SPECIAL USE PERMIT PROCESS

Purpose: A special use permit allows the City with the discretion to
determine the suitability of certain uses on the general health,
welfare and public safety.
K Considerations: The City may consider the following to determine the
"`l°p"" suitability of a certain use:
1. the nature of the land on which the use is to be
located,
2. the nature of the adjacent land or buildings,
3. the effect on traffic into/out of the site, or on
adjacent roads,
4. any other factors the City shall identify as
appropriate to determine the effect of such use.
The Special Use Permit process begins by filling out a SPECIAL USE PERMIT APPLICATION. This,
with a site plan, and other appropriate drawings, must be submitted to the Planning staff. A fee is
associated with the application; $100 for second accessory building applications, $400 for all other
applications. Fees are non-refundable.
Once the application is received, the application is reviewed by staff from the Planning,
Engineering, Assessing, Fire, and Police Departments. The impacts to adjacent properties are
discussed, and stipulations are developed. Simultaneously, a mailing list of all properties within a
350 foot radius of the property is genera ted. Notices of the request are sent to these property
owners. There is approximately four weeks between the application due date and the Planning
Commission meeting.
Prior to the meeting of the Planning Commission, a staff report is written, and the petitioner called
regarding the staff recommendation. .
The Planning Commission is made up of seven residents of the community. The meetings are held
the first and third Wednesdays of the month at 7:30 pm in the Council Chambers in the Municipal
Center. The Planning Commission is an advisory commission to the City Council. It is the
responsibility of the Planning Commission to conduct a public hearing, gather testimony and make
a recommendation to the City Council regarding all special use permit requests.

Analysis
Vern Haldorson, petitioner, is requesting a special use permit to allow the construction of a 529
square foot accessory building. The building will be used strictly for storage and won't be used
for vehicle parking on a regular basis.
Accessory buildings over 240 square feet are a permitted special use. The existing garage and
the proposed accessory building are a total of 1,393 square feet, which is 7 square feet less than
the total allowed by Code. The location of this accessory structure is well suited for this site.
Therefore, staff recommends approval of this special use permit.
Staff Recommendation
Staff recommends the Planning Commission approve the special use permit subject to the
following stipulations:
1. At staff's discretion, inspections will be conducted of the yard area between the street and
the garage and , if found to be regularly used as a driveway, a hard surface drive shall be
constructed by the petitioner within 3 months of receiving such notice from the City.
2. All necessary permits shall be obtained from the City prior to construction.
3. The structure shall not be used for a home occupation.
4. All vehicles shall be stored on a hard surface as approved by the City.
5. The siding and roof materials shall continue to match the exterior of the existing home.

MOTION by Mr. ondrick, seconded by Mr. Saba, to approve the December 15, 1999,
Planning Co ission minutes as presented.

1. PUBLIC HEARING:
Consideration of a special use permit SP #99-13, by Vern Haldorson, for a
proposed storage building, generally located at 514 Dover Street.
MOTION by Mr. Kondrick, seconded by Mr. Kuechle, to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING WAS OPENED AT 7:34 P.M.
Mr. Hickok stated that this special use permit is to allow the construction of a 529
square foot accessory building at 514 Dover Street. The building will be used strictly for
storage and not for vehicle parking on a regular basis. Second accessory buildings
over 240 square feet are permitted with a special use permit in an R-1 zoning district
provided that the total cumulative square feet of all accessory buildings does not exceed
1,400 square feet.
Mr. Hickok stated the property is zoned R-1 single family residential. The property was
platted in 1922. The home was built pre-1949. A home addition was added to the
structure in 1960, and the existing garage was built in 1994. The existing garage and
the proposed accessory building total 1,393 square feet, just underneath the 1,400
square foot requirement. The existing garage is on the opposite side of where the

proposed structure is going to be placed. The new structure will not have a driveway
to service it.
Mr. Hickok stated staff recommends that the Planning Commission approve this special
use permit with the following stipulations:
1. At staff's discretion, inspections will be conducted of the yard area between the
street and the garage. If found to be regularly used as a driveway, a hard
surface driveway shall be constructed by the petitioner within three months of
receiving notice by the City.
2. All accessory permits shall be obtained from the City prior to construction.
3. The structure shall not be used for a home occupation.
4. All vehicles shall be stored on a hard surface drive as approved by the City.
5. The siding and roof materials shall continue to match the exterior of the existing
home.
Mr. Hickok stated that the petitioner is not present at the meeting.
Ms. Savage asked if there were any calls regarding this request.
Mr. Hickok stated that staff did receive a call that day with a concern about notification.
A property owner adjacent to this structure bought the property in October. The GIS
data records for notification still show the former property owner. The new property
owner was concerned about not being notified and not knowing the facts.
Mr. Kondrick asked if it meets all of the side yard setback requirements.
Mr. Hickok stated that it does.
Mr. Kondrick asked if it would be possible for the petitioner to park a vehicle on a pad
outside of this structure but not have it connected to the street by driveway.
Mr. Hickok stated that it is possible, but the primary use is for storage and he believes it
is the petitioner's intent not to have a driveway back there.
Ms. Savage asked if the petitioner had any problem with the stipulations.
Mr. Hickok stated that they had received the report and they did not hear anything any
concerns.
Ms. Savage asked if there would be a problem with the Planning Commission making a
recommendation in the absence of the petitioner.
Mr. Hickok stated that the Commission would be well within its right to make a
recommendation because the petitioner knew about the meeting.
Ms. Savage asked if anyone in the audience wished to address this special use permit.

Ms. Mary Shogren, 524 Dover Street, stated that she and her husband live right next
door. They bought the house in October. In November, the petitioner poured the slab.
Throughout their moving in, the petitioner has had a truck sitting on the yard where the
building is going to be built right now. They are wondering if there is a drainage plan,
because the trusses are fairly large and they are concerned about water running into
their basement. There is also no footing for the building and they are wondering if that
is required.
Mr. Hickok stated that the building will have to meet all building code requirements for
the State of Minnesota. The Building Inspection staff is aware that this slab had been
poured and are very cognizant of the requirements to support the weight of the
structure. All the necessary modifications will be made to do whatever is necessary. As
far as the water concern, the code states that in no case can construction or grading on
a property detrimentally affect adjacent property.
Ms. Shogren stated that the trusses are really large and they will go over the property
line because of where the slab sits. She is concerned that her property value will go
down because this structure is going to be built right outside her kitchen door.
Mr. Kuechle stated that the proposed building is 23 feet by 23 feet.
Ms. Shogren asked if they know how far away from the property line is right now.
Mr. Hickok stated that it is illustrated at five feet from the property line and code requires
that an overhang on a structure not exceed 24 inches. There needs to be three feet of
separation between the edge of the overhang and the property line.
Ms. Shogren asked if the building will have street appeal and not just some building
thrown up there.
Ms. Savage stated that is part of the stipulations.
Mr. Hickok stated that they require that the structure will be compatible with the
elements of the principal structure.
Ms. Shogren asked how wide the door on the building will be. She heard that if a door
is wider than eight feet, the accessory building could serve as a second garage, which
the City of Fridley does not allow.
Mr. Hickok stated that is not correct. There was a special use request where a
gentleman was making a request to reuse an older garage and demolish everything
else on the entire site and it was their claim that they would not need the accessory
building that would remain for vehicles. In that case, the City asked them to remove the
overhead door and use a standard door. The Commission recommended that it have a
standard overhead door. Beyond that discussion, there is nothing in the code that
would prohibit them from doing a standard garage door on this garage.

Mr. Kondrick stated that the fifth stipulation cites that the siding and the roof materials
shall match the exterior of the existing home.
Ms. Savage stated that the petitioner will be going to the City Council on February 7 so
if Ms. Shogren has any additional concerns, she can attend the Council meeting.
Ms. Shogren thanked the Commission.
MOTION by Mr. Kondrick, seconded by Mr. Kuechle, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED
THE MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:45.
Mr. Kondrick stated that he did not have a problem with the special use permit or the
stipulations.
Ms. Savage stated she concurred and feels that it falls within the requirements.

Mr. Hickok stated that Telemet & Process Controls, Inc., and the City of Minneapolis
are requesting to add the Minnea olis Waterworks site at 4500 Marshall Street and the

Ms. Warren stated that the mascot was put together to lace a little lighter note on the program so
Val, the mascot, can go out to different community vents to visit with everybody. If anyone has
any questions about the Values First program the can give her a call.
Councilmember Barnette stated that this prog m has gone in the right direction. Sports violence
is seen in the community and it is import nt to make the point that you can be involved in
competitive hard-hitting sports without le ing it become violent. They are trying to tie in the
Values First logo with as many program as they can.
Mayor Jorgenson thanked Ms. Warre and Val the mascot for coming and stated that the Values
First program fits right in with their ore values.

Mr. Burns, City Manager, stated that the request comes from Vern Haldorson for a 528
square foot accessory structure. Since the structure is within the combined square footage
for garage and accessory structures that is allowed by our code, and since the accessory
structure is well suited for the site, staff recommended Planning Commission approval.
The Planning Commission gave their unanimous approval to this action at their
January 19, 2000 meeting, subject to five stipulations. Staff recommended Council's
approval.
APPROVED SPECIAL USE PERMIT, SP #99-13, BY VERN HALDORSON
WITH THE FOLLOWING FIVE STIPULATIONS: 1) At staffs discretion,
inspections will be conducted of the yard area between the street and the garage
and, if found to be regularly used as a driveway, a hard surface drive shall be
constructed by the petitioner within three months of receiving such notice from the

The Regular Meeting of the Fridley City Council was called to order by Mayor J Benson at
7:37 p.m.

Mayor Jorgenson led the Council and audience in the Pledge of Allegia ce to the Flag.

Barbara War n - Values First Pro ram
Ms. Warren, from e Values First Program, stated that she wanted to thank the City of Fridley
for their support of this program. She said it had been a very fun ten months to watch this
organization de elop. They have been doing many projects and spent a lot of time figuring out
where they ar going to and what they are going to do in the year 2000. They want to spend time
on public re tions, visibility, their image and getting the message out.
Ms. W en stated that in the year 1999, they brought a speaker to the middle school about
charac r building. It was on respect and responsibility and the reaction of the students showed
that e made an impact. They also held an event at Medtronic on sports violence.
s. Warren stated that she wanted to unveil the Values First mascot.
The Values First mascot, Val the Bear, came out to meet Council.

that his compre ensive sign plan be amended to allow logos. He make this request on
behalf of a new enant, Motorcycle Safety Center. Staff recommended approval of the
amendment, subj ct to following stipulations:

INC. AND AUTHORIZING EXECUTION OF A REVISED GRANT
AGREEMENT:
Mr. Burns, City Manager, stated that in Jun of 1998 Council approved a grant of$5,000
from unused Section 8 housing funds to Eli Transitional Housing. The grant was to be
used by Elim for loans to assist low income ho ing candidates to retire debt on Unlawful
Detainers (UD's). Late last year, Staff determ. ed that Elim had not spent any of the
grant money. Elim pointed out that they had no had a candidate that meets the profile
contained in our grant agreement language. They Iso pointed out that other issues were
more prevalent in keeping individuals from suit ble housing. In response to these
discussions, we are proposing that Council accept nguage changes to our agreement
with Elim that would broaden the scope of allowable ans to those in need of affordable
housing. In addition to loans for UD's, we are sugges 'ng that the loans be allowed for
paying utility deposits and old utility bills, telephone h k-ups and old telephone bills,
car repairs, and housing application fees. Staff recomm ds Council's concurrence in
these changes.
