She was referring to the possibility of a fine levied against a developer if he places the building on the lot wrong. Mr. Boardman said he was not aware of any such ordinance. Besides, he said a mistake like this was a common building mistake, and it would not be fair to fine someone for a honest mistake. Mr. Harris said that question could be discussed later. CONSIDERATION OF "NO PARKING" SIGNS FOR McKINLEY STREET, FROM MISSISSIPPI I STREET TO 66-1/2 AVENUE: Councilman Schneider stated the Council heard opinions expressed by the I residents at the last meeting and stated there are quite mixed opinions as to whether or not parking should or should not*be allowed. He stated he had discussed this matter further with residents and there really was no consensus, even in the same households, whether "no parking" signs should be installed. hie stated, at this point, he would recommend it not be posted, but to alert the Public Works Department regarding the snow plowing to make access easier. Mayor Nee stated the KKKK group has asked for an opportunity i to speak to the Council this evening regarding their program and services. Mrs. Muriel Sharpe, representing Koping with Kids from Kradle to Kindergarten, KKKK, appeared before the Council and presented a slide presentation regarding their program and showing their facilities. Mrs. Sharpe stated Koping with Kids began approximately 2-1/2 years ago when Don Larson retired from the School District. She stated the purpose was to help parents with the im- portant job of parenting. She stated all of their activities have been centered in the Community Education Building and they are open Monday through Friday from 9 to 11 a.m. j Mrs. Sharpe stated parents are not only required to remain at the center with their children, but encouraged to participate in projects with the children. She stated, with the location of the senior citizen high rise close to their i facility, these people are using the center to come with their9 randchildren. NEE MAYOR Publish: October 31 , 1979 November 7, 1979 PUBLIC HEARING MEETING OF NOVEMBER 19, 1979 PAGE 6 Councilman Barnette pointed out that storm sewer isn't being considered in this project and the notice received is a standard form used by the City, but is not involved in this particular project. He explained that the properties.on 69th, with the exception of Anderson's and Bacon's would not be assessed for sewer and j water, but only for the road improvement if this is ordered. i Councilman Schneider stated, in his own mind, he is comfortable with everything, except the street surfacing. He felt there were favorable reactions to the sewer and water or it is not being opposed by anyone that is directly affected, if they can make arrangements regarding the assessments on the corner lots. He felt, as far as the street, there would be only three families using it and questioned if l some improvement could be made, without making it a full surfaced street. L_ Mr. Qureshi stated the only additional cost would be putting a small amount of blacktop on the street. He felt if this wasn't provided, there would be a prob- lem of continually putting a stabilizer on it. Mayor Nee felt the question the three families have to settle is if they are willing to live with the results of the street, after it has been dug up, and f if not, if they are willing to pay to have it paved. No other persons in the audience spoke regarding this proposed improvement. MOTION by Councilman Schneider to close the public hearing. Seconded by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing closed at 9:55 p.m. Mayor Nee informed the people that Council action on this improvement would be at the Council meeting on December 3, 1979. PUBLIC HEARING ON FINAL PL P.S. #79-0i�NNSBRUCK VILLAGES 3RD ADDITION BY DARREL A. FARR DEVELOPMENT MOTION by Councilman Schneider to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing opened at 9:55 p.m. Mr. Qureshi, City Manager, stated, basically, there was a survey error and in { order for the actual buildings to conform with the plat, it is necessary to approve this plat. Mayor Nee stated this plat would involve a slight realignment to correct an error so the plat conforms with the actual structure that has been built. There was no response from anyone in the audience regarding this item of business. MOTION by Councilman Schneider to close the public hearing. Seconded by Council- woman Moses. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the public hearing closed at 9:56 p.m. PUBLIC HEARING ON REVIEW OF MISSISSIPPI RIVER CORRIDOR CRITICAL AREAS PLAN FOR THE CITY OF FRIDLEY: MOTION by Councilwoman Moses to waive the reading of the public hearing notice and open the public hearing. Seconded by Councilman Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unanimously and the i public hearing opened at 9:57 p.m. Mr. Boardman, City Planner, stated the City is trying to fulfill the requirements, I under state legislation, which designates the Mississippi River under the Critical 1 Areas Corridor. He stated the draft plan for the City, regarding the Mississippi River Corridor Critical Areas, is now before the Council. Mr. Boardman stated the plan covers the goals and objectives as laid out in the Comprehensive Plan and there is an implementation section, which is required, that lays out what they anticipate on implementation and capital improvements. 10 PUBLIC HEARING MEETING OF NOVEMBER 19, 1979 PAGE 7 Mr. Boardman stated there are critical area regulations which is an overlay district. He stated these regulations are pretty much laid out by the State. He stated the City is presently operating under state regulations and the City is required to meet those regulations as closely as possible. "a Mr. Boardman stated this plan was recommended for approval by the Planning Commission and changes were made to the plan, as recommended by the Commission. He stated a copy has been sent to the Metropolitan Council for their review and their comments are included. Mayor Nee referred to page 28 of the plan which shows an exception. He stated he understands a single family residence doesn't have to have all the documen- tation. Mr. Boardman stated the primary concern is for a large development. Mr. Boardman stated he knows there is a lot of concern about setbacks. He referred to page 31 of the plan which requires that all new structures and � facilities should not be closer than 40 feet from the bluff line or 100 feet from any normal high water line. He stated these would probably cause the most problems, but the City does have the authority to grant variances in those l areas. j Mr. Boardman stated the procedure for review of the Mississippi River Corridor i Critical Areas Plan was similar to the review of the Comprehensive Plan. He I stated other agencies make a review and submit a recommendation back to the j City. He stated the approval of this plan by the Council would be only for review by the various metro agencies. He stated the overlay district has to go through the normal procedure for ordinance changes. Mrs. Irene Maertens, 144 Riversedge Way, stated she was surprised there were changes by the Planning Commission, as she had attended their meeting, but had to leave before it was over. She stated a week before the public hearing, she had tried to find out information about the FMC property from the Parks and Recreation Director and Planning Department, but to no avail. Mrs. Maertens comment about this plan is that it is very vague. She stated j the vagueness is about the park system and capital improvements. She stated implementing authorities have been assigned, but there are no estimated costs. Mr. Boardman, City Planner, then submitted some estimated figures to Mrs. Maertens. Mrs. Maertens questioned the river access and referred to page 18 of the plan. She stated it says there are no official public access points, but several do exist and one is by her home. She asked about the potential of that being I designated. Mr. Boardman stated the primary access point is from the FMC property and discussion of proposed river access is down by the I-694 bridge. He stated I the area where Mrs. Maertens is located is shown as an overlook and there is j ! access into that park area. Mrs. Maertens stated her only comment on what happened regarding the FMC property is that it didn't go through the Commission channels and came directly to the j Council and Council approved it. She felt they weren't informed of what happened. Mayor Nee stated the item'was brought before Council and the County wanted a j decision within 10 days. I Mrs. Maertens stated even a week before the Planning Commission public hearing the Council already had approved this and the Director of Parks and Recreation stated he didn't know of it. She stated there apparently is a lack of communica- tion on such an important project as this one. Mr. Dick Harris, Chairman of the Planning Commission, stated he was speaking J as a private citizen and wanted to make the Council aware of the unusual boundaries in this plan, as it extends all the way to East River Road. He I felt the stringent conditions shouldn't be placed on persons that live several blocks from the River. He stated this was discussed by the Planning Commission and it was their feeling to let it go, as written, and let the Council decide. I 1 1 20 j REGULAR MEETING OF DECEMBER 3, 1979 PAGE 4 I Mrs. Sharpe stated every Tuesday morning they have crafts and the staff is there as resource people and the parents are encouraged to work with their child on the project. Mrs. Sharpe stated they. presently have enrolled 80 Fridley families and about 87-100 pre-schoolers use the center in an average week. 1 � Mrs. Barb Stillson, representing KKKK, stated, last year when the center was closed, evaluation fd'rms were sent out and the response from this was taken into account in scheduling their program for this year. Mrs. Stillson stated some equipment they felt was needed has been pur- chased and evening meetings were set up and speakers obtained on topics �I the parents had suggested. i ' Mrs. Stillson stated their present funding is through Community Education and a grant obtained from the Anoka County Child Care Association. She I stated this grant expires at the end of December and felt there was no chance of getting another grant from them. Mrs. Stillson stated business and civic organizations have been approached requesting support and they have been more than generous, but they can't j expect them to run an entire program.She stated they are presently looking into another grant, but this wouldn't be available until 1981, and didn't know if they would qualify since they don't actually teach or provide day i i care at the center. `c Mrs. Stillson stated, in talking to the State Representative, there didn't seem to be any funds available for this type of program, and this is the i reason they are coming to the Council. I Mrs. Stillson stated she felt they are a very good support group for the parents of pre-schoolers and the reason for their low budget is that they have much volunteer help. She stated the budget given to the Human Resources j Commission was just a breakdown of the funding they need in order to keep ' the program moving and a more detailed budget of their expenditures is in- cluded in the Council's material. She stated they would be able to con- tinue the year, with the monies from memberships and donations, but do need funding to continue next year. She stated the membership fee is $10 per year per family. Councilwoman Moses stated she visited the center and is convinced it is a very worthwhile program. She stated, from infor- mation that was given her, there are otfier programs around the area where they are working with $50,000-$90,000 budgets. She stated KKKK is asking for $3,100 which will just maintain the program on the same level as it is now, however, members are asking for additional hours on Saturdays and in the afternoon. Mayor Nee questioned how much is contributed by the Community Schools. Mrs. Allison stated right now it is $3,600, however, part of it is the grant monies. Councilman Schneider stated he didn't have an opportunity to visit the center, but the center was mentioned to him by several families and, ap- parently, there are families that want the program. Councilman Schneider asked if they coordinate this program with other a School Districts in Fridley. Mrs. Sharpe stated their mailing list is given to them by School District l ► #14, however, they receive referrals from the entire Anoka County area, and do have parents that come in from District 013 who live in Fridley. She stated they would certainly be willing to talk to persons in the other school districts in Fridley. i I
