Res 2020-10 Set Str Imp Proj Public Hearing RESOLUTION NO. 2020 - 10 A RESOLUTION DECLARING COSTS TO BE REASSESSED, ORDERING PREPARATION OF THE PROPOSED REASSESEMENT ROLL AND DIRECTING THE PUBLICATION OF A PUBLIC HEARING NOTICE RELATED THERETO WHEREAS, October 1, 1984, the City Council, pursuant to Minnesota Statute § 429.061, approved three special assessments related to Street Improvement Project No. 1984–1, and Water and Sanitary Sewer Improvement Project No. 145 totaling $8,972.01 against the property located th at 1388 66 Avenue Northeast; WHEREAS, on September 10, 1990, the City Council, pursuant to Minnesota Statute § 429.061, approved two special assessments related to Street Improvement Project No. 1989–1 totaling $13,018.52 against the property located at 7570 Highway 65 Northeast; and WHEREAS, the City Council approved deferments for both special assessments upon adoption as authorized by Minnesota State § 429.061, subd. 2; and WHEREAS, the accrued interest of the special assessments now total $97,024.26 and $88,217.46, respectively; and WHEREAS, pursuant to Minnesota Statute § 429.071, the City Council finds that these special assessments, or any part thereof, to be excessive and determines that reassessment of these parcels to be prudent; and WHEREAS, by resolution passed by the City Council on January 27, 2020, the City Clerk, with the assistance of the City Treasurer, was directed to prepare a proposed reassessment of the costs related to these projects (Exhibit A); and WHEREAS, the City Clerk, with the assistance of the City Treasurer, has notified the City Council that such proposed assessment has been completed and filed by their office for public inspection. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Fridley hereby approves and authorizes the following: 1. The cost of the reassessment to be paid by the City is hereby estimated to be $46,500, and the portion of that cost to be assessed against the benefited properties is estimated to be $46,500. 2. The reassessment shall be payable upon adoption and certification to the County Auditor consistent with agreement established between the City and the parties subject to this reassessment. The City Clerk, with the assistance of the City Treasurer, shall forthwith calculate the proper amount to be reassessed against every assessable lot, piece or parcel of land within the district affected, without regard to cash valuation, as provided by law, and they shall file a copy of such proposed assessment in their office for public inspection. 4. A hearing shall be held at 7:00 p.m. on February 24, 2020 at the City Hall located at 7071 University Avenue Northeast to pass upon such proposed reassessment. All persons owning property affected by such improvement will be given an opportunity to be heard with reference to such reassessment. 5. The City Clerk, with the assistance of the City Treasurer, is hereby directed to cause a notice of the hearing on the proposed reassessment to be published once in the official newspaper at least two weeks prior to the hearing and they shall state in the notice the total cost of the improvement. They shall also cause a mailed notice to be given to the owner(s) of each parcel described in the assessment roll not less than two weeks prior to the hearings.
