Ms. McPherson stated the property is located north of Gardena
Avenue and east of Hillcrest Drive. The property is zoned R-1,
Single Family Dwelling, as are all adjacent properties.

Ms. McPherson stated the petitioner is requesting a special use
permit to allow the construction of a second accessory structure
over 240 square feet. The petitioner is proposing to locate the
structure in the rear yard in a manner which would meet the. Code
requirements as it would be set back three feet from each of the
property lines. The petitioner intends to use the structure for
storage purposes. The addition of the structure to the lot does
not adversely impact the lot coverage nor will it adversely impact
the adjacent properties. The accessory structure cannot exceed 14
feet in height nor can it be used for any home occupation purposes.
Ms. McPherson stated staff recommends that the Planning Commission
recommend approval of the special use permit request with the
following stipulations:
1. The proposed accessory structure shall be architecturally
compatible with the existing dwelling unit and shall not
exceed 14 feet in height.
2 . The accessory structure shall not be used for a home
occupation as defined in the Zoning Code.
3 . If necessary, the petitioner shall provide a hard surface
driveway to the accessory structure by June 1, 1992 .
Ms. McPherson stated that at the time the staff report was written,
it was unclear whether or not the petitioner needed a driveway to
the structure. The petitioner can verify whether or not
stipulation #3 is needed.
Mr. Bargy stated his existing garage is only 12 feet by 25 feet and
6 feet high. It is big enough for one car. The new structure will
be used for the storage of a rototiller, patio furniture, and other
personal lawn maintenance equipment. He stated he sees no need to
have a driveway to the structure.
Ms. McPherson stated the Commission can strike stipulation #3 .

Mr. Kuechie stated that if they approve the special use permit,
they should leave in stipulation #3, but change the wording
slightly to read: "If the petitioner chooses to install a
driveway, the driveway must be hard surface. " He stated it ought
to be clear that if the petitioner ever wants to install a driveway
in the future, it has to be hard surface.

Ms. Dacy stated the minutes of the Council meeting will be recorded
against the property, so any new property owner would see the
minutes in the title search and that should flag the hard surface
driveway requirement.
Ms. Sherek stated that she did not think the stipulation is
necessary; however, if they choose to have it remain, maybe it
should state that if the structure is ever intended for garage
purposes, that a hard surface driveway should be constructed.
Mr. Kondrick stated he did not think the stipulation is necessary
and should be deleted.
The Commissioners agreed.

2. CONSIDERATION OF A LOT SPLIT, L.S. #92-02 , BY MYRON AND
LILLIAN OSTLUND:
To split the above referenced property into two separate
parcels: The East 83 feet, front and rear, of Lots 6 and 14,
Revised Auditor's Subdivision No. 10, Anoka County, Minnesota,
also the East 83 feet of Outlot A, Dennis Addition, Anoka
County, Minnesota, according to the recorded plats thereof on
file and of record in the Office of the Register of Deeds,
Anoka County, Minnesota, generally located at 1400. - 66th
Avenue N.E.
Ms. McPherson stated this property is located east of Central
Avenue and west of the Fridley/New Brighton border. The property
is a double-fronted lot. The rear of the lot fronts on Creek Park
Lane. The property is zoned R-1, Single Family Dwelling, as are
all the adjacent properties.

Ms. McPherson stated the petitioner is proposing to subdivide the
existing single family lot into two parcels. There is a single
family dwelling unit with an attached two-car garage located on the
property addressed as 1400 - 66th Avenue N.E. The petitioner is
proposing to create a new lot, 83 feet by 120 feet. The lot split
will create two lots which meet the minimum requirements of the R-
1 zoning district regulations for lot width, lot size, and setbacks
for the existing dwelling unit. A variance was granted for the
living area to the rear of the garage on the existing dwelling unit
several years ago.
Ms. McPherson stated utilities were stubbed to the lot line for the
vacant lot when Creek Park Lane was constructed in 1984. There are
outstanding special assessments which will need to be paid at the
time the lot is sold or prior to the issuance of a building permit.
A park dedication fee of $750 will also need to be paid at the time
of issuance of a building permit.
Ms. McPherson stated that as the lot split creates two lots which
meet the minimum requirements of the R-1 zoning district
regulations, staff recommends the Planning Commission recommend
approval of this request with one stipulation:
1. A park dedication fee of $750.00 shall be paid at the
time of issuance of a building permit for the vacant lot.
Mr. Ostlund stated his property is located right next to the old
Rice Creek School property. When that was developed, it was
suggested that he split his property into two lots. Since he was
grandfathered in, he was not required to split his property at the
time and would only be required to pay the assessments when he did
split the property.
MOTION by Mr. Saba, seconded by Mr. Kuechle, to recommend to City
Council approval of Lot Split, L.S. #92-02, by Myron and Lillian
Ostlund, to split the above referenced property into two separate

3. CONSIDERATION OF APPROVAL AND ADOPTION OF THE MODIFIED
REDEVELOPMENT PLAN FOR THE HOUSING AND REDEVELOPMENT
AUTHORITY'S REDEVELOPMENT PROJECT NO. 1, AND APPROVAL AND
ADOPTION OF THE MODIFIED INCREMENT FINANCING PLANS FOR THE
CITY'S TAX INCREMENT FINANCING DISTRICTS NO. 1 THROUGH NO. 12 .
THIS PROPERTY IS GENERALLY LOCATED AT THE INTERSECTION OF 59TH
AVENUE AND MAIN STREET:
Ms. Dacy stated the Planning Commission is being asked to approve
the above reference resolution. Before the City establishes any
parcel in a redevelopment project area or a tax increment district,
the Planning Commission needs to evaluate whether or not the
project is consistent with the Comprehensive Plan.
Ms. Dacy stated this particular property is now vacant. It is
located midway between 61st Avenue and I-694. Sheet Metal
Connectors wants to move here from Minneapolis. The property has
been zoned M-2, Heavy Industrial, since 1958.
Ms. Dacy stated that instead of creating a tax increment district,
the HRA is adding the parcel to the redevelopment project area.
State law enables communities to spend tax increment funds on
parcels in a project area. The taxing jurisdictions--the County,
the City, and the school districts--will all continue to receive
the benefit from the property taxes of this site, but it enables
the HRA to spend money.
Ms. Dacy stated that at their July 9, 1992, meeting, the HRA will
be considering a loan assistance package, so not only does the City
benefit from property taxes, but the HRA will benefit because the
loan will be repaid over the next ten years.
Ms. Dacy stated that since the property is proposed to be used for
an industrial purpose and is consistent with the zoning and the
neighborhood, staff recommends approval of the resolution.
MOTION by Mr. Saba, seconded by Ms. Sherek, to recommend to City
Council approval of a "Resolution of the Fridley Planning
Commission Finding the Modification of the Redevelopment Plan for
Redevelopment District No. 1 to be Consistent with the
Comprehensive Plan of the City".

4. APPROVE 1992 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDING
REQUESTS:
Ms. Sherek stated that for all the years she has been on the
Planning Commission, she has also chaired the Human Resources
Commission. Over the past several years, the amounts requested for
CDBG human service funding have continued to rise, well out of
proportion to the amount of funds that have been available. This

year, the City received $31,042 in grant money, slightly less than
they have received in the last couple of years, and the City
received $68,761 in requests. Needless to say, there are going to
be a number of unhappy grant applicants.
Ms. Sherek stated that one of the things the Council had asked the
Human Resources Commission was how the Commission makes their
funding decisions. The Council was particularly interested in
whether the Commission uses a point system. She stated that for
at least the last three years, the Commission has used a number of
criteria and then has made its decisions on a consensus basis
essentially on each of the issues.
Ms. Sherek stated that, traditionally, the City has provided
funding for the counseling organizations in Anoka County. This
year in a conversation at the May 21 public hearing with one of the
recipients from one of the counseling organizations, it came to the
Commission's attention that if the City of Fridley doesn't give
the counseling agencies any funding or funds them at a lower level,
they don't turn away patients, they simply bill the County. The
Commission members thought that perhaps if the County is going to
pay the bill anyway, CDBG funds can be better utilized some place
else, so the Commission reduced the amount of money allocated to
the counseling agencies.
Ms. Sherek stated that another item that might be somewhat contro-
versial is the request from RISE, Inc. , which is an organization
which employs developmentally disabled, both mentally and
physically, persons in sheltered workshop situations. RISE
requested CDBG funds for. capital equipment. The Commission did not
feel that was a good expenditure of CDBG funds because they felt
that since the activity the piece of equipment would be used for
is producing income, the revenue generated from that activity
should be used to purchase the capital equipment.
Ms. Sherek stated the request from Anoka County Community Action
Program (ACCAP) is for the Fridley Senior Outreach Worker who
visits Fridley seniors in their homes. The only way that position
is funded is through the Community Action Plan (CAP) . The
Community Action Plan is actually the administrator of other
people's funds and a supervisor for people working in other
organizations. CAP handles fuel assistance and weatherization,
etc. For a number of years, the Commission has been discussing
with ACCAP the issue of trying to find some other reliable source
of funding for the Senior Outreach Worker so that the Senior
Outreach Worker does not have to come to the Human Resources
Commission every year begging for her job for the subsequent year.
Ms. Sherek stated that one of the things discussed at a recent
Commission meeting is that the Commission request that the Human
Resources Commission and ACCAP be put on a City Council agenda to
make a request to the City Council that the Council consider
funding the Senior Outreach Worker through the City's General Fund.

In view of the increasing aging senior population the City of
Fridley has, this may be a permanent need.
Ms. Sherek stated the Human Resources Commission recommendations
for 1992-92 CDBG Funding for Human Services came about after three
very long meetings and one short special meeting over the last few
months.
Mr. Saba asked about the Chore Service Program and the Senior
Companion Program for which the Human Resources Commission
recommended $5,000 in CDBG funds.
Ms. Sherek stated Chore Services has guidelines based on income
levels, and senior citizens and handicapped people can get chores
done on a sliding fee scale. What the CDBG funding is providing
is some funding for the person who does the administration of that
program.
Ms. Sherek stated the other half of the $5, 000 is for the Senior
Companion Program. The Senior Companion Program matches a person
or a pair of people (typically very frail seniors) with a senior
companion who also is a low income senior who lives in Fridley.
That person is paid a stipend. The senior companion spends 16-20
hours a week visiting a senior. Most of the money for this
program is funded through a federal Title 8 program, which requires
matching funds from the community. Title 8 will not fund the
program 100%.
Mr. Saba asked how seniors know about the Senior Outreach Worker.
Ms. Sherek stated the Senior Outreach Worker gets referrals from
a variety of sources--from family members, doctors' offices, etc.
Mr. Saba asked if any of these programs get funding from United
Way.
Ms. Sherek stated the Senior Center receives some United Way
funding, but she is not sure about the rest. The United Way is
very selective about the programs it funds. The majority of the
money that is coming back to the Senior Center is coming from the
Lions Club and other community organizations.
Mr. Saba stated that the money coming from the VFW, Lions Club,
etc. , is going to be decreasing. These organizations get most of •
their money from gambling, and now a lot of the gambling is at the
big casinos and through the state lottery.
Ms. Sherek stated it is difficult because the Commission would like
to see and fund new and innovative programs, but there are so many
needed ongoing programs that cannot survive without CDBG funds.
Mr. Sielaff asked if there is any data to show how much the senior
population is increasing in the City of Fridley.

Ms. Sherek stated they do not yet have the 1990 census data, but
the 1980 census data showed that the 55-64 age group was the
largest age group in Fridley at that time. That was ten years ago,
so that probably shows that the largest age group in Fridley now
is 60-69.
Mr. Sielaff stated he wondered if there is going to be a turnover
in homeownership in the City in the near future.
Ms. Sherek stated that turnover is starting now in some
neighborhoods. One of the things that is lacking in the Twin
Cities area is alternative housing for senior citizens, so they
are staying in their homes.
Ms. Sherek stated the Senior Outreach Worker has noticed an
increase in calls and contacts for seniors for assistance and for
crisis situations. Another indicator of the increasing senior
population is that the calls for Chore Services are for more
routine chores which would indicate that the seniors are getting
unable to do even the lawn mowing.
Ms. Sherek stated that when she receives the latest census data,
she will share that with the Planning Commission.
Ms. Modig stated that since the counseling agencies were reduced
to $1,000 each, is that all the money they will receive for the
year, or will the Commission give them more if there is more?
Ms. Sherek stated that on occasion CDBG funding has been turned
back by an organization that could not use it or by an organization
that did not qualify. If that should happen and some more CDBG
monies become available, the Commission would certainly consider
recommending more funding to the counseling agencies since their
funding was cut back substantially this year.
Ms. Modig asked how seniors and the community are notified about
the availability of these programs for seniors.
Ms. Sherek stated this information has been in the Fridley Focus.
Both the Senior Companion Program and the Chore Services Program
have been featured in the Focus. All these programs have also been
featured in the City Newsletter. Another person who does an
excellent job of getting this information to seniors is Council-
member Nancy Jorgenson, who was also the Fridley Senior Outreach
Worker for a couple of years.
Mr. Kondrick commended Ms. Sherek and the Human Resources
Commission. He stated they have a very difficult job each year,
and they have done a tremendous job.

REQUEST
McCombs, Frank, Roos, representing Wal-Mart, Inc. , has proposed a
preliminary plat for the property generally located at 85th and
University Avenues. The plat proposes to create two lots and two
blocks, and to dedicate street right-of-way for the extension of
the West University Avenue Service Road.
The petitioner has also applied for a rezoning to rezone a portion
of the subject parcel from M-2, Heavy Industrial to C-2, General
Business, and also for a special use permit, to allow garden
centers and nurseries which require outdoor storage.
SITE
The property totals approximately 29 acres and is currently vacant.
It is "L" shaped, and is adjacent to the Springbrook Nature Center
and Springbrook Apartments. The property is currently zoned M-2,
Heavy Industrial and C-2, General Business. There is C-2, General
Business zoning to the south; R-3, General Multiple Dwelling zoning
and P, Public, zoning to the west. Located to the north of the
subject parcel in Coon Rapids is additional commercial development,
which includes the Red Lobster restaurant, Springbrook Mall, and
Target Greatland. To the north and east of the subject parcel is
the regional shopping center Northtown.
HISTORY
In 1990, First Western Development Corporation of Denver, Colorado,
proposed a 250,000 square foot shopping center with a 120,000
square foot Target Greatland anchor. That proposal included an
off-site wetland mitigation. The proposal was not reviewed by the
City Council.
ANALYSIS
Drainage
Current Conditions
Storm water flows over the subject parcel through two types of
wetlands. A shrub carr wetland (Type VI) is located in the
northwest corner of the property. This area totals approximately
5.9 acres. Water generally flows over land in this area from the
northeast to the southwest. Storm water runoff from Northtown,
Blaine, and Spring Lake Park flows under University Avenue from the
east and through the site in a westerly direction through two
wooded ditches, which are classified as Type VII wetlands. Water
from these two ditches then enters the Springbrook Apartment

complex area and into the Nature Center and south and west to the
Mississippi River through Springbrook Creek.
Post Development Conditions
Once development occurs, storm water will enter and leave the site
from one outlet. The water which currently flows from Northtown,
Blaine, and Spring Lake Park through the two east/west ditches will
be piped and continue to flow in its normal course.
Water which drains off the newly developed site will first be
contained in a series of detention ponds and then released through
the same outlet as the piped water from Northtown, Blaine, and
Spring Lake Park. The subject property is divided into two sub-
watershed areas. Water will flow north and west off of the bulk
of the parking lot into a 2.6 acre detention pond. The pond will
retain the water and release it at a rate which equals the flow of
water off the undeveloped property. Water will also flow off of
the building and the loading dock area where it will be contained
in a series of detention/retention ponds which are located along
the south and west property lines. Water will again be released
from these detention areas at a rate which equals the current rate
of flow of the property in its undeveloped state.
Wetland Mitigation
On-Site
The petitioner is proposing to fill both ditches in order to
construct the parking lot and install the storm water pipe. This
wetland area equals approximately 1. 67 acres. In addition,
approximately one acre of Type VI wetland located in the northwest
corner of the property is also proposed to be filled. The total
area to be filled equals 2. 67 acres. Of the remaining 4.9 acres
of Type VI wetland, 2.3 acres will be converted to Type III, open
water wetland, in order to provide a storm water detention area and
also to meet the requirements of the 1991 Wetland Conservation Act.
In addition, the creation. of the Type III wetland basin will also
fulfill a portion of the Army Corps of Engineers permit. The storm
water detention basin should be enlarged to 2.67 acres in order to
meet the 1: 1 required ratio as outlined in the 1991 Wetland
Conservation Act. For every acre of wetland filled, one acre of
wetland must be created to fulfill the no net loss requirement in
the 1991 Act. In addition to the on-site mitigation proposed by
the petitioner, the Army Corps of Engineers permit required that
off-site mitigation also occur.
The petitioner met with the Springbrook Nature Center Board on June
29, 1992 to review the proposed project and to determine what, if

any, concerns the Nature Center Board may have regarding the
proposed project. It is possible that through the creation of the
wetland basin on the subject parcel that the adjacent Type VI
wetland located at the northeast corner of the Nature Center could
be de-watered as a result of construction of the detention basin
on the development site. Lowering the water table would adversely
affect the Type VI wetland vegetation in the center. Wal-Mart,
Inc. has contracted with Braun Intertec to install four
piesometers, three on the subject parcel and one on the Nature
Center parcel to determine the permanent level of the ground water
and in which direction the ground water flows. Once the Braun
study has been completed, it will be determined if the construction
of the proposed project will adversely impact the wetland area in
the Nature Center. If a problem is identified, the petitioner
proposes to investigate various design solutions to prevent an
adverse impact to the Nature Center. The petitioner will meet with
the Springbrook Nature Center Board to present the findings of the
Braun study and discuss any necessary design solutions at the July
27, 1992 meeting.
Wal-Mart will be required to execute and record against the
property a maintenance agreement for the on-site detention ponds
and wetlands. Wal-Mart will be responsible for the maintenance of
those facilities.
Off-Site
The proposed location of the off-site mitigation project is
Meadowlands Park. This park is located north of Mississippi Street
between Oakley and Kennaston Streets. Historically, Meadowlands
Park has been a bog. History has indicated that this area was
originally a low area which was filled with construction debris and
miscellaneous fill as the surrounding homes and roads were
developed. Homeowners in the area have experienced flooding in
their basements during large storm events. Water does not flow
out of this drainage area easily.
The proposed wetland mitigation project would create a Type III
wetland of 3 .2 acres. In addition, grading in other parts of the
park would create an open play area which would have proper
drainage, and the petitioner is also proposing to construct a
walking trail around the perimeter of the newly created Type III
wetland. Creation of the wetland will provide storage area for
storm water during large storm events. A control structure in the
northeast corner of the wetland will aid in the controlled release
of storm water. The creation of the off-site wetland will fulfill
the Army Corps of Engineers permit requirements as well as solving
a long-term drainage problem in the neighborhood.

Traffic and Road Construction
In order to construct the proposed project, an extension of West
University Avenue Service Road will need to be constructed. The
petitioner has presented a preliminary road design to the City for
review. Staff has sent the preliminary design to Anoka County
Highways and the Minnesota Department of Transportation for review
and comment. The extension is proposed to be aligned with Adler
Street in Coon Rapids which will provide a logical location for a
second traffic light on 85th Avenue if future traffic counts
warrant. The petitioner intends to dedicate adequate right-of-way
for the public street. The proposed 60 foot right-of-way is
adequate; however, additional right-of-way will need to be
dedicated at the intersection of the West University Avenue Service
Road and 85th Avenue to provide medians and turn lanes. Twenty
feet of additional right-of-way will need to be dedicated in order
to provide 80 feet of right-of-way at the intersection. The
petitioner has indicated that the dedication of additional right-
of-way will not pose a problem for the development.
The petitioner has indicated that due to the proposed timetable for
construction of the project that the petitioner intends to provide
the design for the utilities and road for review and revision by
the City. Minnesota State Aid street funds will be used to
construct the extension, therefore, the Minnesota Department of
Transportation will be required to review the design plans. The
petitioner has indicated that Wal-Mart will also be constructing
the road with the City having responsibility for inspecting the
construction.
Zoning District Regulations
The proposed plat creates two lots which meet the minimum lot area,
lot width, and setback requirements set forth in the C-2, General
Business district regulations. The petitioner is proposing to
construct a 116,000 square foot Wal-Mart retail facility. The
proposed building meets the minimum requirements for setbacks and
number of parking stalls. In addition, the petitioner is proposing
extensive landscaping which exceeds the minimum requirements.
Underground irrigation will be required. The petitioner will be
required to install a six foot high screening fence along the west
property line adjacent to the apartment complex. There are
coniferous trees along the common property line; however, the code
specifically states that additional screening must be provided for
the adjacent residential zoning by the commercial user.
The petitioner is proposing to utilize both wall and free-standing
signs. Staff met with the project architect to review the sign

code and the proposed signage for the project. Wal-Mart is
proposing a number of wall signs, some of which will need to be
relocated or reduced in order to meet the maximum amount of square
footage permitted by code. The petitioner indicated that Wal-Mart
will be cooperative in meeting the code requirements. The typical
Wal-Mart free-standing sign of 120 square feet has been reduced to
meet the maximum 80 square feet permitted by the sign code.
The petitioner is proposing to construct the building of rock face
and standard concrete block, as well as additional architectural
material to provide an interesting facade near the front entrance
to the building. The typical colors for Wal-Mart are light and
dark gray, red, and blue with signage proposed to be in red. The
proposed garden center will be enclosed by knee walls and pillars
of rock face masonry block with wrought iron sections between the
pillars. Rock face block is proposed to be used on the north,
east, and south walls of the building with smooth concrete block
reserved for the west wall adjacent to the apartment complex.
The petitioner is proposing to use Sterner lighting standards on
40 foot poles to illuminate the parking lot. Sterner lighting
standards are typically shoe box shaped, with shielded light
sources. A cross section showing the relationship of the lights
to a visitor in the Nature Center was presented by the petitioner.
Staff recommends that the poles be reduced to 30 feet to lessen the
impact on both the Nature Center and the adjacent apartment
buildings.
The City has proposed a bikeway/walkway system along the west side
of University Avenue. The first leg was constructed in 1991
between 71st and 73rd Avenues. The bikeway was constructed in. the
Minnesota Department of Transportation right-of-way for University
Avenue. The proposed development will not impact future
bikeway/walkway plans in this area.
The petitioner will be required to pay a park dedication fee and
remove the billboards prior to the issuance of a building permit.
RECOMMENDATION AND STIPULATIONS
As the proposed plat creates lots which meet the minimum
requirements set forth in the C-2, General Business district
regulations, staff recommends that the Planning Commission
recommend approval of the plat request, P.S. #92-05, with the
following stipulations:
1. Submit a bond in the amount of 3% of the construction value
to insure installation of the outdoor improvements.

2. Underground irrigation shall be installed.
3. The petitioner shall install a six foot high screening fence
along the common property line between the subject parcel and
the apartments to the west.
4. The on-site wetland mitigation area shall be expanded to 2.67
acres to meet the 1:1 replacement required by the 1991 Wetland
Conservation Act.
5. The petitioner shall provide information. regarding permanent
ground water level and flow to staff and the Nature Center
Board, and if construction on the subject parcel shall have
an adverse impact on the adjacent wetlands, the petitioner
shall provide an appropriate design solution to correct such
an adverse impact.
6. The petitioner shall execute and record against the property
a maintenance agreement which states that Wal-Mart, Inc. shall
be responsible for maintainin all detention and wetland areas
on the subject parcel. g
The petitioner shall install baffle weirs on the detention
inlets in order to screen floatables from storm water entering
the detention ponds.

staff prior to the issuance of a building permit.

APPLICATION FOR

Activity: Refer to Exhibit A, entitled "Preliminary Site Plan/Location Map".
The proposed development includes a Minnesota State Aid (MSA) street extension,
Adler Street, a discount retail store of approximately 149,000 square feet in
size and a 3.9-acre commercial lot for future development. The discount retail
store site involves the development of the required parking lot and drive
isles.
Adler Street is a City and County-designated MSA street, a collector-type
street, linking 83rd Avenue to County Road 132. Adler Street is presently
constructed and in-place from 83rd Avenue to the property's south line.
Purpose: The development of this site meets several significant City of
Fridley objectives. First, the extension of Adler Street linking 83rd Avenue
and 85th Avenue provides a north-south MSA collector that relieves traffic from
University Avenue. This street is part of the City's Overall Transportation
Plan. Adler Street is presently constructed north of 83rd Avenue to the
project site's south boundary. Its tie into County Road No. 132 (85th Avenue
North) is required to match the existing intersection of Adler Street (from the
north) and County Road No. 132. Additionally, the design guidelines for MSA
road improvements require a minimum horizontal curve radius of 300 feet, which
is provided for in the proposed design. The design alignment of Adler, as
shown in Exhibit A, meets the City's transportation needs, as well as those of
Anoka County. A total of 3.1 acres of the project site are needed to meet the
City's grade for this roadway.
A second objective of the City of Fridley is to promote economic development,
including revenue generation and employment creation. Based on comparable
historic data, the 149,000 square foot retail facility alone will create
approximately 250 new jobs and generate in excess of $350,000 in property taxes
on an annual basis. Market demographics for the site include the neighborhood
shopping needs for the existing development in the area. Future development of
the outlot will be responsive to additional commercial needs of the immediate
service area.

A third City objective relates to conformance with Fridley's Comprehensive
Plan. The project site is designated for commercial development and the
proposal is consistent with this goal. It should be noted that a much larger
regional commercial center, Northtown Shopping Center, is located northeast of
the project site and other retail facilities are located north and east of the
project site.
Planning for this site, including building and parking setbacks, has been
completed to comply with Fridley's zoning ordinances. However, several site
constraints make the wetland filling unavoidable. First, the Adler Street
extension requires 3.0 acres of the site, most of which is upland area. Design
requirements, as established for MSA streets, as well as the point of beginning
for the street on the south side of the project site and the termination point
at the north side of this site, restrict roadway alignment options. Second,
the narrow Type 7 drainage ditches ids the southern portion of the site restrict
the reasonable development for much of the project. Finally, the "L" shaped
configuration of the parcel further limits site planning.
Description of On-site Wetlands: The on-site wetlands were identified in a
previous Corps of Engineers permit that was issued for this site (Permit No.
89-1396-12) . Construction, as proposed in that permit, never occurred.
Exhibit B, attached hereto, identifies the on-site wetland limits, which
include approximately 7.6 acres of this site's overall 27.8 acres. In the
southern portion of this site are located two confined Type 7, Wooded
Vegetation, drainage ditches (0.82 acres) ; and a Type 7, Wooded Swamp (0.85
acres) is located toward the western portion of this site. The banks of these
drainage ditches are steep and evidence of erosion is apparent. Both Type 7
wetlands are proposed to be filled. In the northwestern portion of the project
are 5.9 acres of Type 6, Shrub Wetland. Most of this area will remain as
wetland and will be enhanced with the creation of an open pond (refer to the
Mitigation Plans section of this document) . The proposal is to fill
approximately 0.7 acres of the Type 6 wetland, as identified on Exhibit B. Of
the Type 7 wetland area being filled, 0.85 acres is Type 7 wooded swamp wetland
and 0.82 acres is Type 7 wooded ditch wetland.

Mitigation Plans
Generally consistent with the earlier Corps of Engineers permit issued for this
parcel, both on-site and off-site mitigation are proposed as compensation for
the loss of wetlands, as follows:
On-Site: In the northwest portion of the parcel, a Type 4 Open Water
ponding area is proposed. The proposed pond will be 2.6 acres in size, to
be located within the remaining Type 6 wetland. The design is anticipated
to incorporate design criteria outlined in the "General Design
Considerations in Creating Artificial Wetlands for Wildlife" (attached) and
the "Wildlife Pond Diagram" (attached) , with respect to slopes, size, shape
and depth. There are considerable wetland areas on the Springbrook Nature
Center site, immediately west of the proposed ponding area, but relatively
limited open waters. Consequently, the proposed ponding area will create
additional diversity to compliment the adjacent off-site wetlands.
Off-Site: The City of Fridley supports the construction of off-site
mitigation within Meadowlands Park. A Concept Plan for this mitigation is
presented in Exhibit D, attached. Meadowlands Park's location in the City
is shown on Exhibit D, being approximately 3 miles south and east of the
project site. Mitigation would include converting 3.2 acres of upland to
wetland. This plan would also alleviate drainage problems in the immediate
area, generally caused by the existing flat topography, high groundwater
conditions, and the site's poorly drained soils. During heavier rainfall
events, stormwater runoff temporarily indunates the park area, and has
resulted in flooded basements and yards. The City of Fridley has a history
of supporting this mitigation plan. The proposed mitigation pond will have
a water level control, varying water depths (3-5 feet) and shallow slopes
(10:1 to 15:1) . Additionally, the mitigation will grade areas to create
several park features, consisting of a playfield, tot lot area, and a
pedestrian trail.
Discharge of Dredged or Fill Material: All dredged or excavated materials are
to be placed upland, above the ordinary high water mark. This material will e
used principally for landscaping berms. Prior to the construction, erosion
control measures, including silt fence, will be installed to prevent the return
of dredged materials to the low areas.

GENERAL DESIGN CONSIDERATIONS IN CREATING
ARTIFICIAL WETLANDS FOR WILDLIFE
The best solution to maintaining adequate wetland resources is to prevent disturbance
to existing natural basins. When this is unavoidable, however, loss of natural
wetland basins can be at least partially offset or be compensated for by construction
of artificial basins. Based on our review of recent literature on the subject, we
recommend that the following general design features be implemented, to the extent
possible, when constructing an artificial wetland basin:
1. The wetland basin can be relatively small (0.5 acre) , but, if at all possible,
should be at least 1.0 acre in size.
2. A variable (rather than an even-sided) shoreline should be constructed if at all
possible since it will increase the amount of shoreline per unit area and increase
the waterfowl usage by providing isolated areas for feeding and loafing.
3. The bottom contour should be uneven and rolling, which will produce a variable
water depth and allow for emergent vegetation growth on shallow areas throughout the
basin. Water depth in shallow areas should be about 12-18 inches and about 3-4 feet
in the deepest areas . The shoreline area should have a gentle (10:1 to 20:1) slope
to provide for adequate vegetative growth, but also can be variable to provide small
vegetative "fingers" and open "bays" and thus more edge. Vegetation growing in these
shallower areas of the basin should produce vegetative islands' and thereby increase
interspersion or edge habitat. A 50% open water and 50% vegetation coverage of the
wetland (including the emergent vegetation around the shoreline) will provide the
greatest species richness and diversity.
4. The wetland should have a good clay seal to prevent leakage . In addition, we
recommend that topsoil be placed on the bottom of the basin to provide a more
suitable substrate for aquatic vegetation growth, which will quickly establish a
detritus food chain and invertebrate abundance. Wetland basins lined only with clay
normally produce less vegetation, fewer invertebrates and lower numbers of waterfowl
than those lined with both clay and topsoil.
5. On projects where existing wetlands are unavoidably impacted; when feasible , muck:
from existing wetlands should be placed in the bottom of the newly-created basin.
This would provide the basin with a naturally-occurring seed bank and other material
of high organic content.
6. It may be desirable to construct one or two small earthen islands within some
newly-created wetland basins to increase diversity and provide an offshore nesting
area for waterfowl and other wildlife.
7. After construction, a layer of natural or domestic hay should be placed on the
wetland substrate; this will allow a detritus food chain to become established more
rapidly.
8. Re-establishing and maintaining an upland vegetative buffer area around the
perimeter of the newly-created wetland basin will provide nesting habitat and help to
ensure optimum waterfowl production occurs on these areas . If mowing of the
vegetation around the wetland basin is necessary, it should be delayed until after
August 1 if at all possible to avoid disturbance to waterfowl, upland game birds and
other wildlife, during the nesting season.

We have reviewed the preliminary plans for Walmart, to be located west of TH 47
and south of CR 132 (85th Avenue NE)within the City of Fridley, and I offer the
following comments:
Right-of-way along CR 132 depicted on the site plan is acceptable as shown
(60 feet south of centerline). Drainage for this site appears to flow
west into the Springbrook Nature Center. The City of Fridley should provide
information on how the run-off from this development will affect flow at
CSAH 1 (East River Road), and what steps are being taken to ensure that
existing drainage problems in the area will not be increased due to this
development.
Access for this site is acceptable located across from Alder Street as
shown in the plans. Right-of-access along the remaining portions of CR 132
should be dedicated to Anoka County. Initial review shows that sight
distance requirements for Case I will not be met at this location because
of existing trees and brush within the sight distance triangles. The City
and the developer should ensure that these sight distance requirements will
be met by clearing the obstructions. Refer to Mn/DOT's Design Manual for
exact requirements. Signalization of this intersection may be a future
possibility, providing that warrants are met. We will be conducting a 16 hour
Manual Traffic Count at this intersection later this summer, to determine
if volumes satisfy the warrant criteria.
A permit for work within the right-of-way is required, and must be obtained
prior to the commencement of construction. Contact Roy Humbert,
Contracts Administrator for the Anoka County Highway Department, for
further information regarding the permit process. The City of Fridley should
contact me when construction of the new city street is near completion, so
that a stop sign installation at CR 132 can be coordinated by this department.

REOUEST
The petitioner, McCombs, Frank, Roos representing Wal-Mart, Inc. ,
requests that a portion of the proposed development site be rezoned
from M-2, Heavy Industrial to C-2, General Business. The request
is generally located at 85th and University Avenues.
The petitioner has also applied for a special use permit to allow
garden centers or nurseries which require outdoor storage, and for
a preliminary plat in order to replat the property into two lots.
SITE
The proposed development site is composed of three vacant parcels
which form a parcel in the shape of an upside down "L". The short
leg of the "L" is 13 acres in area and lies parallel to 85th Avenue
in an east/west manner. This is the portion of the development
parcel which is currently zoned M-2, Heavy Industrial. The
property lies adjacent to Springbrook Nature Center. The property
to the south is zoned R-3, General Multiple Family Dwelling and C-
2, General Business.
ANALYSIS
When evaluating rezoning requests, three criteria must be met:
1. Compatibility of the proposed use with the proposed district.
2. Compatibility of the proposed district with adjacent uses and
zoning.
3 . Compliance of the proposed use with the proposed district
requirements.
Compatibility of Proposed Use with the Proposed District
The rezoning request proposes to rezone the subject parcel from M-
2, Heavy Industrial to C-2, General Business. The C-2 district
allows a variety of commercial and office-type uses within the
district. The proposed use of the subject parcel is that of a
retail use for a Wal-Mart retail facility. The proposed use is
permitted within the proposed zoning district.
Compatibility of the Proposed District with Adjacent Uses and
Zoning
Located to the west of the subject parcel is Springbrook Nature
Center. The remainder of the proposed development site is zoned
C-2, General Business. The proposed rezoning of the subject parcel

will create contiguous zoning with the remainder of the development
site. The C-2, General Business zoning district is compatible with
the adjacent Springbrook Apartment complex located west of the
proposed development parcel.
Rezoning the subject parcel from M-2 to C-2 will decrease potential
environmental concerns which may be related to an industrial use
which would be permitted on the subject parcel under the M-2 zoning
district designation. Regardless if the development proposal is
approved by the City Council, the subject parcel should be rezoned
from M-2 to C-2, as the C-2 district zoning is a better "fit" with
the adjacent Springbrook Nature Center complex. In addition, there
is additional commercial development north of 85th Avenue in Coon
Rapids as well as north and east of 85th and University Avenues in
Blaine.
Compliance of the Proposed Use with the Proposed District
Requirements.
The petitioner is proposing a development which meets the minimum
code requirements outlined in the C-2, General Business district
regulations. The property meets the minimum lot width, lot area,
and setback requirements. The proposed use complies with the
proposed district requirements.
RECOMMENDATION AND STIPULATIONS
The rezoning request meets the three criteria for approval. Staff
recommends that the Planning Commission recommend approval of the
rezoning request, ZOA #92-05, to rezone the subject parcel from M-
2, Heavy Industrial to C-2, General Business. The Planning
Commission should recommend to the City Council that the rezoning
be approved regardless of the City Council action on the entire
development proposal by the petitioner as the representative for
Wal-Mart, Inc.

REQUEST
The petitioner, McCombs, Frank, Roos, representing Wal-Mart, Inc.
requests that a special use permit be granted to allow garden
centers or nurseries which require outdoor storage. The request
is generally located at 85th and University Avenues.
The petitioner has also filed a rezoning request, to rezone a
portion of the property from M-2, Heavy Industrial to C-2, General
Business, and has also filed a preliminary plat request.
SITE
The subject property is approximately 29 acres in area, vacant, and
zoned C-2, General Business and M-2, Heavy Industrial. The special
use permit request will only apply to the newly-platted Lot 1,
Block 1, Wal-Mart Addition, which will be approximately 16 acres
in area. Property to the west is zoned R-3, General Multiple
Family Dwelling and P, Public. Property to the south is zoned C-
2, General Business.
ANALYSIS
The proposed garden center is 50 ' x 130 ' ; 6,500 square feet in
area. The center is proposed to be located at the northeast corner
of the building adjacent to the proposed West University Avenue
Service Road frontage. The garden center is proposed to be
screened through the use of knee walls and pillars constructed of
rock face concrete block with wrought iron fence sections between
the pillars. Pedestrian access to the center will be through the
main store and vehicular access will occur from the main entry
drive into the subject parcel.
The proposed garden center will provide proper screening of
materials within the center and will not adversely impact traffic
access on the subject parcel. Bulk items such as fertilizer, bags
of soil, hay bales, etc. , should be stored adjacent to the building
such that plant materials in the center may provide additional
screening along the proposed West University Avenue Service Road.
RECOMMENDATION AND STIPULATIONS
Staff recommends that the Planning Commission recommend approval
of the special use permit request, SP #92-07, to allow garden
centers and nurseries which require outdoor storage, with the
following stipulations:
1. Plat request, P.S. #92-05, shall be approved.

2. Bulk items shall be stored adjacent to the main building and
screened from the public right-of-way.
The screening shall consist of rock face concrete block, knee

the pillars. The petitioner shall submit a detail of the
garden center which shall be approved by staff prior to the
issuance of a building permit.

Notice is hereby given that there will be a Public Hearing of the Fridley
Planning Commission at the Fridley Municipal Center, 6431 University Avenue

State Trunk Highway No. 47 except the South 1050 feet
thereof and except that part lying North of the South
line of the North 32.12 acres of said Northwest Quarter
of Section 2.
Parcel 3: The East 600 feet of the North 600 feet of the
South 1050 feet of all that part of the Northwest Quarter
of the Northwest Quarter of Section 2, Township 30, Range
24, Anoka County, Minnesota, lying Westerly of State
Trunk Highway No. 47.
This property is generally located at 85th and University
Avenues.
