Dear Mr. Utter:
We have reviewed the request for lot split for Lot 6, Block 2, Moore Lake Hills, located east of CSAH 35 (Central
Avenue)and west of Woody Lane within the City of Fridley,and I offer the following comments:
An additional 10 feet of right-of-way adjacent to CSAH 35 is desired for future reconstruction purposes. If
this additional right-of-way is not dedicated at this time,the setbacks for any new structures should allow
for this future right-of-way dedication. It appears that all applicable Sight Distance Criteria can be met at
the existing driveway onto CSAH 35. Access for the parcel adjacent to CSAH 35 is to be made at its
present location. The City and the property owner shall ensure that the development of this site will not
include any landscape features that will obstruct intersection site distance at the access location.
If any work is to be completed within the County Right-of-Way,a permit is required and must be obtained
prior to the commencement of any construction. Contact Roger Butler,Traffic Engineering Coordinator
for this department,for future information regarding the permit process.
It should be noted that residential land use adjacent to highways will usually result in complaints regarding
traffic noise. Traffic noise at this location could exceed Noise Standards established by the US Department
of Housing and Urban Development and the Minnesota Pollution Control Agency. Anoka County policy
regarding new developments adjacent to existing county highways prohibits the expenditure of highway
funds for noise mitigation measures. The City and/or the Developer should assess the noise situation and
take any action deemed necessary to minimize associated impacts at this site from any traffic noise.

DESCRIPTION OF REQUEST:
Mr. James Utter is requesting the subdivision of Lot 6, Block 2 of the Moore Lake Hills Addition
into two lots. The parcel will become Lots 1 and 2, Block 1 of the Everett Addition. Lot 1 will take
access from Woody Lane and Lot 2 will take access from Central Avenue.
SUMMARY OF ISSUES:
The existing lot is 26,650 square feet in area (0.61 acres) and its approximate dimensions are 90 feet
by 285 feet. The lot has frontage on both Woody Lane and Central Avenue. It is currently described
as Lot 6, Block 2, Moore Lake Hills. A house with an attached garage faces Woody Lane. A
detached garage also exists on the property and it accesses Central Avenue.
For lots zoned R-1, Single Family, Chapter 205.07 of the City Code requires that lots be a minimum
of 9,000 square feet and have a minimum width of 75 feet. The minimum width of the proposed lots
is 85 feet and the lots will have an area of 12,900 square feet and 13,750 square feet respectively.
The dimensions and area of the two lots meet the requirements of the City Code.
Proposed Lot 1 contains the existing house; the house will meet all of the setback requirements of
the R-1 District on the newly defined lot. Lot 2 contains the garage. The garage meets the setback
standards for detached accessory structures, but a garage may not exist on a residential property
unless a principal building also exists. A house must be built on the property or the garage must be
removed.
RECOMMENDED ACTIONS:
Staff recommends that the Planning Commission recommend approval of the subdivision request PS
#98-03 with the following stipulations:
1. A house must be built on Lot 2, Block 1, of the Everett Addition within one year of the approval
of the Plat or the garage must be removed.
2. An easement for an additional 10 feet of right-of-way adjacent to Central Avenue NE (CSH 35)
for future reconstruction purposes be recorded with the County.
3. Before a building permit is granted for Lot 2, the grading and drainage plan should be reviewed
and approved by the City Engineering Department.
4. If Lot 2 is to connect to the City utility services located in the right-of-way of Central Avenue NE
(CSAR 35), the connection should be made prior to Anoka County's reconstruction of CSAH 35.

The Highway Department of Anoka County has recommended that an easement be required of the
plat for an additional 10 feet of right-of-way adjacent to Central Avenue (CSH 35) for future
reconstruction purposes. The driveway onto CSAH 35 should be kept in its present location and no
landscape features should be developed that would obstruct intersection site distance.
The topography of'the site is fairly severe in areas. It is especially low north of the driveway that
accesses Central Avenue. Before a building permit is granted for Lot 2, a grading and drainage
plan should be reviewed and approved by Engineering.
Lot 2 needs to be connected to the city sanitary sewer and water systems. If Lot 2 is to connect to the
City utility services located in the right-of-way of CSAH 35, the connection should be made prior
to Anoka County's reconstruction of CSAH 35. The County is planning on constructing CSAH 35
this year. The developer can either have the work done or the City can do the work and assess the cost
to the property.
Due to the creation of one new lot a park fee of$750 and a storm water fee of$1,000 are due before
the granting of a building permit.
RECOMMENDATION

At the May 18th, 1998 City Council Meeting, Mr. James Utter will request Final Plat approval
for the Everett Addition. A resolution and stipulations for the approval of the plat have been
prepared. The final mylars of the Everett Addition have also been prepared and will be
available at the Council meeting. Staff recommends that the City Council approve the
resolution and attached stipulations as presented. The stipulations are as follows:
1. A building permit shall be issued for Lot 2, Block 1, of the Everett Addition within
one year of the approval of the Plat or the garage must be removed.
2. An easement for an additional 10 feet of right-of-way adjacent to Central Avenue
NE (CSAH 35) for future reconstruction purposes be recorded with the County.
3. Before a building permit is granted for Lot 2, the grading and drainage plan should
be reviewed and approved by the City Engineering Department.

Mr. Kondrick agreed with Mr. Saba. He has some mixed emotions about-this. He can
think of some ways to have some other binding restrictions or stipulations on this
property, but he is going to go along with staffs judgment an
commend denial.
Mr. Oquist concurred. In the past, there have been times where they have not agreed
with staff. This time he agrees and feels the same way. He has some mixed emotions.
He has a business and can appreciate the individual and his business. He is not as
concerned about the parking as he is the a on this site and the requirement and need
for a special use permit. They just do ave the stipulations.

County, Minnesota, to create two conforming lots on which to build. Lot 6, Block 2,
Moore Lake Hills will become Lots 1 and 2, Block 1, Everett Addition, generally
located at 6084 Woody Lane N.E.
MOTION by Mr. Kondrick, seconded by Mr. Oquist, to waive the reading of the public
hearing notice and to open the public hearing.

THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:57 P.M.
Mr. Tatting stated the plat request is to subdivide a parcel located at 6084 Woody Lane
N.E. The existing lot is 26,650 square feet. The minimum lot size in the R-1 district is
9,000 square feet. The proposed lots would be 12,900 square feet and 13,750 square
feet. The minimum lot width is 75 feet. Both lots would be 85 feet wide. The property is
zoned R-1, Single Family, as are the surrounding properties.
Mr. Tatting stated the lot is proposed to be split nearly down the middle with the easterly
portion having frontage on Woody Lane to the east and the westerly lot fronting Central
Avenue to the west. The existing house with attached garage on the easterly portion
meets all of the setback requirements. There is a detached garage on the proposed lot to
the west which meets the code requirements; but, for a garage to exist on a parcel, a
principal dwelling also needs to be on the parcel. Anoka County has requested an
additional 10-foot easement along Central Avenue, which he believed had already been
done.
Mr. Tatting stated the topography has a fairly severe slope. The placement of a house on
the proposed Lot 2 could be something of an issue so the Engineering Department

should review the grading and drainage plans before the actual construction of the
principal structure begins.
Mr. Tatting stated proposed Lot 2 also needs City sewer and water. To the west is
Central Avenue with sewer and water lines. The existing house on Lot 1 has sewer and
water from Woody Lane. Running the water and sewer lines from Woody Lane would
require a lift station. It would be easier to bring in service from Central Avenue. The
County is doing work on Central Avenue this summer so it makes sense to put the stubs
in to the property before construction. Also, creating a new lot requires park fees and
storm water fees.
Mr. Tatting stated staff recommends approval of the lot split request with the following
stipulations:
1. A house must be built on Lot 2, Block 1, of the Everett Addition within one year of
the approval of the plat or the garage must be removed.
2. An easement for an additional 10 feet of right-of-way adjacent to Central Avenue
N.E. (CSAH 35) for future reconstruction purposes be recorded with the County.

Mr. Kuechle asked, in stipulation #1, when does a house constitute being built>
Mr. Tatting stated that is when the building permit is issued. It also has a time frame
involved in which the structure must be completed.
Mr. Oquist stated stipulation #5 requires park fees. Is this typical for a house?
Mr. Tatting stated $750 is typical for a lot.
Mr. Saba asked if there are any plans at present to build a house on that lot.
Mr. Tatting stated he is not sure.
Mr. Utter stated they have someone interested in the lot. The lot to the east with access
to Woody Lane and with the house has a signed purchase agreement. The realtor that
has done the work on the sale of that portion of the property also has a buyer interested
in the lot. The easement may have been an issue originally because of the drawings as
drawn up by the surveying firm and sent to the County. The County sent them back with
the changes they wanted to see. He was in contact with Anoka County to see if there are

any problems and he has a letter indicating that they need the 10 feet. The lot that was
south of this parcel was the same and split into two lots. One of the stipulations was that
there is a curb cut for a driveway to the garage and Anoka County requested that this
access point remain the same.
Mr. Kondrick asked if the petitioner has any problems with the stipulations.
Mr. Utter stated, no.

Mr. Saba stated he thought the request was straight forward.
Mr. Oquist recommended changing stipulation #1 to indicate that a building permit be
issued within one year rather than stating a house must be built.
Mr. Kuechle asked if they should add a stipulation that the driveway cut remain the same.
Mr. Tatting stated they did not need it because the Engineering Department will review
the grading and drainage plan and it seems that this is the only logical place to put the
access.
Mr. Utter stated there has been quite a bit of drainage work done from Hillcrest on down,
Last year, the neighbor to the north had their retaining wall fall down and there was only
one drainage basin. They installed another one and put it all the way through the
property. They have also done a lot of work on Central Avenue.

and along Univer 'ty Avenue between Mississippi and 69th. There are some financial
issues to determin whether they are actually going to do this. The County is looking at
doing Community Pa and Locke Park also with a slung coat. Again, there is a financial
issue involved.
Ms. Savage asked if the ounty was considering doing this along University Avenue
along the southern portion f Fridley. There is a lot of improvement needed there.
Mr. Tatting stated he was not ure. The trails he listed earlier were the only trails
mentioned.
Mr. Kuechle asked if anything wassroposed to happen to the trail between the
Mississippi River and East River Ro``aad.
Mr. Tatting stated he did not think so. The County only mentioned Community Park and
Locke Park.
Mr. Saba asked if there were any plans to Taintain the excessive weed growth along the
bike trail on University. This is a trail that ge a lot of use but looks terrible.
Mr. Tatting stated this trail is in the State right -way and MnDOT only mows twice a
season. The City did at one time contract for se ice to take care of it but that got
expensive.
Mr. Saba stated the City could work with businesses to adopt a portion of the trail in order
to maintain it on a regular basis.
Mr. Hickok stated last week the staff at Bob's Produce cleaned the road along University
Avenue from just south of their site to the next cross street. That is a commendable effort
from Bob's Produce. That does point to the fact that it is important to the businesses to
look good also. He thinks it would make sense to talk to our businesses that do not
maintain and see what their interest is. There are some great efforts there by some
businesses. Staff is hearing from residents that they are tired of the weeds and tired of
the unkempt look. It is not good for the image and residents want to address it. Staff will
work toward solutions.
Mr. Saba stated he would like to see Bob's Produce officially commended for their efforts

ANALYSIS
The existing lot is 26,650 square feet in area(0.61 acres) and its approximate dimensions are 90 feet
by 285 feet. The lot has frontage on both Woody Lane and Central Avenue. It is currently described
as Lot 6, Block 2, Moore Lake Hills. A house with an attached garage faces Woody Lane. A
detached garage also exists on the property and it accesses Central Avenue.
The property is zoned R-1, Single Family. For lots zoned R-1, Chapter 205.07 of the City Code
requires that lots be a minimum of 9,000 square feet and have a minimum width of 75 feet. The
minimum width of the proposed lots is 85 feet and the lots will have an area of 12,900 square feet
and 13,750 square feet respectively. The dimensions and area of the two lots meet the
requirements of the City Code.
Proposed Lot 1 contains the existing house; the house will meet all of the setback requirements of
the R-1 District on the newly defined lot. Lot 2 contains the garage. The garage meets the setback
standards for detached accessory structures, but a garage may not exist on a residential property
unless a principal building also exists. A house must be built on the property or the garage must
be removed.

The Highway Department of Anoka County has recommended that an easement be required of the
plat for an additional 10 feet of right-of-way adjacent to Central Avenue (CSH 35) for future
reconstruction purposes. The driveway onto CSAH 35 should be kept in its present location and no
landscape features should be developed that would obstruct intersection site distance.
The topography of the site is fairly severe in areas. It is especially low north of the driveway that
accesses Central Avenue. Before a building permit is granted for Lot 2, a grading and drainage
plan should be reviewed and approved by Engineering.
Lot 2 needs to be connected to the city sanitary sewer and water systems. If Lot 2 is to connect to the
City utility services located in the right-of-way of CSAH 35,the connection should be made prior
to Anoka County's reconstruction of CSAH 35. The County is planning on constructing CSAH 35
this year. The developer can either have the work done or the City can do the work and assess the cost
to the property.
Due to the creation of one new lot a park fee of$750 and a storm water fee of$1,000 are due before a
building permit can be granted.

Mr. Burns explained that this parking removal is being requested by the Police
Department as one measure needed to curtail drag racing on this stretch of East
River Road. The area in which parking is to be removed is abutted by River Front
Park, the Minneapolis Waterworks and United Defense properties. There is no
residential property that will be impacted by this action. The extent of the parking
removal is from the interstate to the City limits on both sides of East River road.
Staff recommends Council's approval.

7. RESOLUTION #32-1998, AUTHORIZING SUBMISSION OF ICE
FACILITY RENOVATION GRANT APPLICATION:
Mr. Burns stated that Mr. Paul Erickson, Executive Director of the Minnesota
Amateur Sports Commission, has requested that Fridley apply for a second Mighty
Ducks grant. As was the case with the first grant, the City would be applying for a
$50,000 grant that would be matched by another $50,000 from the National Sports
Center Foundation. The money would be used for a variety of repairs to Columbia
Arena including replacement of cooling towers, outside lighting, parking lot
improvements, a VIP seating area, and a sound system. Since Columbia Arena
provides valued services to Fridley residents, and since there is no cost for the City,
staff recommends that Council authorize staff to prepare a second Mighty Ducks
grant application.

RECONSTRUCTION PURPOSES BE RECORDED WITH THE COUNTY; 3)
BEFORE A BUILDING PERMIT IS GRANTED FOR LOT 2, THE GRADING
AND DRAINAGE PLAN SHOULD BE REVIEWED AND APPROVED BY THE
CITY ENGINEERING DEPARTMENT; 4) IF LOT 2 IS TO CONNECT TO THE
CITY UTILITY SERVICES LOCATED IN THE RIGHT-OF-WAY OF CENTRAL
AVENUE N.E. (CSAH 35), THE CONNECTION SHOULD BE MADE PRIOR TO
ANOKA COUNTY RECONSTRUCTION OF CSAH 35; 5) PARK FEES OF $750
SHALL BE PAID BEFORE THE BUILDING PERMIT IS GRANTED; 6) A $1,000
STORM WATER FEE SHALL BE PAID BEFORE THE BUILDING PERMIT IS
GRANTED; AND 7) A DRIVEWAY CUT SHALL REMAIN IN THE EXISTING

Mr. Burns explained that this is the final plat for the James Utter replat of property located
at 6084 Woody Lane. The mylars have been prepared for this plat to be known as the
Everett Addition. Staff recommends Council's approval of the resolution and attached
stipulations.
