Res 2019-47 Costs and PH for Nuisance AbatementRESOLUTION NO. 2019 - 47 RESOLUTION DECLARING COSTS TO BE ASSESSED, ORDERING PREPARATION OF PROPOSED ASSESSMENT ROLL AND DIRECTING PUBLICATION OF NOTICE OF HEARING FOR 2019 NUISANCE ABATEMENT WHEREAS, Minnesota Statutes Section 101.01 allows for a governing body of any municipality to provide for the collection of unpaid special charges as a special assessment against the property benefited for all or any part of the cost of inspections if the City Council has adopted an ordinance adopting regulations consistent with this section of state law; and WHEREAS, the Fridley City Council adopted Fridley City Code Chapter 128 entitled Abatement of Exterior Public Nuisances defines the procedure for removal of exterior public nuisance and allows for the assessment of uncollected fees; and WHEREAS, it is hereby declared by the Director of Finance/City Treasurer that the costs to be assessed for the 2019 Nuisance Abatement, including all incidental expenses thereto, to be $75,210.35. NOW THEREFORE, BE IT RESOLVED, that the that the City Council of the City of Fridley hereby directs the Director of Finance/City Treasurer to forthwith calculate the proper amounts to be specially assessed for said improvement against every assessable lot, piece, or parcel of land benefited by said 2019 Public Nuisance Abatements; and BE IT FURTHER RESOLVED, that the City Council orders a public hearing for the 2019 Nuisance Abatements to be held on October 28, 2019 at 7:00 p.m. in the City Council Chamber of Fridley City Hall located at 7071 University Avenue Northeast; and BE IT FURTHER RESOLVED, that the City Council directs and authorizes the Director of Finance/City Treasurer to prepare and publish a notice for the public hearing in the official newspaper of the City no less than two week prior to the date mentioned above. Notices are being mailed to all property owners. Written or oral objections will be considered at the meeting. No appeal may be taken as to the amount of an assessment unless a signed, written objection is filed with the City Clerk prior to the hearing or is presented to the presiding officer at the hearing. The City Council may, upon such notice, consider any objection to the amount of a proposed individual assessment at an adjourned meeting, upon such further notice to the affected property owners, as it deems advisable. A property owner who has properly objected to the assessment may appeal an assessment to district court pursuant to Minnesota Statutes Section 429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City within 30 days after the adoption of the assessment and filing such notice with the District Court within ten days after service upon the Mayor or City Clerk. The City of Fridley has adopted Resolution No. 14-1995 deferring special assessment payments for senior citizens. The City Council may defer the payment of special assessments for any homestead property owned by a person 65 years of age or older, or for persons retired due to permanent and total disability for which it would be a hardship to make the payments.
