There was no one present for or against the Variance. The City Manager advised
that in construction very often there could be a variation amounting to up to
6 inches, but that this has been brought to the Board because Mr. Silseth is a
City employee, and too, the City Manager was not aware of either this Board's
or this Council's attitude toward allowing the Administrative people to permit
a small variance like this. rather than going to the work of holding the Public
Hearing.
MOTION by Saunders, seconded by Middelstadt, to grant the requested variance.
Upon a voice vote, there being no nays, Chairman Ylinen declared the motion
carried.
DISCUSSION OF ORDINANCE:
Member Saunders brought to the attention of the Board, the fact that in Section 6
of Ordinance 358, it was stated that all decisions of the Board of Appeals
are final, but of course subject to appeal to th2 Council and/or later
Judicial review. The City Manager advised that he assumed that the City Attorney had

approximately 110 feet, 125 feet, 109 feet and 90 feet, subject to verifi-
cation and clarification by the Engineering Department. Upon a voice vote,
all voting aye, the motion carried unanimously.
It was noted there are two zoning categories in the above parcel, but
the Commission felt that no further action was required now, but there is
the possibility of a request later on to extend the commercial zoning.
4. APPLICATION TO BOARD OF APPEALS: S. CHMIELEWSKI: Lot 12, Block 2, Osborne
Manor, special use permit for two family dwelling.
Member Ylinen said he visited the property and talked to adjacent
property owners and only one indicated mild disapproval. He stated it was
a good lot. The petitioner lives in one of the adjacent homes. The
proposed structure would be two stories.
MOTION by Ylinen, seconded by Jensen, to recommend approval of the
petition of Severin or Eleanor Chmielewski, to the City Council for this
two family dwelling on Lot 12, Block 2, Osborne Manor with the specifica-
tion that there be a garage stall for each dwelling unit, connected to
the street with a hard surfaced driveway, and the remainder of the lot
shall be sodded including the boulevard, and further stipulate that the
owner enter into an agreement with the City in connection with the above
requirements that if the owner does not comply with said requirements, the
City shall complete said requirements and assess the cost back to the
I property. Upon a voice vote, all voting aye, the motion carried unanimously.
5. THIRD STREET PATTERN:
Copies of the letter from Erickson Petroleum Corp. indicating their
desire not to participate in plans concerning carrying Third Street
through to 57th Avenue were passed out to the Commission members.
In answer to Chairman Hughes question, Member Jensen (chairman of
the Plats & Subdivisions-Streets & Utilities Subcommittee) said it is
pretty hard to summarize. It involves literally months of study by the
Subcommittee and resulted in a fairly complete division of opinion as to
the merits or demerits of the proposal. The Subcommittee made two motions,
the first motion failed which favored the recommendation of the proposal.
Since there seemed to be no real feeling for continued review of the
problem, it seemed to be the wisest move to forward it to the Planning
Commission. This letter from Erickson Petroleum Corp. is a complete
surprise in view of the Subcommittee meeting which took place on March 30th.
In a very short time they have more or less reversed their feeling. Mr.
Wagner called me after a discussion with Bob Rote so that I would be aware
of the reversal and I called Bob Rote, because the comments made to me
really did not say anything except they were no longer favoring this pro-
posal. Bob Rote informed me they own additional property north of 57th
Avenue across the street of their present site and it is the feeling now
of Bob Rote and the management that the street which they have in the past
proposed could actually become a deterrent in the development of this
property. They could be in the position of having fostered a road which,
in a year or two, they might wish not to be there at all. They have not
developed specific plans at this writing, but did not wish to delay any
action if the Committee wished to continue the study.

�'► MOTION by Councilman Sheridan to grant a lot Split to Mylo Parks on Lot #10,
Auditor's Subdivision No. 10 (Revised) so that starting from Central Avenue
going East, the first ;parcel size will be approximately 235 feet, the next
parcel to the East will be 109 feet, and the third parcel, which is the
` farthest to the East, will be 90 feet. Seconded by Councilman Harris. Upon
a voice vote, there being no nays, Mayor Kirkham declared the motion carried.
3RD STREET PATTERN:

Councilman Liebl asked if every member of the Council was aware that Erickson
Petroleum had dropped the proposal, and was not going through with their
request that 3rd Street go through to 57th Avenue. Councilman Liebl asked
if any member of the Council had anything to do with it or had discussed
it with Mr. Rote. He asked the City Manager if he knew what the reason was
for it being dropped. The City Manager said that Mr. Rote had just asked him
to take it off the Planning Commission's agenda, which he said he could not
do. He told Mr. Rote he should write a letter explaining why they wanted it
taken off. He said that the letter had arrived on the same day as the
Planning Commission meeting. He said that Mr. Jensen had talked to Mr. Rote
and he understood that they were concerned that someday they might want a
building there. Councilman Liebl said that in the Minutes of the Plats and
Subdivisions Sub-Committee Meeting, two had voted in favor of it, two
against, and Mr. Jensen had abstained. He asked why Mr. Jensen had abstained.
The City Manager said he did not know, and he did not believe anyone had
asked Mr. Jensen. Councilman Liebl said that last year Erickson Petroleum
had been very anxious to get this road through, and he had been very
astonished when they had dropped it. Mayor Kirkham said he was curious also,
and had a call into the office now, although he did not ,know if they wanted
their reasons made public.
t Y TWO FAMILY DWELLING - 7541 UNIVERSITY AVENUE NORTHEAST- CHMIELEWSKI:
The City Manager said that the Board of Appeals had only had a few days to
look at this request prior to the hearing, but all five members of the Board
had gone out and looked at it on the following Saturday. He said that it
had come to the Planning Commission Meeting April 6th because the new
Board of Appeals Ordinance did not go into effect until April 8th. He read
the motion of the Planning Commission recommending approval. He said that
the ordinance requires that the Council call a Public Hearing, so the Council
can either concur and set the hearing, or deny the request.
Councilman Harris asked Mr. S. Chmielewski about the lots to the north and
south of his lot. Mr. Chmielewski said there is a house to the north and a
house to the south zoned residential. Councilman Harris asked about the size
of his lot. Mr. Chmielewski said it was 175x135. Councilman Harris asked if
this will have to go to the Building Board. The City Manager said that- they
will have to go to the Building Board with the plans for the structure.
Mr. Chmielewski said he had found some smashed footings on this lot. The
City Manager said that if this was from over 8 years ago, there would be no
record. Councilman Sheridan said that at' one time there was a high water
table in this area which may explain the old footings. Mayor Kirkham said
he thought this area was complete. Councilman Samuelson said that it was
R-1 on both sides and R-1 in back.
The Council discussed a date for a Public Hearing and decided on May lst.

�y MOTION by Councilman Samuelson that the Special Permit Application go through
the normal procedures, and a Public Hearing be set for May 1, 1967 to fill
the Council's obligations. Seconded by Councilman Sheridan.
Councilman Sheridan said that he would like to explain to the parties
applying that the Council has only granted two or three Special Use Permits
for multiple dwellings in residential districts in the past, and those
were considerably larger lots. He said that he would -like to express his
opinion, that regardless of the hearing, he would not be in favor of the
permit because of the lot size, but the Council will go through the necessary
procedures. Mayor Kirkham said he did not like to discourage the petitioners
unnecessarily, but they should be apprised of the fact that with the knowledge
he has so far, he will be in opposition, but that the Council will go ahead
with the hearing May 1st.
UPON a voice vote, there being no nays, Mayor Kirkham declared the motion
carried.
ADJOURNMENT:
There being no further business, Mayor Kirkham declared the Special Council
Meeting of April 10, 1967 closed at 9:22 P.M.

said that it was. Councilman Sheridan said that the $3.05 top figure has
been for street drainage, and this project is for a pocket in the back of
the lots, and not of any benefit to any other part of the District. He
said that he felt the cost was high, and as there were no representatives
present, he suggested postponing it at this time. He said that if the
Council is to go through with the project, he thought including it in the
whole project would set a precedent on packets or holes in the drainage
district, and the City would be obligated to go back and pick up water holes.
Councilman Harris said he would agree with this, but he did not feel that
the project could be forgotten, as the problem will be magnified when curbs
and gutters go in. Mayor Kirkham said he felt this had a direct bea-wing on
the whole project. The City Engineer said that up to now the policy has
been not to pick up back yard drainage.
Councilman Harris said that as no one is here for or against the project,
he would suggest they close the hearing and take the matter under advisement.
Councilman Liebl said he would like a chance to talk to the people and see
how they feel.
MOTION by Councilman Liebl that the Public Hearing for Storm Sewer #5C
(Addendum Yfl) be continued until the Regular Council Meeting of May- 15, 1967.
Seconded by Councilman Samuelson. Upon a voice vote, there being no nays,

f; PUBLIC HEARING ON A REQUEST FOR A SPECIAL USE PERMIT - TWO FAMILY DWELLING
IN R-1 DISTRICT, SEVERIN & ELEANOR CHMIELEWSKI:
�� The City Manager read the Notice of Hearing. The City Engineer handed out
maps of the proposed location. Mayor Kirkham asked if the involved parties
were present. There was no answer. The City Engineer said that everything
is built up in this area except an old partial basement that has been there for
years. Mayor Kirkham said he felt this amounts to spot zoning and that to
change the zoning on this would be contrary to what the Council is trying to
do throughout the City.
Mayor Kirkham said that hearing no other interested parties, the hearing was
closed at 8:19 P.M.
CONSIDERATION OF POLICE COMMISSION REPORT OF NOVEMBER, 1966:
Mayor Kirkham drew the Council's attention to six letters in the back of the
agenda relating to this matter.
MOTION by Councilman Harris to receive the communications from Mr. Marvin W.
Smith, 6801 Oakley Street Northeast; Mr. Walter Miller, Electro Cote Company;
Mr. Kenneth M. Holmes, Minnesota Linseed Oil Company; Mr. Harry Henerickson,
Fullerton Metals Company; Mr. John F. Haines, Unity Hospital; and S. W. Carlson,
Park Construction Company. Seconded by Councilman Liebl. Upon a voice vote,
there being no nays, Mayor Kirkham declared the motion carried.
Councilman Liebl said that since he had asked that this matter be on the agenda,
he would like to read the following letter from the agenda which he had
addressed to the Council:

MOTION by Councilman Harris that this project not be put in at this time,
. but be returned .to the Administration for an alternate solution on enforcing
the off-street parking for the affected property. t "
The City Engineer said that the Administration had written letters in 1962
telling the people they were in violation and that they had to provide
parking in the back, but they had come to the Council about the water
problem, so it was now up to the Council on whether it be done now or not,
but he felt that it should be brought to their attention.
The Motion was seconded by Councilman Samuelson. Councilman Liebl asked the
people present in the audience if there was a water problem. One of the
visitors said that the first apartment has water in the spring as it runs
down the slope, but an alley would just make it a runway and increase the
problem.
The vote upon the motion was a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.
SEWER USE AGREEMENT (TABLED 5/8/67) :
Mayor Kirkham reminded the Council that this is the letter he had read at the
last Council Meeting, and the Council had decided to reconsider the last
paragraph. Mayor Kirkham suggested that they just eliminate the first two
sentences of the last paragraph, and start the last paragraph, "If this be
your position, we suggest then that you commence a declaratory judgment action
to have the meaning of the supplemental agreement determined by the District
Court." Councilman Samuelson suggested that in the fourth paragraph, they
eliminate the word "ignore" and substitute the words, "to use their own
interpretation of".
MOTION by Councilman Liebl to adopt the letter to the NSSSD with the proposed
changes. The motion was seconded and upon a voice vote, there being no nays,
Mayor Kirkham declared the motion carried.
DOUBLE BUNGALOW USE PERMIT (HEARING CLOSED 5/1/67) :
Councilman Samuelson said his feelings were that this was spot zoning and
would be putting a multiple dwelling in the immediate center of an R-1 District.
MOTION by Councilman Samuelson to deny the Double Bungalow Use Permit. Council-
man Liebl asked about the zoning surrounding this lot. Councilman Harris said
that it was all R-1. Councilman Liebl said he assumed that the people opposed
this. Councilman Samuelson said there had been no one present at the meeting
either pro or con except the people making the application. Councilman Harris
said he thought this had been disposed of at the last meeting. Mayor Kirkham
said that the hearing had been closed but no action had been taken.
The motion was seconded by Councilman Harris. Upon a voice vote, there being
no nays, Mayor Kirkham declared the motion carried.
REZONING REQUEST IN SPRING BROOK PARK AREA (TABLED 5/1/67) :

The City Engineer pointed out on the map the different zonings requested.
Councilman Harris asked if Ashton was a deadend. The City Engineer said that
it goes to Ironton now, and eventually will go to the City limits at the
railroad tracks. Councilman Samuelson asked if this was the Planning
Commission's scheme. The City Engineer said that it was.
