The City reserves the right, based on a case by case analysis, to waive any of the above requirements. VACATION PROCESS se: A vacation is an act by the City where the City gives up its right of HE r"UN A w7' use of a right of way or an easement for a public purpose. z ,.�;. Vacation requests can be made for streets, alleys, or easements. trite ve` : x 'K velopme The Vacation process begins by filling out a VACATION APPLICATION. This, with a site plan, and other appropriate drawings, must be submitted to the Planning staff. The legal description of the area to be vacated must also be included. A$250 fee is required with the application. Fees are non-refundable and are used for postage, publication of notices and other expenses associated with the request. The applicant may need to hire a registered-land surveyor to prepare the legal description of the item to be vacated. Once the application is received, the application is reviewed by staff from the Planning, Engineering, Assessing, Fire, and Police Departments. The impacts to adjacent properties are discussed, and stipulations are developed. Simultaneously, a mailing list of all properties within a 350 foot radius of the property is generated. Notices of the request are sent to these property owners. There is approximately four weeks between the application due date and the Planning Commission meeting. Prior to the meeting of the Planning Commission, a staff report is written, and the petitioner called regarding the staff recommendation. The Planning Commission is made up of seven residents of the community. The meetings are held the first and third Wednesdays of the month at 7:30 pm in the Council Chambers in the Municipal Center. The Planning Commission is an advisory commission to the City Council. It is the responsibility of the Planning Commission to conduct a public hearing, gather testimony and make a recommendation to the City Council regarding all vacation requests. The City Council may only consider vacation requests if all affected property owners petition for the vacation. This is especially critical for street and alley vacation requests. The property is located near the intersection of Mississippi St. and Highway 65. The adjoining property owners are requesting a utility easement across the back 10 feet of the HRA lot (see attached map) to connect to the City's sanitary sewer system. The property owners are planning to construct a new home on the lot and can only access the sewer system via the HRA site. There is an existing 5 foot drainage and utility easement, but from a practical standpoint this is inadequate for a sewer pipe. The petitioner is requesting that the HRA expand the easement to a full 10 feet. The cleanest way to accomplish this is to vacate the existing 5 foot easement and create a new 10 foot easement. The vacation request would have to go through the Planning Commission and be approved by the City Council. Recommendation Staff recommends that the HRA grant a 10 foot drainage and utility easement along the north property line of 1015 Mississippi St. subject to the following conditions: 1. The petitioner would prepare all easement language and documents (subject to review by HRA legal counsel) and pay all recording costs. The language would include provisions that the beneficiary of the easement would be responsible for restoring any property that was damaged as a result of construction in the easement area. 3 F � 1015 Mississippi Street August 28, 1998 Page 2 2. The motion carried unanimously. Mr. Bolin stated the petitioner, Mr. Pearson, is requesting that the City vacate the current five-foot utility easement along the rear property line at 1015 Mississippi Street, and then grant a 12-foot utility easement along the back edge of that property. The purpose of the easement is to provide utilities to a recently created lot at 6526 Brookview Drive. Mr. Bolin stated the home at 1015 Mississippi Street was built in 1951. The home has structural problems. The Housing and Redevelopment Authority (HRA) purchased the site in the spring 1998. The home was removed in July 1998. The code requires a utility easement of 12 feet along rear property lines when an alley is not present. Mr. Bolin stated staff recommends approval of the utility easement vacation and rededication. The 12-foot easement is necessary to provide utilities to the neighboring property. The lot split which created the lot on Brookview Drive was approved by the City Council in November 1998. The property owner to the north of the new lot will not grant an easement for the utilities; therefore, it is necessary to come across the City's lot. By going through this process, the City's lot will then be in conformance with the required City codes for having a 12-foot easement. Mr. Kondrick asked if staff had received any comments from the neighbors. Mr. Bolin stated he had received one call from a citizen who wanted to know what the utility easement/vacation was. Mr. Kuechle asked if this would create any problems with the offset of the easements. Easements are normally 5 feet on either side of the property line and this will be 12-feet on one side. Mr. Bolin stated that once it gets across the City's property, then the easements will be fine the rest of the way. Mr. Hickok stated the new house that will be built at 6526 Brookview Drive will be able to cut at a diagonal to get to the utilities if necessary. That offset of 10 feet on one lot and 12 feet on the next will not cause problems. Mr. Kuechle asked if this is also true on the west side. Medtronic ha applications. Her presentation will go through the staff analysis and reports for the master plan, the preliminary plat and the street vacation. After the Planning Commission has made a recommendation to the City Council, sta will then review the requests for a zoning text amendment and the special use Perm' . The Community Development Department compiles the comments from all of e City's departments; in this case, the Police Department, Fire Department, Enginee ' g, and Building Division in making a report to the Planning Commission and, ultimate , to the City Council. Ms. Dacy stated the first request is for approval of the aster plan. The purpose of the master plan is to create a guide plan for the corporat office campus. There are four elements that will be part of this campus: 1. The worldwide corporate headquarters; 2. A research and development center located on the development; 3. An education center where there will be a number of physicians and clients that will come to Fridley and go to this ce er to learn more about the petitioner's business and products; and 4. Facilities to house the neuro part the business which will be in addition to an existing facility in Columbia Hei ts. Ms. Dacy stated that, in addition, the"petitioner is indicating about 1 million square feet of corporate office space is anticipated for the site. However, the environmental review process (AUAR) analyzed the impacts of up to 1.6 million square feet of development on the site. The AUAR assume there would be build-out over the next decade in about 400,000 square foot inremen At the last HRA meeting, the HRA made a determination and motion to ecommend to the Planning Commission and the City Council that this proposed c evelopment is consistent with the City's redevelopment plan. Ms. Dacy stated Pha1 is proposed to encompass six buildings on the eastern half of the site. The corpor to headquarters building will have the administrative offices for the company. The bu' in will have four floors, approximately 138,000 square feet, and the overall heigh of the building will be approximately 85 feet. The neuro building is proposed to be 128,000 square feet on three floors, and approximately 70 feet in height. The term penthouse refers to the area where the mechanical equipment is enclosed. The research building is just under 61,000 square feet on three floors, with an approximately height of 55 feet. The education building will also be three floors and approxirp`ately 55 feet in height. The campus commons building will be approximately 40 fee0and will house the support types of uses including the cafeteria, auditorium, fitne center and information resource center. The central plant facility is the building y whh will contain the central heating and cooling equipment for the campus. Overall height of this structure will be 40 feet with a rooftop screen for the equipment.
