RESOLUTION TO VACATE A STORM SEWER EASEMENT FOR THE PROPERTY
GENERALLY LOCATED AT 6431 UNIVERSITY AVENUE, PETITIONED BY THE
CITY OF FRIDLEY'S HOUSING AND REDEVELOPMENT AUTHORITY
WHEREAS, the City has given preliminary plat approval to plat the real property legally
described on Exhibit A (the "Subject Property"); and
WHEREAS, as a result of platting the Subject Property, a storm sewer easement, legally
described in Exhibit B, needs to be vacated:
WHEREAS, notice of a public hearing concerning the requested vacation was duly provided in
accordance with City Code Section 205.05.08 and a public hearing was held on said request at
the City Council meeting on April 8, 2019, at the City of Fridley Civic Campus, located at 7071
University Avenue NE, Fridley, Minnesota; and
WHEREAS, at the City Council Meeting on April 8, 2019, the City Council of the City of
Fridley proceeded to hear all person interested in said vacation request and all persons interested
were afforded an opportunity to present their views and objections to the granting of said Petition
and the City Council considered the request for said vacation; and
WHEREAS, a copy of the UTILITY EASEMENT VACATION DESCRIPTION has been
attached hereto as Exhibit C; and
NOW THEREFORE, BE IT RESOLVED that:
1. The City of Fridley, PURSUANT TO City Charter Section 12.07, City Code Section
205.05.8 and Minnesota Statues 412.851, hereby vacates the utility easement situate
in the City of Fridley, County of Anoka, State of Minnesota, to wit:
All that part of the utility easement lying over, under, and across Lot 6 and 7, Block
1, as created and dedicated in FRIDLEY PLAZA CENTER, according to the
recorded plat thereof, Anoka County, Minnesota.
PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF FRIDLEY THIS
8TH DAY OF APRIL 2019.

Block 1, FRIDLEY PLAZA CENTER, according to the recorded plat thereof, and lying westerly
of the West line of Lot 14, Block 1, said plat of FRIDLEY PLAZA CENTER.
and
That part of the University Avenue East Service Drive NE, formerly known as University
Avenue, and that part of Fourmies Avenue NE accruing thereto by reason of street vacation.
and
That part of the University Avenue East Service Drive, formerly known as University Avenue
and 6th Avenue, as created and dedicated in the plat of REES' ADDITION TO FRIDLEY
PARK, Anoka County, Minnesota, lying southerly of the westerly extension of the most
northerly line of Lot 4, Block 1, FRIDLEY PLAZA CENTER, according to the recorded plat
thereof, and lying northerly of the westerly extension of the South line of Lot 13, Block 1, said
plat of FRIDLEY PLAZA CENTER.
