REQUEST
Jay Windschitl, of Tradition Homes, Inc. is requesting to replat the property
located at 5541 5th Street, to create 5 separate lots from part of Lot 26 and Lots
27, 28, and 29, Block 7, Hamiltons Addition to Mechanicsville, in order to
construct a 4-unit owner occupied town home development.
ANALYSIS
The subject property is zoned R-3, Multi-Family, as are all surrounding
properties. A wrecking permit was issued in 2002 to remove the home and
garage, both of which were constructed prior to 1951. The property as it exists
today is vacant.
City Code requires that lots in the R-3, Multi-Family zoning district have a
minimum lot area of 15, 000 square feet for a four unit dwelling. The subject
property is 19,007 square feet, which exceeds the minimum requirements. The
proposed town home development also meets all setback and lot coverage
requirements.

City Staff recommends approval of this preliminary plat request, with stipulations.

Stipulations
City Staff recommends that the following stipulations be placed upon approval of
this request.
1. The final landscape plan shall meet code requirements for number of
and size of plantings and be reviewed and approved by City staff prior
to issuance of a building permit.
2. All landscaped areas shall have irrigation installed.
3. Brick on building elevations shall be extended up to the banding
element above the garages. (Shown on submitted elevations)
4. A grading and drainage plan shall be submitted and approved by the
City's engineering staff prior to issuance of a building permit.
5. A utility plan shall be submitted and approved by the City's engineering
staff prior to issuance of a building permit.
6. Individual services will be required for each unit.
7. Petitioner shall provide easements as shown on preliminary plat.
8. The petitioner shall pay applicable park dedication fee of $1,500 per
unit prior to the issuance of any building permits.
9. The petitioner shall provide proof that any existing wells or individual
sewage treatment systems located on the site are properly capped or
removed.
10. Association documents to be filed with final plat.
11. A Development Agreement outlining the Developer's obligation to
install utilities, etc., will be prepared by the City and shall be signed by
the Petitioner, prior to final plat approval.

Ms. Stromberg explained that Jay Windschitl, of Tradition Homes, Inc., is requesting to replat
the property located at 5541 5th Street to create 5 separate lots from part of Lot 26 and Lots 27,

Ms. Stromberg stated that the property is zoned R-3, Multi-Family, as are all surrounding
properties. A wrecking permit was issued in 2002 to remove the home and garage, both of
which were constructed prior to 1951. The property as it exists today is vacant.
Ms. Stromberg stated that the City code requires that lots in the R-3, Multi-Family zoning district,
have a minimum lot area of 15,000 square feet for a four unit dwelling. The subject property is
19,007 square feet which exceeds the minimum requirements. The proposed town-home
development also meets all setback and lot coverage requirements.
Ms. Stromberg stated that City Staff recommends approval of this preliminary plat request as it
provides additional housing opportunities for Fridley residents, with the following stipulations:
1. The final landscape plan shall meet code requirements for number of and size of
plantings and be reviewed and approved by City staff prior to issuance of a
building permit.
2. All landscaped areas shall have irrigation installed.
3. Brick on building elevations shall be extended up to the banding element above
the garages (shown on submitted elevations).
4. A grading and drainage plan shall be submitted and approved by the City's
engineering staff prior to issuance of a building permit.

Mr. Saba asked if these town-homes will be owner occupied.
Ms. Stromberg replied that yes, they will all be owner occupied.
Chairperson Savage asked if the staff has received any comments about this proposal.
Ms. Stromberg stated the staff received one call from a neighbor who was inquiring about the
height of the structure and she had drainage concerns. Staff explained to her that the grading
and drainage plans are reviewed and approved by the city engineering staff.
Ms. Johns asked if, in developments such as this, the residents are required to keep their
garbage and recycling bins inside the garage.
Ms. Stromberg explained that they are allowed to store them in the side yard. On this site, 5th
Street is the front yard for the whole development because that is where their main access is.

Mr. Kuechle asked if the four lots are underneath the buildings themselves and the fifth lot is the
common area.
Ms. Stromberg stated that is correct.
Mr. Kondrick asked what is the height of the structure.
Mr. Windschitl, petitioner, stated the building is 36.5 feet tall which meets the city ordinances.
He also stated he has no objections to the stipulations recommended by staff.

Dr. Burns, City Manager, stated the petitioners are seeking to replat their
property into two single-family lots. The Planning Commission held a public
hearing on May 5, 2004, and pproved the plat request by a unanimous vote,
subject to 12 stipulations. Sta. recommends Council's approval.

6. Appointment— City Employees.
Dr. Burns, City Manager, stated staff is recommending the appointment of
Rebecca Brazys to the position of Licensing and Records Technician. Rebecca
has been serving as Council Secretary and will continue in that role as well as in
the role of full-time employee. Prior to coming to Fridley, Rebecca worked as an
executive secretary for Scherer Brothers Lumber and Old Home Foods. She
also worked for Porter County, Indiana, as an administrative assistant and
secretary for ten years. Rebecca holds an Administrative Staff Certificate from
the Carlson School of Management at the University of Minnesota.
Approved the appointment of Rebecca Brazys to the position of Licensing
and Records Technician.
Dr. Burns, City Manager, stated staff recommends the appointment of Gina
Saucedo to the position of Fridley Police Officer that was vacated by the
promotion of Jim Mork to Sergeant. Gina graduated from St. Paul Central High
School in 1990. After hig school, she attended cosmetology school and
became a certified cosmetolo 'st. She developed an interest in law enforcement
and began taking law enforce ent classes in 1997. She graduated from North
Hennepin Community College
it
a degree in Law Enforcement in 2000. After
completion of police skills trainin in St. Paul, she worked as a security officer for
American Security and as an 9ffice Technician and CSO for the City of
Robbinsdale. In 2003, Gina bega working as a licensed police officer for the
Mille Lacs Tribal Police Department.
Approved the appointment of Gin Saucededo to the position of Fridley
Police Officer.

the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

Dr. Burns, City Manager, stated th6 purpose of this action is first to ratify or
reconfirm all previous actions of the`'City with regard to Vineland Park Plat and
the land swap with certain easements.granted to each of the parties, the City of
Fridley and School District No. 14. he second part of this action reauthorizes
staff to finalize the documents by coll cting all pertinent signatures and filing said
documents with Anoka County. he preliminary Vineland Park Plat was
approved in 1996 and the final plat as approved and filed in 2002. Tonight's
action completes the land swap bet en the City of Fridley and School District
14 that was started in 1996, reaffirms II previous actions, and authorizes staff to
execute quit-claim deeds, well certifi tes and easements associated with the
land swap. The new plat recognizes xisting land uses by the City and School
District No. 14 and eliminates confusi n created by the existence of City and
district buildings and facilities on pro erty owned by the other entity. Staff
recommends Council's approval.

5. Approve School Resource Officer Se ice Agreement between the City of
Fridley and School District No. 14.
Dr. Burns, City Manager, stated the City as been providing school resource
officers for the Fridley Middle School and H h School since 1994. Until now, all
of the costs for salary and benefits have bee borne by the City. The agreement
establishes district responsibility for half of he salary and fringe benefit costs
during the nine months that school is in ses ion. The officers will serve at the
direction of the Fridley Public Safety Direct and will be a resource in both
schools for faculty and administration. The ag eement runs through the last day
of the current school year and is subject to re ewal on an annual basis. Staff
recommends Council's approval.

CONSTRUCTING A 4-UNIT TOWN HOME DEVELOPMENT, GENERALLY
LOCATED AT 5541 5TH STREET NE.
WHEREAS,the Planning Commission held a public hearing on May 5, 2004, and recommended
approval of said plat; and
WHEREAS, the City Council approved the preliminary plat for FIFTH STREET
TOWNHOMES at their May 24, 2004, meeting, with stipulations attached as Exhibit A; and
WHEREAS, a copy of the plat FIFTH STREET TOWNHOMES has been attached as Exhibit B.
NOW, THEREFORE, BE IT RESOLVED, that the City Council approves the Final Plat for
FIFTH STREET TOWNHOMES and directs the petitioner to record plat at Anoka County
within six months of this approval or such approval shall be null and void.

EXHIBIT A
STIPULATIONS
1. The final landscape plan shall meet code requirements for number of and size of
plantings and be reviewed and approved by City staff prior to issuance of a building
permit.
2. All landscaped areas shall have irrigation installed.
3. Brick on building elevations shall be extended up to the banding element above the
garages. (Shown on submitted elevations)
4. A grading and drainage plan shall be submitted and approved by the City's
engineering staff prior to issuance of a building permit.
5. A utility plan shall be submitted and approved by the City's engineering staff prior to
issuance of a building permit.
6. Individual services will be required for each unit.
7. Petitioner shall provide easements as shown on preliminary plat.
8. The petitioner shall pay applicable park dedication fee of$1,500 per unit prior to the
issuance of any building permits.
9. The petitioner shall provide proof that any existing wells or individual sewage
treatment systems located on the site are properly capped or removed.
10. Association documents to be filed with final plat.
11. A Development Agreement outlining the Developer's obligation to install utilities,
etc., will be prepared by the City and shall be signed by the Petitioner,prior to final
plat approval.
