LOT SPLIT APPLTGATION FROC10,URE
1 . Obtain application form at City Hall. (6431 University Ave. N.E. , Fridley)
2. Return completed application form with the required sketch of the property
involved and the lot split fee of $15.00 for each original lot being split.
3. The application will be submitted to the Plats & Subdivisions and Streets
& Utilities Subcommittee for recommendations. This Committee mets once a
month, when required. The City will supply the applicant with minutes of
the Subcommittee.
4. Following the Plats & Subs Committee recommendation of approval, the owner
must then obtain a Certificate of Survey on the original parcel or parcels
along with the new pare-.e „reat- � w. 't: al: -xistir4� struc.t.dres tied in.
5. The Certificate of Survey should then contain a simple description of a part
of a platted lot or registered lot and be filed with the Engineering Department
for Planning Commission recommendations. The Planning Commission meets on the
second and fourth Thursday of the month. The City will supply the applicant
With minutes of the Planning Commission.
6, The recommendations of the Planning Commission are submitted to the City
Council for final action. The Council meets on the first and third Monday
of the month.
7. The City Council approval may be subject to certain stipulations which must
be complied with by the applicant.
8. A letter will be sent to the applicant to notify him of the Council action
and to advise him to comply with the conditions imposed by the City. The
letter will also contain any necessary deeds for easements and other pertinent
papers for his signature.
9. Mhen all the conditions of the lot split have been complied with, the applic". t,
ehould file the lot split in Anoka County.
10. In all cases whsre Council action has been sought and denied, no petition for
identical action can be presented until a period of six months has elapsed.

The meeting was called to order by Chairman Schmedeke at 8:20 P.M.
ROLL CALL:

1. LOT SPLIT REQUEST: L.S. #71-11, ALBERT M. JOHNSON: Lot 2, Block 1, Al Rose
Addition -- to split off the North 19 feet of Lot 2 and add to Lot 1.
James L. Lorbeski represented Mr. Johnson.
Darrel Clark explained that Mr. Johnson, in March, 1971, requested a Special
Use Permit to build a double bungalow on Lot 1, Block 1, Al Rose Addition pro-
vided he would make one common driveway. He felt 90 feet was not quite enough
to build a double bungalow and include this provision and therefore, wished to
take the North 19 feet of Lot 2 and add to Lot 1.
He said that sewer and water is served off the back of both lots.
Mr. Crowder asked where the double bungalow would be built. Mr. Clark said
on Lot 1 probably closer to East River Road than the existing house on Lot 2.
Mr. Schmedeke stated the request complied with the requirements of the City
Code as the land was zoned properly and this was a common type of lot split.
MOTION by Crowder, seconded by Engdahl, that the Plats & Subdivisions-Streets
& Utilities Subcommittee recommend to the Planning Commission approval of the
Lot Split Request, L.S. #71-11 by Albert M. Johnson, to split off the North 19
feet of Lot 2, Block 1, Al Rose Addition and add to Lot 1, Block 1, Al Rose
Addition providing this would be only one entrance for both lots onto East River
Road. Upon a voice vote, all voting aye, the motion carried unanimously.
2. LOT SPLIT REQUEST: L.S. #71-12 WALLACE E. ANDERSON: Lot 6, Block 1, Adams
Street Addition. To split off the South 26 2/3 feet and add to Lot 7 for a
buildable site, and add the North 13 1/3 feet of Lot 6 to Lot 5.
3. LOT SPLIT REQUEST: L.S. #71-13, WALLACE E. ANDERSON: Lot 4, Block 1, Adams
Street Addition. To split off the North 26 2/3 feet of Lot 4 and add to
Lot 3 and to split off the South 13 1/3 feet of Lot 4 and add to Lot 5.
Chairman Schmedeke said these two items would be considered together.
Mr. Wallace E. Anderson was present.
The Chairman said he was not exactly in favor of this request, but this was

Mr. Clark said there were houses on Lots 1 and 2. The owner of Lot 1 said
that their biggest concern was that the school should fence the boundaries so
that the children are not permitted access to their rear yard. However, he was
in favor of the vacation.
Mrs. Janet Cisewski, 1559 75th Avenue (West 149.5' of Lot 10 and 11, Block 2) :
She was against the vacation of the streets until the school purchased her two
lots. The School had made an offer for her lots which she did not feel was
adequate.
Mr. Clark said the concern of Mr. Edward Stumpf, 1545 75th Avenue, was that
If these streets were vac4ted, the value of his property would drop because the
lot would be landlocked. He felt the City should not make a final decision on
the vacation until the school is the actual fee owner.
Chairman Erickson agreed that, until the land is actually acquired, the
City cannot vacate it.
Mrs. Cisewski and Mr. Robert Eigenheer (531 Mississippi Street) both said
they were served with condemnation notices. Darrel Clark explained the procedure
of condemnation to them.
Chairman Erickson, speaking to Mr. Munson, said that he felt the Commission
would have no objection granting the vacation if the School owned the property.
It would be better for the Board to wait until the entire property is secured
and then come in. At that time they will be able to make the request as the
owner.
MOTION by Minish, seconded by Zeglen, that the Planning Commission table
the vacation request, SAV #71-06, by independent School District #16 to vacate
75� Avenue from Lakeside to proposed Cleveland Street and proposed Cleveland
Street from 7511 Avenue North 240 feet until the School District had acquired
all the property. Upon a voice vote, all voting aye, the motion carried
un nimously.
7. LOT SPLIT REQUEST: L.S. 471-11, ALBERT M. JOHNSON: Lot 2, Block 1, Al
Rose Addition, to split off the North 19 feet of Lot 2 and add to Lot I.
Mr. Al Johnson said he had made a mistake on the plat as Lot 1 should have
been larger to permit the construction of a two family dwelling, The zonipg
was R-1, and in order to build a double bungalow in an R-1 zoge, it would have
to be done by a special use permit.
Mr. Clark said approval was given for a special use permit with the ptlpu-
lation that there be one common access onto East River Road from hots 1 and 2.
Mr. Johnson said with a common driveway, he would have to go around behind
the back of the house. With the additional 19 feet, the double bungalow could
be placed so that he would meet the setback requirements.
MOTION by Fitzpatrick, seconded by Schmedeke, that the Planning Commission
\ recommend to Council approval of the Lot Split request, L.S. #71-11, for Albert
Johnson to split off the North 19 feet of Lot 2, Block 1, Al Rose AddiLion and
add to Lot 1 concurring with the Plats & Subdivisions-Streets 6 Utilities Sub-

Mr. Wallace Anderson was present.
Mr. Schmedeke, Chairman of the Plats & Subdivisions-Streets & Utilities Sub-
committee explained that the Subcommittee recommended approval of the lot splits
as requested but he voted nay. He said he voted against the requests for the
following reasons: Lots 1 and 2 are not owned by the petitioner. The petitioner
owns Lots 3, 4, 5, 6 and 7. His thinking was that Lots 3 and 4 could be used,
for an 80 foot building site and Lots 5, 6 and 7 could be split into 60 foot
lots. We had a similar situation when the Planning Commission recently approved
the splitting of Lots 9, 10 and 11 into two 60 foot sites over on Washington
Street. Another strong factor, he believed, is Lots 11 and 12 behind Lots 3 and
4 on Washington have one common owner who would probably built on both lots.
Lots 8, 9 and 10 are also under one ownership. He felt his suggestion would
be the sensible way of splitting. He stated the zoning ordinance requires a
75 foot frontage as the minimum size of the lot. He would suggest the following
compromise: The lot on the North would be 75 feet, 65 feet for the next lot
and leave a 60 foot lot on the South. He felt if the Commission would create:
too many substandard lots, especially in this instance when it was not a hard-
ship, there may be other requests coming in with 66 foot lots.
Mr. Anderson said that the property is on a minimal type of street becauae
the East side of Jefferson Street has never been dedicated. It is a glorified
alley. His thoughts were that the lots were as large as possible with the
rear yard facing living rooms and having attached garages and such. Since the
last meeting he thought of a different kind of building for the lots. He felt
an attached garage would be no problem.
Mr. Anderson continued that there are many lots iu the City 65 feet and less.
He felt that by making three equal lots and three comparable building sites that
would be the thing to do. By making the lots of different sizes, you definitely
put a burden on the builder to put something more in one house and riot the
others. Three different types of structures would cost more. The average
person would rather see three comparable buildings. There is a problem with
the debris on the property to the South. He felt that in the best interest of
the adjacent property owners and the City, three equal lots would be preferable.
Mr. Schmedeke asked Mr. Anderson how long he had owned the property and the
answer was two months, however he has been acting as the real estate agent for
the previous owner for two years.

MOTION by Councilman Kelshaw to set the Public Hearing for the final plat !`
by Viewcon for December 13, 1971. Seconded by Councilman Liebl. Upon a voice
vote, all voting aye, Mayor Kirkham declared the motion carried unanimously.
5. FINAL TOWNHOUSE PLAN, VIEWCON, INC. : For Phase I and II for the townhouse
area generally locate 4 mile east of Matterhorn Drive and �j mile north
of Interstate #694, described as Outlot F, Innsbruck North, Section 24.
The City Engineer reported the Planning Commission recommended approval and
showed the plan on the easel.
MOTION by Councilman Kelshaw to concur with the recommendation of the Planning
Commission. Seconded by Councilman Breider. Upon a voice vote, all voting
aye, Mayor Kirkham declared the motion carried unanimously.
6. VACATION REQUEST: SAV #71-06, INDEPENDENT SCHOOL DISTRICT #16: Request
to vacate 75� Avenue from Lakeside to proposed Cleveland Street and pro-
posed Cleveland Street from 753� Avenue north 240 feet.
This item was continued by the Planning Commission.
7. LOT SPLIT REQUEST: L.S. 471-11, ALBEIT M. JOHNSON: Lot 2, Block 1, Al
Rose Addition, to split off the north 19 feet of Lot 2 and add to Lot 1.
MOTION by Councilman Liebl to concur with the recommendation of the Planning
Commission and grant the request for a lot split by Albert Johnson. Seconded
by Councilman Kelshaw. Upon a voice vote, all voting aye, Mayor Kirkham
declared the motion carried unanimously.
8. LOT SPLIT REQUEST: L.S. #71-12, WALLACE E. ANDERSON: Lot 6, Block 1,
Adams Street Addition. To split off the south 26 2/3 feet and add to
Lot 7 for a buildable site, and add the north 13 1/3 feet of Lot 6 to
Lot 5.
9. LOT SPLIT REQUEST: L.S. #71-13, WALLACE E. ANDERSON: Lot 4, Block 1,
Adams Street Addition. To split off the north 26 2/3 feet of Lot 4 and
add to Lot 3 and to split off the south 13 1/3 feet of Lot 4 and add
to Lot 5.
The City Engineer showed the area on the overhead projector and said these two
requests were to combine five 40' lots and make three lots out of them. The
resulting .lots would then be 66 2/3 feet wide. This does not meet the standard
lot size, however, these lots were platted many years ago and seems to be the
best use of these 40' lots. Councilman Liebl asked if granting this request
would be setting a precedent and the City Attorney said that because it is
done once, does not make any action legally binding. Every situation has to
be considered on its merits. Mayor Kirkham added that this type of split has
already been granted in this area. Councilman Harris commented that this
seems to be the most logical use of the substandard lots.
MOTION by Councilman Kelshaw to concur with the Planning Commisison and grant
the requests for the lot splits requested by Wallace Anderson. Seconded by
Councilman Harris. Upon a voice vote, all voting aye, Mayor Kirkham declared
the motion carried unanimously.
