Dear Mr. Johnson: At your request I have examined the above property regarding its potential, highest and best use and development possibilities. First, the parcel does not lend itself to subdivision for single or two family residences for 2 principal reasons : 1. The extremely high cost of improvements - i .e - Streets, sewer, water, etc . makes the project economically unsound. 2. The high traffic- count on Mississippi Street and Highway 65 to- gether with high decibal level created by high speed traffic is not conducive to high quality residential sites. Second, the density created by multi-family construction undoubtedly would create much neighborhood objection. Also, again the noise level at the intersection is a problem. My recommendation for the property would be a low rise, 1, 1}¢ or 2 story professional office building with berms to hide the parking along Mississippi Street. A walkout level could easily be provided on the North end toward Highway 65. Access should be limited to Lucia Lane. As many trees as possible should be preserved to "hide" the structure. This could easily be accomplished as the trees are very large and well spaced. Some should be left even in the parking area. It is my firm belief that this type of structure would do the least amount of damage to the site and would inconvenience the neighbors and the city the least and would provide a fair return to the land owner. MOTION by Mr. Langenfeld, seconded by Mr. Peterson, to open the Public Hearing. Upon a voice vote, all voting aye, the motion carried unanimously. The Public Hearing was opened at 7: 52 P.M. Mr. Boardman showed the Commission the plans for the lots. He explained exactly which lots were involved with the request. Ile pointed out that at the intersection of Highway 65 and Mississippi there was no other commercial enterprises. Mr. Wyman Smith, the attorney representing Mr. Gerald G. Johnson, explained the rezoning request. He said that 1,1r. Johnson had owned the property in question for 22 years. Ile said that since Fridley had its original zoning scheme laid out, the property had been zoned R-1 . He said that it has been maintained as R-1 since that point in time. He said that the lots were nicely wooded lots and that the neighborhood had definitely benefited from that property. He pointed out that Mr. Johnson still had to pay taxes on that property and he has decided that he granted to develop his property. He felt that it was not reasonable to try to develop it as R-1 since it was located on the corner of a very busy intersection. Mr. Smith Brent on to explain that the type of restaurant that would locate on that property was a family-type restaurant. He said that they ?Manned to have a nicely planned building that would be a sit-in restaurant. Ile said it would not be a drive-in or fast food restaurant. He said that there would be no liquor license applied for. IIe said that the restaurant would really be a good use for the property and most suitable to the neighborhood. Mr. Jim Lobman, President of the restaurant company that would be located on the proposed site, explained that the restaurant would be a nice family-style restaurant. Ile said that the Company was local. He said that the restaurant concept was developed in 1962. He said that he wanted the neighborhood to understand that the restaurant was not a national chain restaurant trying to move into the area; he felt that the proposed restaurant would actually be very good for the area. Mr. Walter Boyd, the real-estate broker working with J' s Restaurants, indicated that he was not a member of the family or an employee, but that he was working with Mr. Lobman on the transaction. Ile explained to the Commission all the statistics involved with the proposed restaurant. IIe indicated the taxes it would bring in as well as the employment statistics. He felt that the information would be of interest to the Commission as well as the Community. He said it didn' t seem anyone was interested in building at the corner of Mississippi and Highway 65. He felt that the family-style restaurant was the best solution for that piece of property. Ms. Schnabel asked if the .restaurant would be open 24 hours. Mr. Lohman indicated that it would be open 21� hours every day. Mr. Clarence Timo, 6517 Lucia Lane NE, read to the audience and the Commission the rezoning request objections and petition for denial. He read, "To the City of Fridley, Planning Commission and Council Members: "Ide as residents of the City of Fridley, Minnesota$ hereby protest the Rezoning Request described in ZOA #78-05 for the following reasons: 1) One of the most important objections we have to the Rezoning application is that it is a request for Spot Zoning; that is to say that the placing of a business establishment right in the middle of us homeowners and citizens of Fridley, totally surrounded by lots zoned as R-1 (single family duelling units) . 2) The traffic problems a) The Knights of Columbus Hall at the North end of Lucia Lane has a number of functions going on at their Club House at various times. All cars returning from those functions as well as the Lucia Lane Apartments are routed South on Lucia Lane towards Mississippi Street, there being no exit at the North end. From there it meets all traffic traveling east and nest on Mississippi Street that already has conjestion problems. (He had a picture he showed to the Commission of that exact conjestion problem that he had taken at 6: 00 P.M. June 7, 1978) . b) Highway 65 and Mississippi Street already has a history of many serious accidents at that corner. c) If the parking lot for the proposed restaurant were to fill up; or if some people, including trucks, semi' s, etc. , wouldn' t feel like getting jammed into a parking lot, they would park in front of the homes, creating a further traffic hazard. This would further compound the hazards of traffic. e) Itinerant traffic, including trucks, semis, etc. from Highway 65 would invariably park on Mississippi Street or other convenient side streets instead of getting into the parking lot and would return via the many side streets that intersect Mississippi. 3) The depreciation of home value. Traffic, noise, littering of streets by customers, and potential hang-out of undesirable resulting in possible vandalism in the area. Parking lot lights shining in homes all night and ugly parking lots in the area. People with small children wouldn' t care to buy homes in the area because of the additional traffic on side streets. The aesthetic quality of the area would be lost forever with the loss of the beautiful trees; where otherwise could be built beautiful homes. Pollution from cars and trucks; undesirable smells of a restaurant; placement of industrial garbage containers which would result as an attraction for flies and rodents." Mr. Timo said that new streets and gutters were installed less than one year ago at the urging of the City of Fridley to improve Fridley' s residential appearance. He said that the residents did not leant that appearance ruined. Mr. Timo said that all the residents in the area purchased their homes with the understanding that all the property in the area was zoned R-1 Mr. Timo proceeded to read the introduction to a petition that had in excess of 260 signatures. IIe explained that the people were all property owners unless it was indicated after their name that they were renters. "Petition protesting Rezoning; To the Council of the City of Fridley. - We the undersigned being tax payers and residents of the City of Fridley, or/and being owners of the property abutting on Highway 65 and Lucia Lane and Mississippi Street do hereby join in a petition protesting against any commercial, business, or industrial building on said residential property referred to in ZOA /78-05, which includes Lots 5,6 & 7 and the westerly 1361 feet of Lot 4 on Lucia Lane Addition. We request that you do not allow rezoning of said property which now is zoned R-1 and tide want it to remain R-1 . I have personally signed this petition and a qualified voter of the City of Fridley and my residence is correctly written after my name." PLANNING COMMISSION ME,1 TING - JUITTE, 1278 Pafre 6 1 F Mr. Timo said that he personally went to most of the people. He said that Mr. Russell Burris of 1150 Mississippi Street NE had accompanied him on the first few. Mr. Timo attested to the fact that he personally visited every one of the people with the exception of the few that Mr. Burris had visited and the few people that happened to be on vacation or not home during the time he went around with the petition. MOTION by Mr. Langenfeld, seconded by Mr. Oquist, that the Planning Commission receive the petition. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Joe Randall, 1210 Mississippi Street NE, said that he had lived in Fridley most of his life. He said that the original owner of the property in question sold the property with the main intent that the property remain residential. He said that the area consisted of 33 quality homes that were occupied .by people who care for their neighborhood. Ms. Marge Daun, 6546 Lucia Lane, said that they had moved to their present home from 34th and Johnson Street NE, and the main reason was to get away from the very problems that the proposed restaurant would create. Ms. Loretta Lane, 1132 Mississippi Street NE, said that they had lived at that address for 28 years. She said that they built with the intention of living at that address for a long time. She said that they did not like the idea of having spot zoning in the area. She also said that it would be very inconvenient to have the restaurant driveway directly across from their driveway. She said that their home would probably lose their access onto Mississippi street because of the traffic that would be generated by the restaurant. Mr. Russell Burris, 1150 Mississippi Street NE, pointed out that he presently, also, had enough trouble getting out of his driveway. He didn' t like the possibility of having access driveways for a restaurant located across from his property either. He said that there was already too much traffic in that area. He didn' t feel it would be feasible to put a restaurant in that location, he said it mould only add to already hazardous situation. Mr. Terry Daun of 6546 Lucia Lane said that if Mr. Johnson would sell the lots for a reasonable price, he would be able to sell the lots for residential development. Mrs. Long, Dellwood Drive, said that there were many little children that lived in the area. She said that presently the parents have to constantly be aware of the traffic that was in the area. She felt that the restaurant would only add to that traffic problem. She said that the safety of the children should be considered. He said that if the property was rezoned, it should be considered that 11ississippi Street and Highway 65 mould develop into a major commercial corner. He said it wasn' t viable that only one restaurant would be allowed in an area without expanding the entire area into a commercial center. He said that he teas totally against that concept. Mr. Robert Zuehlke, 1260 Mississippi Street NE, said that he has lived at that address for 15 years. He said that the traffic on Mississippi Street was already so great and to add something like the proposed restaurant would only compound many of the existing problems. He felt that there was enough property available in the area that was already commercially zoned. He couldn' t understand why a person .`could want to locate a restaurant in a residential area. He said that comprehensive planning had been done for zoning and he felt that Fridley should abide by that plan. IIe said that he agreed that the property could have been sold years previous if it had been reasonably priced. Mr. Mearl Crosser, 6565 Lucia Lane NE, said that they already had a traffic problem in the area only added to by the Knights of Columbus Hall and the area didn' t need another establishment that mould add even more traffic. He said that he had bought a home nine years ago with plans of staying in the area. Hor:ever, if the traffic increases much more, he would have to consider looking elsewhere for housing. Ms. Kathy Nelson, 6366 Pierce Street, said that she represented many of the neighbors who were all opposed to the rezoning. She said that they had signed the petition and they wanted the Commission to know that they were at the meeting and were in opposition. Mrs. Robert Bystrom, 6533 Lucia Lane NE, said that another reason for her opposition to the proposed restaurant was that she hated to see all the beautiful trees removed from that property. She said that they not only added beauty to the neighborhood but also acted somewhat as a sound barrier. A person in the audience asked what would become of the J 's Restaurant located north on Highway 65. Mr. Lobman said that the proposed restaurant would not be anything like that restaurant. He said it would probably be closed. The person from the audience asked why he didn' t keep the restaurant where it was presently located rather than moving it further South against the wishes of the neighborhood. PLATTI1ING COMMISSION MERTITTG - JUNE, Z, 1978 Page 8 Mr. Lobman said that there were too many rules and regulations that had to be followed 'by restaurant owners in the present times that a lot of the conditions they feared could never happen. Mr. Lobman said that one of the aspects of the property that was most appealing to the restaurant was the fact that there were many trees on the property. Tie said that they planned to keep as many of the trees as possible. Mr. Lobman said that he didn' t feel that the restaurant would or could have an adverse effect on as many people as signed the petition. He said that figuring 26 houses per block, 260 signatures would mean that signatures would have been obtained from ten blocks of homes; he didn' t feel that the restaurant could effect that much area. Mr. Lobman agreed that there was a lot of traffic at Mississippi Street and Highway 65. He said that was why he felt it would be a good location for a restaurant. He said the traffic problem was another reason he felt that it was an ideal commercial location. He said that he would never want to build a home at that location to raise a family. He didn't feel that it was at all suited for an R-1 Zoning. Mr. Lobman said that the point was raised that customers would have to make a left turn to enter the establishment. He said that many establishments existed that people had to turn left to enter. Mr. Lobman didn' t feel that any consultant would consider that corner of Mississippi Street and Highway 65 as a residential corner. Mr. Lobman said that the restaurant garbage would be picked up every day. He didn' t feel that there would be any problems of rodents, bugs, etc. Mr. Lobman said that the restaurant would have green areas. He said they would have an underground sprinkling system, maintenance service, fertilizer companies that take care of the green areas of the restaurants, shrubs, etc. He said that the landscaping of the restaurants are excellent. Mr. Lobman said that, in summary, he did not agree with a lot of the points of objections that had been presented. Mr. Wyman Smith said that he agreed with a lot of the points that had been made. He said that the people that lived close to that corner would sign the petition to keep the property in its present state because it was a beautiful piece of property. However, he pointed out that Mr. Johnson was the person paying the taxes on that property and he, also, had some rights to make use of that property. Ile said that it rras' a family restaurant that could be reasonably located in a residential area. Mr. Smith said that the traffic was already existent in the area. He said the Courts have long said that the increase of traffic because of the use of property was not an excuse for not doing it. Ile said that aesthetics has never been used as criteria for denial of a request. He said that the request had a minimal problem in the area of health and safety of the public. Mr. Henry 11•7etcher, 6500 Pierce Street TIE, said that he was definitely against any type of spot rezoning in Fridley. He said that Mr. Johnson knew the property was zoned P.-1 when he purchased it. He said that Mr. Johnson could have sold that property as R-1 if he would have been willing to accept the dollar value of R-1 property. He said that it was felt by some of the neighbors that the main reason he hasn' t sold the property was because he wanted to sell the land as commercial and not residential. He said that he was definitely against the request. MOTION by Mr. Storla, seconded by 17s. Schnabel, to close the Public Hearin;. Upon a voice vote, all voting aye, the motion carried unanimously. The Public Hearing was closed at 8: 48 P.M. Mr. Langenfeld commented that it was his opinion that some of the statements regarding the rezoning were assumptions. He said that he didn' t feel the petitioner was trying to mislead anyone with his statements abouts the taxes, etc. He asked ghat the Staff had to say regarding the request. Mr. Boardman said that it could be a useable residential area. He said that if a rezoning was granted on that property, there would be enough demand to have to consider the same request for the other corners of Highway 65 and Mississippi. He said that it would result in similar problems that were present where the corner was commercial and the remainder of .the block was residential. Mr. Boardman said that it was spot development and Fridley has been trying to get affray from that type of thing. He said that it wasn't viewed as a good rezoning. Ms. Schnabel said that she had always wondered why that corner had never been developed. She said that it was a beautiful corner and felt it would make nice home sites. She pointed out that many trees would still have to be removed to construct three separate houses. She said it was possible that the same number of trees would have to be removed for the three individual home sites as would have to be removed to construct the proposed restaurant. Mr. Peterson asked when the lots were zoned R-1 . Mr. Boardman said that it was zoned R-1 in 1955 and has always been zoned R-1 . Johnson: Rezone Lots 5 , 6, 7 and the westerly 136. 50 feet of Lot 4 , Lucia Lane Addition, from R-1 (single family dwelling units) to C-2 (General Business Areas) , for a proposed restaurant site , the same being 1145 Mississippi Street NE , for the following reasons: 1 ) It would definitely be a spot rezoning; 2) There would be a traffic problem (which already existed) ; 3) It would interfere with the bike trails; 4) It could have an effect on the depreciation of the homes in the area; 5) It would have an environmental impact in regards to noise and aesthetic values . Mr. Langenfeld said that he fully realized the rights of the property owner, but he felt that the particular type of zoning request should be denied. Mr. Peterson asked the petitioner if he would consider operating the restaurant on less than a 24-hour basis. Mr. Lobman . said that he didn' t feel a reduction in hours would make the neighborhood residents feel any differently about the proposed restaurant . Chairperson Harris said that he understood the petitioner ' s dilemma; however, he felt that the rezoning of the property would riot be in concert with the rest of the surrounding properties as it has been developed. He said that the surrounding neighbors had the right to expect that since the property was zoned as R-1 , that the status quo would be maintained. Mr. Harris felt that the property in question could be developed in an R-1 manner. He indicated that because of the above statement he would vote in favor of denial of the request . UPON A VOICE VOTE , all voting aye, the motion carried unanimously. Chairperson Harris declared a break at 9 : 22 P.M. Mr. Storla left the meeting because of prior commitments. 3. CONTINUED : ENERGY COMMISSION DISCUSSION Mr. Oquist indicated that Mr. Storla had left some comments on the Energy C-bmmittee. He read the statements to the Commission: Mr. Storla felt that people that should be considered as members of the Energy Committee could be someone from the American Legion and from the Leaque of Women Voters because both of the groups ' National Committee has recommended that they get involved in the Energy problem. Mr. Storla also felt that someone from the Cabel TV or the Sun Newspaper should be a member of the Committee to act as a public relations person. HUMAN RESOURCES COMMISSION MEETING AUGUST 3 1978 - PAGE 7 Mr. Storla stated that if they did send a communication to any business, they should actually tell what needed to be fixed, widened, etc. Ms . Van Dan stated that one comment many handicapped made was that they hated being treated like garbage by having to come in a back or side door where garbage was thrown out or freight was delivered. Mr. Fleming stated that the City had provided handicapped parking and the depressed curbing within the last year. Also, a modest amount of money had been appropriated so that all new curbing would be depressed. A certain amount of the old curbing had been changed, with a goal to have depressed curbing throughout- the city. Mr. Boardman had told him that in June 1978 the City had applied to H.U.D. for a block grant to study architectural barriers in the city and to get money to eliminate those barriers . Another point was that the Building Inspection Division of the city was hard at work implementing the State Building Code. As he under- stood it, Chapter 55 of it spoke to this in that all new commercial and industrial buildings must be accessible to the handicapped. Another con- tribution the city was making was by helping both commercial and private builders to try to make those buildings barrier-free that were not now barrier-free. Ms . Van Dan stated that if the City had actually applied for a block grant and funding, this Commission should be involved. Mr. Storla asked Mr. Fleming to check on what the City was going to do ++' in regard to the barriers in the Civic Center and also to find out more fi about the block grant. MOTION by Mary Van Dan, seconded by Mary Jo Dobson, that the Commission go to the Target ,Store on 53rd Ave. N.E. to evaluate the remodeling in regard to architectural barriers . If the facility was not barrier-free, then the Commission would write a letter with strong recommendations to 1 Target. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Fleming stated that if the situation had changed and it was now barrier- I free, he thought the Commission should thank Target for their changes . Mr. Sobiech, Public Works Director, explained that this request is to rezone from R-1 to C-2 the area located at the northeast corner of Mississippi Street and T.H. 65 for a proposed restaurant. He stated the Planning Commission did hear the matter at their June 7th meeting and did recommend to the Council denial of the request. The denial is based on several reasons as noted: 1. It would be a spot rezoning. 2. It would be a traffic problem. 3. It would interfere with the bike trail. 4. It would have an effect on depreciation of home values in the area. 5. It would have an environmental impact on noise and aesthetic values. The petitioner was at the meeting and was represented by Attorney Wyman Smith. Mr. Smith stated the restaurant is no longer available to the petitioner. He is looking for another location. He stated most of the people liked the area just the way it is--it's like a private park. Now it is zoned R-1 and it has always been that way. Mr. Johnson has explored other alternatives for the i property with builders and architects. Mr. Johnson has come up with a number ( ( ----------- 205 REGULAR MEETING OF AUGUST 21, 1978 PAGE 2 of uses. None of them would be single family dwellings. If it is the Council 's and people's wish to keep it R-1 then that is the end of the problem. It is the Council 's responsibility to protect property owners and overall planning for • the community. There must be some use for this area. He can show economically single family dwellings are unfeasible. He stated he is suggesting tonight that they would like to come up with some plans for anothdr use. Mr. Smith and Mr. Johnson would like to discuss it with the staff and City planner. One of the uses is an office building. It would save some trees facing Lucia Lane. The second plan the architect has is to allow the building of some tri-plexes or j r four-plexes. This would also be possible. It would make the land economically (I feasible. Mr. Johnson has paid taxes for 22 years on this property. They are trying to come up with something that will harmonize with the community. They need to explore this with the City planner. I Mr. Smith passed out copies of plans the architect drafted to the City Council. Also letters from three companies indicating the cost that would be involved in building single family dwellings. Mayor Nee suggested to Mr. Smith that he read the letters to the Council and audience. Mr. Smith then read the letters. He stated he respectfully requests this, property owner be given a chance to further explore this and see if they can get a positive reaction from the staff. Councilman Schneider asked Mr. Herrick, City Attorney, if the Planning Commission hearing was held on the R-1 to C-2 and all input was directed to the restaurant. It is appropriate at this time to consider another proposal. Mr. Herrick asked Mr. Smith what the proposal would be as far as the office is concerned. Mr. Smith stated C-2 would make it legal. He stated their thought was that time is a problem and everyone is concerned and they also are concerned. This would give them a chance to report any zoning less than that, an R-2 or R-3, and it • seems to him the Council has done this before where they have had application ( for one zoning and have ended up working out a compromise. Mr. Herrick stated it would be possible to rezone it to CR-2 for office construction where it would be lesser zoned. Mayor Nee asked how may lots there were. Mr. Smith stated that there are three lots on Mississippi and one lot on Highway 65. Mayor Nee asked if anyone in the audience wanted to review the sketches. Councilman Schneider asked if there were any comments from the audience or Council. Mayor Nee stated they had received a petition from the people in the area. MOTION by Councilman Schneider to accept Petition No. 16-1978 as presented. Councilman Fitzpatrick seconded the motion. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. Mr. Smith stated it would be unfair for the people to talk about it when they haven't seen it. He stated they wanted to work something out. He stated the Council and people have to take the proposition they cannot build single family homes. Mayor Nee stated he did not understand why they could not build homes. Mr. Smith stated many builders won't build on it. It is not economically sound. They have no interest in it. At the Planning Commission meeting we discussed alternatives. He stated they knew they will have to have some hearings on this. • Mr. Wayne Hitchcock, 6532 Pierce Street pointed out or a map other multiple dwellings in the area. Councilman Hamernik stated he had to go along with the wishes of the area property owners. It is up to them to say if they want to look at other proposals. He asked if anyone was interested in listening to other alternatives. [ Ms. Joyce Swanson, 6601 Lucia Lane, stated she was not interested in rezoning. I The traffic is already bad. She stated she was not interested in an alternative that would create more traffic. Mayor Nee asked the audience to raise their hands if they were interested in an alternative One person raised his hand. Mr. Clarence �stated he lived in the area. The property owner does not live there. We are concerned about noise, pollution and safety. Our concern is not monetary--it is keeping Fridley residential. I Mayor Nee stated if there is negative action tonight the property owner does have the right to come back in six months. Mr. man asked Mr. Johnson for the names of realtors he had contacted who turned ` down building on the sites. Mr. -TQR&n stated Arlan Realty had stated to Mr.*Tema4'_"_ j that they would be interested in buying the property. He does not believe homes i could not be built there and he would like to see some evidence. _ Mr. Johnson stated he would send Mr. man copies of the letters he has. NEW BUSINESS: RECEIVING THE' PLANNING COMMISSION MEETING MINUTES OF AUGUST 9, 1978: 1. THOMAS SIGN COMPANY, SP #78-07; 5333 UNIVERSITY AVE. N.E.: I Mr. Sobiech, Public Works Director, stated this is a request for a special use permit by the petitioner to open a sign operation at this location. Now it is a j vacant facility and was formerly Metro 500 Tire Company. They do have a proposal to improve the area including both the structure and exterior. He showed the j Council the Architect's plan for the building. One of the stipulations is that there be an actual landscape drawing. The Planning Commission did hear the request on August 9th and did recommend approval with the stipulations. One of the stipulations was that an appropriate development bond or letter of credit be given to insure that the exterior development item be taken care of and that the materials will be stored within the screened area and a suitable agreement be negotiated regarding the rear alley and all the painting be done in an improved area. i I Mr. Sobiech stated that one item that might be confusing is regarding the alley. The alley is being used by residents to the east and could be used by the gas station and this facility. The City is indicating that if appropriate improvement is requested that the property owners would have no objection to the share of the assessments of any alley improvements. Also, he stated he would like to ask the , representative from the sign company if he would be willing to put up some posts or curbing by the screening fence in the alley so there would be no damage to the fence. • • 206 REGULAR MEETING OF AUGUST 21, 1978 PAGE 3 Councilman Schneider stated the original hearing on this was held on June 7th. People here were at the Planning Commission meeting. At that point everyone expected it to come up in July. It was postponed until now. He stated he does • j not believe that no one is interested in this property. He hoped Mr. Johnson could build on it as R-1. He stated his primary concern is preservation of the neighborhood. There has been adequate time to build on it. as R-1. He feels • the Council should take some action on it. The petitioner has a right to apply again. Mayor Nee asked what the waiting period was for reapplying. Councilman Schneider stated six months. MOTION by Councilman Schneider to accept the letters Mr. Smith had presented to the Council from William K. Meyer of Suburban Engineering dated June 28, 1978 and Oliver R. Erickson of Bronson Erickson Inc. dated August 16, 1978. Councilman I Fitzpatrick seconded the motion. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously. j I Mayor Nee stated he had received a letter from Mr. Russ Burris on August 21, 1978 and this should be included with the above letters. I I ' Mayor Nee asked if anyone would like to comment. i Mr. Clarence Inma , who lives on Lucia Lane, stated they wanted it to remain R-1. He stated any discussion of alternatives tonight would be inconsistent. We are here tonight to have the Council vote upon the request for a rezoning for a proposed restaurant site. We have not had time to prepare for any other proposals. Mr. Ed Haedke, 6540 Lucia Lane, stated Mr. Johnson knew when he bought it it was zoned residential. a Mr. Don Bolten, 980 Mississippi Street, stated the Council has done a good job in zoning in that area. All four corners are R-1. If we spot zone it, the i entire area might end up that way. We feel it is a nice single family area. } i f IJ • Mr. Joe Randall, lives at 1210, stated this has been discussed for many years. When we start rezoning, it confuses everyone. Mr. Smith stated along Highway 65 the whole length of the City there is only one parcel facing Highway 65 that is single family. Everything else has some other use. How can you call this spot zoning. We are not asking for the world. We want fair treatment by the staff. Certainly there is sone use for this property other than single family dwellings. Please refer this matter to your staff for a report. Give us a chance to see if we can convince the staff that this is a sound and sensible use with minimum harm or problem to the property owners. Councilman Schneider stated to Mr. Smith the people have to be convinced that the plan is a sound proposal for the neighborhood. At the Planning Commission meeting we discussed informally with Jerry Boardman about single family homes in ! the area. It,seems to me there is not very much single family property left in this City. Perhaps there are alternatives but at this point I do not see any. I Mr. Smith stated you are looking at it politically. You have been elected to abide by the best interest of the community. i Councilman Schneider stated before he was elected he was against the property being rezoned. He stated in his judgment he did not see any reason to make • an exception. He stated he had not been inconsistent with his past stand. I Mr. Paul Johnson, 3925 Shamrock Drive, stated he had lived in Fridley for many years. This was a vacant piece of property then and still is. He stated he didn't feel anyone should put little kids in the area of high traffic. He stated he owned the property north of there. An office building is a quiet use. Mayor Nee stated we have a procedural problem here. The proposal is to rezone to C-2 and in doing that the Council really loses control of what goes on. He stated he wants to see some hearing on it.
