A letter will be sent to the applicant to notify him of the Council action and to advise him to comply with the conditions imposed by the City. The letter will also contain any necessary deeds for easements and other pertinent papers for his signature. 9. When all the conditions of the lot split have been complied with, the applicant should file the lot split in Anoka County. 10. ROLL CALL: Members Present: Crowder, Engdahl, Schmedeke, Pierce Member Absent: Meissner 1. LOT SPLIT REQUEST: L.S. #71-04, BROOKVIEW INVESTMENT COMPANY BY VIRGIL HERRICK. Part of Lots 2 and 3, Auditor's Subdivision No. 59. To pro- vide a new building site off 63rd Avenue. Mr. Virgil Herrick, representing Brookview Investment Company, was present. He stated that his group bought this property and decided to build an office on the land facing University Avenue. At the time of the purchase, the property belonged to one person. He had been told that at one time the land was two parcels and this accounts for the "T" shaped property. In order to construct a second office building and get a mortgage for it, the land would have to be split. They felt it was a logical split because the present building fronts on University Avenue and the proposed building would front on 63rd Avenue. One copy of the certificate of survey showed the entire parcel and the second copy showed the piece on University Avenue and the legal descrip- tions were on each survey. Darrel Clark commented that both lots exceed the minimum requirements of this type of zoning which is C-2S, general shopping areas, and requires either 200 feet frontage or 25;000 sq. feet. We have here adequate square footage but it is a little bit short on frontage. The ordinance requires only one of the two. Both parcels have access. The legal descriptions are a little bit long but are not regular metes and bounds descriptions. If there were more lots involved with similar descriptions, we probably would ask that the land be platted. The Subcommittee should consider the lot sizes as far as the Code is concerned and the descriptions which are a little bit lengthy but not too much so. Mr. Schmedeke read the following from Fridley Code: 45.103. Lot Requirements & Setbacks Yards, lot sizes, and open spaces shall be as required in this section for buildings hereafter erected in the C-1, C-1S, C-2 and C-2S Districts . 1. Lot Area A lot area of not less than 25,000 square feet is required for one main building. 2. Lot Width A lot width of not less than 200 feet is required at the required setbacks. From Ordinance No. 441 dated 11/3/69 Plats & Subdivisions-Streets & Utilities- April (6_ 1971 Page 2 Amending 45.103 relating to lot area and lot width requirement: 1. Lot Area A lot area of not less than 25,000 square feet is required for one main building, however, if the lot width for a lot is a minimum of 200 feet, the lot area requirement of 25,000 square feet is waived, and no minimum lot area is required. 2. Lot Width A lot width of not less than 200 is required at the required setback, however, if the lot area for a lot is a minimum of 25,000 square feet, the lot width requirement of 200 feet is waived and no minimum lot width is required. From Ordinance #459 dated 6/15/70 Because of the terrain, there is a lift pump at the street for the sanitary sewer to serve the present building. Darrel Clark said he did not think a second pump would be needed as Mr. Herrick had said that when the plans were drawn for the present building, the utilities were planned for both lots. Mr. Herrick asked about the storm sewer and the Engineering Assistant explained that the storm sewer manhole was at the southwest corner of Moon Plaza. MOTION by Crowder, seconded by Engdahl, that the Plats & Subdivisions- Streets & Utilities Subcommittee recommend to the Planning Commission approval of the lot split request, L.S. #71-04, Brookview Investment Company by Virgil Herrick with the description of that portion of the property as contained in the Suburban Engineering Document written November 17, 1967 showing the entire parcel and a second document showing the piece of property facing University Avenue. Upon a voice vote, all voting aye, the motion carried unanimously. 2. CONTINUED REVIEW OF EXISTING PLAN FOR STREET LAYOUT NORTH OF OSBORNE ROAD: Chairman Schmedeke said he visited the area and found it was larger than he had expected. He felt the area would be a hard one to drain and to install sanitary sewer. Darrel Clark explained the area to be discussed included Osborne Road on the South 85th Avenue on the North, University Avenue on the East and East River Road on the West. Referring to the crossover on University Avenue and 85th Avenue, a signal has been proposed for that intersection and the Agree- ment has been drawn. There are existing signals at Osborne Road and University Avenue and East River Road and Osborne Road. There are no additional signals proposed in 1971 for East River Road. Referring to crossovers, there are three streets that go to East River Road, namely 79th, 83rd and Osborne Road. Pointing out the railroad crossings at the present time, Darrel Clark said there were crossings at 77th Avenue (grade crossing with stop sign and possible elimination) , one North of 79th Avenue, Ironton and 85th Avenue. Planning Commission Meeting - April 7, 1971 Page 6 MOTION by Fitzpatrick, seconded by Schmedeke, that the Planning Commission receive a map designated as Exhibit #1, with the following inscription "Approved 3-23-71 subject to concurrence of City of Fridley, E. J. Lundheim". Upon a voice vote, all voting aye, the motion carried unanimously. a Chairman Erickson referred to the letter in the Agenda on Page 40A from the Fridley Assembly of God Church written by Rev. G. Mark Denyes, pastor. The letter was in protest to another service station at the intersection of Univer- sity Avenue and Osborne Road because there are two filling stations presently there. MOTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission close the public hearing of the rezoning request, ZOA #71-03,to rezone from R-3 to C-2 and a request for a special use permit, SP #71-03, to construct a service station in an C-2 District by the American Oil Company represented by John P. Youngdale. Upon a voice vote, all voting aye, the motion carried unanimously. Mr. Zeglen suggested the item be tabled for at least a month. Mr. Schmedeke would like it delayed also because this evening was the first time they were shown plans and it would only be fair to give the Commission more time for study. Chairman Erickson agreed and also for the sake of not taking up unnecessary additional time of the petitioner. It would be well to continue for 30 days and review after the study of gas stations. MOTION by Zeglen, seconded by Schmedeke, that the rezoning request, ZOA #71-03, and the special- use request, SP #71-03, by American Oil Company be continued for 30 days at which time the Planning Commission should have come to some kind of conclusion after the study of the future development of gas stations. Upon a voice vote, all voting aye, the motion carried unanimously. Chairman Erickson informed the audience that these requests would be heard again on May 5, 1971. 4. LOT SPLIT REQUEST: L S #71-04, BROOKVIEW INVESTMENT COMPANY REPRESENTED BY VIRGIL HERRICK: Far-t of Lots 2 and 3, Auditor's Subdivision No. 59, to provide a new building site off 63rd Avenue. The Engineering Assistant explained that this property is under one ownership at this time. The parcel is divided at the rear of the lot line to make a building site for another structure facing 63rd Avenue. Both parcels are 25,000 square feet. The only question is that of the legal descriptions. They are a bit lengthy but have no angles or bearings. The Subcommittee felt that to require a plat for just two lots was asking for a bit too much. Chairman Erickson asked for the description. He explained the reason .being the obvious relationship of the party involved with the City is such that he did not feel the petitioner should be put into a position where he could get any criticism. Darrel Clark read the description of the parcel where the building now is as Lots 2 and 3 except Sandy Terrace. This would be the first description, the second one is the total description of the first one with the exceptions. -Plannin&Commission Meeting - April 7, 1971 Page 7 Mr. Fitzpatrick asked for further clarification of lengthy descriptions. Darrel Clark said that if there were three or four lots in a row, the descrip- tions would be too difficult, but when there are only two, it is questionable whether or not to plat. If you allow two lot plats, there would be a tremen- dous number of plats. Mr. Schmedeke added that if another party came along with two parcels, under this circumstance, the Planning Commission would have to allow it. Darrel Clark said that on torrens property, metes and bounds descriptions will not be accepted by the County. They would want either a plat or registered land survey. Both of these parcels will be served with sewer from 63rd Avenue. The sewer line would run over to 63rd with a lift pump to the northerly portion of the new parcel. The watermain is on both 63rd Avenue and University Avenue. The lift pump is privately owned. MOTION by Schmedeke, seconded by Fitzpatrick, that the Planning Commission recommend approval to the Council of the lot split request, L.S. #71-04, by Brookview Investment Company, represented by Virgil Herrick, of part of Lots 2 and 3, Auditor's Subdivision No. 59, to provide a new building site off 63rd Avenue. Upon a voice vote, all voting aye, the motion carried unanimously. 10. CONTINUED INFORMAL HEARING ON ADOPTION OF 1970 UNIFORM BUILDING CODE AND THE AMENDMENTS THEREOF: This is a new paragraph to explain the reason for suggesting the changes in the Uniform Building Code. 46.01. . The purpose of this ordinance is to provide standards suited to the environment of our community. Some of these standards are more restrictive than other communities by design, with the intention .of offering the citizens of our community safeguards above the minimum standards established by the Uniform Building Code. The sections noted in this chapter of the code do not deal with the aesthetics of a building but only with the provisions which govern their construction, and it is our intention to pro- mote the health, safety, and general welfare of our community through realistic, practical and enforceable building construc- tion standards. 46.011. Non-controversial. MOTION by Fitzpatrick, seconded by Schmedeke, that the Planning Commission approve 46.011. Upon a voice vote, all voting aye, the motion carried unanimously. 46.021. Chairman Erickson said this section proposes to do what the City had done before. He wrote a letter to U.B.C. referring to the question of roof sheathing. They answered that the Code does permit 12" roof sheathing, and edge block, too. Certain 1j" ply- wood was acceptable for 24" centers. Also 5/8" is acceptable for 24" center. Part of the inspection duty is to be assured the materials are being used that are required. The Chief Building Inspector said the plywood is stamped whether it is ;4", etc. When there is no stamp, the plywood does not meet the requirements. RECEIVING THE MINUTES OF THE BUILDING STANDARDS - DESIGN CONTROL SUBCOMMITTEE MEETING OF APRIL 6, 1971: CONSIDERATION OF A REQUEST TO CONSTRUCT A 4 STALL GARAGE FOR AN APARTMENT BUILDING LOCATED ON LOT 1, BLOCK 1, ERCO'S 1ST ADDITION, THE SAME BEING 6550 - 56 CENTRAL AVENUE N.E. , FRIDLEY, MINNESOTA. (REQUEST BY WILLIAM ZAIER, 6556 CENTRAL AVENUE N.E. , FRIDLEY, MINNESOTA) : The City Engineer reported that the Building Board recommended approval, subject to their stipulations. MOTION by Councilman Liebl to concur with the Building Standards - Design Control Subcommittee and approve the building permit for William Zaier subject to the Board's stipulation. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried unanimously. RECEIVING THE MINUTES OF THE PLANNING COMMISSION MEETING OF APRIL 7, 1971: 1. PROPOSED PRELIMINARY PLAT, P.S. #71-01, SILVER OAKS WEST, BY KEITH HARSTAD: Part of Lot 7, Auditor's Subdivision #22 (Rice Creek Road and Stinson Boulevard - approximately 1� acres) MOTION by Councilman Liebl to set the Public Hearing date for May 10, 1971 for the preliminary plat, Silver Oaks West-. Seconded by Councilman Breider. Upon a voice vote, all voting aye, Mayor Kirkham declared the motion carried Ve unanimously. #2 below 3. AN ORDINANCE AMENDING AND RECODIFYING CHAPTER 46 OF THE FRIDLEY CITY CODE, KNOWN AS THE BUILDING ORDINANCE: (1970 Uniform Building Code) The City Engineer reported that the Ordinance is presented in the Agenda. The Planning Commission has reviewed it and they recommend approval, except the section which was adopted by the City Council by Ordinance in 1967. On Page 41, in regard to sheathing it states: "All walls between attached garages and frame buildings shall have sheathing extending from top plate to bottom plate". This is to give additional separation in the event the sheet rock is broken. After discussion, the Council felt that this section should be left in. MOTION by Councilman Kelshaw to approve the Ordinance as submitted on first reading and waive the reading. Seconded by Councilman Liebl. Upon a roll call vote, Kelshaw, Kirkham, Liebl and Breider voting aye, Mayor Kirkham declared the motion carried.
