JJ Addition
Dear Stacy,
We have reviewed the Preliminary Plat for JJ Addition,to be located on the south side of CSAH 6 (Rice
Creek Road) at 1400 and 1420 Rice Creek Road within the City of Fridley, and I offer the following
comments
Anoka County reviewed the Preliminary Plat for Kluscar Addition on September 24, 2004. At that
time, access points were determined for this property, right of way requirements were communicated,
and the right of access was dedicated to Anoka County. As previously indicated in 2004, an additional
20-30ft of right of way adjacent to CSAH 6 is required to reconstruct the route to county standards in
the future. If the additional right of way is not dedicated along the route, the City should plan for the
route to become a City street.
Access points to the lots within the plat as depicted on the survey are consistent with previous reviews
of this area and are acceptable as submitted. A storm sewer catch basin is currently inplace in the
center of the proposed driveway, which will likely need to be relocated as a part of the development.
Drainage plans and calculations should be provided for the development. The post-developed
rate/volume of runoff must not exceed the pre-developed rate/volume of runoff for the 10-year, critical
design storm. An engineering plan review fee estimated at$150.00 will apply to this project. Contact
Andrew Witter, Engineering Program Manager, for further information and to coordinate the
engineering plan review process. Please submit the drainage calculations and the applicable
engineering plan review fee to Mr.Witter for his review and approval.
It should be noted that residential land use adjacent to highways usually results in complaints
regarding traffic noise. Traffic noise at this location could exceed noise standards established by the
U.S. Department of Housing and Urban Development and the Minnesota Pollution Control Agency.
Traffic volumes on this section of CSAH 6 are projected to increase over time. When this section of
CSAH 6 is reconstructed in the future, it is likely that the reconstructed roadway section will be wider
than the present roadway section, and construction of noise walls will not likely be included in the
reconstruction project. The City and/or the Developer should assess the present and future noise
situation and take any action deemed necessary to minimize associated impacts at this site from the
existing and future traffic noise.

obtained prior to the commencement of construction (access permit = $150.00 each; right of way
permit = $110.00). License Permit Bonding, methods of construction, design details, work zone

The petitioner, Eugene Jankowski, is seeking to replat two large single family lots at 1400 and
1420 Rice Creek Road, into three single family lots.
In 2004, the property at 1420 Rice Creek Road, which was 42,208 square feet in size, was sub-
divided from one large single family lot into two single family lots. As a result of that plat
request, a new home was constructed on what was the southern portion of 1420 Rice Creek
Road and is now 1424 Rice Creek Road. Since then, the original home at 1420 Rice Creek
Road has been demolished and another new single family home is being constructed in its
place.

The current preliminary plat request will sub-divide the lot at 1420 Rice Creek Road, which is
28,461 square feet and the lot east of it at 1400 Rice Creek Road, which is 50,024 square feet
into three new single family lots.
Fridley requires that lots in the R-1 district be a minimum of 75' in width with a minimum total lot
area of 9,000 square feet. The proposed Lot#1 will be 102.58 feet in width and 43,953 square
feet in size after the replat. The proposed Lot#2 will be 75 feet in width and 16,642 square feet
and proposed Lot#3 will be 75 feet in width and 17,890 square feet in size after the replat. As a
result of the subdivision, all three newly created lots will meet the minimum standards for
properties in the R-1, Single Family zoning district.
Lot#1 will remain as is, with the existing house and detached garage. A new single family
home will be constructed on Lot#2 and a new single family home is currently being constructed
on Lot#3.
NEIGHBORHOOD COMMENTS
Staff has heard comments from one neighboring property owner, who was inquiring about how
the two lots would be sub-divided to make three.
RECOMMENDATION
City Staff recommends approval of this preliminary plat request, with stipulations.
• Proposed lots exceed the size standards required by the City of Fridley Zoning
Code.
• Provides additional homeownership opportunities for Fridley residents
STIPULATIONS
Staff recommends that if the plat is granted, the following stipulations be attached.
1. Property owner of record shall obtain all necessary permits prior to construction.
2. Property owner of record at time of building permit application to pay required $1,500
park fee prior to issuance of a building permit for Lot#2.
3. Property owner of record at time of building permit application to pay all water and
sewer connection fees prior to issuance of a building permit.
4. Provide proof that any existing wells or individual sewage treatment systems located
on the site are properly capped or removed.
5. Petitioner shall provide easements as shown on preliminary plat drawing.
6. Driveway on Lot#1 shall be moved to be within 3 feet of the property line or moved
to be within the property line and a letter shall be submitted stating that the property
owner of Lot#2 is in agreement with the fact that the driveway on Lot#1 is located
on the property line.

Commissioner Savage asked if staff has received any other comments from neighbors.
Ms. Stromberg replied no.
Commissioner Dunham asked if the lot was on the property line and if the driveway would need to be
moved.
Ms. Stromberg replied that the driveway would need to be moved to be three feet from the property line
or a letter would need to be written stating that the owners were in agreement that it was okay the
driveway was closer than three feet to the property line.
Commissioner Saba asked if there were any water or drain issues with the properties.
Ms. Stromberg answered no.
Eugene Jankowski, 28123 31St Ave. Mpls, stated that he is the property owner and is currently building a
new house on the lot at 1420 Rice Creek Rd. He is hoping to build an attached three car garage on the
newly created lot. He will have a written letter to bring to the city regarding the driveway and the driveway
will be opposite of how it exists today.
Commissioner Savage asked if Mr. Jankowski had any problems with the stipulations.
Mr.Jankowski replied no.
Commissioner Savage asked if Mr. Jankowski had any conversations with the neighbors regarding this
lot split.
Mr.Jankowski replied that so far the neighbors are pleased with the changes.
Commissioner Kuechle asked when construction would begin on the new lot.

Mr. Jankowski stated that he was not sure. The first home took 14 months to sell so he was not sure
when construction would begin on the new lot.
Commissioner Dunham commented that the houses Mr. Jankowski is building look very nice.

INTRODUCTION
The petitioner, Eugene Jankowski, is seeking to replat two large single family lots at 1400 and
1420 Rice Creek Road, into three single family lots.
Fridley requires that lots in the R-1 district be a minimum of 75' in width with a minimum total lot
area of 9,000 square feet. The proposed Lot #1 will be 102.58 feet in width and 43,953 square
feet in size after the replat. The proposed Lot#2 will be 75 feet in width and 16,642 square feet
and proposed Lot#3 will be 75 feet in width and 17,890 square feet in size after the replat. As a
result of the subdivision, all three newly created lots will meet the minimum standards for
properties in the R-1, Single Family zoning district.
PLANNING COMMISSION RECOMMENDATION
At the March 7, 2007, Planning Commission meeting, a public hearing was held for PS #07-02.
After a brief discussion, the Planning Commission recommended approval of the preliminary
plat request, PS #07-02, with the stipulations as presented.
THE MOTION CARRIED UNANIMOUSLY.

The petitioner, Eugene Jankowski, is seeking to replat two large single family lots at 1400 and
1420 Rice Creek Road, into three single family lots.
In 2004, the property at 1420 Rice Creek Road, which was 42,208 square feet in size, was sub-
divided from one large single family lot into two single family lots. As a result of that plat
request, a new home was constructed on what was the southern portion of 1420 Rice Creek
Road and is now 1424 Rice Creek Road. Since then, the original home at 1420 Rice Creek
Road has been demolished and another new single family home is being constructed in its
place.

INTRODUCTION
On March 7, 2007, the Planning Commission considered plat request PS #07-02, by Eugene
Jankowski. Mr. Jankowski plans to replat two large single family lots at 1400 and 1420 Rice
Creek Road, into three single family lots. City Staff and the Planning Commission recommend
approval of plat request, PS#07-02, with 6 stipulations. At the March 26, 2007, City Council
meeting, the preliminary plat was approved, with 6 stipulations.
Since the March 26, 2007, City Council approval of the preliminary plat, City staff has received
comments from Anoka County. Based on those comments, stipulations#7 has been added to
the recommended approval.
RECOMMENDATION
City Staff and the Planning Commission recommend final plat approval of PS#07-02.
STIPULATIONS
1. Property owner of record shall obtain all necessary permits prior to construction.
2. Property owner of record at time of building permit application to pay required$1,500

Councilmember Varichak commented that 10:00 p.m. seemed very ly when the bars are
open until 2:00 p.m. She thought 12:00 midnight seemed more reason le.
Councilmember Bolkcom stated that the patio is for enhanced ating for dinner. This is an
opportunity for people to sit outside and eat. With the activity of people going in and out we
need to be careful and start out slow. In the future the hours c be extended if needed.
Councilmember Varichak said staying open to midni t would let people still enjoy the
outside.
Councilmember Barnette said Councilmember Bo com's point was that Council made a
decision a long time ago that the City would have estaurants and not bars. At this time, he
supports the 10:00 p.m. time but in the future Co cil may realize that 10:00 p.m. is too early.
This will be difficult to enforce for those trying to ake their drink outside and have a cigarette.
Mr. Tomaro, Pickled Park, requested special onsideration in regards to the time limit and for
music. He said his business is in a commerc. 1, non-residential area. He would like to create an
enjoyable dining experience and use the pa o primarily for food service. The goal would be not
to create a noisy patio, but to create a mole enjoyable experience for the customers. Having to
police a coke, water or alcoholic drink 'll be difficult and hard to monitor. Televisions and
background music are common on pat' s and would create a nice experience. The closing time
of 10:00 p.m. would hamper entertai ent. He would like Council to consider a provision that
since they are in a commercial, n n-residential area, they could stay open until the end of
business hours.
Councilmember Barnette aske staff to check out other establishments in the area.
Councilmember Bolkcom s ggested checking nearby cities such as Columbia Heights. She
said they should look at iss s where the business is not next to residents and to remember the
goal is to focus on dining. he suggested leaving the time at 10:00 p.m. and if it works, the time
could be extended in the ure.
Mayor Lund stated t at he had no problem passing this first reading and asked if all
establishments have re eived information on this issue.
Mr. Pribyl answere that every business that holds a liquor license received a copy and staff has
not received any comments.
Mayor Lund sta/d that it all boils down to common sense and being neighborly. He was not
against a televis"n on the patio as long as it did not interfere with neighbors. At the next reading
there may be re comments from establishments. Council will look at both ways, both 10:00
p.m. closing d midnight.
Councilme ber Saefke asked about the 3.2% beer that is sold in Commons Parks and what the
closing ti m there was.

Eugene Jankowski, 1400 Rice Creek Road, said his son owns the property and they will do
what is necessary.
Councilmember Varichak asked if it would be a problem if the son moved and the new owner
does not like the drive way.
Mr. Hickok answered that once a letter is on file, the driveway will stay that way as it was a pre-
existing condition.

Councilmember Bolkcom said that Springb ok Nature Center will be holding a Spring Fling

Call or stop at the Nature Center if you are ble to volunteer for this event. Admission is $5.00
for non-residents, $4.00 for Fridley residen s, and children 2 and under are free.
Mayor Lund announced that the Lions ill be having a pancake breakfast on Sunday, April 1.
Also, the first recycling event will be on pril 14, from 9:00 a.m. to 1:00 p.m.
Councilmember Bolkcom added that f residents needed more information they can find it on
the website. Residents should have rec ived a letter in the mail regarding this event.
Councilmember Bolkcom thanked everyone for attending the comprehensive plan meetings.
The next meeting will be on April 2. Reference the Fridley website for additional information.
Mr. Hickok stated that feedback om the Comprehensive Planning Meetings is on the website
and on file at the City. The meeti gs will also be on cable television.
Councilmember Bolkcom state that the Comprehensive Planning Meeting on April 2 will have

William Burns, City Manager, stated this is a replat of two large family lots into three single-
family lots. With Council's approval of the preliminary plat, the County has asked staff to
include a seventh stipulation. The stipulation requires that the petitioner get the necessary
permits from the County before starting work in their right-of-way. Staff recommends Council's
approval of the additional stipulation and the final plat.

4. Resolution Receiving Final Plans and Specifications and Authorizing the
AdvertisemeV for Bids for Street Improvement Project No. ST. 2007 — 3 (Quiet
Zone).
William Burns, City ager,
mstated the design includes concrete medians, signage, driveway
entrance alignments, and triping. Construction will occur at the 771h Avenue and Osborne Road
railroad crossings. The ork is being done to comply with Federal Railway Administration
requirements for the creati n of Quiet Zones at these crossings. Access changes have been
worked out with each of the ee impacted property owners, and staff is estimating project costs
will be $65,000. The project will be funded with MSAS funds. Staff recommends Council's
approval.

5. Receive Bids and Award C retract for the ST. 2007—2 Mill and Overlay Project.
William Burns, City Manager, stated hey opened six bids on Wednesday, August 8. The low
bid was received from Northwest A halt from Shakopee, Minnesota, in the amount of
$287,845.90. The bid is for mill and over y work on portions of 61"Avenue from University to
Seventh Street, and Seventh Street from 5 ' Avenue to 61St Avenue. Staff recommends council
receive the bids and award the contract to th low bidder,Northwest Asphalt.
RECEIVED BIDS AND AWARDED CONT CT TO NORTHWEST ASPHALT IN THE
AMOUNT OF $287,845.80.
6. Resolution Authorizing Traffic Contro Signal Agreement No. 91252R for the
Replacement of the Traffic Control System n TH 65 and Osborne Road.
William Burns, City Manager, stated Council approve a preliminary agreement for replacing
these controls in October 2005. Since the agreement do not provide for internally illuminated
name signs, they are asking Council to approve the agre ment and authorize staff to add the
street name signs. Since they have included these signs on similar projects on University
Avenue and Highway 65, they are recommending Counci approve this expenditure of an
additional $10,000 for this purpose. The inclusion of the signs ill bring the City's contribution
to this project to an estimated $43,777. MSAS money can be ed to cover these costs. Staff
recommends Council's authorization to sign the current agreement with MnDOT and to add, at a
point where it is appropriate, the internally illuminated street name s ns to this agreement.

2. Approve Tower Site Agreement Between the City of Frid y and T-Mobile Central,
LLC, for the Installation of Cellular Antennas on the arion Hills Water Tower
(Ward 1) (Tabled July 23,2007).
William Burns, City Manager, stated this item was tabled t the July 23 council meeting with
direction to staff to respond to five issues raised by Cou ilmember Saefke. The first concern
had to do with the involvement and concurrence of the ter Division Supervisor. Although the
supervisor was not initially involved in evaluating th' proposal, he has reviewed the plan and
concurs with the proposed location of the T-Mobile s rage shed on the south side of the tower.
Dr. Burns stated Councilmember Saefke's s and concern had to do with the potential
interference with the City's telemetry system t at also operates from the tower. The issue has
been reviewed with our SCADA consultant. He has determined there is no conflict from the
standpoint of frequency interference. ile has agreed to cooperate and make certain there
is no line-of-sight interference as well. C uncilmember Saeflce also raised concerns about how
T-Mobile will gain access to their sto ge shed during a snowstorm. His concern will be
addressed with the construction of a urrounding curb that will enable the City snow plow
operators to push snow from the pa ing lot across the sidewalk that serves the storage shed.
Councilmember Saefke's fourth co cern was placement of the storage building. He suggested
that staff consider locating it in 'de the fence that surrounds the tower. Staff, including the
Water Division Supervisor, ha e reviewed this option and determined the building is better
situated outside the fence on e south side of the tower as proposed. Councilmember Saeflce
also expressed concerns ab ut the labeling of the tower site as the Johnson Street tower.
Although the Johnson Stre right-of-way has never been vacated, they are replacing references
to the Johnson Street tow with references to the Marion Hills tower in the Agreement.
Dr. Burns stated the t ms of the lease agreement are as follows. T-Mobile will place up to nine
antennas on the tow in bunches of three. It will be granted an access easement and area for
construction of the ' x 12' storage equipment building. The Agreement provides for a monthly
payment of$1,75 plus an additional $125 per month for each additional antenna after the first
nine. The rent ' to be increased annually by an amount equal to the CPI but not less than
2 percent or mo e than 5 percent. The term of the lease is five years with an option to extend the
lease for four dditional five-year periods. Staff recommends Council remove this item from the
table and ap ove the Tower Site Agreement.

The Council action described above is only to approve the preliminary plat. You must have an
approved final plat prior to recording at Anoka County. When the final plat has been prepared
by your surveyor, a copy of the plat should be sent to the Anoka County's Surveyor's office for
review. Once that review is completed, please submit three full size copies of the final plat to
the Community Development Department. The Community Development staff will contact you
as to which council meeting the item will be scheduled for consideration (it will be placed under
the "consent agenda"). After Council action on the final plat, the mylars of the plat must be
submitted to the City for signature by the Mayor and City Clerk. Once signed, the plat is ready
for recording at Anoka County. The final plat must be submitted for action within six months of
approval of the preliminary plat.

2. Approve Tower Site Agreement Between the City of ridley and T-Mobile Central,
LLC, for the Installation of Cellular Antennas on a Marion Hills Water Tower
(Ward 1) (Tabled July 23, 2007).
William Burns, City Manager, stated this item was tabled at the July 23 council meeting with
direction to staff to respond to five issues raised by auncilmember Saefke. The first concern
had to do with the involvement and concurrence of t Water Division Supervisor. Although the
supervisor was not initially involved in evaluatin this proposal, he has reviewed the plan and
concurs with the proposed location of the T-Mob' e storage shed on the south side of the tower.
Dr. Burns stated Councilmember Saefke' second concern had to do with the potential
interference with the City's telemetry syst that also operates from the tower. The issue has
been reviewed with our SCADA consult t. He has determined there is no conflict from the
standpoint of frequency interference. T obile has agreed to cooperate and make certain there
is no line-of-sight interference as well Councilmember Saefke also raised concerns about how
T-Mobile will gain access to their orage shed during a snowstorm. His concern will be
addressed with the construction o a surrounding curb that will enable the City snow plow
operators to push snow from the arking lot across the sidewalk that serves the storage shed.
Councilmember Saefke's fourt concern was placement of the storage building. He suggested
that staff consider locating it nside the fence that surrounds the tower. Staff, including the
Water Division Supervisor, ave reviewed this option and determined the building is better
situated outside the fence the south side of the tower as proposed. Councilmember Saefke
also expressed concerns bout the labeling of the tower site as the Johnson Street tower.
Although the Johnson S eet right-of-way has never been vacated, they are replacing references
to the Johnson Street to er with references to the Marion Hills tower in the Agreement.
Dr. Burns stated th terms of the lease agreement are as follows. T-Mobile will place up to nine
antennas on the to er in bunches of three. It will be granted an access easement and area for
construction of th 10' x 12' storage equipment building. The Agreement provides for a monthly
payment of$1,7 0 plus an additional $125 per month for each additional antenna after the first
nine. The ren is to be increased annually by an amount equal to the CPI but not less than
2 percent or re than 5 percent. The term of the lease is five years with an option to extend the
lease for four additional five-year periods. Staff recommends Council remove this item from the
table and ap rove the Tower Site Agreement.

William Burns, City Manager, stated this is a replat of two large family lots into three single- ,
family lots. With Council's approval of the preliminary plat, the County has asked staff to
include a seventh stipulation. The stipulation requires that the petitioner get the necessary
permits from the County before starting work in their right-of-way. Staff recommends Council's
approval of the additional stipulation and the final plat.

4. Resoluti Receiving Final Plans and Specifications and Authorizing the
Advertise ent for Bids for Street Improvement Project No. ST. 2007 — 3 (Quiet
Zone).
William Burns, Cit Manager, stated the design includes concrete medians, signage, driveway
entrance alignments, a d striping. Construction will occur at the 77"' Avenue and Osborne Road
railroad crossings. Th work is being done to comply with Federal Railway Administration
requirements for the cre tion of Quiet Zones at these crossings. Access changes have been
worked out with each of t e three impacted property owners, and staff is estimating project costs
will be $65,000. The proj ct will be funded with MSAS funds. Staff recommends Council's
approval.

5. Receive Bids and Awar Contract for the ST. 2007—2 Mill and Overlay Project.
William Burns, City Manager, stat d they opened six bids on Wednesday, August 8. The low
bid was received from Northwest sphalt from Shakopee, Minnesota, in the amount of
$287,845.90. The bid is for mill and o erlay work on portions of 61"Avenue from University to
Seventh Street, and Seventh Street from 3rd Avenue to 61St Avenue. Staff recommends council
receive the bids and award the contract to he low bidder,Northwest Asphalt.
RECEIVED BIDS AND AWARDED CO TRACT TO NORTHWEST ASPHALT IN THE
AMOUNT OF $287,845.80.
6. Resolution Authorizing Traffic Cont of Signal Agreement No. 91252R for the
Replacement of the Traffic Control Sysf$m on TH 65 and Osborne Road.
William Burns, City Manager, stated Council appr ved a preliminary agreement for replacing
these controls in October 2005. Since the agreement oes not provide for internally illuminated
name signs, they are asking Council to approve the a reement and authorize staff to add the
street name signs. Since they have included these si s on similar projects on University
Avenue and Highway 65, they are recommending Cou it approve this expenditure of an
additional $10,000 for this purpose. The inclusion of the sig will bring the City's contribution
to this project to an estimated $43,777. MSAS money can be used to cover these costs. Staff
recommends Council's authorization to sign the current agreeme with MnDOT and to add, at a
point where it is appropriate, the internally illuminated street name igns to this agreement.
