RE: Preliminary Plat/Lot Split
Capretz Addition
Dear Stacy,
We have reviewed plan for the Capretz Addition Preliminary Plat/Lot Split, located on the east side of
CSAH 1 (East River Road) near Glenn Creek Road within the City of Fridley, and I offer the following
comments.
It should be noted that when we received the preliminary plat of the Capretz Addition for review,
we were also in the process of reviewing the property as a request from Mr. Capretz to widen the
existing access to the property.
The existing Right of Way corridor on CSAH 1 should be adequate for future reconstruction
purposes. No additional right of way will be required at this time.
It appears that there are obstructions for the sight corner in the southeast quadrant for access to
Lots 1 and 2. The obstructions are trees located outside of the county right of way and
consequently, are considered non-correctable. The city/developer shall ensure that all applicable
intersection sight distance requirements are met to the fullest extent possible for this site.
Access to Lots 1 and 2 shall be made within 30 ft of their common property line. The right of
access along CSAH 1 shall be dedicated to Anoka County with exception of the south most 30ft
of Lot 1 and the north most 30 of Lot 2. It is recommended that each access be defined and
separated with 136-18 curb and standard curb drops and aprons(See attached Concrete Apron
Detail). A single,wide opening to serve both lots is not acceptable and would likely lead to
future requests from property owners to modify and/or separate the driveways,which this
department would not be supportive of. It should be noted that based upon our review of this site,
it appears that unauthorized access to the Capretz property is currently being made via the City's
bike/ped path(see photograph 1 attached).

An Residential Access Permit will be required for a new access to Lot 1 (permit fee=$150.00)
and a permit to work within the county right of way will be required of the contractor making the
access modifications within the Right of Way(permit fee=$110.00). Since Lot 1 already has an
access,no access permit will be required for Lot 2,Please contact Josie Scott, Traffic
Engineering Technician, for additional information on the permit process.

Analysis
The petitioners, John and Sandra Capretz are seeking to replat the property located at
7335 East River Road into 2 single-family lots.
The existing home was built prior to 1949 and is located on the southern portion of the
lot. The existing lot is approximately 170 ft. by 234 ft, which is 39,780 square feet. The
petitioner plans to sub-divide the lot into 2 single family lots, one of which will
accommodate the existing home and the other will allow for the construction of a new
single-family home.
Fridley requires that lots in the R-1 district be a minimum of 75' in width with a minimum
total lot area of 9,000 square feet. The proposed Lot #1 will be 75 feet in width and
16,790 square feet in size after the replat. The proposed Lots #2 will be 93.44 feet in
width and 22,600 square feet in size after the replat.

and sewer connection fees prior to issuance of a building permit.

MOTION CARRIED UNANIMOUSLY.
1. PUBLIC HEARING
Consideration of a Preliminary Plat, PS #04-02, by John and Sandra Capretz, to divide
one single family lot into two single family lots, generally located at 7335 East River
Road NE.
MOTION by Mr. Kondrick, seconded by Ms. Johns, to open the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON SAVAGE DECLARED THE
MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT 7:32 P.M.
Ms. Stromberg explained the petitioners are seeking to replat this property into two single family
lots. The existing home was built prior to 1949 and is located on the southern portion of the lot.

meeting, but their comments have been added as required stipulations. Anoka County has

determined that a single wide driveway is not acceptable, therefore stipulation #9 has been
modified and stipulations 10, 11 and 12 have been added.
Ms. Stromberg stated that City staff recommends approval of this plat request with the following
stipulations as the lots meet the minimum requirements and it provides additional home
ownership opportunities for Fridley residents.
Ms. Stromberg stated that staff recommends that if the preliminary plat is approved, the
following stipulations be attached:
1. Property owner of record shall obtain all necessary permits prior to construction.
2. Property owner of record at time of building permit application to pay required $1, 500
park fee prior to issuance of building permits.
3. Property owner of record at time of building permit application to pay all water and sewer
connection fees prior to issuance of a building permit.

Ms. Stromberg responded that the staff received a letter from Anoka County stating that each lot
must have their own driveway, so they have to grant the second lot access.
Mr. Kondrick asked who would be responsible for the cost of the second driveway.
Ms. Stromberg stated the new property owner would be responsible for the cost of the new
driveway.
Mr. Oquist asked if there are any issues with the existing driveway.
Ms. Stromberg explained that the existing driveway will need to be moved because it is currently
over the property line.
Chairperson Savage asked if the staff had heard any comments from neighbors.
Ms. Stromberg stated they have not.
Mr. Kondrick asked if the property owner is aware that he has to move his driveway.

Ms. Stromberg explained that Jay Windschitl, of Tradition Homes, Inc., is requesting to replat
the property located at 5541 5th Street to create 5 separate lots from part of Lot 26 and Lots 27,

28, and 29, Block 7, Hamiltons Adition to Mechanicsville, in order to construct a 4 unit owner-
occupied town-home development.
Ms. Stromberg stated that the property is zoned R-3, Multi-Family, as are all surrounding
properties. A wrecking permit was issued in 2002 to remove the home and garage, both of
which were constructed prior to 1951. The property as it exists today is vacant.
Ms. Stromberg stated that the City code requires that lots in the R-3, Multi-Family zoning district,
have a minimum lot area of 15,000 square feet for a four unit dwelling. The subject property is
19,007 square feet which exceeds the minimum requirements. The proposed town-home
development also meets all setback and lot coverage requirements.
Ms. Stromberg stated that City Staff recommends approval of this preliminary plat request as it
provides additional housing opportunities for Fridley residents, with the following stipulations:
1. The final landscape plan shall meet code requirements for number of and size of
plantings and be reviewed'and approved by City staff prior to issuance of a
building permit.
2. All landscaped areas shall 111� ve irrigation installed.
3. Brick on building elevations hall be extended up to the banding element above
the garages (shown on submktted elevations).
4. A grading and drainage plan shall be submitted and approved by the City's
engineering staff prior to issuarjce of a building permit.
5. A utility plan shall be submittednd approved by the City's engineering staff prior
to issuance of a building permit
6. Individual services will be required for each unit.
7. Petitioner shall provide easement as shown on preliminary plat.
8. The petitioner shall pay applicable park dedication fee of$1,500 per unit prior to
the issuance of any building permits.
9. The petitioner shall provide proof thet any existing wells or individual sewage
treatment systems located on the site`are properly capped or removed.
10. Association documents to be filed with final plat.
11. A Development Agreement outlining the Developer's obligation to install utilities,
etc., will be prepared by the City and shall be signed by the Petitioner prior to
final plat approval.
Mr. Saba asked if these town-homes will be owner occupied.
Ms. Stromberg replied that yes, they will all be owner occupied.
Chairperson Savage asked if the staff has received any comments about this proposal.
Ms. Stromberg stated the staff received one call from a neighbor who was inquiring about the
height of the structure and she had drainage concerns. Staff explained to her that the grading
and drainage plans are reviewed and approved by the city engineering staff.
Ms. Johns asked if, in developments such as this, the residents are required to keep their
garbage and recycling bins inside the garage.
Ms. Stromberg explained that they are allowed to store them in the side yard. On this site, 5th
Street is the front yard for the whole development because that is where`their main access is.

INTRODUCTION
The petitioners, John and Sandra Capretz are seeking to replat the property located at
7335 East River Road into 2 single-family lots.
When the City receives a plat request along a County right-of-way, the City needs to
receive comments/stipulations from the County regarding that plat. City staff received
comments from Anoka County on Monday, May 3, 2004, after the planning packets had
already gone out to the Commissioners. The County's comments have since been
added as required stipulations, therefore, stipulation #9 has been modified and
stipulations #10, 11, and 12 have been added.
PLANNING COMMISSION RECOMMENDATION
At the May 5, 2004, Planning Commission meeting, a public hearing was held for PS
#04-02. After a brief discussion, the Planning Commission recommended approval of
plat request, PS #04-02, with the stipulations as presented.
THE MOTION CARRIED UNANIMOUSLY.

hearing on May 5, 2004, and approved the plat request by a unanimous vote,
subject to 12 stipulations. Staff recommends Council's approval.
Approved Preliminary Plat Request #04-02, by John and Sandra Capretz,
with the following 12 stipulations:
1. Property owner of record shall obtain all necessary permits prior to
construction.

Consortium Joint Powers Agreement.
Dr. Burns, City Manage , stated Fridley has been a part of the Southern Anoka County
Community Consortium nce the early 90's. SACCC has sponsored the Values First
Program and served as a discussion forum for Fridley and Columbia Heights city and
school district representatives. Hilltop has also been a member and participant. The
resolution asks Council to commit to membership for another two years at an annual
cost of$5,782. Staff recommends Council's approval.

WHEREAS, the Planning Commission held a public hearing on May 5, 2004, and recommended
approval of said plat; and
WHEREAS, the City Council approved the preliminary plat for CAPRETZ ADDITION at their
May 24, 2004, meeting, with stipulations attached as Exhibit A; and
WHEREAS, a copy of the plat CAPRETZ ADDITION has been attached as Exhibit B.
NOW, THEREFORE,BE IT RESOLVED, that the City Council approves the Final Plat for

months of this approval or such approval shall be null and void.

The Council action described above is only to approve the preliminary plat. You must have an
approved final plat prior to recording at Anoka County. When the final plat has been prepared
by your surveyor, a copy of the plat should be sent to the Anoka County's Surveyor's office for
review. Once that review is completed, please submit three full size copies of the final plat to
the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

The Council action described above is only to approve the preliminary. You must have an
approved final plat prior to recording at Anoka County. When the final plat has been prepared
by your surveyor, a copy of the plat should be sent to the Anoka County's Surveyor's office for
review. Once that review is completed, please submit three full size copies of the final plat to
the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

John F. and Sandra K. Capretz, for the Purpose of Creating Two Single
Family Lots, Generally Located at 7335 East River Road NE (Ward 3).

Dr. Burns, City Manager, stated this request will create two lots out of one. It was
unanimously approved by the Planning Commission on May 24 with the following twelve
stipulations-

$1,500 park fee prior to issuance of building permits.
3. Property owner of record at time of building permit application to pay all water
and sewer connection fees prior to issuance of a building permit.
4. Property owner of record at time of building permit application shall obtain a
permit from Anoka County for any work done within the county right-of-way.
5. Petitioner to properly maintain Lot No. 1 until sale occurs.
6. Provide proof that any existing wells or individual sewage treatment systems
located on the site are properly capped or removed.
7. Petitioner shall provide easements as shown on preliminary plat drawing.
8. Grading and drainage plan to be approved by City's engineering staff prior to
issuance of any building permits, in order to minimize impacts to the surrounding
properties.
9. Each property shall have their own access onto East River Road, defined and
separated with 136-18 curb drops and aprons.
10. Access to lots 1 and 2 shall be made within 30 feet of their common property
lines.
11. Property owner of record at time of building permit application to obtain
residential access permit from Anoka County Highway Department for the new
access to Lot 1.
12. Each property shall be accessed through proper, legal driveways.
Staff recommends Council's approval.

2. Resolution Extending the Term of the Southern Anoka County Community
Consortium Joint PoW ers Agreement.
Dr. Burns, City Manager, state Fridley has been a part of the Southern Anoka County
Community Consortium since th early 90's. SACCC has sponsored the Values First
Program and served as a discuss' n forum for Fridley and Columbia Heights city and
school district representatives. Hill p has also been a member and participant. The
resolution asks Council to commit to embership for another two years at an annual
cost of $5,782. Staff recommends Cou nil's approval.
THIS ITEM WAS REMOVED FROM CO SENT AGENDA AND PLACED ON THE
REGULAR AGENDA.
RESOLUTION NO.2004-53
RESOLUTION APPROVING A PLAT, P.S. #04-02, CAPRETZ ADDITION, BY JOHN F.
AND SANDRA K. CAPRETZ, FOR THE PURPOSE OF CREATING TWO SINGLE
FAMILY LOTS, GENERALLY LOCATED AT 7335 EAST RIVER RAOD NE.
WHEREAS, the Planning Commission held a public hearing on May 5, 2004, and recommended
approval of said plat; and
WHEREAS, the City Council approved the preliminary plat for CAPRETZ ADDITION at their
May 24, 2004, meeting, with stipulations attached as Exhibit A; and
WHEREAS, a copy of the plat CAPRETZ ADDITION has been attached as Exhibit B.
NOW, THEREFORE, BE IT RESOLVED, that the City Council approves the Final Plat for
CAPRETZ ADDITION and directs the petitioner to record plat at Anoka County within six
months of this approval or such approval shall be null and void.
