However, the Commission is not in a position to give an opinion before a public hearing unless, per- haps, they could say they could.not go along with the request. The property, Mr. Momchilovich said, has been vacant all the time, and now there are no trees because of the tornado. He has an exit from the Highway at the South end of the property. The fact was brought up that once before a request was made for .com- mercial and the public hearing was held and the request denied. The procedure of rezoning was explained to Mr. Momchilovich, and he agreed to follow it. 4. REZONING REQUEST: ZOA #68-02, ROBERT WILSON: Lot 4, Block 1, Wilson Addition. Rezone from R-1 to R-3A. Set Public Hearing date. There was a short discussion regarding the location of the property and adjacent uses. MOTION by Jensen, seconded by Myhra, that the Planning Commission set the Public Hearing date of March 14, 1968 at 8:00 o'clock P.M. for the rezoning request, ZOA #68-02, Robert Wilson of Lot 4, Block 1, Wilson Addi- tion to rezone from R-1 (single family dwellings) to R-3A (apartment and multiple dwelling districts). Upon a voice vote, all voting aye, the motion carried unanimously. 5. REZONING REQUEST: ZOA #68-03, ARO INDUSTRIES, INC. : Lots 1, 2 and 3A, Second Revision of Auditor's Subdivision #21 and Lot 1, Brookview Addition. It was noted that Lot 1, Brookview Addition is not served by any utilities. and access is by Channel road by an old easement. In the proposed plan, one building will be placed on Lot 1 on the North side of the Creek, and a retaining wall will be constructed. A suggestion was made if it might not be feasible to the because of the terrain. It was felt Aro Industries should bring in a topog map in order to study better placing of utilities and flood plain areas. The area in question is about 31-2 acres. The Com- mission felt a sketch should be presented including the placing of the buildings so that they could get a little better idea of the property lines. The Commission were told this land was now being used as a truck farm. The buildings are near the river with the exception of the Evanoff home. The intentions are to raze the present structures except the Evanoff dwel- ling. The watermain follows Riverview Terrace. Planning Commission Meeting - March 14, 1968 Page 3 MOTION by Erickson, seconded by Myhra, that the Planning Commission approve the preliminary plat, P.S. #68-01, Al Rose Addition, by Albert M. Johnson of Lot 36, Revised Auditor's Subdivision #23. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Jensen said mention should be made of the lot depth being waived due to the area on both sides having been platted. It was noted that the buildings located on Block 2 will be taken down. The audience was told that consideration of this item would be by the Council on Monday, March 18th, and a public hearing date for the final plat may be set for the second Monday in April which is the 8th. 2. PUBLIC HEARING: REZONING REQUEST, ZOA #68-02, ROBERT WILSON: Lot 4, Block 1, Wilson Addition. Rezone from R-1 to R-3A. The Public Hearing Notice was read by Chairman Hughes. A communication from Mrs. Mable F. Gadbois was received which referred to this Item. Mr. and Mrs. Wilson were present. Mr. Wilson said being it is all industrial property to the rear of this area, the lot to the north has a tri- plex on it, he thought it would really dress up the neighborhood to have this type structure in there. He said Mrs. Gadbois' property is an old farm and there is some 40 lots that are vacant. Mr. Erickson said according to the zoning map, the area north, Gailsview Addition, had not been recorded as of .January 1, 1968. Mr. Wilson was asked if he were the owner of Lot 1 when the rezoning originally took place, but he said the former owner rezoned the lot in 1960. The Chairman asked the Engineering Assistant if he had discussed this request with the City of Columbia Heights. Darrel Clark replied that he had talked to Mr. Brown, City Engineer, and he informed him that the zoning across the street was R-2. He would inform the City Manager of Columbia Heights of the hearing and if he felt they would comment, that they would send a letter. They were also told this would go before the Council before anything would be final. Mr. Myhra wondered if the size of the land was insufficient for a four- plex and was informed that was true. A triplex was the largest apartment Mr. Wilson could build. Mr. Erickson then addressed Mr. Wilson and asked him that knowing the fact he could not build a four unit apartment on this building site, if it was his wish to continue this request? Mr. Wilson said they built two apart- ments in Columbia Heights, the same type of building, on 80 foot lots, Mr. Erickson said that there was a change made for multiple units in our ordinance, but presently under our ordinance, you cannot build more than three units, Mr. Wilson said that the building burned was a two family dwelling and was that way when he bought it. Ile thought the house was 75 years old, maybe older. Planning_Conuuission Meeting - March 14, 1968 Page 4 ! Mr. Erickson said he did not find the request particularly out of line with the adjoining property. The Gadbois property is rather large and that will be divided some day; Columbia Heights is already zoned multiple. MOTION by Erickson, seconded by Jensen, that the public hearing be closed and that the Planning Commission recommend that the rezoning request, ZOA #68-02, Robert Wilson, of Lot 4, Block 1, Wilson Addition be rezoned from R-1 (single family district) to R-3A (apartment and multiple dwelling district) but attach a recommendation to the City Council that no waiver be given for any more than three unit apartment. Upon a voice vote, all voting aye, the motion carried unanimously. r Chairman Hughes explained that this item would appear on the Council Agenda of March 18, 1967 for the purpose of setting a public hearing. 3. PUBLIC HEARING: REZONING REQUEST, ZOA #68-04, LOUIS MOMCHILOVICH: The South 150 feet front and rear of Lot 9, Auditor's Subdivision #88. Rezone from R-1 to multiple dwelling. Chairman Hughes read the Public Hearing Notice. Mr. Momchilovich addressed the Commission saying he had talked to the people to the North and they preferred the commercial, but would go along with the apartment or multiple dwelling. The people to the East (3) had no objections either. To the South there are apartments and they had no objections. He said he planned to build an 8 unit apartment house. Mr. Erickson recalled that the last time this was discussed, there was some talk about an easement through the property. Is this property directly to the North? Mr. Momchilovich answered it would be directly West of his property and East of the Highway, and that it was a recorded easement. Russell Burris, 1150 Mississippi Street: He was in favor of leaving the zoning. the way it is now, especially when thousands of dollars were spent to zone it R-1. The lot he spoke of would be suitable for double bungalow. Stephen Kachina, 6476 Dellwood: I have lived on the street for eleven years, have gone through changes and would like to see it stay R-1. We have all got roots there and don't feel we should have apartments right now. We have gone through rezonings several times. The people in back of the property could not be here. This is about the second time we have been up here. Mrs. Loretta Lane, 1132 Mississippi Street: We would like to keep the area residential, but in the event that property is zoned differently, and the lot South be rezoned, we do not want to be in the middle. We have been approached by mortuaries and doctors. We feel our property could be rezoned, but if not, we would like residential. Our lot is on the corner of Mississippi Street and Highway' #65. Mr. Momchilovich thought the area should have been all commercial in the first place as it is right along the four lane highway. Mr. Burris said that thousands of dollars have been spent to have the area zoned properly and when they finished this complete survey of the City, they zoned this area R-1. Mr. Momchilovich said the reason was that the homes were there in the first place. I� REGULAR COUNCIL MEETING, MARCH 18, 1968 PACE 15 said that any check to the joint venture would have to have Mr. Davies approval, and this should be a satisfactory way of making the payment. The City Attorney asked the City Engineer if he was recommending that this be paid to the joint venture. The City Engineer said he was, subject to the approval of the City Attorney. The City Attorney said that this would meet with his approval. Mr. Davies pointed out that the City was protected under the bond. f MOTION by Councilman Samuelson to approve the payment of the following estimate as discussed: F.D. INTERSECTION PATTERN: MISSISSIPPI STREET AND EAST RIVER ROAD: The City Engineer pointed out that the Planning Commission had adopted a resolution recommending a modification in this intersection as diagrammed .because of the traffic problem. Councilman Samuelson said that a lot of study has gone into this intersection, and he believed that Judge Johnson was the only objector. Councilman Liebl said that Judge Johnson does not concur with the way the City will have to finance it, as the people have paid three times for street, and he would like to ask the Attorney if they can be assessed again for the fourth time. The City Attorney said that the Council has the authority to assess the whole project if the benefit is greater than the cost, or it can be paid out of the mill levies, or any combination of general taxes and assessments the Council decides on. �I SPECIAL PUBLIC HEARING, APRIL 8, 1968 PAGE 4 how it will be divided. The Attorney said that he was not present to complain about the assessment, but they have given an easement and been very cooperative, and would like the Council's consideration in being notified when the assessment hearing is held. He was told that he would be notified. Mr. Christian Berg, 298 - 67th Avenue Northeast, asked about his assessment for Lot 1, Block 5, Rice Creek Plaza South Addition. The City Engineer said that any benefit to him would have to be figured before the project could be assessed, and the figure listed is just an estimate of cost. He said that the slip off will be south .of his property and there are no final plans prepared. Councilman Harris said that Mr. Berg has been called in for the Public Hearing as his property may be concerned, but looking at the map, he was not sure that there would be any benefit to his property. He said that this determination would be made when the final plans were done. No one else wished to be heard. MOTION by Councilman Samuelson to close the Hearing. Seconded by Councilman Harris. PUBLIC HEARING ON CONSIDERATION OF THE FINAL PLAT, AL ROSE ADDITION, P.S. #68-01, ALBERT M. JOHNSON, GENERALLY LOCATED WEST OF EAST RIVER ROAD BETWEEN 62ND WAY AND 63RD WAY: Mayor Kirkham read the Notice of Hearing. The City Engineer handed out a map of the area, and said that this plat fits into an overall plan that this area had at one time. He explained the way the street will go and that all lots meet the minimum area requirement. He said the City will need some additional easements on the back lot line and some utility easements. Mr. Harris, 6210 Riverview Terrace, asked if this included lots to the west of Riverview Terrace. The City Engineer said 3 lots were included. Council= man Liebl asked Mr. Johnson if these were all to be R-1 lots. Mr. Johnson said they were, and that he was not going to build any multiples. No oneelse in the audience wished to speak either in favor or opposition of the plat. Councilman Liebl said that he thought this would improve this area and build it up. He said he thought it was very gracious of Mr. Johnson to do this, and that the neighbors appreciate it. MOTION by Councilman Harris to close the hearing. Seconded by Councilman Liebl. Councilman Sheridan asked if this was the property where the house had burned down. Mr. Wilson was present at the � r Council Meeting and said that the house had burned down December 13th, and that it had been a total loss. Mr. Wilson said he wanted to rezone this property a ` + because he was growing older and wanted to live on the ground floor, with rental property above him. He said that he wanted to build a 3-plex. The City Engineer I , SPECIAL PUBLIC HEARING, APRIL 8, 1968 PAGE 5 {checked the code to see that he would have sufficient property to build a tri- plex, and found that a tri-plex could be put in. Councilman Liebl said that Mr. Wilson's neighbor, Mrs. Gadbois, was objecting f to the rezoning. He asked if everything on Main Street was R-l. Mr. Wilson ii said he thought the property Mrs. Gadbois owns in Columbia Heights is R-3. The City Engineer said that the property on the south of Mrs. Gadbois is R-3 and the property to the north has a tri-plex on it. Councilman Liebl said that this property borders on Columbia Heights and it is the City's policy to communicate with them. The City Manager said that he had telephoned the Manager of Columbia Heights, and that the people had been notified by letter. Mr. Wilson said that Mrs. Gadbois farms this land, and he thought the only objection she has is she is afraid that sooner or later she will have to move if it gets built up. No one else wished to speak. MOTION by Councilman Harris to close the hearing. Seconded by Councilman Samuelson. Upon a voice vote, there being no nays, Mayor Kirkham declared the Public Hearing on ithe rezoning request by Robert Wilson (ZOA #68-02) closed at 9:12 P.M. Mayor Kirkham told Mr. Wilson that the Council will make a determination at a later date. CONSIDERATION OF RICE CREEK/CENTRAL AVENUE PLAN: Councilman Harris said that the Planning Commission, in their meeting with the Council , held March 25 , 1968 , had indicated that their previous motion adopting the plan was still their feeling at the present time . He said that it was certainly a flexible motion and the plan could be changed at the dictates of the development in the area. Mayor Kirkham said it should be pointed out that this is just a plan to follow and subject to change . Councilman Sheridan said that some of the people within the area felt they were not in a position to make their plans at this time , but felt that if this was laid out and adopted now, it would be laying out the future of their plat . Councilman Harris said that about 10 property owners out of 11 people in the area present at a previous Council Meeting , felt that this was the best plan that had been proposed. - He said that any streets would still have to be pet- itioned by the owners . . Reverend Henderson, representing the People ' s Church, said that they have gotten the impression that when the time comes , they will get a road whether they want it or not , if not by petition, by condemnation. Councilman Harris said that this normally is not done . Reverend Henderson -said that his Church was not ready to say what they will- want , to do in the future , but this will pretty well determine where the road will go once it is put on record. Councilman Harris asked if he ob- jected to the road pattern pertaining to his property, and not to. the overall project . Reverend Henderson said that if he was a builder , he would -think ,thPs- was very good and a -reasonable plan-, but- they-- are not, - - n in a mood to develop it and would like to leave it as it is . Council- man Harris said -lie thought the Planning Commission ' s motion sets the plan up as a ,gud de for the development of the parcels with a great deal of freedom, but it still gives a starting area to work from. It was needed to prohibit downed trees, which are unsightly and are a hazard to small children who would like to play in them. They could be hurt when the trees became rotten. They also took into consideration the fact that Aetna had indicated to the City we would get a refund. However, the County has said that they will not share 50% of the cost. He said the Administration felt that less than 50% would not be worthwhile. The City Attorney commented that it would seem that the County would go along with this and suggested that this girl could also handle the fines ensuing from our tagging ordinance. Councilman Liebl wondered how three clerks, one for each court can handle the work load, when under the system now, every town has a clerk. CORRESPONDENCE- A. ROBERT WILSON• RE- REQUEST FOR BUILDING TWO SINGLE FAMILY DWELLINGS: Mr. Robert Wilson, 4020 Main Street was present at the Council Meeting and explained that he had previously requested a change in zoning to allow him to build a tri-plex. He said that he now has a buyer for this property, if he could split lot into two buildable sites with the zoning remaining R-1 . He said that he felt that this was too big a lot for one single unit. Councilman Samuelson asked how big the lot was. Mr. Wilson answered that it was 101'h' front footage and 135 ' deep. Councilman Liebl said that he had received calls from the neighbors indicating that they would prefer single family homes on this lot. Mr. Wilson said that the lot across from him in Columbia Heights was a 40 ' lot, but it was explained to him that Fridley does not consider 40 ' to be a buildable lot. Councilman Samuelson told Mr. Wilson that this request would have to proceed through regular channels, and would first require a lbt split, and then to the Board of Appeals, if it was necessary, depending on the size of the buildings. MAYOR KIRKHAM COMMENDING VIRGIL HERRICK, CITY ATTORNEY: Mayor Kirkham said that this letter comes from the office of the Mayor and read it into the Minutes as follows: FROM THE OFFICE OF THE MAYOR TO VIRGIL C. HERRICK Now that the District Court has made it's order in the litigation involving the City of Fridley and the North Suburban Sanitary Sewer District, I would like to make a brief comment and commenda- tion on the result. I believe that this Council has maintained a consistent position relative to the supplemental agreement which was the main point of controversy in this action. We authorized our City Attorney, Virgil C. Herrick, to attempt to negotiate an equitable settlement between the parties. I am of the opinion that his representation of the Council 's wishes was excellent. It later became necessary by virtue of the action started by the NSSSD for the City to become involved in legal proceedings that took place in the Anoka County District Court during the spring and early summer. During that time, Mr. Herrick represented the City again and did an excellent job of conveying the City's position to the District Court. The result certainly bears witness to the type of representation he has afforded the City. REGULAR COUNCIL MEETING OF SEPTEMBER 16, 1968 PAGE 6 Councilman Harris asked how they were to be served by sewer. The City Engineer said that they would be served by N.S.S.S.D. lines. Mr. Jim Gibbs, representing the City Attorney said that the City Attorney had talked to Mr. Jensen and has started working on a contract to protect the City 's interests. TRINITY DRIVEWAY PROBLEM: The City Engineer said that there were two driveways at 6100 and 6110 Trinity Drive where the driveways do not come to the pro- perty line. The property owners are willing to pay the cost of the portion of driveway on their property directly to the con- tractor if the City contractor will do the driveway from the Curb line to the edge of the existing driveways. If Council so desires, the City can go ahead and do this. He said that they have agreed to a temporary access to the tract off East River Road about 900 ' from the south leg of the cloverleaf. He said that he had talked to the County Traffic Engineer about this. He said that the permanent intersection development should be at the south end of the tract. The Highway Department is planning on putting in �L traffic signal at the south leg of the intersection of East River Road and 1.694. Any future signal at the south location will have to be paid 500% by the City and 505% by the County if the traffic warrants the signal. He said that the County will also have to accept this access proposal. The Planning Commission also suggested a study be made by the City Attorney on the need of a development contract to protect the City. The third item is a list of protective covenants to be submitted with the Registered Land Survey. REZONING REQUEST: ZOA #68-02. ROBERT WILSON: Lot 4, Block 1, Wilson Addition, rezone from R-3A to R-1. The Chairman recalled the Planning Commission, on October 10, 1968, recommended to Council approval of the lot split subject to a building permit for only one house until the land is rezoned to R-1, and Council concurred at their October 21st meeting. An application for rezoning was sent to Mr. Wilson, but he has not returned it. A builder talked with the Engineering Assistant and it was explained to him that the land has to be rezoned to single family dwellings before he could build on the two lots. To date no permit has been taken out for a house. No action. 5. HYDE PARK ADDITION REZONING STUDY: The Chairman explained that Mr. Chapman of Nason, Wehrman, Knight & Chapman, Inc. would be unable to be present at a public meeting on January 9, 1968. LOTION by Mittelstadt, seconded by Fitzpatrick, that the Planning Commission accept the notice of the informal public hearing prepared by the Engineering Department for Wednesday, January 8, 1968 with amendments as indicated. The Chairman requested the recording secretary to send the letters to the people of Hyde Park Addition on December 24, 1968, and that mention of the meeting be made in the January 2nd issue of the Fridley Sun. 6. SIGN ORDINANCE: The Commission considered in detail the corrections indicated at the last meeting of December 5th, correcting their own working copies (this meeting making the eighth session of study). MOTION by Mitt elstadt, seconded by Myhra, that the Planning Commission recommend approval to the Council the "Sign Ordinance" as corrected at this final study. Referring to the item in the Fridley Sun regarding billboards to be installed without charge to the City by a sign company, being a directional sign for the City in one direction, the Commission wondered when Council was considering this, did they have some information that the Commission was studying the sign ordinance, and their thinking of the problem of billboards. 7. PROPOSED ZONING ORDINANCE REVIEW: The Chairman submitted a list of items to be discussed at this meeting and the City Engineer also added to the list.
