Gentlemen:
'.the, following represents our general observations and understanding of the
situation with respect to the re-zoning request noted above:
1. The general property- and building layout in the vicinity of the site is
approximately as indicated on the accompanying in sketch. In the vicinity

of the property in question, all structures are less than 35 feet in
height, and to the east, all are less than 20 feet high. Two multiple
family dwellings are located south of Ironton Street, across from the
property. The westernmost contains five dwelling units and the
adjacent building three.
Z. The property to the north is zoned I`.rS-1 at present. A gas station with
open storage is the only significant development on this property. The
predominant zoning in the area except for the existing multiple family:
is R-1.
3� All of the existing structures in the vicinity of the property in question
are of a similar scale. TL-is inity of acale should be preseJ-vad.
. The property is located at the outer edge of its neighborhood and traffic
generation within the neighborhood �'pred.ominantly single family detached
homes) would not be a problezm, if access is controlled.
51, East River Road on Vie west edge of the property carries high traffic
volumes and access onto this road should be carefully controlled.
Recognizing the above, it is our feeling; that:
l.. An appropriately designed multiple dwelling on the site in question would
be an acceptable use but, to preserve the character of the developing
neighborhood, the sire and number of units should be carefully controlled

A re-zoning of the entire property to R-3A would not provide this control.
Therefore, we recomrriend that the requested re-zoning be denied until
the following is considered:
a. Re-zone part of the property to R-3A so that the requirements of
Fridley°s presen�-, zoning ordinance will restrict the future develop-
ment to approximately four to six dwelling units. This could be
done leaving the existing residence in an R-1 zone (comparable to
"2 lots).
ba Re-submit the request accompanied by a specific set of site and
building drawing: indicating the exact nature of the proposed devel-
opment to meet tile criteria mentioned above.
We further recommend that:
1. When the property* is developed, access be restricted to Ironton Street,
not East River Road.
2, A barrier of landscaping (hedges and tree planting) be incorporated into
the site design shielding the development from the high traffic volumes on
East River Road and the R-1 property. Consideration should. also be give-n
to increasing the side ?.-ard requirements on the East River Road side of
the property,

60 feet, and he was informed that 75 feet is the required amount. It was
noted the land to be rezoned would take ten apartment units, but the Commission
felt the amount of units should be restricted to seven. The problem of traffic
was discussed, with the Commission feeling that access should be on Ironton,
because of the present problem of East River Road at that point. Mr. Froid
stated that Mr. Leonard Dailey was interested in building an apartment and
the Commission felt they would like to arrange a meeting with him to discuss
the type of building he proposed to build. The Commission felt that the type
of rezoning would depend upon the kind of building which would be built.

system should be looked at, but it is not a large amount. Councilman Harris
mentioned that there was a request for another carwash on Old Central and
wondered if they would both go to the same interceptor and Mr. Comstock answered
no. Mr. Comstock was asked if the maximum peak amount would affect the sewer
system. Mr. Comstock said that it would affect it, but only at the main
interceptor. Mayor Kirkham stated that the Council should be sure they do
not tie up a lot of CFS, and he thought the Council should have the engineers
go over this. Councilman Wright said that he would like another day to look
at it. Mr. Comstock said that he did not think it would overtax the sewer
system, but he would like to look at the equipment they are proposing to use,
see the amount of water the equipment will use and determine the amount of
RRCs. Councilman Samuelson said that they would have to be charged on a rec
basis, and he suggested they go ahead, based on the engineer's approval,
but that Mr. Mortenson should be aware that the sewer charges may be high
because of the volume of water being disposed of.
MOTION by Councilman Wright to approve the construction of a car wash
requested by Sheldon Mortenson, subject to his exact determination of the out-
flow and the approval thereof by the Engineering Department and subject to any
future sewer connection charges due to usage. Seconded by Councilman Harris.
Upon a voice vote, there being no nays, Mayor Kirkham declared the motion
carried.

The City Manager read the motion of the Planning Commission recommending the
rezoning and explained that there was a question relative to whether to
replat or split the lots. The City Manager stated that he has advised
Mr. Froid that it would be best to plat it, and in the near future he will.
start replatting the remainder through the Planning Commission. Councilman
Wright asked, if he is going to replat it, could we get the hearing on the
rezoning and the plat on the same evening and just have one meeting. The
City Manager said that Froid does not want to replat unless he gets the
rezoning. Councilman Samuelson asked if there was any possibility of keeping
it all R-1. The City Manager said that they feel this is a bad corner.
Councilman Harris asked if a public hearing would not be the proper thing to
see the sentiments of the people.
MOTYON by Councilman Wright to accept the recommendation of the Planning
r :ommission, and on that basis call a Public Hearing for May 9, 1966. Seconded

Councilman Harris stated that he thinks Mr. Hodne should be directed to take
an intensified loe&k at this area as one of his first projects, as Mr. Harris

tax monies for the studies were spent just the same. Neither this Council
nor any other Council advocates spending that does not benefit the City. If
some members of this Council are to be intimidated by this type of immature
thinking it must be remembered that it was a decision of a unanimous Council
to look into the feasibility of locating in Locke Park. The vote, as decisive
as it was has not changed my opinion that the present site is the most desirable."
Councilman Wright said he would like to point out, in light of Mayor Kirkham°s
comments, that any funds expended in connection with the redevelopment project
in Fridley were Federal tax .funds and not City funds. Mayor Kirkham said that
he had used that words, "tax dollars."
Mr. Carl Paulson, a visitor to the Council Meeting, stated that there is no
distinction between Federal or City funds in the morality of squandering money,
and there has been some misconception, and the people are misinformed about
the $28,000 spent for City Hall plans. He said this was done, by his recol-
lection, at the order of the Council to relocate at a less expensive site to
save $100,000, so the purpose of the Council was honest and above board.
Mr. Paulson mentioned one of the men running for Council and stated he felt
he would serve the City well. Councilman Wright stated that Mr. Paulson was
out of order, and Mayor Kirkham said that campaigning should be kept out of
the Council chambers.
MOTION'by Councilman Wright to authorize the Administration to proceed to
advertise for bids for the new City Fall construction on the basis of the
plans for ,64th and University with itemized adds/deletes as agreed upon with
the Architect. Seconded by Councilman Harris. Upon a voice vote, there
being no nays, Mayor Kirkham declared the motion carried.
A visitor to the Council Meeting asked if the Council had taken into con-
sideration in their plans, the possibility of a County wide Municipal Court
System being brought in. He named many suburbs that have had to replan their
City Halls to take care of the space requirements for this, and he felt that
in about four years there will be an overall change in Anoka County, as there
has been in Hennepin County, and Fridley will have full fledged judge, and
jury cases. Be said he hoped the new building contemplated has looked forward
to this. Councilman Harris pointed out that the new building will have seating
in the court room for 48 people and asked if this would be sufficient., and was
told it would be plenty.
Councilman Wrigbt pointed out that the Council had gone into this in great
detail in 1964, and the Architect had provided space for jury rooms, recorder,
restrooms, and it has been arranged so that the jury box rolls out of the way
for Council Meetings. Mr. Gibbs, acting for the City Attorney, said that the
City Attorney is on a committee that hopes to prepare the bill to bring in
this Municipal Court system, and submit it to this legislature with the hopes
of going into this type of operation by January of 1968.

map and Mayor Kirkham asked if anyone cared to be heard on this item. There

MOTION by Councilman Harris to approve the final plat of Froid's Addition and
close the Hearing. Seconded by Councilman Sheridan. Upon a voice vote, there
being no nays, Mayor Kirkham declared the motion carried.
PUBLIC HEARING ON ASSESSMENT ROLL - ST. -1965-2:
The City Manager read the Notice of Hearing. Councilman Wright stated that
before the Public Hearing is opened, there was an action that was appropriate
for the City Council to take, which he would like to describe as to its source
and history. He stated that the original assessment roll for 57th Avenue from
University Avenue to 7th Street was made up in the same way as all other
assessmeat rolls on the basis of cost divided by front footage. He said that
property owners are assessed only for a normal width and quality street, and State
Aid streets are put in at a 44 foot width with a 9 ton axle weight base and
higher specifications for mixture and durability. Councilman Wright said that
on 7th Street the Council gave a credit for the street surface that had been
in 9 years, and the Administration has recommended that there be a credit for
remaining surface on 57th Avenue toward the'new street. This policy applies
to State Aid streets only, because there is the inconvenience of additional
traffic on these streets, and they are more heavily travelled streets. He
said that a new assessment roll has been prepared taking this credit into
consideration.
MOTICN by Councilman Wright that the Council Policy be that at the time of
resurfacing streets of less than ten years of age, that for streets'desigaated
as State Aid streete,built to State Aid standards, credit be given. Seconded
by Councilman Harris.
A visitor to the Council Meeting said that there has been no street at all
where he has lived for seven. years. Councilman Wright said that this will
not apply in that case. Another visitor asked if this would apply to 7th
Street also. The Council stated it would apply to any State Aid street. The
City Engineer held up a map with all the State Aid streets marked. Another
visitor said that 7th Street has ten times the traffic as Main Street, and
asked how it compares. Councilman Wright said that Main Street is a County
road and is not directly assessed. He said it would be fine if the County
took over 7th Street. Mayor Kirkham pointed out that the Council does not
designate which streets are to be County roads.
Vote upon the motion on Council policy: Upon a voice vote, there being no
nays, Mayor Kirkham declared the motion carried.
MOTION by Councilman Wright, that in line with the policy just adopted, the
alternate Assessment Roll prepared which reduces the cost of the Assessment
Roll by $3,747 on 57th Avenue, based on a credit of $1.50 per running foot
for each side of the street for past assessments paid, be brought forward as
the roll on which this hearing tonight will be based, and as a substitution
for the roll previously prepared. The motion was seconded and upon a voice
vote, there being no nays, Mayor Kirkham declared the motion carried.

The City Manager reminded the Council that they have held a Public Hearing.
He said that the Council's decision had been to wait until the plat was
approved, and that had been done at the ,previous meeting.
MOTION by Councilman Harris to adopt the Rezoning Ordinance on 1st Reading,
waiving the reading. Seconded by Councilman Wright. Upon a Roll Call Vote,
Kirkham, Harris, Sheridan. and Wright voting aye, Mayor Kirkham declared the
motion carried.
Councilman Samuelson returned to the Council table.
DANGEROUS BUILDING AT 6881 CENTRAL AVENUE NORTHEAST:
The City Manager said that the City Attorney has advised Mr. Bauer that if he
has not started removing the building by October 15th, the City will hire
someone to do it.
MOTION by Councilman Harris to concur with the Administration's decision that
the City will start proceedings on or after October 15, 1966. Seconded by
Councilman Wzight. Upon a voice vote, there being no nays, Mayor Kirkham
declared the motion carried.
DANG$ROUS BUILDING AT 6001 UNIVERSITY AVENUE NORTHEAST:
The City Attorney said that he had gotten a call from Mr. Marchiafava, and
Mr. Marchiafava had indicated to him that he was going to rebuild the building
to the original size and original plans. The City Attorney said he told him
that in order to do this, the plans should be sent to the Building Inspector.
The City Manager asked the Council about setting a deadline date.
MOTION by Councilman Harris that Mr. Marchiafava submit plans for rebuilding
his building up to coda by November 1, 1966, and if he does not, the City

The City Manager mentioned that the Ordinance as drafted does not have a '
Councilman; or someone from the Fire Prevention Bureau as members. He asked
the Council if they thought they should be represented as non-voting ex officio
members. Councilman Wright said that he felt it was .important that both are
represented, but he did not know if it was necessary that they have a vote.
In his opinion, they should both be ex officio members. Councilman Samuelson
agreed with this. Councilman Harris suggested that this was something that
could be left up to the Administration. After viewing the plans, the
Administration could decide if they were needed at the meeting. The City
Manager suggested they could be invited if they would like to came.
