECTION 3. That the Zoning Administrator is directed to change
the offical zoning map to how said tract or area
to be rezoned from Zoned D strict M-1 (light industrial
areas) to R-1 (single family dwelling areas) .
