Tatting, Planning Assistant RE: Garage Setback at 236 Rice Creek Way I've finished looking at the plat maps, aerials and the address files. The propertyto your north 230 RC Blvd is 35 ft-from the property--line-and your- house varies between 35 ft and 42 ft. The property to the south (240 RC Blvd) is on the cul-de-sac so different setback standards apply and also the drainage utility easement forces it back further from the property line; the garage appears to be 35 feet from the property line. Due to this information, your new garage does not have to meet an averaging standard, just the same setback as the house - 35 feet. I approximated the location of the curb and indicated the location on your survey. I included the survey of the neighbor to the south. A power pole is indicated on this survey, but the survey was last revised in 1967, so I do not know if it is the same power pole. The pole is 95 ft from the property line, so this may give you a good indication of where the 35 ft mark is, for placement of the garage. City Manager Authorization: 60 Day Date:, June 16, 1998 DESCRIPTION OF REQUEST: Mr. Patrick Elwell is requesting a special use permit to allow the construction of a second accessory building on his property. The proposed garage is 14 feet wide by 24 feet deep, an area of 336 square feet. The building will have eight foot walls with a 4/12 pitch roof. The proposed garage will use the same access point to Rice Creek Boulevard as the attached garage. The property is located at 236 Rice Creek boulevard NE. SUMMARY OF ISSUES: Section 205.07.0l.C.(1) requires a special use permit for accessory buildings over 240 square feet, - other than the first accessory building. The proposed second accessory structure is 336 square feet in area. Mr. Elwell's property is located on the west side of Rice Creek Blvd, adjacent to where the road "T's." The driveway to the existing attached garage is nearly adjacent to the "T." The petitioner's site plan indicates that the proposed garage will utilize the existing driveway; a second driveway/curb-cut should not be created at this parcel. There is sufficient area to place the proposed garage in order to meet all setback requirements. A variance for the proposed garage would not be necessary. RECOMMENDED ACTIONS: Staff recommends that the Planning Commission recommend approval of the special use permit with the following stipulations: 1. A second driveway/curb-cut shall not be created at the property. 2. The second accessory building shall be one story, 14 feet wide by 24 feet deep and meet the standards of the Fridley Zoning Ordinance and the Uniform Building Code. Plaque to Bruce Bondow (Former member of Environmental Quality and Energy Commission): Mayor Jorgenson presented a plaque to Mr. Bondow in recognition of his sixteen years of service on the Environmental Quality and Energy Commission. Plaque to Dean Saba (Former Member of Environmental Quality and Energy Commission: Mayor Jorgenson presented a plaque to Mr. Saba in recognition of his eighteen years of service on the Environmental Quality and Energy Commission. The Councilmembers took this opportunity to express their grateful appreciation to each of these citizens for their dedicated service to the City.
