At that time, access points were determined for this property, right of way requirements were communicated, and the right of access was dedicated to Anoka County. As previously indicated in 2004, an additional 20-30ft of right of way adjacent to CSAH 6 is required to reconstruct the route to county standards in the future. If the additional right of way is not dedicated along the route, the City should plan for the route to become a City street. Access points to the lots within the plat as depicted on the survey are consistent with previous reviews of this area and are acceptable as submitted. A storm sewer catch basin is currently inplace in the center of the proposed driveway, which will likely need to be relocated as a part of the development. Drainage plans and calculations should be provided for the development. The post-developed rate/volume of runoff must not exceed the pre-developed rate/volume of runoff for the 10-year, critical design storm. An engineering plan review fee estimated at$150.00 will apply to this project. Contact Andrew Witter, Engineering Program Manager, for further information and to coordinate the engineering plan review process. Please submit the drainage calculations and the applicable engineering plan review fee to Mr.Witter for his review and approval. It should be noted that residential land use adjacent to highways usually results in complaints regarding traffic noise. Traffic noise at this location could exceed noise standards established by the U.S. Department of Housing and Urban Development and the Minnesota Pollution Control Agency. Traffic volumes on this section of CSAH 6 are projected to increase over time. When this section of CSAH 6 is reconstructed in the future, it is likely that the reconstructed roadway section will be wider than the present roadway section, and construction of noise walls will not likely be included in the reconstruction project. The City and/or the Developer should assess the present and future noise situation and take any action deemed necessary to minimize associated impacts at this site from the existing and future traffic noise. Councilmember Bolkcom stated that the patio is for enhanced ating for dinner. This is an opportunity for people to sit outside and eat. With the activity of people going in and out we need to be careful and start out slow. In the future the hours c be extended if needed. Councilmember Varichak said staying open to midni t would let people still enjoy the outside. Councilmember Barnette said Councilmember Bo com's point was that Council made a decision a long time ago that the City would have estaurants and not bars. At this time, he supports the 10:00 p.m. time but in the future Co cil may realize that 10:00 p.m. is too early. This will be difficult to enforce for those trying to ake their drink outside and have a cigarette. Mr. Tomaro, Pickled Park, requested special onsideration in regards to the time limit and for music. He said his business is in a commerc. 1, non-residential area. He would like to create an enjoyable dining experience and use the pa o primarily for food service. The goal would be not to create a noisy patio, but to create a mole enjoyable experience for the customers. Having to police a coke, water or alcoholic drink 'll be difficult and hard to monitor. Televisions and background music are common on pat' s and would create a nice experience. The closing time of 10:00 p.m. would hamper entertai ent. He would like Council to consider a provision that since they are in a commercial, n n-residential area, they could stay open until the end of business hours. Councilmember Barnette aske staff to check out other establishments in the area. Councilmember Bolkcom s ggested checking nearby cities such as Columbia Heights. William Burns, City Manager, stated hey opened six bids on Wednesday, August 8. The low bid was received from Northwest A halt from Shakopee, Minnesota, in the amount of $287,845.90. The bid is for mill and over y work on portions of 61"Avenue from University to Seventh Street, and Seventh Street from 5 ' Avenue to 61St Avenue. Staff recommends council receive the bids and award the contract to th low bidder,Northwest Asphalt. RECEIVED BIDS AND AWARDED CONT CT TO NORTHWEST ASPHALT IN THE AMOUNT OF $287,845.80. 6. Resolution Authorizing Traffic Contro Signal Agreement No. 91252R for the Replacement of the Traffic Control System n TH 65 and Osborne Road. William Burns, City Manager, stated Council approve a preliminary agreement for replacing these controls in October 2005. Since the agreement do not provide for internally illuminated name signs, they are asking Council to approve the agre ment and authorize staff to add the street name signs. Since they have included these signs on similar projects on University Avenue and Highway 65, they are recommending Counci approve this expenditure of an additional $10,000 for this purpose. The inclusion of the signs ill bring the City's contribution to this project to an estimated $43,777. MSAS money can be ed to cover these costs. Staff recommends Council's authorization to sign the current agreement with MnDOT and to add, at a point where it is appropriate, the internally illuminated street name s ns to this agreement. Approve Tower Site Agreement Between the City of Frid y and T-Mobile Central, LLC, for the Installation of Cellular Antennas on the arion Hills Water Tower (Ward 1) (Tabled July 23,2007). William Burns, City Manager, stated this item was tabled t the July 23 council meeting with direction to staff to respond to five issues raised by Cou ilmember Saefke. The first concern had to do with the involvement and concurrence of the ter Division Supervisor. Although the supervisor was not initially involved in evaluating th' proposal, he has reviewed the plan and concurs with the proposed location of the T-Mobile s rage shed on the south side of the tower. Dr. Burns stated Councilmember Saefke's s and concern had to do with the potential interference with the City's telemetry system t at also operates from the tower. The issue has been reviewed with our SCADA consultant. He has determined there is no conflict from the standpoint of frequency interference. ile has agreed to cooperate and make certain there is no line-of-sight interference as well. C uncilmember Saeflce also raised concerns about how T-Mobile will gain access to their sto ge shed during a snowstorm. The issue has been reviewed with our SCADA consult t. He has determined there is no conflict from the standpoint of frequency interference. Resolution Authorizing Traffic Cont of Signal Agreement No. 91252R for the Replacement of the Traffic Control Sysf$m on TH 65 and Osborne Road. William Burns, City Manager, stated Council appr ved a preliminary agreement for replacing these controls in October 2005. Since the agreement oes not provide for internally illuminated name signs, they are asking Council to approve the a reement and authorize staff to add the street name signs. Since they have included these si s on similar projects on University Avenue and Highway 65, they are recommending Cou it approve this expenditure of an additional $10,000 for this purpose. The inclusion of the sig will bring the City's contribution to this project to an estimated $43,777. MSAS money can be used to cover these costs.
