LOT SPLIT APPLICATION PROCEDURE
1. Obtain application fors at City Hall (6431 University Avenue N.E.. Fridley).
2. Return completed application form with the required sketch of the property
involved and the lot split fee of 5100.00for each original lot being split.
3. The application will be checked over by Staff and the owner my be required
to submit a Certificate of Survey containing a simple description of a part
Of a platted lot or registered lot, along with the new parcels created with
all existing structures tied in.
4. The application will then be submitted to the Planning Commission for their
recommendation. The Planning Commission meets on the Wednesday following
the City Council meeting. which is generally the first and third Wednesdays
of the month.
5. The recommendations of the Planning Commission are submitted to the City
Council for final action. If a Certificate of Survey wasn't required before,
it will be required for this meeting. The City Council meets on the first
and third Mondays of the month.
6. The City Council approval may be subject to certain stipulations which must
be complied with by the applicant.
7. A letter will be sent to the applicant to notify him of the Council action
and to advise him to comply with the conditions imposed by the City. The
letter will also contain any necessary deeds for easements and other pertinent
papers for his signature.
8. When all the conditions of the lot split have been complied with. the applicant
should file the lot split in Anoka Countyr after the City Council has passed a
resolution.
9. In all cases where Council action has been sought and denied, no petition for
identical action can be presented until a period of six months has elapsed.
NOTE: THE RESULTING REAL ESTATE TAXES AND SPECIAL ASSESSMENTS FOR
THE NEW PARCELS IN TOTAL AFTER THE LOT SPLIT MAY EXCEED THE
AMOUNT ASSESSED TO THE ORIGINAL PARCEL. THE FINANCE DEPARTMENT
OF FRIDLEY MAY BE ABLE TO PROVIDE THE ESTIMATED AMOUNT OF

The City of Fridley Planning Commission will be holding an informal hearing

ON LAND SUBDIVISION
Date I
In determining fair market value of public areas for land subdivision for cash payment as
required by Ordinance #633, the following values will be used:
Residential Subdivision $1,500.00 per lot
Residential Lot Split $ 750.00 per lot
Commercial/Industrial Subdivision or Lot Split $ 0.023 per sq. ft.
This fee is to be paid at the time of final plat or lot split approval. The City Council
may defer collection to the time a building permit is requested for individual lots
created by such subdivision/lot split.
The City retains the option to accept an equivalent amount in cash from the applicant for
part or all of the portion required to be dedicated.
PARR FEE AGREEMENT
The undersigned understands that according to the City Plating Ordinance, the following
public park land dedication is required to plat residential , commercial or industrial
zoned property.
It is further understood that the public park land dedication or cash payment equivalent
is at the discretion of the City.
It is agreed that a cash payment of $X54, Lot will be paid according to the above stated

Gentlemen:
Pursuant to my secretary's telephone conversation with you,
please find enclosed herewith two Personal Representative 's Deeds
transferring the remaining property in Lot 2, Block 1 , Brookview
Second to J. A. Menkveld & Associates Inc.
Lot 2, Block 1 , Brookview Second was originally sold by Wallace
Miller to Menkveld by Contract for Deed in September of 1985. At
that time the lot was split into four parcels and this split was
approved by the City on October 2, 1985. The first two parcels
were transferred by Warranty Deed from Wallace E. Miller on
October 31 , 1985, and subsequently filed with the County.
On November 9 , 1985, and prior to the transfer of the remaining
two parcels , Mr. Miller passed away. We are now proposing to
transfer this property by Personal Representative's Deed to the
Menkvelds . I understand that because the transfer was approved
more than six months ago and these deed were not filed within the
six months time period allowed, that the City Council will once
again have to review this matter. I am also enclosing for their
information, copies of the original warranty deeds stamped
approved by the City of Fridley.
We would ask that the City Council reinstate the lot split and
stamped the enclosed Personal Representative's Deeds as
approved. The anticipated closing date is July 31 , 1986. We
would, therefore, appreciate your prompt attention to this
matter.

same being 6771-6781-6791-6795 Brookview Drive N.E.
Mr. Robinson stated the lot was located just to the west of Brookview Drive,
north of 67th and bordering on 68th Ave. This large lot was zoned R-1 as most
of the area is. He stated the proposal was to divide the lot into four single
family lots. Each meet the minimum of 75' lot width. The only variance needed
for the houses would be lot area. None are 9,000 sq. ft. If the Planning
Commission approves the lot split, they will automatically approve the variance
for the lot area.
Mr. Robinson stated Staff would recommend the following stipulations: (1 ) park
fees- 3; (2) the lot split be recorded at the County prior to any building per-
mits being issued.
Dr. Vos stated he would be very happy to see single family homes in this area.
The houses Mr. Menkveld is building now have improved the area tremendously.
MOTION BY MR. KONDRICK, SECONDED BY MR. WELLAN, TO RECOMMEND TO CITY COUNCIL

UPON A VOICE VOTE, ALL VOTING AYE, VICE-CHAIRPERSON OQUIST DECLARED THE MOTION

UPON A VOICE VOTE, ALL VOTING AYE, VICE-CHAIRPERSON OQUIST CLARED THE
PUBLIC HEARING CLOSED AT 9:02 P.M.
Mr. Oquist stated he thought they had gotten a little 1 t as to what this
public hearing was actually for. He was not sure they ere ready to discuss
what should be done with the park. They have gotten ome good input from
the consultants and some input from the citizens, b it was not a concensus
input because the citizens have not had the oppor nity to discuss this among
themselves before coming to a public hearing. H stated maybe the park issue
should go back to the Parks & Recreation Commi ion and then it can come
back to the Planning Commission when there is a concensus of the citizens as
to what they would like to see done in the rk.
Mr. Kondrick agreed. He stated this iss should come back to the Parks &
Recreation Commission where it belongs. The interest in the Parks & Recreation
Commission is to change the park from at it is into something that is more
usable and more fun for the resident Before this had all happened, the
Commission had wanted to have a pub c hearing at their August meeting. He
stated they would like to have tha public hearing and have the issue of the
preliminary plat continued until hey have gotten more input from the citizens.
Then they can come back to the anning Commission and City Council with
some recommendations as to wha can and should be done with the park.
Mr. Minton stated he suppor d Mr. Kondrick's concept of deferring this issue.
He felt both the discussio they have had at this meeting and the engineering
information was important but now it was important for this to go back to the
Parks & Recreation Commi sion in order to get some neighborhood input.
Ms. Gabel stated she lso agreed. She had been very confused with this whole
discussion.
MOTION BY MR. KOND CK, SECONDED BY MR. MINTON, TO TABLE PRELIMINARY PLAT,
P.S. #85-02, MEAD -LANDS PARK, BY THE CITY OF FRIDLEY, AND THAT THE ISSUE OF
PARK DEVELOPMENT AND DESIGN BE RESUBMITTED TO THE PARKS & RECREATION COMMISSION
FOR MORE INPUT.
Mayor Nee st ed the City Council was the only body that can authorize a replat,
and as far he knew, the City Council did not authorize the City to petition
for a repl t of public land. He stated that in order for the City to sell park
land, the City has to have a public hearing in order to find an excess. The
City Cha ter requires the City Council to have a public hearing to hear all
commen and find if there is an excess for the purposes for which the land was
donat . None of that has happened, and he did not know why the public hearing
on t e preliminary plat was before the Planning Commission. He had also thought
th public hearing was to discuss the park improvements.

Mr. Burch, Asst. Public Works D' ector, stated this is a request for a
special use permit to permit outside storage of equipment and materials
at 7773- 7779 Ranchers Road E. He stated the Planning Commission has
recommended approval of is request with the stipulation that the
petitioner work with e City staff for additional landscaping to be
completed by the f of 1985.
MDTION by Coun ' man Goodspeed to concur with the unanimous recommendation
of the Pl ' g Cormission-and approve special use permit, SP #85-05, with

Mr. Burch, Assistant Public Works Director, stated this request is to split
Lot 2 of Block 1, Brookv iew Second Addi ti on i nt o f our 1 of s to be use d f or
single family residences. He stated the Planning Commission recommended
approval with the stipulation that the three park fees be paid and the lot
split be recorded at the County before building permits are issued.
Mr. Burch stated the City would ask the petitioner cooperate with any
projects along 67th Avenue, as far as utility easements and assessments.
Mayor Nee questioned why the property was being split instead of platting
it. Mr. Burch stated it would be quicker to split the lot rather than plat
it.
Mr. Herrick, City Attorney, stated it seems to him the City's policy, in the
past, has been to require a plat except where someone had a parcel of land
and wanted to split off one building site. He stated he didn't recall where
a lot split was allowed of a parcel for four building sites. He stated,
haw ev er, he is not saying this cannot be done.
Mr. Qureshi, City Manager, stated the ordinance requires property can be
split if the legal description is simple. He stated, in this case, the lot
splits are quite easy to describe. He stated his only concern is that the
proper utilities are provided since there are no utilities to serve the two

middle lots. He stated in order to build on these lots, it would be
necessary for the petitioner to provide utilities, and also to obtain a
survey of the four lots in order to get exact dimensions.
The petitioner stated he was aware utilities had to be provided to service
the lots.
MOTION by Councilman Goodspeed to concur with the unanimous recommendation
of the Planning Commission and approve lot split, LS #85-05, with the
following stipulations: (1) three park fees be paid; (2) the lot split be
recorded at the County before building permits are issued; and (3) that
final dimensions of the lots meet City code. Seconded by Councilman
Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the
motion carried unanimously.
6-C. CONSIDERATION OF IDT SPLIT REQUEST, IS #85-06 LAND TO BE USED
FOR SINGLE FAMILY RESIDENCES, 4000 MAIN STREET N.E. , BY EVELYN
CORNELIUS:

Planning Commission recornnended approval with stipulations f payment of
the park fee; recording of the lot split at the County; and iral dimensions

Mr. Cbrnelius, the petitioner, stated he would like eliminate Parcel A
frau this lot split. Councilman Fitzpatrick aske if this was done, how
close the south wall of Mr. Cornelius' hane would to the property 1 i ne.
Mr. Cornelius stated it would meet the code r irements of ten feet. He
also stated he would like the park fee d erred until such time as a
building permit is issued.
MDTION by Councilman Fitzpatrick to co r with the unanimous recommendation
of the Planning Commission and a rove lot split, LS #85-06 with the
following stipulations: (1) park ee becomes due and payable if and when
there is a building permit issue on Parcel B; (2) the lot split be recorded
at the County before any buil ' ng permit is issued or prior to October 15,
1985; and (3) the final d' ensions of the lot split meet City code.
Seconded by Councilman Ba tte.
Mr. Qureshi, City Ma . r, advised Mr. Cornelius that if the park fee is
deferred, the cost be different in the future in comparison to what he
would pay now. . Cornelius stated he wasn't worried as he wouldn't be the
one building on e lot.
UPON A VOI VOTE TAKEN Q4 THE ABOVE MDTION, all voted aye, and Mayor Nee
declared e motion carried.

completed by the fall 985.

Mr. Burch, Assistant Public Works Director, stated this request is to split
Lot 2 of Block 1, Brooke iew Second Addi ti on i nt o f our 1 of s to be use d f or
single family residences. He stated the Planning Conr^,ission recorrc,ended
approval with the stipulation that the three park fees be paid and the lot
split be recorded at the County before building permits are issued.
Mr. Burch stated the City would ask the petitioner cooperate with any
projects along 67th Avenue, as far as utility eascinents and ass�essnent.s.
Mayor Nee questioned why the property was being split instead of platting
it. Mr. Burd, stated it would be quicker to split the lot rather than plat
it.
Mr. Herrick, City Attorney, stated it seems to him the City's policy, in the
past, has been to require a plat except where someone had a parcel of lard
and wanted to split off one building site. He stated he didn't recall where
a lot split was allowed of a parcel for four building sites. He stated,
how ev er, he is not saying this cannot be done.
Mr. Qureshi, City Manager, stated the ordinance requires property car, be
split if the legal description is simple. He stated, in this ca s_, the lot
splits are quite easy to describe. He stated his only concern is that the
proper utilities are provided since there are no utilities to serve the two

re-oessary for the petitioner to provide utilities, and also to obtain a

Mr. Cornelius, the petitioner, stated he would ke to eliminate Parcel A

Mr. Cbrnelius stated it would meet the requirements of ten feet. He
also stated he would like the park a deferred until such time as a

MOTION by Councilman Fitzpatrick o concur with the unanimous recommendation
of the Planning Commission d approve lot split, LS #85-06 with the
following stipulations: (1 rk fee becomes due and payable if and when
there is a building permi issued on Parcel B; (2) the lot split be recorded
o at the County before ilding permit is issued or prior to October 15,
1985; and (3) the f 1 dimensions of the lot split meet City code.
Seconded by Council Barnette.
Mr. Qureshi, Manager, advised Mr. Cornelius that if the park fee is
deferred, th cost may be different in the future in comparison to what he
would pay Mr. Cornelius stated he wasn't worried as he wouldn't be the
one buil ng on the lot.

WHEREAS, The City Council approved a lot split at the August 5, 1985 meeting;
and
WHEREAS, such approval Was to split Lot 2, Block 1, Brookview Second Addition
into four lots, two 75.04 foot lots, one 82.04 foot lot and one 81 .23 foot lot
to be used for single family residences, the same being 6771-6781-6791-6795
Brookview Drive N. E. ; and
WHEREAS, the City has received the required Certificate of Surveys from the
owner; and
WHEREAS, such approval will enable the owner to sell Lot 2, Block 1, Brookview
