Int I 7 7— v :. Planning Commission Meeting - April 25 , 1968 Page 6 The Engineering Assistant called attention to a discrepancy in the right of East River Road. The County originally took an additional 24 feet for East River Road . Back when Lorrie Johnson was interested in the property, the City asked for an additional 26 feet of right of way and described it as being part of the Block 22 . Since that time a survey was made by the County and the new alignment was made on East River Road creating an island of land 10 to 15 feet wide . Mr . Hirsch said the driveway easement and the strip between the driveway and East River Road belongs to the present property owners and they would like to see it aligned to their property . The Engineering Assistant said Anoka County has seen the discrepancy and may ask that it be cleared up because it is torrens property . The original intent was at one time for a 50 foot wide service drive . Since that time , service drives for East River Road have not been talked about , therefore , perhaps the Right Of Way could be reduced to the amount needed for turn lanes . It was decided that Mr . Wormsbecker should return with more information. 3 . REZONING REQUEST : ZOA #68-09 , LARRY DEAN FERGUSON : Lots 1 and 2 , Block 3, Gunderson Terrace . Rezone from R-1 to R-3 . MOTION by Erickson, seconded by Jensen, that the Planning Commission set the date of June 13 , 1968 for the public hearing of ZOA #68-09 , LARRY DEAN FERGUSON: of Lots 1 and 2 , Block 3 , Gunderson Terrace to be rezoned from R-1 to R-3 . Upon a voice vote , all voting aye , the motion carried unanimously. 4 . HYDE PARK ADDITION ,/ZONING PROBLEM: Chairman Hughes said the attention of the Planning Commission was -called to the editorial which appeared in the Fridley Sun on April 24 , 1968 in which the editor spoke favorably of the action to delay zoning of the land in the Hyde Park Area . Mr . Myhra said that since the time of Council ' s final action on Mr . Schmedeke 's petition , very little action has been taken, and that it is time for the Commission to consider the approach that we should be taking in this matter as to recommending a course to the council . He said the Commission should continue to recommend to the Council that they feel a need for professional help and guidance ask if Planning Commission Meeting-April 25 , 1968 Page 7 there is the possibility, in the- near future , of getting help from a City Planner? The Engineering Assistant informed the Commission that Council has asked the Engineering Department and Planning Commission to restudy the area and with boundaries in mind between 2 1/2 Street and University Avenue , S7th to 60th Avenues as a possible commercial area and also to restudy the traffic flow pattern that should be setup. The drafting department is working on existing structures and location of utilities in the area . Mr . Erickson said he did not believe that the Planning Commission has the time or knowledge to go through a comprehensive study of the area and he would like to request the Council if the hiring of a professional planner is not iminent , to reconsider the Planning Commission acceptance of the service of a Planning Consultant such as Nason, Wehrman, Knight and Chapman, Inc. The Chairman continued that if the availability of a permanent planner for the City is to be delayed by even one or two months , that it would be desirable thing to have a temporary planner ' s help during that period. The estimate that Nason, Wehrman, Knight and Chapman , Inc . for completion of the study for the Hyde Park Area was two months . It has been now a month since final action on the Schmedeke rezoning petition which leaves only five months before a new application can be made . Mr. Myhra said he thought that the editorial was quite right in noting also that the property owner does deserve getting this thing accomplished as quickly as he can . MOTION by Jensen, seconded by Erickson , that the Planning Commission request information from Council relative to the time schedule for hiring a staff planner so that the Planning Commission would be able to better estimate the task of considering the Hyde Park Area and if, in the opinion of the Council , the hiring of a staff planner is going to be delayed for longer than 30 days , the Council should reconsider the Planning Commission request for a temporary planner consultant . Upon a voice vote , all voting aye , the motion carried unanimously . ADJOURNMENT : The Commission adjourned at 10 : 00 P .M. to the Conference Room for the Study of the Proposed Zoning Code . Mr. Jensen explained to Mr. Loftsgaarden that the Commission could not give him much of an expression on the plan until an application were filled out and the request go through regular channels. It was felt there would be tremendous public opposition building residential and industrial together. There was no action taken. 11. LOT SPLIT REQUEST: L.S. #68-10, THOMAS E. MARXEN: South 138 feet of the North 306 feet of Lot 5, Auditor's Subdivision #108. Mr. Marxen was not present. No action. �( 12. CONTINUED: PUBLIC HEARING, REZONING REQUEST, ZOA #68-09,_ LARRY FERGUSON: Lots 1 and 2, Block 3, Gunderson Terrace. RezoneTrom R-1 to R-3. (See pages 1 and 2) Mr. Ferguson entered at 8:30 P.M. Due to an error, he received a public hearing notice with the wrong time and therefore he was not heard r by the Planning Commission. MOTION by Erickson, seconded by Myhra, that the Planning Commission inform the Council that due to an error, Mr. Ferguson received a public hearing notice with the incorrect time of the hearing and therefore, he was not heard by the Planning Commission, and further, that the Commission recommends to the Council that in considering the recommendation for the denial, that the Council take this fact into consideration. Upon a voice vote, all voting aye, the motion carried unanimously. 13. PLANNER FOR HYDE PARK AREA: The City Engineer explained that the Council authorized hiring a con- sultant for this area, and a letter has been received from Nason, Wehrman, Knight and Chapman, Inc. The Chairman read the letter from the consulting firm. Mr. Jensen said the time table should *be verified. MOTION by Myhra, seconded by Ylinen, that the Planning Commission request the firm of Nason, Wehrman, Knight and Chapman, Incorporated to go ahead with a Contract and that when it is received, the City Attorney check it. PUBLIC HEARING: REZONING REQUEST, ZOA #68-09 LARRY FERGUSON: Lots 1 and 23, Block 3, Gunderson Terrace. Rezone rom R-1 to R-3. The public hearing notice was read by Chairman Hughes. Mr. Ferguson was not present. Mr. Dale Hagen, 7478 Hayes Street: We have a petition which we would like read into the minutes of this meeting. This will sum up our wishes. The heading of the petition dated June 12, 1968 is as follows: We the undersigned property owners of single family dwellings and residents of the area in, around, and adjacent to Lots 1 and 2, Block 3, Gunderson Terrace, hereby petition the Planning Commission of the City of Fridley to deny the request (ZOA #68-09) to rezone the R-1 district to any other zone than R-1. That the undersigned represent the majority of the single family dwelling property owners in, around and adjacent to Lots 1 and 2, Block 3, Gunderson Terrace, and hereby voluntarily signify our objection to such rezoning requests and respectfully request the Planning Commission to deny such requests. There were thirty-one signatures. MOTION by Myhra, seconded by Ylinen, that the Planning Commission accept the petition requesting denial of the rezoning request, ZOA #68-09, dated June 12, 1968. Upon a voice vote, all voting aye, the motion carried. Virginia Conrad, 7440 Bacon Drive: Mrs. Conrad stated they did not care to have an influx of apartments. As far as D. W. Onan needing residences, there are still plenty of R-1 Districts. She did not think that apartment buildings built that close to private residences would be beneficial. Mike Svitak, 1381 75th Avenue: He stated he had not had the opportunity to sign the petition presented to the Planning Commission this evening and asked permission to do so. He opposed the rezoning. Henry G. Hamersma, 1405 Onondaga Street: When he built his house about a year ago, there were no apartments. If there had been, he would not have built. Planning Commission Meeting - June 13, 1968 Page 2 MOTION by Erickson, seconded by Myhra, that the Planning Commission close the Public Hearing of the rezoning request, ZOA #68-09, Larry Ferguson, of Lots 1 and 2, Block 3, Gunderson Terrace to rezone from R-1 to R-3. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Erickson commented that, obviously, this is pretty much of a single family area, and, at this particular time, he saw no reason to extend this type of zoning East of Central Avenue. MOTION by Erickson, seconded by Myhra, that the Planning Commission ' recommend to the Council denial of the rezoning request, ZOA #68-09, Larry Ferguson of Lots 1 and 2, Block 3, Gunderson Terrace to rezone from R-1 to R-3. Upon a voice vote, all voting aye, the motion carried unanimously. The Chairman said he agreed with Mr. Erickson's reasoning. The present use of the area is not an argument in favor of additional multiples in that area at all. He informed the audience that the recommendation of the Planning Commission is not binding, but the decision rests with the City Council. This recommendation will be forwarded to Council for their meeting on June 17, 1968. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. Carl Paulson said that on Item #2 (a garage setback variance request for his neighborhood) the Minutes were correct as he had attended the Meeting and that he had no objections. REZONING REQUEST, ZOA—#68-09 LARRY FERGUSON: Lot 1 and 2, Block 3, Gunderson Terrace. Rezone from R-1 to R-3 . It was pointed out by the Planning Commission in the Minutes that Mr. Ferguson was not in attendance at the Public Hearing before the Planning Commission due to a mix-up in time, and this fact was noted by the Council. The Petition in opposition to the rezoning request was then considered. PETITION NO. 13-1968 - FOR DENIAL OF REZONING R QE UEST ZOA #68-09 - LOTS 1 AND 2, BLOCK 3, GUNDERSON TERRACE, TO REZONE R-1 DISTRICT TO ANY OTHER ZONE THAN R-1 . MOTION by Councilman Harris to receive Petition No. 13-1968. Seconded by Councilman Liebl . Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried . MOTION by Councilman Samuelson to concur with the Planning Com- miasion 'in the denial of the rezoning request ZOA #68-09 by Larry Ferguson. Seconded by Councilman Harris. CARTER-DAY COMPANY REGISTERED LAND SURVEY RLS #68-03: MOTION by Councilman Harris to concur with the Planning Commission in their approval of the Registered Land Survey for Carter Day. Seconded by Councilman Samuelson. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. 6. VACATION REQUEST: SAV #68-03, HENRY G. SAFFERT: Lots 22A and 22B, Block 1, Lyndale Builders 4th Addition, for garage. The City Engineer explained that this request was for about 2 ' so his proposed garage could use about 18" of the land in question. There is a question of whether this can be done by resolution or must go through the usual channels as an Ordinance. Mr. Gibbs said he was not sure if a resolution would be sufficient. The City Engineer suggested if the Council concurs, then to go through the usual procedure. MOTION by Councilman Samuelson to concur with the recommendation of the Planning Commission for approval of the vacation of 2 ' requested by Henry Saffert. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. 7. PROPOSED PRELIMINARY PLAT. P.S. #68-04, BARTH ADDITION, MEWIN BARTH: Lots 16 and 17, Block 2, Spring Lake Park Lakeside. The City Engineer explained that this preliminary plat meets all miniolm requirements and if the Council concurs they could set up the Public Hearing for the final plat. MQTION by Councilman Harris to concur with the Planning Commission and set the Public Hearing date for the final plat on July 8, 1968. Seconded by Councilman Liebl. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried. 8. LOT SPLIT REQUEST: L.S. #68-12, CENTRAL SERVICE CO. , KEITH HOLVENSTOT, AGENT: Lot 15, Block 4, Bennett Palmer Addition. The City Engineer explained that Erickson wish to extend to the pgrt,h for more parking space. The split would be 24' on the south 4nd 26' on the north of the lot.
