N.W., ANDOVER, MINNESOTA 55304-4005 (763) 862-4200 FAX (763) 862-4201 September 24, 2004 Stacy Stromberg City of Fridley 6431 University Ave.NE Fridley,MN 55432 RE: Preliminary Plat— Kluscar Addition Dear Stacy, We have reviewed the preliminary plat of Kluscar Addition, to be located on the south side of CSAH 6 (Rice Creek Road) at 1420 Rice Creek Road within the City of Fridley, and I offer the following comments. The existing right of way adjacent to this section is 30ft south of centerline, which does not match our right of way standards for a CSAH route. For this roadway to be reconstructed as a county state aid highway, an additional right of way corridor of 20-30ft is required (50-60ft of right of way south of the CSAH 6 right of way centerline; 100-120ft total right of way corridor width). If a right of way corridor of 100-120ft does not fit into the City's comprehensive plans for the parcels adjacent to CSAH 6, then perhaps discussions between City and County staff should be initiated to discuss the possibility of turning this route over to the jurisdiction of the City of Fridley. Please contact Doug Fischer, County Engineer,to initiate such a discussion. If the route is to remain on the county highway system but the additional right of way dedication does not occur in conjunction with this plat, the building setbacks for the involved parcels is to account for the future right of way needs. The right of access along CSAH 6 (with exceptions for approved access locations) is to be dedicated to Anoka County. There are Intersection Sight Distance deficiencies for the Sight Corners for both proposed lots. The deficiencies for the existing driveway on Lot 1, Block 1 are more severe than those for Lot 2, Block 1. The Lot 2 deficiencies are considered relatively minor. Typically, we would require that the access points for these two adjacent lots be located within 30ft of their common lot line. However, doing so in this case would require the relocation of the existing driveway on Lot 1. Given the location of the existing garage and dwelling on Lot 1, it is unlikely that this would be acceptable to either the owner or the City. Consequently, we will not require that the access for Lot 1 be relocated from its current location in conjunction with this plat. There is an existing curb cut/driveway opening on Lot 2. No additional access points for either parcel will be permitted. This section of roadway is already being maintained by the City of Fridley under an agreement with Anoka County. The area is fully developed and would not be able to be expanded to meet County standards without the acquisition of nearly every property along this corridor and is unrealistic. Discussions of County tum-back have taken place with Mr. Fischer; however, we have been told this needs to be kept on the CSAR system to link with the adjacent Ramsey County CSAR route. Therefore, the right-of-way width will remain consistent with the rest of this roadway. The intersection sight distances are not really an issue as you note in your letter. In addition, these are merely driveways with equal or better visibility than any other driveway along this roadway. No mass grading is planned. One single family home is planned to be built using the existing driveway cut. As we discussed on the phone, no detailed drainage calculations will be required as this is only the addition of one single family home. The City understands that the County will not expend any highway funds to protect this new lot from noise. We do not see this as a problem as although the roadway is part of the CSAR system, its use is as a typical residential through street. The existing garage on Lot#2 at the closest point is 5.66 feet from the east property line. Detached garages can be located 3 feet from the property line. The new home must be a minimum of 10 feet from the side property line for living space. Ms. Westover questioned if the items that are currently being stored in and around the garage on Lot#2 will remain. Ms. Stromberg responded that the petitioner plans to sell the property and she is not aware of what the buyer's intentions would be, but assumes the current storage items belong to the petitioner. Councilmember Billings stated that whilreciates the reason for bringing this change forward, the current organizationre not Fridley based are doing a good job of getting their money into the Cityy and helping Fridley residents. He thinks the proposed ordinance changemerely trade organizations that are helping one aspect of the City of Fridley to get organizations that also help the citizens of Fridley a little differently. Hesse organizations trying to set up lawful gambling should go directly to the Fridley locations that are licensed rather than going through the City. Councilmember Wolfe stated he understands the Mayor's interest in proposing this ordinance change, but he pointed,/out that groups representing specific interests, such as wrestling or hockey, would use the proceeds from the gambling for their interests only, not for wide-spread uses such as currently established organizations do. Councilmember Barnette co mented that as sensitive as he is to the needs of Fridley organizations, he cannot su port this proposed ordinance, particularly because of how it would impact organizations currently established. Councilmember Bolkco expressed concern that this ordinance would be hurting some organizations for other organizations' gain. She added that Sandee's Restaurant indicated they have never been approached by a Fridley organization. Councilmember Bill' gs stated he appreciates Mayor Lund bringing this matter forward because now there will be an action by the City Council that will let the residents know where Council sta ds on this issue. This discussion also enlightens Fridley residents as to what happens o the charitable gambling dollars in the City. Mayor Lund co mented that he believes it is unfair that other communities have these types of restri ions, but he is concerned that some organizations would be hurt in an effort to help others. The City could not just accept the aud' . Mayor Lund asked the City Attorney to clarify the $10 milli n figure referred to in the proposed ordinance change. Mr. Knaak explained the $10 million figure would refer to the size of the annual budget for the entire organization. Council can lower the amou 't. Mr. Steve Anderson stated he is the Vice Presidentof the Tri-City Hockey Association. He said he was concerned to learn that the Spring ake Park hockey program operates lawful gambling in a Fridley bar. He explain . that he would like to see priority consideration given to Fridley organizations over outside groups. Councilmember Wolfe asked if Tri-City Hockey would meet the new criteria. Mr. Anderson stated he believes they woul as all their practices are at Columbia Arena and their board meetings are held in Fridl y. The board is 75% Fridley residents and 80% to 90% of the participants live in Frid ey. Councilmember Barnette explained th one-fourth of the students in Spring Lake Park schools live in Fridley. MOTION by Councilmember Barnette, seconded by Councilmember Bolkcom to receive the correspondence dated October 25, 2004, from the Minnesota Sports Federation. Councilmember Bolkcom aske that the correspondence regarding this matter that was included in the Council's pack t be reviewed. Mr. Pribyl reviewed the corr spondence stating that CLIMB Theater asked Council not to change the City ordina ce as it relates to charitable gambling; Spring Lake Park Lions Club asked for an e emption if this ordinance is approved; Sandee's Restaurant expressed concern about this proposed change; and the Fridley Lions Club questioned the exemption for large organizations. MOTION by Mayor Lu d, seconded by Councilmember Billings, to waive the reading and approve the ordin ce on first reading. Mayor Lund stated h brought this matter forward in response to concerns from several organizations, but it as not his intent to exclude existing organizations. Preliminary Plat Request PS #04-05 by Yoava Klucsar to Divide One Single Family Lot into Two Single Family Lots, Generally Located at 1420 Rice Creek Road NE. Mr. Hickok, Community Development Director, stated Mr. Klucsar is seeking a vacation of an unimproved portion of Carlton Street and an unimproved 12-foot alley on the northeast side of his property. These vacations will allow platting without any encumbrances. The petitioner is also seeking to replat his property to divide it into two single family lots. The existing home was built in 1951 and the garage on the east side of the lot was built prior to 1949 or was built without a permit. The second garage was constructed in 1991 and is located next to the home. To allow construction of that garage, a variance was granted to increase the total floor area of all accessory buildings from 1,400 square feet to 1,932 square feet. If Council approves this request, that previous variance will no longer be an issue. The lot is 193 x 238 feet for a total square footage of 42,208. The petitioner plans to subdivide the lot with one lot to accommodate the existing home and garage and the other to accommodate the original garage and allow for construction of a single family home. Fridley requires the lots in an R-1 district be a minimum of 75 feet in width and a minimum total area of 9,000 square feet. The first lot will be 117 feet in width with 28,461 square feet and the second lot will be 77 feet in width with 17,747 square feet after the replat. While preparing the preliminary plat, the surveyor discovered an unimproved 30 foot portion of Carlton Street and unimproved 12 foot alley way that had never been vacated. Neither the street nor the alley could be utilized or connected and there are no underground utilities that would stop them from being vacated. Mr. Hickok stated the Planning Commission reviewed this petition on October 6 and recommended approval of the proposed street and alley way vacation and the preliminary plat with the following stipulations. Staff recommends concurrence with the Planning Commission's recommendation. 1. Property owner of record shall obtain all necessary permits prior to construction. 2. Councilmember Billings stated he drafted this resolution because there was a lot of talk in the City about matters on which the Council had made no decisions. The only purpose of the resolution was to make the public aware. Councilmember Wolfe referred to information in one of the local newspapers claiming that if the levy is not successful a larger Public Works budget would be required. He pointed out that the City has maintained is park for 30 years. There was also a claim that Springbrook Nature Center is a fa for for many people purchasing homes in Fridley, yet a review of recent home sal s records revealed no remarks regarding Springbrook. He commented that Council is not taking sides on the Springbrook referendum by simply telling the truth. Councilmember Bolkcom stated misinformation is typical in many political campaigns. She recommended that the residents contact the City Manager if they have questions regarding Springbrook. Councilmember Wolfe commented that the Springbrook levy is not the only tax increase affecting Fridley residents. Dr. Burns, City Manager, stated staff is recommends that in light of lost State aid and generally declining City financial reserves, we begin bonding for the portion of our annual street improvement project not covered by property owner assessments or Municipal State Aid. The intent is to certify the debt service required for repayment of these bonds for tax collection in 2006. This resolution will authorize staff to begin the competitive sale of general obligation b nds sufficient to cover the unfunded costs of the 2005 street improvement project. e expect to sell these general obligation bonds on an annual basis to cover the unfu ed costs of future street improvement projects. Preliminary Plat Request PS #04-05 by Yoava Klucsar to Divide One Single Family Lot into Two Single Family Lots, Generally Located at 1420 Rice Creek Road NE. Mr. Hickok, Community Development Director, stated Mr. Klucsar is seeking a vacation of an unimproved portion of Carlton Street and an unimproved 12-foot alley on the northeast side of his property. These vacations will allow platting without any encumbrances. The petitioner is also seeking to replat his property to divide it into two single family lots. The existing home was built in 1951 and the garage on the east side of the lot was built prior to 1949 or was built without a permit. The second garage was constructed in 1991 and is located next to the home. To allow construction of that garage, a variance was granted to increase the total floor area of all accessory buildings from 1,400 square feet to 1,932 square feet. If Council approves this request, that previous variance will no longer be an issue. The lot is 193 x 238 feet for a total square footage of 42,208. The petitioner plans to subdivide the lot with one lot to accommodate the existing home and garage and the other to accommodate the original garage and allow for construction of a single family home. Fridley requires the lots in an R-1 district be a minimum of 75 feet in width and a minimum total area of 9,000 square feet. The first lot will be 117 feet in width with 28,461 square feet and the second lot will be 77 feet in width with 17,747 square feet after the replat. While preparing the preliminary plat, the surveyor discovered an unimproved 30 foot portion of Carlton Street and unimproved 12 foot alley way that had never been vacated. Neither the street nor the alley could be utilized or connected and there are no underground utilities that would stop them from being vacated. Mr. Hickok stated the Planning Commission reviewed this petition on October 6 and recommended approval of the proposed street and alley way vacation and the preliminary plat with the following stipulations. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 17. Resolution of the Fridley City Council about the Springbrook Nature Center. Councilmember Billings stated he drafted this resolution because there was a lot of talk in the City about matters on which the Council had made no decisions. The only purpose of the resolution was to make the public aware. Councilmember Wolfe referred to information in one of the local newspapers claiming that if the levy is not successful a larger Public Works budget would be required. He pointed out that the City has maintained this park for 30 years. There was also a claim that Springbrook Nature Center is a factor for many people purchasing homes in Fridley, yet a review of recent home sales records revealed no remarks regarding Springbrook. He commented that Council is not taking sides on the Springbrook referendum by simply telling the uth. Councilmember Bolkcom stated m information is typical in many political campaigns. She recommended that the residen contact the City Manager if they have questions regarding Springbrook. Councilmember Wolfe commented that the Springbrook levy is not the only tax increase affecting Fridley residents. Councilmember Billings stated again if Council wishes to table this resolution until after the vote on the referendum, we will know whether we need to go into more detail. FRIDLEY CITY COUNCIL MEETING, OCTOBER 25, 2004 PAGE 14 OF 17 Mr. Knaak said the current ordinance does restrict the number of locations for any one organization to no more than two within the City and the proposed language would not change that. Councilmember Billings stated that while e appreciates the reason for bringing this change forward, the current organization that are not Fridley based are doing a good job of getting their money into the City of Fridley and helping Fridley residents. He thinks the proposed ordinance chang would merely trade organizations that are helping one aspect of the City of Fridl in order to get organizations that also help the citizens of Fridley a little differently. He stated those organizations trying to set up lawful gambling should go directly to the Fridley locations that are licensed rather than going through the City. Councilmember Wolfe stated he i nderstands the Mayor's interest in proposing this ordinance change, but he pointe out that groups representing specific interests, such as wrestling or hockey, would u e the proceeds from the gambling for their interests only, not for wide-spread uses s ch as currently established organizations do. Councilmember Barnette commented that as sensitive as he is to the needs of Fridley organizations, he cannot support this proposed ordinance, particularly because of how it would impact organizations c-rrently established. Councilmember Bolkcom e pressed concern that this ordinance would be hurting some organizations for other o anizations' gain. She added that Sandee's Restaurant indicated they have never been approached by a Fridley organization. Councilmember Billings stated he appreciates Mayor Lund bringing this matter forward because now there will be an action by the City Council that will let the residents know where Council stands n this issue. This discussion also enlightens Fridley residents as to what happens to th charitable gambling dollars in the City. Mayor Lund comme ted that he believes it is unfair that other communities have these types of restriction , but he is concerned that some organizations would be hurt in an effort to help other . The City could not just acc pt the audit. Mayor Lund asked the City Attorney to clarify th $10 million figure referred to in the proposed ordinance change. Mr. Knaak explained the $10 million figure wuld refer to the size of the annual budget for the entire organization. Council can lower the amount. Mr. Steve Anderson stated he is the Vice resident of the Tri-City Hockey Association. He said he was concerned to learn that t e Spring Lake Park hockey program operates lawful gambling in a Fridley bar. He explained that he would like to see priority consideration given to Fridley organizations over outside groups. Councilmember Wolfe asked if Tri-Cify Hockey would meet the new criteria. Mr. Anderson stated he believes they would as all their practices are at Columbia Arena and their board meetings are heXd in Fridley. The board is 75% Fridley residents and 80% to 90% of the participants live in Fridley. Councilmember Barnette explained that one-fourth of the students in Spring Lake Park schools live in Fridley. MOTION by Councilmember Barnette, seconded by Councilmember Bolkcom to receive the correspondence dated.October 25, 2004, from the Minnesota Sports Federation. MOTION by Mayor Lund, seconded by Councilmember Billings, to waive the reading and approv the ordinance on first reading. Dr. Burns, City Manager, stated the City is seeking to clarify and widen right-of-way boundaries along a railway service drive loc ted between Ely and Liberty Streets. All of the impacted property is already City-owne right-of-way. The owner of both abutting properties at 160 Ely Street and 160 Libe Street agrees to the change with the exception that the City will do a future land swwith him. One letter of opposition was received from the resident at 176 Ely Street.\ But that letter appeared to focus on removal of trees that were scheduled to beatc as part of the street reconstruction project. There were no objections raised th public hearing before the Planning Commission. Staff recommends Council's concur nce with the Planning Commission approval. APPROVED. 7. Mr. Van Auken is to bear full responsibility for the creation of a new cul-de-sac on his property. Four abutting prope owners would be responsible for assessments associated with the installation of co crete curb and gutter along that portion of the street where the existing cul-de-sac is being replaced (a distance of approximately 120 feet). Randi Schanus has an Associate of Arts degree from North Hennepin Community College in Law Enforcement and has been employed as a Detention De uty by the Hennepin County Sheriff since April 2002. Ryan George earned a Bachel r of Arts degree in Criminology from the University of Minnesota at Duluth and has orked more than 300 hours with the Duluth Police Department Detective Unit.
