(presumably to cover the settlement) PS 00-01 REQUEST Tim Jawor, petitioner, is seeking to create 7 separate lots from Lot 11, Block 1, Melody Manor, in order to construct a 6 unit owner occupied townhome complex at 7411 University Avenue. ANALYSIS In 1999, the petitioner applied for a plat and variance to build a 7 unit townhome structure on this property. These requests were denied due to the extent of the rear yard setback variance being requested. Staff has met with the petitioner on two occasions during this most recent application period to resolve as many issues from the past application as possible. With the current request, all variances have been eliminated. During the previous requests, there was some debate about how much brick should be placed on this building in order to maintain the character found along University Avenue. The petitioner did not want any brick, due to cost, while staff wanted enough brick on the building to architecturally tie the building together, maintain consistency with what the City has required of other developers, and blend this architecture with what surrounds it on the sides. This past week, the petitioner submitted two different elevations which show varying amounts of brick. The first option (Option A in the attachments) was submitted by the petitioner on March 28th. This is the option which most fully ties the building together architecturally and gives the appearance of being a four sided building. The second option (Option B in the attachments) was submitted on March 30th, by the petitioner. This option is much less desirable as it does not give the building a balanced look on all four sides. City staff recommends Option A, as this building will be highly visible for years to come due to it's location along University Avenue. RECOMMENDATIONS City Staff recommends approval of this preliminary plat request, with stipulations. This plat request will allow the proposed building to meet all code setback requirements. STIPULATIONS Staff recommends that the following stipulations be attached to the preliminary plat approval. 1. Grading and drainage plan to be submitted and approved by City's engineering staff prior to the issuance of any building permits. 2. Parking lot to be constructed to Code standards. 3. Amount of brick used on building shall resemble Option A (as attached), submitted on March 28, to give building a four sided finished appearance. 4. Code required fence shall be extended along the entire East side of the property. 5. All elements of the building must meet the current building code and be approved by the City Building Official. 6. Screening berm on West side of property must meet zoning code requirements for height. 7. Petitioner shall submit utility plan prior to issuance of any building permits. 8. Mr. Bolin stated that the petitioner,Timothy Jawor, Is seeking to create seven separate lots from Lot 11 , Block 1 , Melody Manor, in order to construct a six-unit owner-occupied townhome complex at 7411 University Avenue. This property is rezoned to R-3, which PLANNING COMMISSION MEETING,APRIL 5, 2000 PAGE 2 allows multi-dwelling complexes including rental and owner-occupied condominium type units. Existing identical apartment buildings are located on the south and north sides of the property. A church is located to the east and a mixture of commercial buildings are located across University Avenue. There are six lots for each of the units and the remainder of the property is the seventh lot. Mr. Bolin stated that in 1963, Mr. Ed Chies owned the property and obtained a building permit for an eight-unit apartment building, but he never constructed the building. In 1964, the City rezoned the property to R-2, which allows duplexes but not apartment buildings. In 1970, Mr. Chies sued the City to obtain his original building permit. A settlement was reached allowing R-3 standards to be applied to the property. In 1986, the zoning maps were accidentally drawn to show the property as R-3, but the property was never properly rezoned until the past summer. In 1994, someone proposed a seven-unit rental condominium project that required many variances, and the request was withdrawn. Mr. Bolin stated Mr. Jawor purchased the property last year and applied for a variance and replat to put in a seven-unit townhome project. The request was denied due to the variance for a rear yard setback from 40 feet down to 17 feet. By eliminating the seventh unit, the new proposal does not need any variances. Last June, the City rezoned the property to R-3 for the zoning maps to be consistent with the court settlement as well. Mr. Bolin stated that with the previous plat request, staff and the petitioner debated how much brick should be placed on the building. In the past week, the petitioner submitted two different elevations. Elevation option A is the option Staff feels most architecturally ties the building together and gives the appearance that all four faces are equally finished and would tie in with the buildings to the north and to the south. Both of those apartment buildings are over 30 years old but are in good shape due to the brick. Staff would like to see this building last as long as the buildings to the north and to the south. Option B, the petitioner's preferred option for brick, has only brick on the corners and a little bit on the north side in the two alcoves where the garage service doors are located. The brick is banded across both elevations. Staff recommends approval of the plat request with the following stipulations: 1. Grading and drainage plan shall be submitted and approved by the City's Engineering staff prior to the issuance of any building permits. 2. The parking lot shall be constructed to Code standards. 3. The amount of brick used on building shall resemble Option A (as attached), submitted on March 28, 2000, to give the building a four-sided finished appearance. 4. Ms. Savage asked if staff preferred option A because there is more brick. Mr. Bolin stated that was correct. Ms. Savage asked if the Christianson Crossing homes had brick. Mr. Bolin stated that all of the units had some brick. There are a few that do not have quite as much brick. The interior set of units is brick all the way around, has brick bollards, and is a reddish colored brick. Ms. Savage asked if the property has been vacant for a long time. Mr. Bolin stated that it has been vacant a long time. Ms. Modig asked if the seventh lot includes all of the area in front. Mr. Bolin stated that the seventh lot is all of the common property owned by the association. Ms. Modig asked how this green space is different than how it was proposed in 1999. Mr. Bolin stated that there is 23 feet more green space from the rear property line. Ms. Modig asked if that was by eliminating one townhouse. Mr. Bolin stated that was correct. The petitioner, Mr. Jawor, stated that the only concern he has is with stipulation #3 regarding the brick. One of the things they look at is cost. They thought option B was a good compromise. That is the one they intended to submit for the City. They were not required to submit building elevations for the site plan, and there was a mix-up with the architect who drew option A. They came to retrieve option A, but the City already had it. Option B has a lot of brick to go down in the front and back of the building. The back of the building is where the gas and electric meters and air conditioning units will be. There are planting areas in front of the brick areas where they will have shrubs. Those will be open to each individual unit to what they want for a planting area. PLANNING COMMISSION MEETING,APRIL 5, 2000 PAGE 4 Mr. Jawor stated that he and his partner talked about originally having most of the brick on the University Avenue side. Staff wants to have the building balanced. They agreed to put brick on the far end of the building that will be screened with a six-foot high fence from the church. Nobody will be able to see that, but it will balance the building. Staff has mentioned that they want the building to look the same down the road as it does now. The building is still part siding and part brick. That argument is really irrelevant. The siding is maintenance-free with vinyl aluminum siding and aluminum soffits. Some day that needs to be replaced. What they are dealing with here is what looks better. The brick is decorative. These are single-family owner-occupied homes. Most of those do not have brick all the way around them. The Rottlund homes across the street do not have brick on the back of the buildings. He is asking that they can look at option B. They are trying to avoid putting brick all the way across the building on the front and back. Ms. Savage asked what the color would be. Mr. Jawor stated that they have not picked out that color yet, but staff can make that determination. It will be a neutral brick type. Ms. Savage asked if he has any problem with any other stipulations. Mr. Jawor stated that he did not. Ms. Modig asked what the cost differential would be per unit with or without the brick. Mr. Jawor stated that the additional brick would run somewhere around $6,000, $1,000 per unit. Fridley requires the concrete curbing around the parking lot and sprinkler systems when many cities do not. These things add to the cost, and it does get a little expensive. Mr. Kondrick stated that the east-west elevations in terms of the brick are not an issue. Mr. Jawor stated that was correct. Mr. Kondrick asked Mr. Jawor if the "bone of contention" was with the south face of the building for the brick. Mr. Jawor stated that is the one side where the air conditioning would go so that is where the brick will not be seen. It is more labor intensive to add the brick to all of the edges. The small panels by the garage doors are probably as expensive as the larger panels in the back. Mr. Kondrick stated that there is very little brick on the garage door side from one option to the other. It is the other south side where the bone of contention is. Mr. Jawor stated that both of those long elevations face the apartment buildings as well. PLANNING COMMISSION MEETING,APRIL 5, 2000 PAGE 5 Mr. Kondrick stated he understands that. Are the air conditioning units going to be on the south elevation side or on the garage door side? Mr. Jawor stated the air conditioning units would be on the south elevation as well as the gas and electric meters. Ms. Johns asked if the air conditioning units would be underneath the patio part of the elevation or by the doors. Mr. Jawor stated that they would probably be underneath the decks against the brick panels. Ms. Johns asked if he looked at any other options as far as putting the brick into the building without running the full span. Mr. Jawor stated that there were other ideas that came up. His original plan included putting brick only on the University Avenue side. Staff wants it to be on both ends of the building to balance it. He wanted the brick to be on the backside by the church and the fence where nobody can see it, to balance the building. That is the point where they want to stop, but staff is recommending that they go front and back. Ms. Johns stated she would think that if he were to balance the building by wrapping the corners from the short ends of the building, that would make more sense than running along the whole exterior face. Coming from when you turn the corner, you can see the end of the buildings with the brick, but then all of a sudden there is nothing when you turn the corner. Mr. Jawor stated that was what they tried to do. They came around the corner two feet both ways and the soffit by the garage doors carried it up. Ms. Johns asked why there were windows in option B and no windows in option A. Mr. Jawor stated these elevations were drawn purely to show the brick and rooflines. The architect missed the windows in option A, but the windows will be there. Mr. Kuechle asked what color the garage door would be. Mr. Jawor stated that the garage doors would be painted to match the siding. It would be tan basically. Mr. Kondrick stated that he is an advocate of having more brick; however, he also understands Mr. Jawor's proposal. Supposing the brick was eliminated in option B underneath the six windows and the brick was carried on everywhere except for under the windows. He likes the north elevation just the way it is. Mr. Kuechle stated that in option B, the north elevation is really broken up with the garage doors and the outpost for the garage entrances. Putting those narrow pieces of brick in between the garage doors will not make it that visible. PLANNING COMMISSION MEETING,APRIL 5,2000 PAGE 6 Mr. Jawor stated that the parking area will be in front of those garage doors. Ms. Savage stated that the most visible part is going to be in the south elevation. Ms. Savage asked if anybody else in the audience wished to address this request. Mr. Jack Kirkham, a member of the church next door to the property, stated that he would like to see Mr. Jawor get a break. Option B looks a lot better than any of the duplexes that exist on University, and they would welcome the development of the property that has been vacant for a long time. They understand the savings if he can go without the brick and he believes that option B looks very nice. Mr. Lynne Hanson, owner of the building to north of the property, stated Mr. Jawor put together a good plan, and he hopes the City will approve it. He has been picking up garbage and junk on the lot for years and he thinks this will really improve the property. Mr. Kuechle stated that he wanted to discuss the brick issue and try to come up with some sort of plan. How would it be if they looked at a combination of options A and B and not including the area under the deck on the south elevation for the brick? How would it be to not to require any additional brick on the north elevation? Mr. Jawor asked if he meant no brick on the garage side. Mr. Kuechle stated that he meant no more brick other than what is shown on option B. The north elevation would stay as it is. Mr. Jawor stated that he would be agreeable to that. Ms. Savage asked Mr. Kuechle is he was suggesting that the brick (option A) under the windows would be left out. Mr. Kuechle stated that was correct and all of the brick on the north elevations would be as shown on option B. Mr. Jawor stated that he did not have a problem with that. Mr. Miller, the petitioner's partner in this development, asked what they were trying to accomplish by doing that. Do they feel they want to tie in the building better? By option B, they thought they brought the brick in to tie the building together and keep it at the price they have to consider in this process. By putting those extra panels in the back, what are they truly accomplishing? Is it an aesthetic look that they think is going to help the community or are trying to please staff? They are trying to get the best possible housing at the best possible price and that is the reason for option B. Mr. Kondrick stated that aesthetics are important. They are more important to staff than to the Commission. He is thinking how they can compromise. He would brick the whole thing if he had his way. He feels brick means a little more to the minds of most people and that is why he thinks he would prefer to have this compromise. PLANNING COMMISSION MEETING,APRIL 5, 2000 PAGE 7 Mr. Miller stated that is what he is trying to understand. MOTION by Mr. Saba, seconded by Mr. Kondrick, to close the public hearing. Mr. Kondrick stated this is a good project, it adds to their community, and currently it is an eyesore. It would be great if they can compromise on the brick. Ms. Savage stated she understands where the other Commission members are coming from. She personally believes that there are many beautiful buildings that do not have brick. She does not have enough of an architectural vision to know what is being proposed is really good and looks good. It is a very worthwhile project and great asset for Fridley. MOTION by Mr. Kuechle, seconded by Mr. Kondrick, to recommend approval of the Plat, PS #00-01, by Timothy Jawor, to accommodate a 6-unit townhouse, generally located at 7411 University Avenue with stipulation #3 amended as follows: 1 . PUBLIC HEARING: Consideratiol of a special use permit, SP #00-03, by Maertens-Brenny Construction ompany, to increase the allowable lot coverage from 40% to 50% to accommoda a proposed new building for Metal-Tek, Inc., generally located at 7901 Main St et NE. MOTION by Mr. Kondrick, seconded by Mr. Kuechle, to open the public hearing. UPON A VOICE VOTE, AL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED A THE PUBLIC HEARING WAS OPENED AT 8:16 P.M. Mr. Bolin stated that Maertens- renny is requesting a special use permit to allow a proposed manufacturing buildin for Metal-Tek, Inc., to occupy 47% of the lot located at 7901 Main Street. The lot is ove 107,000 square feet in size. The proposed building will be 50,561 square feet in size. City code does allow a one-story building in an M-2 district to cover up to 50% of the to with the special use permit. That same section of code also requires the petitioner to eet all other ordinance requirements. Mr. Bolin stated the property is locate on the corner of 79th Avenue and Main Street. The building takes up nearly half of the ite. In 1998, a special use permit was approved to allow a building on the site t 49% lot coverage, with some condtions. Some variances were needed prior to co struction. Those were never obtained and the special use permit lapsed one year later si ce construction had not started. The new plan meets all the setbacks, parking stall n bers, and landscaping requirements. Staff recommends approval with the following stip lations. 1. All proper permits shall be obtained prior to tart of construction. 2. Final drainage calculations and plan shall be pproved by City Engineering staff prior to issuance of a building permit. 3. Due to lack of space on site, snow must be truc ed off site and properly disposed of. 4. The petitioner and property owner shall meet wit City Planning, Building, and Engineering staff for a pre-construction meeting p 'or to issuance of a building permit. The petitioner shall contact Planning staff t coordinate the meeting. 5. There shall be no outdoor storage of equipment, su lies, or product. 6. Any propane tanks located on site shall be stored in ccordance with State and Federal standards. Mr. David Phillips, architect for the project, stated that after ey obtained the special use permit in 1998, they did over$100,000 worth of soil corr ction. They believe they did substantial construction work in preparing the site for use f the building by the soil correction. Stipulation #3 is the only one they take exception t . Many shopping centers and his office building all store the snow in the parking I t and on the grass area. The ordinance is already written to allow the shrinkage of t e parking lot in the ti FRIDLEY CITY COUNCIL MEETING OF APRIL 24 2000 PAGE 19 and the negotiations are still taking place. The new negoti d Minneapolis ordinance still has not been approved by the Minneapolis City Council. Mr. Flora stated that he received a memorandum this ruing that said it would be advertised for one week and was effective today. Councilmember Bolkcom stated that she took little offense that they pass something just to pass something. Council spent time reading t is and had conversations. There was also a lot of staff time involved. Mr. Swintek apologized for that implic ion. He meant to say that the right-of-way ordinance that Fridley passed was right on the he is of the ordinance that Minneapolis and St. Paul passed plowing new ground. There was a erise of urgency to get a right-of-way ordinance approved prior to the construction season, the League putting together a model, and the PUC putting together a working group. Mr. Flora stated that he has b n working with this issue for over five years, and he is one of the authors for the League mod . It was through the League's attorneys and the PUC task force that the ordinance was adopted MOTION by Council ember Bolkcom to approve the first reading of an Ordinance Revising Chapter 407 of the F 'dley City Code in its entirety, and amending Chapter 11 of the Fridley City Code, entitled " Ge eral Provisions and Fees." Seconded by Councilmember Wolfe. Mayor ro Tem Barnette stated that the second reading would be on May 8. 13. PLAT REQUEST, PS 400-01, BY TIMOTHY JAWOR, TO ACCOMMODATE A SIX-UNIT TOWNHOME DEVELOPMENT, GENERALLY LOCATED AT 7411 UNIVERSITY AVENUE N.E: Councilmember Billings stated that he would be abstaining from the discussion and the voting on this request. Mr. Bolin, Planner, stated that Mr. Miller, Mr. Jawor's partner, is representing Mr. Jawor this evening. Mr. Bolin stated that Mr. Jawor is seeking a replat of Lot 11, Block 1, Melody Manor. He would like to create seven separate lots to construct a six-unit townhome development complex at 7411 University Avenue. The property was rezoned last year to R-3 to allow multiple dwelling complexes. The properties immediately adjacent to the north and south are zoned R-2. To the east is R-1 zoning district with a church located on the property. Across University Avenue is commercial property. This is a preliminary plat itself. There would be six individual lots, one FRIDLEY CITY COUNCIL MEETING OF APRIL 24,2000 PAGE 20 for each unit, and the seventh lot would be the remaining space. A drive aisle is on the north side of the property with the garage doors facing the north. Mr. Bolin stated that the petitioner submitted Option A on March 28 that incorporated brick all the way around the building. A few days later, the petitioner called back and said that Option A had been submitted in error, and that he would prefer to see brick as proposed in Option B. The Planning Commission recommended approval and amended the third stipulation as it relates to brick to read that "the amount of brick used on the building shall resemble Option B on the north elevation, and modified Option B on the south elevation to be four panels of brick between the decks unless another is negotiated with staff." Mr. Bolin stated that he had a telephone discussion with Mr. Jawor, and he requested that the City Council not consider Planning Commission's Option B. He said his first choice is the original Option B proposal. He felt that he liked the looks of his Option B or even the looks of the City's Option A over the revised Option B. Staff recommended approval and that the original Stipulation No. 3 requiring the brick to be a continuous band around the building be included as worded in the stipulations. Staff proposed that the wording would read as follows: "The amount of brick used on the building shall be finished as illustrated in Option A as attached to the packets submitted on March 20, 2000 to give the building a four sided finished appearance." Mayor Pro Tem Barnette asked if Mr. Jawor and Mr. Miller met with staff prior to March 28 and if there was discussion about the brick. He asked if there was an understanding of what was going to be presented by the petitioner. Mr. Bolin stated that they did not have anything drawn by the petitioner to show the options with brick on it until March 28 when they received Option A. Councilmember Bolkcom stated that she would like to understand the City's reason for Option A. Mr. Bolin stated that staff's job is to try to get the best finished product possible for the City. There is a requirement in the City Code that requires brick or masonry on buildings in the R-3 district. The City also strives to have commercial district buildings to be finished on all four sides so the building looks balanced and does not give the appearance that one side is any less important than the other. Option A gives it the balanced look on all four sides. Councilmember Bolkcom asked how it compares to the townhomes at Christianson Crossing as far as the brick. Mr. Bolin stated that with the Christianson Crossing, there are a few buildings that face towards Mississippi Street that do not have quite as much brick on them as some interior buildings that have brick on all four sides. Not all the houses on the Christianson Crossing development have brick on the building. Ms. Dacy, Director of Community Development, stated that a lot of comparisons have been made to the Christianson Crossing development. This was a total package that was negotiated. A lot of the architectural elevations were determined based on a lot of factors. The bottom line s FRIDLEY CITY COUNCIL MEETING OF APRIL 24,2000 PAGE 21 with staff s recommendation, is that it is a recommendation. Each project is different, this project is highly visible on both sides of the north and south elevation. Option A looks better. Staff tries to give options and recommendations. They are suggesting that the brick going all the way around makes the project that much better. Mayor Pro Tem Barnette stated that he thought the brick on the Banfill development looked nice. Mr. Bolin stated that Banfill did not need to receive any discretionary stipulations from the City. It went straight to the building permit. Councilmember Bolkcom stated that part of the reason to have brick also is to blend in with the apartment buildings that have brick. Mr. Bolin stated that was correct. Along University Avenue there is brick with the apartment buildings and immediately adjacent to the property as well as the commercial buildings on University Avenue. Councilmember Wolfe stated that even if they build Option A or Option B, it is not going to look like the two apartment buildings on either side. This is just a recommendation. Ms. Dacy stated that it is a recommendation, but staff felt it did have merit. It is a different style than the adjacent apartment buildings, but the brick element is existing on the adjacent buildings. Mayor Pro Tem Barnette stated that at the Planning Commission this was a big item for discussion. He thought staff was spending a lot of time on an issue that is not that important. He thought the building looked nice and fit in beautifully. The petitioners have nothing but support except for the brick issue. The petitioners tried to compromise by bricking the corners and two sides. He thought Option B was something he could live with. Mr. Max Miller, partner of Tim Jawor, stated that the reason they preferred Option A or B was that Option C did not tie the brick together structurally, as they thought it should and would not give the City what it is looking for. They felt that they did tie the brick together with the adjoining buildings by doing Option B. On Option B at the south side of the building, plants and air conditioning units would be blocking most of the brick anyway. They felt it was important to bring the brick to the side of the building and tie it in with the neighborhood. Councilmember Bolkcom stated that the reason they are not in favor of Option A is because it is a lot more expensive. Mr. Miller stated that is the reason, and it is not an efficient use of the funds because it would not really add anything to the building. Councilmember Bolkcom asked what the difference was. Mr. Miller stated that they were looking at a difference of about $4,000 for the whole project with a difference of cost basically being $1,000 per unit. FRIDLEY CITY COUNCIL MEETING OF APRIL 24, 2000 PAGE 22 Councilmember Wolfe stated that he also thought that if they kept making everything look the same it will make Fridley a sterile little town. Councilmember Bolkcom stated that they are making everything look basically the same because they are looking at buildings that were built in different eras. She thought Council had to look at what staff was saying because they do this for a living, and there was a lot of discussion about the brick from the Planning Commission. She thought it was a good project, and there would be more green space than the last project. Mayor Pro Tem Barnette asked Mr. Miller if he looked at Option B and adding additional brick. Mr. Miller stated that he would prefer to put the extra money in. He did not feel that he would accomplish what they were trying to do, and it would look even worse. They would have to do this in a correct architectural way, and that option would not be correct. He believed they had to do Option A or B. Option C would not look good. Councilmember Bolkcom asked Ms. Dacy and Mr. Bolin if they agreed that revised Option B was better off than Option B. Mr. Bolin stated that Option A was the most ideal. The revised Option B does not accomplish what the City wants, but A or B would be okay. Ms. Dacy stated that she thought the Planning Commission was trying to find a constructive type of compromise. The developer took a look at it. Staff agreed with the developer that it is either Option A or B. INFORMAL STATUS REPORTS: Councilmember Bolkco stated that she, Mr. Flora, and Mayor Pro Tem Barnette had the pleasure of meeting with nDOT regarding the noise wall. There are still a couple of people who were not happy about he noise wall. Most people were happy with the additional space they would have. The fence ould be coming out, and the wall is a little more decorative than presented. Overall, it was a go d meeting. Construction will not begin until fall. MnDOT stated that they would send out additio 1 information letters before starting the project. Mayor Pro Tem Barnette stated tha a number of people will be gaining 20 feet after the noise wall is constructed. People were as ing how the City would maintain this, but this is all State right-of-way, not the City's property. eople are more than welcome to maintain that as part of their backyard. Councilmember Bolkcom stated that if any e has questions they can call Mr. Flora. There is a concern about the East River Road project. The neighborhood is concerned about making the right hand turn on to Liberty Street. It would b a very costly revision. Mr. Flora stated that when East River Road was r uilt, they offset Liberty Street to give the east and west sides a better turning motion with traffic. The west side of Liberty Street was moved north and the east side was moved south. The medi on East River Road was installed for the northbound turn onto Liberty Street, so they would ave to redo the intersection and entire median section of East River Road as well as both entr ces on Liberty so the vehicles can enter and exit off East River Road. Councilmember Bolkcom asked if Liberty Street would be cl ed on the left side. Mr. Flora stated that one option is to close the median and the you would not be able to cross East River Road. Liberty Street is now the one exit to the east west off East River Road. It is not built to allow for through traffic. Mr. Flora stated that he received a memorandum this ming that said it would be advertised for one week and was effective today. Councilmember Bolkcom stated that she took little offense that they pass something just to pass something. Council spent time reading t ' and had conversations. There was also a lot of staff time involved. Mr. Swintek apologized for that implic ion. He meant to say that the right-of-way ordinance that Fridley passed was right on the he s of the ordinance that Minneapolis and St. Paul passed plowing new ground. There was a ense of urgency to get a right-of-way ordinance approved prior to the construction season, the League putting together a model, and the PUC putting together a working group. Mr. Flora stated that he has b n working with this issue for over five years, and he is one of the authors for the League mod . PLAT REQUEST, PS #00-01, BY TIMOTHY JAWOR, TO ACCOMMODATE A SIX-UNIT TOW�THOME DEVELOPMENT, GENERALLY LOCATED AT 7411 UNIVERSITY AVENUE N.E: Councilmember Billings stated that he would be abstaining from the discussion and the voting on this request. Mr. Bolin, Planner, stated that Mr. Miller, Mr. Jawor's partner, is representing Mr. Jawor this evening. Mr. Bolin stated that Mr. Jawor is seeking a replat of Lot 11, Block 1, Melody Manor. He would like to create seven separate lots to construct a six-unit townhome development complex at 7411 University Avenue. The property was rezoned last year to R-3 to allow multiple dwelling complexes. The properties immediately adjacent to the north and south are zoned R-2. To the east is R-1 zoning district with a church located on the property. Across University Avenue is commercial property. This is a preliminary plat itself. There would be six individual lots, one FRIDLEY CITY COUNCIL MEETING OF APRIL 24, 2000 PAGE 20 for each unit, and the seventh lot would be the remaining space. A drive aisle is on the north side of the property with the garage doors facing the north. Mr. Bolin stated that the petitioner submitted Option A on March 28 that incorporated brick all the way around the building. A few days later, the petitioner called back and said that Option A had been submitted in error, and that he would prefer to see brick as proposed in Option B. The Planning Commission recommended approval and amended the third stipulation as it relates to brick to read that "the amount of brick used on the building shall resemble Option B on the north elevation, and modified Option B on the south elevation to be four panels of brick between the decks unless another is negotiated with staff." Mr. Bolin stated that he had a telephone discussion with Mr. Jawor, and he requested that the City Council not consider Planning Commission's Option B. He said his first choice is the original Option B proposal. He felt that he liked the looks of his Option B or even the looks of the City's Option A over the revised Option B. Staff recommended approval and that the original Stipulation No. 3 requiring the brick to be a continuous band around the building be included as worded in the stipulations. Staff proposed that the wording would read as follows: "The amount of brick used on the building shall be finished as illustrated in Option A as attached to the packets submitted on March 20, 2000 to give the building a four sided finished appearance." Mayor Pro Tem Barnette asked if Mr. Jawor and Mr. Miller met with staff prior to March 28 and if there was discussion about the brick. He asked if there was an understanding of what was going to be presented by the petitioner. Mr. Bolin stated that they did not have anything drawn by the petitioner to show the options with brick on it until March 28 when they received Option A. Councilmember Bolkcom stated that she would like to understand the City's reason for Option A. Mr. Bolin stated that staff s job is to try to get the best finished product possible for the City. There is a requirement in the City Code that requires brick or masonry on buildings in the R-3 district. The City also strives to have commercial district buildings to be finished on all four sides so the building looks balanced and does not give the appearance that one side is any less important than the other. Option A gives it the balanced look on all four sides. Councilmember Bolkcom asked how it compares to the townhomes at Christianson Crossing as far as the brick. Mr. Bolin stated that with the Christianson Crossing, there are a few buildings that face towards Mississippi Street that do not have quite as much brick on them as some interior buildings that have brick on all four sides. Not all the houses on the Christianson Crossing development have brick on the building. Ms. Dacy, Director of Community Development, stated that a lot of comparisons have been made to the Christianson Crossing development. This was a total package that was negotiated. A lot of the architectural elevations were determined based on a lot of factors. The bottom line FRIDLEY CITY COUNCIL MEETING OF APRIL 24, 2000 _ _ _PAGE_21 with staff's recommendation, is that it is a recommendation. Each project is different, this project is highly visible on both sides of the north and south elevation. Option A looks better. Staff tries to give options and recommendations. They are suggesting that the brick going all the way around makes the project that much better. Mayor Pro Tem Barnette stated that he thought the brick on the Banfill development looked nice. Mr. Bolin stated that Banfill did not need to receive any discretionary stipulations from the City. It went straight to the building permit. Councilmember Bolkcom stated that part of the reason to have brick also is to blend in with the apartment buildings that have brick. Mr. Bolin stated that was correct. Along University Avenue there is brick with the apartment buildings and immediately adjacent to the property as well as the commercial buildings on University Avenue. Councilmember Wolfe stated that even if they build Option A or Option B, it is not going to look like the two apartment buildings on either side. This is just a recommendation. Ms. Dacy stated that it is a recommendation, but staff felt it did have merit. It is a different style than the adjacent apartment buildings, but the brick element is existing on the adjacent buildings. Mayor Pro Tem Barnette stated that at the Planning Commission this was a big item for discussion. He thought staff was spending a lot of time on an issue that is not that important. He thought the building looked nice and fit in beautifully. The petitioners have nothing but support except for the brick issue. The petitioners tried to compromise by bricking the corners and two sides. He thought Option B was something he could live with. Mr. Max Miller, partner of Tim Jawor, stated that the reason they preferred Option A or B was that Option C did not tie the brick together structurally, as they thought it should and would not give the City what it is looking for. They felt that they did tie the brick together with the adjoining buildings by doing Option B. On Option B at the south side of the building, plants and air conditioning units would be blocking most of the brick anyway. They felt it was important to bring the brick to the side of the building and tie it in with the neighborhood. Councilmember Bolkcom stated that the reason they are not in favor of Option A is because it is a lot more expensive. Mr. Miller stated that is the reason, and it is not an efficient use of the funds because it would not really add anything to the building. Councilmember Bolkcom asked what the difference was. Mr. Miller stated that they were looking at a difference of about $4,000 for the whole project with a difference of cost basically being $1,000 per unit. FRIDLEY CITY COUNCIL MEETING OF APRIL 24, 2000 PAGE 22 ' Councilmember Wolfe stated that he also thought that if they kept making everything look the same it will make Fridley a sterile little town. Councilmember Bolkcom stated that they are making everything look basically the same because they are looking at buildings that were built in different eras. She thought Council had to look at what staff was saying because they do this for a living, and there was a lot of discussion about the brick from the Planning Commission. She thought it was a good project, and there would be more green space than the last project. Mayor Pro Tem Barnette asked Mr. Miller if he looked at Option B and adding additional brick. Mr. Miller stated that he would prefer to put the extra money in. He did not feel that he would accomplish what they were trying to do, and it would look even worse. They would have to do this in a correct architectural way, and that option would not be correct. lie believed they had to do Option A or B. Option C would not look good. Councilmember Bolkcom asked Ms. Dacy and Mr. Bolin if they agreed that revised Option B was better off than Option B. Mr. Bolin stated that Option A was the most ideal. The revised Option B does not accomplish what the City wants, but A or B would be okay. Ms. Dacy stated that she thought the Planning Commission was trying to find a constructive type of compromise. The developer took a look at it. Staff agreed with the developer that it is either Option A or B. INFORMAL 5TATUS REPORTS: Councilmember Bolkco stated that she, Mr. Flora, and Mayor Pro Tem Barnette had the pleasure of meeting with InDOT regarding the noise wall. There are still a couple of people who were not happy about he noise wall. Most people were happy with the additional space they would have. The fence •ould be coming out, and the wall is a little more decorative than presented. Overall, it was a go d meeting. Construction will not begin until fall. MnDOT stated that they would send out additio 1 information letters before starting the project. Mayor Pro Tem Barnette stated tha a number of people will be gaining 20 feet after the noise wall is constructed. People were as 'ng how the City would maintain this, but this is all State right-of-wav, not the City's property. eople are more than welcome to maintain that as part of their backyard. Councilmember Bolkcom stated that if any e has questions they can call Mr. Flora. There is a concern about the East River Road project. The neighborhood is concerned about making the right hand turn on to Liberty Street. It would b a very costly revision. Mr. Flora stated that when East River Road was r uilt, they offset Liberty Street to give the east and west sides a better turning motion with traffic. The west side of Liberty Street was moved north and the east side was moved south. The medi on East River Road was installed for the northbound turn onto Liberty Street, so they would ave to redo the intersection and entire median section of East River Road as well as both entr ces on Liberty so the vehicles can enter and exit off East River Road. Councilmember Bolkcom asked if Liberty Street would be cl ed on the left side. Mr. Flora stated that one option is to close the median and the you would not be able to cross East River Road. Liberty Street is now the one exit to the east west off East River Road. It is not built to allow for through traffic. Options are to close the m ian and put a larger distance on the crossing on East River Road, do nothing, or redo the entire se tion of East River Road and Liberty Street.
