HAAPALA CITY CLERK OF THE CITY OF FRIDLEY EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL HELD SEPT. 11. 1989, AT 7:30 O'CLOCK P.M. , AT CITY HALL, CITY OF FRIDLEY, MINNESOTA Pursuant to due call and notice thereof, a meeting of the City Council of the City of Fridley, Minnesota, was duly held at the City Hall in said City on Monday, the 11th day of September, 1912, at 7:30 o'clock p.m. The following members were present: Mayor Nee, Councilman Billings, Fitzpatrick, Schneider and Jorgenson and the following were absent: None * * * * * The City Clerk announced that the proposed assessment for 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS had been filed in his office on the 23rd day of August, 1989, and that notice of hearing on said assessment to be held at the meeting of the Council on the 11th day of September, 1989, had been given in the form and manner as provided by law. The City Clerk presented an affidavit showing publication of such notice in the official newspaper, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor announced that the meeting was open for consideration of objections to the assessment heretofore filed with the City Clerk for 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS The City Clerk reported that written objection had been filed by the following persons affecting the following described lots, pieces, or parcels of land, to-wit: NAME OF OBJECTOR DESCRIPTION OBJECTION None The following persons were then heard and presented their objections to said assessment: NAME OF OBJECTOR DESCRIPTION OBJECTION None After due consideration of all said objections, Councilman Schneider introduced the following resolution and moved its adoption: RESOLUTION NO 73-1989 - CONFIRMING ASSESSMENT ROLL FOR 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS RESOLUTION NO. 73 - 1989 RESOLUTION CONFIRMING ASSESSMENT FOR 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS BE IT RESOLVED by the City Council of the City of Fridley, Minnesota, as follows: 1. The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS in said City against every assessable lot, piece, or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece, or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed, except None 4. The amounts specified in the proposed assessment are changed and altered as follows: None 5. This Council finds that each of the lots, pieces, or parcels of land enumerated in said proposed assessment as altered and modified was and is specially benefited by the 1989 SEWER LATERALS, WATER LATERALS AND SERVICE CONNECTIONS in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each lot, piece, or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces, or parcels of land therein described. Page 2 - Resolution No. 73 - 1989 6. Such proposed assessment as altered, modified, and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified, and corrected, with the changes and alterations herein above made, are affirmed, adopted, and confirmed as the proper special assessments for each of said lots, pieces, or parcels of land respectively. 7. Said assessment so affirmed, adopted, and confirmed, shall be certified to by the- City Clerk and filed in his office and shall thereupon be and constitute the special assessment for 1989 SEWER LATERALS, WATER LATERALS, AND SERVICE CONNECTIONS 8. The amounts assessed against each lot, piece, or parcel of land shall bear interest from the date hereto until the same have been paid at the rate of eight (8%) per cent per annum. 9. Such assessment shall be payable in fifteen (15) annual installments payable on the first day of January in each year, beginning in the year 1990, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 10. The City Clerk is hereby directed to make up and file in the office of the County Auditor of Anoka County a certified statement of the amount of all such unpaid assessments and the amount which will be due thereon on the first day of January in each year. The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the WATER, SANITARY SEWER AND STORM SEWER IMPROVEMENT PROJECT NO. 183 in said City against every assessable lot, piece, or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece, or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed, except None 4. The amounts specified in the proposed assessment are changed and altered as follows: None 5. This Council finds that each of the lots, pieces, or parcels of land enumerated in said proposed assessment as altered and modified was and is specially benefited by the WATER, SANITARY SEWER AND STORM SEWER IMPROVEMENT PROJECT NO. 183 in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each lot, piece, or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces, or parcels of land therein described. Such proposed assessment as altered, modified, and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified, and corrected, with the changes and alterations herein above made, are affirmed, adopted, and confirmed as the proper special assessments for each of said lots, pieces, or parcels of land respectively. 7. Said assessment so affirmed, adopted, and confirmed, shall be certified to by the City Clerk and filed in his office and shall thereupon be and constitute the special assessment for WATER, SANITARY SEWER AND STORM SEWER IMPROVEMENT PROJECT NO. 183 8. The amounts assessed against each lot, piece, or parcel of land shall bear interest from the date hereto until the same have been paid at the rate of eight (8%) per cent per annum. 9. Such assessment shall be payable in twenty (20) annual installments payable on the first day of January in each year, beginning in the year 1990, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 10. STREET 1988 - 1 & 2 (PART B) BE IT RESOLVED by the City Council of the City of Fridley, Minnesota, as follows: 1. The City Clerk has with the assistance of the engineers heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the STREET IMPROVEMENT PROJECT NO. STREET 1988 - 1 & 2 (PART B) in said City against every assessable lot, piece, or parcel of land in accordance with the provisions of law, and has prepared and filed with the City Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece, or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. Said proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed, except None 4. The amounts specified in the proposed assessment are changed and altered as follows: None 5. This Council finds that each of the lots, pieces, or parcels of land enumerated in said proposed assessment as altered and modified was and is specially benefited by the STREET IMPROVEMENT PROJECT NO. STREET 1988 - 1 & 2 (PART B) in the amount in said proposed assessment as altered and modified by the corrective roll in the amount set opposite the description of each lot, piece, or parcel of land, and that said amount so set out is hereby levied against each of the respective lots, pieces, or parcels of land therein described. • Page 2 - Resolution No. 77 - 1989 6. Such proposed assessment as altered, modified, and corrected is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment as altered, modified, and corrected, with the changes and alterations herein above made, areaffirmed, adopted, and confirmed as the proper special assessments for each of said lots, pieces, or parcels of land respectively. 7. Said assessment so affirmed, adopted, and confirmed, shall be certified to by the City Clerk and filed in his office and shall thereupon be and constitute the special assessment for STREET IMPROVEMENT PROJECT NO. STREET 1988 - 1 & 2 (PART B) 8. The amounts assessed against each lot, piece, or parcel of land shall bear interest from the date hereto until the same have been paid at the rate of 9-1/2% per cent per annum. 9. Such assessment shall be payable in fifteen (15) annual installments payable on the first day of January in each year, beginning in the year 1990, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 10.
