N.W., ANDOVER, MINNESOTA 55304 (763) 862-4200 FAX (763) 862-4201 April 30,2004 Stacy Stromberg City of Fridley 6431 University Ave.NE Fridley,MN 55432 RE: Preliminary Plat/Lot Split Capretz Addition Dear Stacy, We have reviewed plan for the Capretz Addition Preliminary Plat/Lot Split, located on the east side of CSAH 1 (East River Road) near Glenn Creek Road within the City of Fridley, and I offer the following comments. It should be noted that when we received the preliminary plat of the Capretz Addition for review, we were also in the process of reviewing the property as a request from Mr. Capretz to widen the existing access to the property. The existing Right of Way corridor on CSAH 1 should be adequate for future reconstruction purposes. No additional right of way will be required at this time. It appears that there are obstructions for the sight corner in the southeast quadrant for access to Lots 1 and 2. The obstructions are trees located outside of the county right of way and consequently, are considered non-correctable. The city/developer shall ensure that all applicable intersection sight distance requirements are met to the fullest extent possible for this site. Access to Lots 1 and 2 shall be made within 30 ft of their common property line. The right of access along CSAH 1 shall be dedicated to Anoka County with exception of the south most 30ft of Lot 1 and the north most 30 of Lot 2. It is recommended that each access be defined and separated with 136-18 curb and standard curb drops and aprons(See attached Concrete Apron Detail). A single,wide opening to serve both lots is not acceptable and would likely lead to future requests from property owners to modify and/or separate the driveways,which this department would not be supportive of. It should be noted that based upon our review of this site, it appears that unauthorized access to the Capretz property is currently being made via the City's bike/ped path(see photograph 1 attached). Ms. Stromberg explained that Jay Windschitl, of Tradition Homes, Inc., is requesting to replat the property located at 5541 5th Street to create 5 separate lots from part of Lot 26 and Lots 27, PLANNING COMMISSION MEETING, MAY 5, 2004 PAGE 4 28, and 29, Block 7, Hamiltons Adition to Mechanicsville, in order to construct a 4 unit owner- occupied town-home development. Ms. Stromberg stated that the property is zoned R-3, Multi-Family, as are all surrounding properties. A wrecking permit was issued in 2002 to remove the home and garage, both of which were constructed prior to 1951. The property as it exists today is vacant. Ms. Stromberg stated that the City code requires that lots in the R-3, Multi-Family zoning district, have a minimum lot area of 15,000 square feet for a four unit dwelling. The subject property is 19,007 square feet which exceeds the minimum requirements. The proposed town-home development also meets all setback and lot coverage requirements. Ms. Stromberg stated that City Staff recommends approval of this preliminary plat request as it provides additional housing opportunities for Fridley residents, with the following stipulations: 1. The final landscape plan shall meet code requirements for number of and size of plantings and be reviewed'and approved by City staff prior to issuance of a building permit. 2. Ms. Stromberg stated the staff received one call from a neighbor who was inquiring about the height of the structure and she had drainage concerns. Staff explained to her that the grading and drainage plans are reviewed and approved by the city engineering staff. Ms. Johns asked if, in developments such as this, the residents are required to keep their garbage and recycling bins inside the garage. Ms. Stromberg explained that they are allowed to store them in the side yard. On this site, 5th Street is the front yard for the whole development because that is where`their main access is. Hilltop has also been a member and participant. The resolution asks Council to commit to membership for another two years at an annual cost of$5,782. Staff recommends Council's approval. Resolution No. 2004-53 Approving a Plat, PS #04-02, Capretz Addition, by John F. and Sandra K. Capretz, for the Purpose of Creating Two Single Family Lots, Generally Located at 7335 East River Road NE (Ward 3). It was unanimously approved by the Planning Commission on May 24 with the following twelve stipulations- 1. tipulations:1. Property owner of record shall obtain all necessary permits prior to construction. 2. Property owner of record at time of building permit application to pay required $1,500 park fee prior to issuance of building permits. 3. Property owner of record at time of building permit application to pay all water and sewer connection fees prior to issuance of a building permit. 4. Property owner of record at time of building permit application shall obtain a permit from Anoka County for any work done within the county right-of-way. 5. Petitioner to properly maintain Lot No. 1 until sale occurs. 6. Provide proof that any existing wells or individual sewage treatment systems located on the site are properly capped or removed. 7. Petitioner shall provide easements as shown on preliminary plat drawing. 8. Grading and drainage plan to be approved by City's engineering staff prior to issuance of any building permits, in order to minimize impacts to the surrounding properties. 9. Each property shall have their own access onto East River Road, defined and separated with 136-18 curb drops and aprons. 10. Access to lots 1 and 2 shall be made within 30 feet of their common property lines. 11. Property owner of record at time of building permit application to obtain residential access permit from Anoka County Highway Department for the new access to Lot 1. 12. Resolution Extending the Term of the Southern Anoka County Community Consortium Joint PoW ers Agreement. Dr. Burns, City Manager, state Fridley has been a part of the Southern Anoka County Community Consortium since th early 90's. SACCC has sponsored the Values First Program and served as a discuss' n forum for Fridley and Columbia Heights city and school district representatives. Hill p has also been a member and participant. The resolution asks Council to commit to embership for another two years at an annual cost of $5,782. Staff recommends Cou nil's approval. THIS ITEM WAS REMOVED FROM CO SENT AGENDA AND PLACED ON THE REGULAR AGENDA. RESOLUTION NO.2004-53 RESOLUTION APPROVING A PLAT, P.S. #04-02, CAPRETZ ADDITION, BY JOHN F. AND SANDRA K. CAPRETZ, FOR THE PURPOSE OF CREATING TWO SINGLE FAMILY LOTS, GENERALLY LOCATED AT 7335 EAST RIVER RAOD NE. WHEREAS, the Planning Commission held a public hearing on May 5, 2004, and recommended approval of said plat; and WHEREAS, the City Council approved the preliminary plat for CAPRETZ ADDITION at their May 24, 2004, meeting, with stipulations attached as Exhibit A; and WHEREAS, a copy of the plat CAPRETZ ADDITION has been attached as Exhibit B.
