Mr. Peterson presented to the Board, for their inspection, plans of the proposed house. The plans showed the house being built as a single family dwelling with a w�,3.k out apartment in the basement. There would be a etairway down to the apartment from the upstairs, ae well as an outside door. Robert Havel, 6911 East River Road: I was interested in the type of home to be built and how long it will be rented out. Chairman Mittelstadt expla.ined to him that the houae is described ae a duplex but will look like a single family dwelling with an apartment in the basement. Mr. Havel: Who would occupy the building? Mr. Peterson explained that he will live i.n the house and would rent out the basement. Mr. Miniah asked the applicant why he was asking for a two family dwelling on this lot when the other structures in the immediate area are aingle family dwelling�s. Mr. Peteraon explained that he did not think he could afford to build a home right now but with renting out a part of the house he thought he would be able to build. The applicant was a�ked if he had talked to any of the neighbore about his request. Mr. Berry eaid he had talked to sone of the neigh'bors and they were glad that th�, lot would be getting cleaned up. They had no objectiona. It wae brought out that the aquare footage of the lot is adequate for a two family dwelling. MOTION by Minish to- recommend to the Council to deny the request for a Special Use Permit for the following reasons; 1 . The only form of difficulty that has been ahown to the Board is a matter of economics in terme of developing the lot. It would take around 1 ,000 yards of fill to make it a buildable lot and therefore is more suitable £or a double dungalow or a d1�p��.;�,- , 2. The lot is adjacent to t� Locke Lake �{:=� �ciation area which is all single family dwelling�s . 3. The Girl Scout Camp will remain a wildlife refuge for what ever wildlife they nay have. Seconded by Ahonen. Chairman Mittelstadt abatained from voting as he did not want to ma,ke it poesible to have a tie vote. Mr. Deys brought the certificate of survey. The survey shawed a definite problem regarding the exieting house as it was placed on the proposed lot line. Because of the narrow lots, a setback problem is created which would require a variance. It was suggested Mr. Deys go before the Board of Appeals and make an application for a sideyard variance and setback. MOTION by Fitzpatrick, seconded by Jensen, that the Planning Co�ission refer the Lot Split Request, L.S. ��69-15, Arthur Deys, of Lots 3 through 5, Block 7, Hyde Park Addition to the Board o£ Appeals for their opinion. Upon a voice vote, all voting aye, the motion carried unanimously. It was suggested that Mr. Deys ahould look into dividing the split by a diago- nial line being approximately 60 feet on the street side and approximately 57 feet on the rear lot line of the new lot. 7. REQUEST FOR A SPECIAL USE PERMIT FOR CONSTRUCTION OF A TWO FAMILY I7WELLING IN R-1 ZONING: Lot 3, Block 4, Ostman's Addition by Roger L. Peterson. Referred by Council at June 2nd meeting. I Mr. and Mrs. Roger Peterson and Mr. Harland Berry (contractor) were present, �� Mr. Mittelstadt said, explaining the action of the Board of Appeals, this was '� a requeat for a special use pennit to construct a two family dwelling in R-1 � zoning with living quarters one on top of each other. The Code indicates that a � double bungalow, by specia� use permit, goes from the Board of Appeals to the w � Planning Co�ission Meeting - June 11, 1969 Page 6 Planning Co�ission and then to Gouncil,,, There are $1,000 in back taxes, and becauae of the hole on the lot, it would take about 1,000 yards of fill at $1.00 ' a yard to fill it up. The floor of the basement is much higher than the water ' table. There could be a parking problem with renters in the basement. He should have a three car garage, as the neighborhood does not want cars standing outside. If the Board had O.K'd. a turn around, this would h8ve had to be made in the front of the house facing East River Road. Then there is the possibility that the petitioner would not be the permanent owner. There could be deteriora- tion with different owners. The neighbors, however, appreciate having the hole filled and would agree to the use. Mr. Swanson said the actual house, for all appearance's sake, would be a regular single family house with a walkout [o the rear. He had a petition from all the people in the surrounding neighborhood and no one was against it. MOTION by Mittlestadt, seconded by Jensen, that the Planning Commission receive the petition preaented by Roger PeterBbn'w�th eleven eignatures approving the : rezoning request, dated June 11, 1969. Upon a voice vote, all voting aye, the motion carried unanimously. The plans for the house were ahown �nd discussed with the Planning Co�ission by Mr. Berry, the contractor. He explained the lot wss given to Mrs. Peterson ' as a gift. This put an entire different aspect to the initial expense in getting ' the lot ready for construction. The Commission agreed that a turn around should be provided on the lot so that cars would not have to back onto East River Road, and that there should be a three car garage. MOTION by Jensen, seconded by Fitzpatrick, that the Planning Coumiission recom- mend approval of the special use permit by Roger L. Peterson for construction of a two family dwelling provided that the petitioner makes provision for a turn around on the property so that autoa may enter East River Road head on, rather than backing on, and that a three car garage be constructed as part of this li proposal. Upon a voice vote, all voting aye, the motion carried unanimously. � Mr. Mittelstadt asked if there was no way the City can expect the owner, now that he received a special use permit to operate an apartment within the confines of R-1, that you can stipulate that if the original owner sells the property, it ' reverts back to R-1? The Engineering Assistant answered that, as long as the use remains the same and the building is not altered, the use does not change. 9. HYDE PARK REZONING STUDY: The City Engineer explained that the Planning Commission disapproved ef the Plan Circle Flow and recommended Plan Alternative Scheme A-1 prepared by Nason,Wehman, Knight ar.d C?�apman, Inc. Mayor Kirkham said that the Council is still waiting �o hear from the Highway Departm�nt concer.ning the slip- off ramp. He then read the Planning Commission Minutes to the members of the audience. Councilman Liebl questioned .what the Chairman meant by his comment on moving the access further south. Did he mean no access off University Avenue? He said that he was very much impressed by the accuracy and ingenuity of the City Manager when he presented his plan to the Planning Car,�nission, Council and the audience. He asked if the rest of the Council concurred with the Plan Circle Flow as presented by the City Manager. Mayor Kirkham said that it was the concensus of the Council that they were in agreement a*ith the plan. Councilman Sheridan sa.id that he understood the comment of the Chairman to mean that if the Plan Circle Flow is followed, that the slip off ramp should be moved further south. Councilman Harris agreed that was the way he under- stood it. Mr. Eldon Schmedeke said that he was surprised at the stand taken �y the Planning Commission. They are doing the opposite of what the people want, and he said � that this was very disturbing to him. Mayor Kirkham said that each body makes their own evaluation, and obviously the Planning Corunission's stand is dif- ferent from that of the Council's, but each body tries to make their deter- mination to the best of their ability, and for the good of the community. Councilman Sheridan asked the Council Secretary to point out to the Planning Commission Secretary an error on Page 2 of the Planning Commission Minutes, second paragraph, which states "--peat, 6 to 8 inches� deep--" which should read "-- peat, 6 to 8 feet deep--". He questioned whether the Council would wish to acquire some land behind the Frostop for future loop backs, as the traffic is increasing in this area. Councilman Sheridan pointed out that the north two quadzants are not under the jurisdiction of the City of Fridley and there would be no real purpose in acquiring land for loop backs unless Spring Lake Park were to do so also. The City Engineer said that the traffic coming from the south on the T.H. #65 East Service Road cannot get onto Osborne Road going west. The right approach would be to have an overall plan. Councilman Sheridan felt that this should not be part of his current request, and if the City wants more land for a loop back, they should have to pay for it. This would be a benefit to the community, and may or may not be a hinderance to the business. Mr. Sherman Hanson said that he had wanted to close off the access to the south. He asked what the purpose was in requiring sidewalks. The City Engineer ex- plained that this is being done with all the businesses along Osborne Road, so that in the future there will be a completed sidewalk to the school. Council- man �arris said that the Council has been getting agreements from the busi- nesses that they will put in sidewalks when the City feels that they a;e necessary, Mr. Hanson said that he would sign an agreement to put them in sometime in the future. Whether or not these lots should be served by a public road with a cul-de-sac will be the Council's decision. Councilman Samuelson said that he had received a letter from Mr. Allan Z. Rolland, 3458 Irving Avenue North, Minneapolis, stating that he wishes to start construction on a home on Lot 2 of the proposed plat. The City Engineer pointed out that more right of way may be needed if there is to be a cul-de-sac required, which may affect the set back. Councilman Samuelson said that as it was pointed out before, mortgage money is extremely difficult to obtain, especially if there is not public access. He asked if the cul-de-sac were to be put in, would there be adequate land to meet the City standards. The City Engineer suggested requiring a 45' front yard set back, then the roadway could be made wider if necessary. Councilman Samuelson agreed, since Mr. Rolland would be taking a chance on building before the platting is completed. He said that Mr. Rolland has to be out of his home by ,7une 24th, and his request is somewhat premature, however, if it is to be allowed, he would agree with the 45' front yard setback and the understanding that the City of Fridley would not be tied to any responsibility in the event the plat wss not approved for • some reason. Councilman Liebl pointed out that there was nothing in the Planning Commission Minutes about an increase in setback. The City Engineer said that the setback requirements are controlled by the City Code, if the easement is changed to a public 40' roadway.
