1989 POLICY STATEMENT ON PARK FEES
ON LAND SUBDIVISION

In determining fair market value of public areas for land subdivision for cash
payment as required by Ordinance #633, the following values will be used:
Residential Subdivision $1,500.00 per lot
Residential Lot Split $ 750.00 per lot
Commercial/Industrial Subdivision or Lot Split $ 0.023 per sq. ft.
This fee is to be paid at the time of final plat or lot split approval. The City
Council may defer collection to the time a building permit is requested for
individual lots created by such subdivision/lot split.
The City retains the option to accept an equivalent amount in cash from the
applicant for part or all of the portion required to be dedicated.
PARK FEE AGREEMENT
The undersigned understands that according to the City Platting Ordinance, the
following public park land dedication is required to plat residential, commercial
or industrial zoned property.
It is further understood that the public park land dedication or cash payment
equivalent is at the discretion of the City.

A meeting was held at 4:00 p.m. on March 27, 1989, at the City offices to
discuss the above referenced project. Present at the meeting were:
Jock Robertson, Director Community Development, City of Fridley
Barbara Dacy, Planning Coordinator, City of Fridley
Naeem Qureshi , Progressive Consulting Engineers, Inc.
Reviewed new site plan with the City. The City wants Target to maintain
visual screening for the residents north of 73rd. However, the 200' set
back can be used for ponding.
The EAW may be needed to be resubmitted for processing. PCE will conduct
run off calculations to determine if run off changes substantially. Barbara
will discuss with the Environmental Quality Board the changes and get their
reaction. If EAW needs to be readvertised for 30 days comment period, do it
after May 3rd.
Preliminary plat approval process will need a new application and
notification to all property owners within 350 feet of the project.
Deadline for application is April 4th for May 3rd Planning Commission
meeting. Send 8 1/2" x 11" reduction of preliminary plat and site plan with
the application to Barbara Dacy.
Date for vacation of Able Street has been extended. The City will redo the
estimate for costs of bike path. Put the bike path between the two holding
ponds. Send copies of plans to the City for review and approval .
Fire lane will need a turn around at the end.
Special use permit for equipment storage will be required. Show on a plan
the areas of storage and type of equipment which will be stored and
screened.
Jack Robertson suggested that we have a neighborhood meeting. The City can
supply a list of residents within 350 feet of the property.

is planning a 746,000 square foot expansion to the existing Northern
Distribution Center located at 73rd Avenue N.E. and Central Avenue.
We would like to invite you to attend an informational meeting to learn
about our proposed plat for the use of this property at 7:30 p.m. on
Tuesday, April 25th at the Community Education Center library located at
6085 7th Street N.E. in Fridley.
We are planning to use this site in accordance with its current zoning.
We have applied to Fridley for plat approval . We are working
cooperatively with your city officials to develop this project.
Our proposed development plan includes the following:

truck and car parking spaces in a professionally landscaped -
environment.
2. We will save most of the existing mature trees in the 200 feet

3. We have agreed to give the City of Fridley a public bike trail
easement across the entire northern boundary of our site. The
public bike trail will extend to Locke Park along the western edge
of the property.
4. Truck traffic to the site will be routed through the existing entrance
and guard facility off of Central Avenue, one block south of 73rd
Avenue N.E.

Dear Mr. Flora:
Attached please find a preliminary grading plan and a set of runoff
calculations for the site. We have also included a set of original
calculations for the site plan approved in 1987.
The runoff calculations show that there is a small increase in the
runoff over those completed in 1987. This is a result of a slight
increase in the building and parking area. In 1987 the areas were 14.32
acres and 11.86 acres respectively. Presently the areas have been
increased to 15.06 acres and 15. 14 acres respectively. The holding pond
has been enlarged to accommodate the additional runoff such that the
amount of run off leaving the site is the same as in the 1987 site plan.
We feel that the runoff increase is minimal and does not warrant
reconsideration of the EAW. A negative declaration on the EAW was
resolved by the City Council on August 18, 1987.

This is to confirm that the City Council at the May 15, 1989
meeting established June 5, 1989 as the public hearing date for the
final plat for the Target Distribution Center. Given Target' s
recent decision to plat the property into one lot and to attach the
buildings, it is necessary for you to transmit a revised plat and
site plan for the June 5, 1989 hearing. Please submit three full
size copies with an 8 1/2" x 11" reduction.
If there have been any amendments to the landscape plan, we would
also request to receive a copy of it so that our staff report can
reflect the most accurate and up-to-date proposals for screening
the property. This will also help resolve the Council ' s concerns
about the issues that the neighborhood residents raised.

They found the project as planned to be in accordance with the Rules & Regulations and Guide-
lines of the District and therefore approved the permit as requested, with the following ad-
ditional stipulations: No additional stipulations.
NOTE: Failure to implement and maintain the sediment-erosion control and cover establishment
measures outlined in the permit exhibits may result in forfeiture of your cash surety. If
such measures are satisfactorily provided, the cash surety will be returned with interest
after permanent vegetative cover has been established. Please notify the District Office
in writing when permanent vegetative cover has been established and a final inspection will
be made.
It is the responsibility of the Perniittee to provide all measures necessary to positively
contain sediment on the site during construction. This may require the use of erosion
control measures not outlined on the erosion control plan. If this requirement is not met,
the Permittee may be ordered to provide additional erosion control measures if deemed neces-
sary by the District Inspector. It is also the responsibility of the property owner to pro-
vide whatever maintenance is necessary to assure that the stormwater management systems ap-
proved as part of this permit will continue to function as originally designed.
A followup inspection will be conducted at the project site to assure compliance with all
agreements, terms and/or stipulations to this Permit. Failure to comply with the foregoing
may result in rescission of the Permit, and is in violation of Chapter 112.89 MSA, a mis-
demeanor.
This document is not transferable, and is valid for one (1) year after the date of issuance.
No construction is authorized beyond expiration date. If Permittee requires more time to
ccuplete construction, a renewal of the Permit will be necessary.
Please contact us at 483-0634 when the project is about to comrence so an inspector may view
the work in progress. Permittee has paid for 2 inspections: one at project commencement and
one at completion. Any additional inspection requested or required will be billed at $15/visit

SUBJECT: Target Northern Distribution Center
We have received a letter from the Engineer and the Contractor for
the construction of the Target Northern Distribution Center south
of 73rd Avenue and west of Highway 65. In their letter, they are
requesting the use of 73rd Avenue as a circuitous route for their
trucks which will be hauling in fill to the site and hauling out
waste material commencing on August 1 and continuing through the
middle of November hauling during the 8 : 00 a.m. to 5: 00 p.m.
period.
Based upon their proposed route and schedule, they will be adding
a considerable amount of truck traffic in a westbound direction
during the day period. Their proposed schedule should not
adversely impact the morning or evening rush hour periods.
It would be my recommendation that we allow the Target contractors
to utilize 73rd Avenue as a hauling route for development of the
property. We would require the Contractor to be responsible for
sweeping the street and keeping it in repair during this period.
Unless the Council has some concerns, I will prepare a letter
indicating concurrence with their proposed plan.

Dear John:
This letter will serve as a follow-up to my meeting
with you and Larry Rogers of Glenn Rehbein Excavating
on July 18 , 1989 . In that meeting, we discussed the
flow of the truck traffic for the earthwork portion of
the Target Distribution Center project.
Due to the large amount of fill that has to be brought
to the site to bring it up to final grade, Rehbein
Excavating and Witcher Construction have been reviewing
the best truck flow patterns in order to expedite
construction. We would like to propose entering the
site off of Highway 65 along a temporary construction
road on Target' s property just south of the existing
building. The trucks would then exit the site near the
northwest corner of the property where the bike path
will be constructed. The trucks would then travel west
on 73rd Avenue to University Avenue. I have enclosed a
plan of the site showing the proposed traffic flow for
your review.
The bulk of the truck traffic for the earthwork will
start on August 1, 1989 , and continue through the
middle of November, 1989 . Rehbein Excavating expects
the first trucks to begin arriving at the site at
approximately 8 : 00 a.m. , and the last trucks would be
leaving the site at approximately 5 : 00 p.m.

We have received a letter request from Rehbein Excavating, Inc. ,
the contractor working on the Target Distribution site. They
desire to haul and spread the necessary fill material until 9 : 00
p.m. with equipment cool down to 9 : 30 p.m. during the month of
August and the first part of September.
As the majority of the work will be in the southern portion of the
property, it should not have a detrimental effect on the Melody
Manor neighborhood.

Our firm is working as a subcontractor for Witcher Construction Co .
for the construction of the new distribution center.
As the project progresses, it will be necessary to work some extended
hours to facilitate construction. We would anticipate operating
daylight hours which in the summertime extends beyond your 7: 30 pm
limit to around 9 : 30pm.
We anticipate continuing our truck hauling operation until around
8: 00pm, and we would then work on site spreading and compacting the
material until 9 : 00pm. With a cool down period for the machines
we would anticipate that the site would be quiet by 9 : 30pm.
The majority of the extended hours for work will occur in the month
of August through the first part of September . We request that you
grant us a noise permit for the extended hours. Please give us a call
if you have any questions or need clarification.

Enclosed are copies of the Target site plans that we received
during the planning process and copies of the grading plan and
landscaping plan that we received as part of the grading permit
approval.
The first enclosure, identified by red letter A, is the site plan
submitted as part of the plat process. It indicated a 240 foot
setback from the front property line along 73rd Avenue to the
proposed parking area.
The second enclosure, identified by red letter B, is the site plan
that was submitted for the grading permit approval. A portion of
the parking area was moved 30 feet to the north in order to
compensate for a portion of the parking area which was deleted in
order to make extra room for a larger ponding area in the northwest
corner of the site (254 foot dimension) .
The third enclosure, identified by red letter C, is a 8 1/2" x 11"
reduction of the grading plan for the site. Outlined in dark green
is the existing tree line. Colored in red is the new Jackson
Street entrance. Colored in blue are the proposed detention ponds
and wetland areas. Colored in yellow is the proposed bike path.
The fourth enclosure, identified by red letter D, is an enlargement
of the grading plan along 73rd Avenue. Because of the xeroxing,
these plans have no scale. However, I have identified approximate
dimensions of the existing limits of the trees and where the limits
of grading will occur. You will note that in the area of the
extreme northwest corner of the site where the baffled weir is,
trees were removed to install this drainage control mechanism. The
second cut in the tree line is for the bike path and the next cut
in the tree line is for Jackson Street, which is identified in red.

Finally, enclosed is the preliminary landscape plan for the
property. You will note that the landscape plan identifies the
large ponding areas that were required by the Army Corp of
Engineers in order to recreate wetland areas on the site. I have
labeled on the plan the groups of evergreens that are proposed to
be installed on the property. In the key of the plan are the
species name and their height at planting.

Dear Mr. Qureshi:
This is to confirm that City staff completed its site plan review
of the Target Northern Distribution Center expansion along 73rd
Avenue N.E. in Fridley. As part of this review, you have already
received a land alteration permit from the City. Other items that
will need to be addressed at the time of application for the
building permit are as follows:
1. Submission of a final landscape plan.
2 . Submission of an underground irrigation plan.
3 . Payment of the $120, 000 for relocation of Able Street.
4. Resolution of the park dedication fee.
5. Prior to building permit issuance, Target shall execute a
petition and waiver of hearing for the public improvement
project on 73rd Avenue.
6. A 15 foot bikeway/walkway easement shall be submitted for the
bikeway/walkway along the west side of the property, and
depending on the Army Corp of Engineers interpretation, a 25
foot roadway/bikeway/walkway easement shall be submitted along
73rd Avenue.
7. The two tax parcels shall be combined into one tax parcel.
8. Compliance with the recommendations of the building inspector.

Anoka County has reviewed the staked location of the
bikeway/walkway in Locke Park. Ron Cox from the Anoka County Park
and Recreation Department has advised that the proposed alignment
is satisfactory. As we discussed in our meeting of last Thursday,
Target will prepare the easement across the railroad easement for
the bikeway. Target will also send the City a letter stating that
the bikeway/walkway will be rough graded. Given that the alignment
has been verified, you can now obtain the survey information into
Locke Park.

Dear Mr. Dowd:
This is to follow-up on our telephone conversation on August 4,
1989 regarding park dedication fees for the Target Northern
Distribution Center on 73rd Avenue N.E. in Fridley.
Section 211 of the Fridley City Code regulates the subdivision of
properties. Section 211 requires that either land is dedicated for
public purposes in the amount of 3% of the lot area or that a cash
payment park dedication fee be made in lieu of land dedication.
At the time that the original structure was built on the property,
the City did not charge a park dedication fee for commercial and

To use the dimensions indicated on the plat for the newly created
lot, the calculation of a park fee would be as follows:
The average distance of the north and south lot lines, which
equals 1,887 .065 feet x the average of the distance of the
east and west lot lines, which equals 1,247.535 feet, x $.023
per square foot. The total square feet equals 2, 354,179.6
square feet and the resulting park dedication fee equals
$54, 146. 13 .
Darrel Clark, Chief Building Official, has spoken with your
contractor regarding some of the other fees associated with the
foundation permit and the fees necessary for the building permit.

Dear Mr. Styrlund:
This is to respond to your transmittal dated August 21, 1989,
regarding the roof plan locating roof top units on the proposed
Target Warehouse expansion. I have reviewed the plans with the
Community Development Director. It appears from the materials that
you submitted to us that some of the units may be as tall as 4 ft.
11 in. It appears that the parapet height is approximately 1 1/2
feet. Given the location of the roof top units on the roof, a
person standing along 73rd Avenue would not see the roof top units.
However, persons in the neighborhood beyond 73rd Avenue may be able
to see the units if the existing trees were not located along the
south side of 73rd Avenue. It is my understanding that the roof
units will be enclosed by a box-like enclosure and there will beno
exposed units.
The intent of the ordinance is to screen the roof top equipment
from adjacent public view. It appears by the plan you have
submitted that this is achieved. Please review these comments and
contact me.

SUBJECT: Million Gallon Storage Tank Design
I have been in contact with Pat Dowd from the Target Corporation
regarding their fire safety requirements for their plant expansion
project located on the south side of 73rd Avenue.
Based upon the area that is to be added to their storage plant and
their fire insurance criteria, Target has an option of either
constructing an onsite water storage facility for fire protection
or to pay increased fire insurance costs for their facility which
they propose to complete in 1990.
As a means of reducing their costs and improving their overall fire
protection and operation of the Target warehouse, they are
interested in funding the location and design of the 1 MG storage
facility if it is to be located in the Locke Park area.
I have received the attached FAX indicating their interest to
support the design of the storage facility up to an amount of
$50, 000. 00.
Associated with the design of the water reservoir is their desire
to have the facility in operation in 1990. This, in essence,
requires the plans and specifications to be aggressively prepared
and a contract awarded in January of 1990 in order to allow for
completion by October of 1990.
Recommend the City Council receive the contribution from Target for
the design of the 1 MG reservoir and authorize the execution of a
design agreement with HNTB for the 1 MG reservoir in the Locke Park
area.
I also recommend you consider the possibility and the impact of
funding and constructing the 1 MG reservoir in 1990.

This is to confirm our conversation regarding the City' s five year
capital improvement plan which includes the construction of a one million
gallon reservoir at the Locke Park facility at 69th and University.
It is our understanding that the current planning would call for the design
of the tank in 1991, construction in 1992, and final painting/operation in
1993. This would be 2+ years after Target occupies its expanded facility
In January of 1991.
This capital improvement is necessary to ensure Target that adequate City
water supply and distribution is available to protect our major distribution
facility at Fridley.
Target desires that the City of Fridley accelerate this schedule and make
any and all reasonable efforts to have the new reservoir in service by
January of 1991 when the expansion is occupied.
To support this effort, Target has agreed to pay the design fees, to a
maximum of $50,000, such that this work can begin immediately. The City
of Fridley, in turn, would do what is necessary to allow construction of the
tank to begin in early 1990 such that the tank can be painted and put in
service by January of 1991.
Could you advise us of the timing and action required to accelerate the
construction of this new reservoir.

Dear John:
Target has offered, and the City Council has accepted, to advance to the
City of Fridley the $50,000 design fee for accelerating the construction
of a 1 mg. water reservoir in the Locke Park area.
This agreement to provide to $50,000 is based on the City' s ability to
move forward and complete this project in 1990, with the only risk being
the ability to complete the painting of the structure prior to the winter
weather in late 1990. Your estimated schedule was to bid the work this
December and award a contract for construction in January of 1990.
This reservoir is extremely critical to Target to be assured that we have
adequate and reliable water sources and distribution systems to protect
this major facility. Fire damage or loss to this facility would drastically
affect our ability to service all of the Target Stores in the upper-
midwest. We feel the City of Fridley will do what is required to put
this new reservoir into service by January of 1991.
Enclosed is Target' s check for $50,000 to fund the design fees. Should the
construction of the reservoir not be funded for 1990 construction, Target
would expect these design fees to be refunded in 1991 , when the funds for
design would have been available under the normal five year City Capital
Improvement Plans.
Please keep us advised of your progress. Our thanks to you and the City
of Fridley for making this happen.

I spoke to Larry Hoekstra, owner of 841 - 73rd Avenue N.E. ,
Fridley, about our conversation on May 10, 1990 regarding whether
or not additional evergreens could be planted in the area directly
across from his property. I advised them that your landscape
architect did not want to install evergreens in this area due to
the wet soils. I stated that you would determine whether or not
relocation of evergreens from other areas in the site could be
accomplished, such that they could be planted nearer 73rd Avenue
N.E. so that wet soils could be avoided.
I am forwarding a copy of this letter to Mr. Hoekstra, and told him
that I would obtain a written response regarding this matter. Mr.
Hoekstra is concerned about the winter-time view from his property
into the site.
I appreciate your cooperation, and would appreciate a response at

Chapter 5, Section 505.2 of the 1994 Uniform Building Code states that the area of any one or
two story building of Group B, F Division Building 1 or 1, M, S Division 1, 2, 3, 4 or 5, and
H, Division 5 occupancies shall not be limited if the building is provided with an approved
automatic sprinkler system throughout as specified in Chapter 9 and entirely surrounded and
adjoined by public ways or yards not less than 60 feet in width.
It is my interpretation of Section 505.2 that the 60 foot yard requirement shall be within the lot
on which the building is located. Any future expansion of the Target Distribution Center will
have to conform to the requirements of the State Building Code for 'Buildings of Unlimited
Area".
The Kwik File/Carter Day buildings will not be allowed to expand their building area until the
provisions of the unlimited area section of the building code are met. A 60 foot yard on all
sides of the buildings will have to be provided and maintained.

Ms. Dacy stated the property is located west of Highway 65, north
of Locke Park, and south of 73rd Avenue. The property is zoned M-
2, Heavy Industrial.
Ms. Dacy stated the petitioner is requesting to plat its 76-acre
property into two parcels. The eastern lot will contain the
existing Target facility, and the western lot will contain the
proposed warehouse expansion.
Ms. Dacy stated that in 1984 when Target was contemplating this
building expansion, they applied for a vacation to vacate Able
Street. In order to vacate the right-of-way, Council conditioned
their approval upon Target entering into a street relocation
agreement to relocate Able Street to provide access to Locke Park
and construct a building. At that time, the current access to
Locke Park was not constructed. In the lapse of time between 1984
and the present, the County constructed the current entrance.

There is now no longer a need for a street entrance into Locke
Park; however, the City still wants to maintain a bikeway/walkway
access into the park.
Ms. Dacy stated in 1987, the petitioner completed an Environmental
Assessment Worksheet (EAW) process with the City. The City Council
approved the EAW in August 1987 . Through that EAW process, it was
noted that the wetland area located approximately in the center of
the property was subject to the jurisdiction of the Army Corps of
Engineers. The petitioner subsequently found out they had to
revise their site plan and receive an Army Corps of Engineers '
permit. The result of their work with the Army Corps is to
actually move the parking area out of the wetland area to preserve
it and recreate a wetland area in the area where the original
building expansion was to be located. The revised site plan, in
conformance with the Army Corps, relocates the parking area further
to the west and on the western side of the building.
Ms. Dacy stated the item being acted on at this meeting is for a
preliminary plat to divide the total acreage into two lots with the
new lot line being moved 33 feet to the east from the easterly
right-of-way line of Able Street. So, the current building exists
on Lot 1 and the proposed building will extend into Lot 2 . The
proposed site plan locates the proposed building less than ten feet
from the existing building. City ordinance requires a 20 foot side
yard between the lot line and the building. However, the ordinance
also states that no side yard is required if a common wall is
provided between the two buildings which meet the requirements of
the building code. If the buildings are separated, the building
code requires 120 feet of separation. This issue should be
resolved prior to final plat consideration by the City Council, and
the site plan and plat amended accordingly.
Ms. Dacy stated the petitioner is requesting to relocate the
bikeway/walkway access along the west lot line and meander it
through the two detention ponds on the northwest corner of the
site, connecting it to the proposed bikeway/walkway along the south
side of 73rd Avenue.
Ms. Dacy stated that regarding the grading and drainage issues, the
proposed building is 82 , 075 sq. ft. which is larger than the 1987
proposal . However, the overall impervious surface for building a
parking area has only increased by 1.7%. The entire runoff from
the site will be directed into two detention ponds in the northwest
corner of the site. The wetland area will remain as is and a
wetland area will be recreated in the center of the site.
Ms. Dacy stated the petitioner conducted a neighborhood meeting,
and some traffic concerns were raised by the neighbors. The City
has plans for the improvement of 73rd Avenue in 1991 from two lanes
to four lanes. The improvement plan shows an expansion of the

pavement to the south side (Target side) by 10 feet. There will
be no alteration of the existing frontage road or the existing
north side of 73rd Avenue. The City can complete the pavement
expansion and curbing within the current right-of-way; however, the
proposed bikeway/walkway will have to be constructed in an easement
which staff is recommending be reserved on the Target property.
That will necessitate the removal of some brush and smaller trees
along 73rd Avenue; however, there a 200 ft. setback will still be
maintained from the right-of-way to the edge of the proposed
parking area. Trees will be removed to recreate the wetland in the
center of the site; however, a 100 ft. setback will be maintained
from the new recreated wetland to the south right-of-way line. The
buffer of existing trees will remain.
Ms. Dacy stated the neighbors were concerned about the new entrance
onto 73rd Avenue opposite Jackson Street. The petitioner has
indicated this entrance will be used only as an emergency entrance
if the current access from the Highway 65 service road is picketed
or if there is a strike. Staff is recommending as a stipulation
that this entrance be used only in an emergency situation. This
new entrance is opposite the Jackson Avenue intersection on the
north side, and the neighbors were concerned about the direct view
looking south from Jackson. The petitioner has indicated to staff
that they are revising the landscaping plan to provide a planting
screen to block the view into the property and they will replace
trees that are lost due to the construction of the entrance.
Ms. Dacy stated employees and truck traffic will increase as a
result of the proposed expansion. There will be 530 employees
entering and leaving the site. Truck traffic is expected to
increase from 160-180 trucks per day to an estimated 220 trucks per
day using the Highway 65 entrance. The increase in traffic from
the employee access should not adversely affect the traveling
capacity of 73rd Avenue.
Ms. Dacy stated three building expansions are proposed. The major
one totals approx. 570, 000 sq. ft. , another expansion onto that to
the west of 86, 000 sq. ft. , and a 91, 000 sq. ft. expansion on the
northeast corner. The petitioner has provided adequate parking
spaces to meet the code requirements for warehouse and office
purposes.
Ms. Dacy stated staff is recommending approval of the preliminary
plat, PS #87-05, with the following stipulations:
1. The lot line shall be located between the two parcels,
such that either the required setback is maintained
between the lot line and building, or the proposed
expansion is connected to the existing building by a
common wall. The petitioner shall revise the site plan

and preliminary plat prior to final plat consideration
by the City Council .
2 . The petitioner shall receive approval from the Army Corps
of Engineers and the Rice Creek Watershed District prior
to grading the site.
3 . The petitioner shall submit a landscape plan prior to
building permit issuance.
4 . The petitioner shall convey a 15 foot bikeway/walkway
easement along 73rd Avenue and along the alignment to
connect to the 73rd Avenue easement. A bikeway/walkway
construction plan shall also be submitted for review by
the City.
5. Truck/trailer access shall be limited to the entrance on
the Central Avenue Service Road, except in strike or
emergency situations, where the entrance west of Able
Street may be used temporarily.
6. A special use permit application must be filed for
exterior storage on the property.
Mr. Barna recommended that the word "strike" be deleted in
stipulation #5.
Mr. Pat Dowd, Target Project Manager for Construction, introduced
Tom Whisenhunt, Director of the Project for Distribution who
represents the Distribution Center people; Raquel Rudquist, the
Project Architect; Naeem Qureshi, Civil Engineer; and Chuck Woods,
the Landscape Architect.
Mr. Dowd stated Target has been a member of Fridley for 20+ years.
Originally, Fridley was the Target headquarters for the entire
country. In Fridley, Target employs the most people than any of
the other cities around the country where they have stores or
companies, with the possible exception of Los Angeles. Currently,
the existing distribution services a five-state area in Western
Wisconsin, Iowa, Minnesota, North and South Dakota. Expansion of
the center has been contemplated since the early 19801s, but to
date, it was put off due to constructing facilities in other
states. They are really now operating out of five warehousing
situations in the Midwest--Plymouth, Mendota Heights, Bloomington,
DesMoines, and Fridley. They are now in the position where they
have to get into another warehouse base yet this year in order to
continue to operate. In order to service the stores in this five
state area, they need to consolidate under one roof, and that is
the reason for the replat petition.

Mr. Dowd stated they had brought along some boards and drawings
which might explain some of the traffic issues, the scope of the
project, etc.
Ms. Rudquist showed the landscaping plan. She stated there was
some concern from the neighbors about screening the view of the
parking area from Jackson Street, and they have located some
landscaping in that area to reflect that concern.
Mr. Barna stated he is concerned about the appearance of the south
side of the building. A 35 ft. block wall is not very pretty to
those viewing it from the park side.
Mr. Woods stated they will have plantings along that area and will
do what they can to soften that side of the building. They will
be using a combination of shrubs, flowering materials, and some
vines.
Mr. Barna stated he would like to see some definite plans to break
up the visual impact of that large building.
Mr. Whisenhunt stated they will have to maintain a fire lane down
the south side of the building. There are also some tall unsightly
power poles taller than the building, and access must be maintained
to those. So, while tall plantings might sound attractive, he did
not know how they would work in with the above factors.
Mr. Dahlberg asked why the plat was being requested, why the
division into two plats? His reason for asking was that if the
buildings are connected, then it is still a part of the primary
building on the site, so, technically, there might not be the need
to plat it into two parcels.
Mr. Whisenhunt stated he thought the issue was that when they drew
the building and drew the expansion, they drew out a concept
showing the two buildings standing off because they did not know
the footings. That 10 feet might have mislead the engineers into
thinking that they physically wanted to separate the building. He
believed Mr. Dahlberg is correct in that one large plat is really
what they want.
Mr. Dahlberg stated the combining of the two parcels with the
vacation of the street and the property that is gained by the
vacation into one large piece of property seems to make the most
sense.
Ms. Rudquist stated this would certainly be preferable to them.
Ms. Dacy agreed. She stated the combination might be the way to
go; however up until this point, she did not think staff had

received a clear indication as to whether or not the buildings were
going to be attached.
Mr. Dahlberg stated this should be resolved prior to the City
Council meeting.
Ms. Dacy stated the Planning Commission can approve the replat as
one or two lots. There would be no changes in the stipulations,
except stipulation #1.
Ms. Sherek stated she has a concern about the truck egress from the
Target plant. She stated she lives across Highway 65 and she
almost gets run over every morning about 7 : 00 a.m. by trucks on
73rd Avenue. She is curious to know if Target representatives have
any way of controlling the truck traffic to use Highway 65 to
Highway 10 or I-694 to 35-W instead of 73rd Avenue to 35-W. While
73rd Avenue is rated for that type of truck, when 73rd Avenue
enters Moundsview, it becomes more of a residential street. The
truck traffic is causing problems for the neighborhood and it is
not appropriate.
Mr. Whisenhunt stated Target certainly has a good relationship with
their carriers, and he would be glad to address this concern with
the managements.
Mr. Keith Bellefeuille, 7310 Jackson Street N.E. , stated his
concern is not only for the view from Jackson Street, but also for
the safety. He has lived here 10 years and has seen a lot of
accidents on 73rd Avenue. He would propose moving the entrance to
the parking lot as far west as possible.
Mr. Bellefeuille stated he would like to know what "emergency"
means and when they might expect that entrance to be used by
trucks, how often, and what control the City or anyone else has
over that.
Mr. Bellefeuille stated he would like to see the south side of the
building made of glass walls as opposed to block walls. Glass
walls seem to take on the color and light of its surroundings and
would make the building more "park-like" .
Mr. Whisenhunt stated the entrance on 73rd and Jackson which was
shown as proposed secondary truck entrance was changed after the
neighborhood meeting. They are now saying they will maintain the
existing secondary access close to Central Avenue, but the only
traffic going in and out of the entrance at 73rd & Jackson is
vehicular traffic to service the small building, and that entrance
will be heavily landscaped.

Mr. Dowd stated the entire truck circulation and trailer parking
area is a secured area, fenced in its entirety, and enters and
exits at one location with a guard at Highway 65.
Mr. Qureshi stated they are essentially extending the wetland area.
The Army Corps of Engineers wants them to compensate for the
wetland area lost for construction. There will be no change in
drainage in this area. They are creating another wetland or pond
so that all the water that comes off the parking lot and building
will go into the pond, then spill over into the existing pond, then
an outlet from the existing pond will go into the storm sewer on
73rd Avenue. The amount of runoff that is going to be allowed to
leave the site has to be maintained at its present condition. Any
excess water that will occur because of added paved area will have
to be stored in this pond, and that is the primary reason for
adding a pond. They are not changing the pattern or amount of
runoff from what is leaving the site now.
Ms. Rudquist stated that regarding Mr. Bellefeuille ' s suggestion
of a glass wall on the south side, they could make a presentation
of their ideas for the design of the south wall at the Council
meeting.
Ms. Pam Porchniak, 7305 Van Buren Street N.E. , stated the questions
regarding whether the entrance across from Jackson Street would be
used during a strike and what constitutes an emergency had not been
answered.
Mr. Whisenhunt stated any entrance is a "strikable" entrance;
however, he could not imagine anyone wasting time on the
73rd/Jackson entrance. The primary entrance is off Highway 65.
He would suggest stipulation #5 be deleted in its entirety. Once
they decided to keep their secondary entrance as it exists, then
this entrance became very minor.
Ms. Porchniak asked how the fencing would be landscaped.
Mr. Woods stated they intend to have lower scale plantings along
73rd Avenue to help screen the fencing, and they will have some ivy
plantings on the fence to soften the view.
Mr. Bob Lange, 189 Logan Parkway, stated he is also concerned about
the drainage.
Mr. Qureshi again stated that this development will not change the
amount of water leaving the site any more than it is now in its
undeveloped state.
Mr. Dick Pearson, 7231 Jackson Street N.E. , stated he is concerned
that the plantings along 73rd Avenue are sufficient to screen the
parking lot.

Mr. Pearson stated traffic is already heavy on 73rd Avenue. Adding
one lane each way will make it more difficult to enter 73rd Avenue
from Melody Manor, particularly at Jackson Street.
Ms. Dacy stated at this time there are no plans for a stop sign at
that intersection; however, they do have to meet certain standards
to make sure the street is designed in a safe manner.
Ms. Porchniak suggested Target consider staggered starting times
for Target employees. It might help alleviate some of the traffic
problems.

hearing.

Mr. Saba stated the plan looked like a well thought out plan, and
the expansion is definitely needed. Target has certainly tried to
address all the concerns of the neighborhood.
Mr. Dahlberg commended Target for their responsiveness to the
community and the neighbors. It is appreciated when a petitioner
has done their homework and taken the opportunity to find out the
neighbors' needs and concerns. His only recommendation is that the
plat be resolved before the Council meeting.
Mr. Barna suggested the first sentence in stipulation #1 be deleted
and that stipulation #1 read as follows: "The petitioner shall
revised the site plan and preliminary plat prior to final plat
consideration by the City Council. "
The Commissioners concurred with this suggestion.

Ms. Dacy stated this property abut Osborne Road on the north,
Commerce Lane on the west, and th University Avenue Service Road
on the east. The property is ned C-1, Neighborhood Commercial
District, and is surrounded b -1 and M-2 zoning to the south, C-
1 zoning to the southeast, v cant M-2 zoning to the northwest, and
C-2 and C-3 to the north.
Ms. Dacy stated five ariance requests were brought before the
Appeals Commission a d those were summarized in the staff report.
One of the varian requests was to reduce the size of parking
stalls from 10 x 20 ft. to 9 ft. x 18 ft. , and the Appeals
Commission app ved that variance.
Ms. Dacy s ated that if this proposed plan was not before the
Planning ommission and they were just looking at zoning issues,
staff uld probably recommend that this property, and probably the
C-1 operty to the south, be rezoned to C-2 . Given the way the

immediate area has developed, staff feels C-2 uses and regulations
are more appropriate than C-1 in this location.
Ms. Dacy stated the Appeals Commission raised some c ncerns about
egress and ingress to the site and whether there wou d be a traffic
problem leaving the site onto the service road and then onto
Osborne Road. At peak times, staff agrees tha stacking could
occur. Looking at the width of the driv ways, staff is
recommending the driveways be striped to allow a free right hand
turn on each of the exits, one lane in and tw lanes out onto the

Ms. Dacy stated staff is recommending approval of the rezoning
request, ZOA #89-01, by Jerome Far ell, with the following
stipulations:
1. Approval of the variance r quests request for the number
of parking spaces to be 35 spaces on-site, with cross
parking easements to pr ide 384 spaces.
2 . Compliance with the si a plan stipulations as recommended

Northern Distribution Center Addition
The City Council approved the Target Northern Distribution Center
Addition final plat on July 10, 1989 . A stipulation of approval
was that a 15 foot bikeway/walkway easement be reserved along the
south right of way line of 73rd Avenue. In a recent meeting with
representatives from Target, we determined that the City may need
up to 25 feet for adequate snow storage between the curb and the
bikeway/walkway. Target has agreed to convey the extra ten feet
for both roadway and bikeway/walkway purposes.
RECOMMENDATION
Staff recommends the City Council approve an amendment to the final
plat such that a 25 foot roadway and bikeway/walkway easement is
created along the south right of way line of 73rd Avenue.

Councilman Schneider stated he believed the idea of expansion of
the parking lot turn-around was to minimize cars stopping on
Gardena and dropping off children.
Ms. Dacy stated staff would prefer cars do not stop on Gar na and
there is the possibility of shifting the parking more t he north
and providing more landscaping.
Councilman Billings stated at the time the i was previously
before the Council, he was Chairman of the Pla ing Commission and,
as he recalls, there is not sufficient sp a to have an adequate
22 foot wide driveway on the east side the building.
Councilman Schneider asked Mr. Kad if they would be willing to
move the parking further to the rth.
Mr. Kader felt, at this poi , it would be a lot of expense. He
stated the parking areas n the middle of the lot are not near
neighboring property o ers. He stated they would like to plant
some trees by the fen a on their property and the Foco's property.
Councilman Schne' er asked Mr. Kader if they would be willing to
work with the F co's to come up with an acceptable plan. Mr. Kader
stated he ha no objection to meeting with the Foco's.

and epresentatives of the Islamic Center to try and work out a

Councilman Schneider asked the size of the restaurant. Mr.
DiMaggio stated it is 5, 600 square feet with Xarraement

Mayor Nee asked Mr. DiMaggio if he had an with the

affirmative and stated they would be located evelopment

Mr. Ed Kaspszak, 1317 Hillcrest Drive, s ed this sounds like a
good business, but his one concern is th traffic. He felt persons
patronizing this establishment would u e Old Central, rather than
Highway 65. He stated if persons lea all at one time, there will
be some problems and accidents.
Councilman Schneider stated the Council is aware of the traffic
issue and attempting to addre this with the redesign of East
Moore Lake Drive. He stated y business that locates in the area
would generate traffic.
Mr. Kaspszak stated 240 eople leaving the establishment at one
time does concern him.
Councilwoman Jorgen n stated the exits have been designed to
direct traffic ont Highway 65, rather than Old central. She also
stated internal s ' nage has been discussed with the shopping center
owners.
Mr. Kaspsza stated all he wanted was to call the Council's
attention t this issue.
No other persons spoke regarding this application for an on-sale
liquor icense.

dwelling unit.
Mayor Nee stated the Council could discuss the fea ibility and need
for staff to notify property owners when tena s are not paying
their water bills. He stated Mr. Zelevarov wo d be notified when
the Council discusses this item.

Mr. Joe DiMaggio and is wife, Barb, and restaurant consultant,
Larry Salley, were esent to address any questions from the
Council.
Mr. DiMaggio statg4 the restaurant they propose to construct would
be managed byhi business partner, George Vespa, and himself. He
stated they hav a similar establishment in Erskine, Minnesota and
the restauran is listed in the Minnesota Business Tourist Guide.

Ms. Dacy, Planning Coordin or, stated this item was tabled by the
Council at the last meeti to have the neighboring residents, Mr.
and Mrs. Foco, meet w th the Islamic Center representatives
regarding a screening an. She stated the two parties did meet
on May 18 and have sp ken to each other on the phone since that
meeting.
Ms. Dacy stated th Islamic Center agreed to construct a six foot
wood fence alon the east and north lot lines and install
vegetation on t eir side of the fencing over the next three
planting season She stated the Foco's indicated they would be
willing to rem o a the existing chain-link fence. She stated it was
agreed to hav a wood screen on the loading dock area. Ms. Dacy
stated the Foco's prefer construction of an eight foot fence in
certain area,s along the property line. She stated the Zoning
Ordinance tipulates a maximum fence height of four feet in the
front yar area and, in other areas, a maximum height of seven feet
for sing family residential districts.
Ms. Da stated another issue is the parking. She stated the
Islami Center has submitted a new proposal for parking. She
state there are currently 34 parking spaces on this site. Ms.
Dacy stated when this item was before the Planning Commission,

located on the southwest corner of 73rd Avenue and Highway 65. Ms.
Dacy reviewed the existing zoning adjacent to his parcel.
Ms. Dacy stated when this plat was submitted to the Planning
Commission, a 120 foot separation between the two buildings would
have to be provided to meet building code requirements. She stated
if a common wall is provided, no side yard is required between the
two buildings. She stated Target's plan is to attach the expansion
to the existing building to meet the code requirement. Ms. Dacy
stated the plat application has been amended to reflect this
change.
Ms. Dacy stated the Council received a site plan showing the
building expansion. She stated it is slightly different than the
plan submitted in 1987, as the preserved wet lands is in the center
of the property, and Target is working with the Army Corps of
Engineers and the Rice Creek Watershed District to obtain their
approvals. Ms. Dacy stated there has been no significant increase
in surface area and no need to re-analyze the Environmental
Assessment Worksheet.
Ms. Dacy stated a neighborhood meeting was held on April 25. She
stated the primary concerns were the improvements along 73rd Avenue
and whether the frontage road abutting the Melody Manor area would
be affected. She stated there will be an expansion of the pavement
along the south side adjacent to the Target property, however, the
improvement project will not alter the current width of the
frontage road. She stated there was also concern about the line
of sight from Jackson Street. Ms. Dacy stated Target is in the
process of submitting a landscaping plan to screen this entrance
with evergreens. She stated the primary access to the site will
be from the service road along Highway 65.
Ms. Dacy stated the Planning Commission recommended approval of the
preliminary plat subject to stipulations which she outlined.

variance to allow 45 percent coverage of the lot and submitted a
second variance which was denied.
Councilman Billings stated the City Attorney has expressed some of
the same concerns he has in regard to this request. a stated the
ordinance is fairly clear in this particular ar He stated if
he had to vote this evening, it would be for defiial , but wondered
if it would be more prudent to look at the o dinance to see if it
is still relevant. He stated this is otentially the second
business the City could lose because of the fact they are not able
to expand. He felt he did not wan overcrowding and building
against building, but perhaps the o inance should be reviewed.
Mr. Herrick stated one approac may be that the ordinance state
that not more than a certain percentage of the lot could be covered
by the building and parking ot. He felt it may not be a bad idea
to survey other citiet, to-Adetermine their requirements.
Mr. Burns, City Mana er, questioned staff if they recalled the
range of lot Covera allowed in previous variances.
Mr. Robertson, Community Development Director, stated as he
recalls, the ty has not granted a variance for 47 percent of lot
coverage.

with Target, it was determined the City would need a 25 foot
easement, rather than 15 feet, for street, bikeway/walking and snow
storage. She stated Target has no problem with dedicating this
additional 10 feet. Ms. Dacy stated this amendment would change
the easement from 15 to 25 feet for a roadway and bikeway/walkway.

Ms. Dacy, Planning Coordinator, stated this re qu st is for a
variance to increase the lot coverage from 40 to 47 is

allow the construction of additional warehouse an office space at
7855 Rancher' s Road. She stated the petitioner ans to expand the
building by adding another 7 , 700 square fee . Ms. Dacy stated
staff has identified two alternatives to the variance. She stated
the current 21, 000 square foot building occ pies 35 percent of the
lot coverage. She stated one alternative was to only add half of
the space or construct a two storyaddition with warehouse
facilities on the first floor and offic s on the upper level . She
stated because of these alternatives„staff is recommending denial

Ms. Dacy stated the Appeals Comm' sion felt the proposed addition

Mr. Guy Reithmeyer stated t company needs the warehouse space and
a smaller addition or a o story building would not meet their
needs. He stated the par ing on the site is well in excess of what
is needed. He stated a ditional landscaping will be provided and
a retention area to re eve pressure on the existing storm drainage
system.
Councilman Billin asked if Cortron was the owner of this

Mr. Herrick City Attorney, stated he felt this was a significant
variance a d if it was granted, it would set a precedent and make

future. He stated Elo Engineering had an almost identical request

Mr. Derrick stated if the Council feels they want to change the

A RESOLUTION APPROVING PLAT, P.S. #87-05,
TARGET NORTHERN DISTRIBUTION CENTER ADDITION
WHEREAS, the Planning Commission held a public hearing on the Plat,
P.S. #87-05, on May 15, 1989 and recommended approval; and
WHEREAS, the City Council also conducted a public hearing on the
proposed Plat at their June 5, 1989, Council meeting and approved
the Plat at their June 19, 1989, meeting; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City
of Fridley hereby approves the Plat, P.S. #87-05, with the
stipulations attached as Exhibit A, and authorizes the Mayor and
City Manager to sign the Plat as prepared by Clark Engineering
Company.
BE IT FURTHER RESOLVED that the petitioner is requested to record
this Plat at Anoka County within six (6) months or said approval
with become null and void.

TERNIINATION OF STREET EASEMENT AGREEMENT
This Termination of Street Easement Agreement dated as of
OC?O 8 E R 31 1990, is between MT Properties, Inc., a Minnesota
corporation, and Dayton Hudson Corporation (formerly Dayton-Hudson
Corporation), a Minnesota corporation..
RECITALS
1. Minnesota Transfer Railway Company and Dayton Hudson
Corporation entered into that certain Street Easement Agreement dated December
31, 1984 and recorded in the Office of the Registrar of Titles of Anoka County,
Minnesota on March 1, 1985 as Document No. 140224, whereby Dayton Hudson
Corporation was granted an easement over certain property owned by Minnesota
Transfer Railway Company, said property being more particularly described on
attached Exhibit A.
2. MT Properties, Inc. is the current owner of the property described
on Exhibit A and the successor in interest to Minnesota Transfer Railway
Company.
3. The parties now desire to terminate the Street Easement
Agreement.
NOW THEREFORE, the parties agree that the Street Easement
Agreement is hereby terminated and shall have no further force and effect.
IN WITNESS WHEREOF, the parties have executed this
Termination of Street Easement Agreement as of the date set forth above.
