Cert. of Comp. 5720 4th Street CERTIFICATE OF COMPLETION
WHEREAS, the Housing and Redevelopment Authority in and for the City of Fridley,
Minnesota,a political subdivision of the State of Minnesota(the"Authority")and Gateway East
Redevelopment LLC, a limited liability company organized under the laws of the State of
Minnesota (the "Redeveloper"), have entered into a Contract for Private Redevelopment (the
"Agreement")dated April 6,2001 regarding certain real property referred to in the Agreement as
the "Redevelopment Property" described on Exhibit 1 attached to this Certificate; and
WHEREAS, the Agreement contains certain conditions and provisions requiring the
Redeveloper to construct improvements upon the Redevelopment Property(hereinafter referred
to and referred to in the Agreement as the "Site Improvements" and the "Minimum
Improvements"); and
WHEREAS, Section 4.3 of the Agreement requires the Authority to provide an
appropriate instrument promptly after the substantial completion(as defined in the Agreement)
of any single unit of the Minimum Improvements and its corresponding Site Improvements, so
certifying said substantial completion;
NOW, THEREFORE, in compliance with said Section 4.3 of the Agreement, this is to
certify that the Redeveloper has substantially completed the following portion of the Minimum
Improvements and Site Improvements in accordance with the conditions and provisions of the
Agreement relating solely to the obligations of the Redeveloper to construct the Minimum
Improvements and Site Improvements (including the dates for beginning and completion
thereof):
Town Home Unit: 5720 4th Street NE
This certification shall be a conclusive determination of satisfaction and termination of the
agreements and covenants in the Agreement with respect to the portion of the Minimum
Improvements and Site Improvements described above,and of satisfaction and termination of the
obligations of the Redeveloper, and its successors and assigns, to construct the Minimum
Improvements and Site Improvements and the dates for the completion thereof.
