PUBLIC HEARING: CONSIDERATION OF A PRELIMINARY PLAT, P.S. #93-02 , BY THE CITY OF FRIDLEY: To replat property described as Lot 1, Block 1, Shorewood Plaza, Lot 1, Block 2, Shorewood Plaza, Lots 1 and 2, Block 3, Shorewood Plaza, Outlots A, B, C, and D, Shorewood Plaza, and that part of the Southwest Quarter of Section 13, Township 30, Range 24, Anoka County, Minnesota, lying southerly of Moore Lake Highlands 3rd Addition, northerly and westerly of Moore Lake Drive and easterly of State Trunk Highway 65. This property is generally located at the intersection of Highway 65 and East Moore Lake Drive, between Highway 65 and Central Avenue. The subject parcels include the East and West Moore Lake Shopping Centers, the Northwest Racquet, Swim & Health Club, and Sears Outlet. The purpose of this plat is to correct errors from the previous 1989 plat. No new development is proposed. PLANNING COMMISSION MEETING, JULY 14, 1993 PAGE 2 UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON NEWMAN DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 7:32 P.M. Ms. McPherson stated the Shorewood Plaza Replat is to revise the Shorewood Plaza Plat which was approved by the City of Fridley in 1987. The properties involved are the old Shorewood Shopping Center, the East Moore Lake Commons Shopping Center, the Sears Outlot building, the Moore Lake Racquet, Swim & Health Club, and Outlot B which is at the intersection of East Moore Lake Drive and 63rd Avenue. Ms. McPherson stated that during the replatting process, the City was also in the process of redesigning and reconstructing East Moore Lake Drive in order to accommodate the increased traffic from the proposed development. The Minnesota State Aid Department denied the City's original design; and after the plat was approved, the City had to redesign the road to meet the Minnesota State Aid Street (MSAS) Standards. As a result of the realignment and the redesign of the road, additional right-of-way was needed. The City also has to return some right-of-way that had been dedicated. A Surveyor's Certificate was recorded after the plat had been recorded; however, this did not allow the City to record the required bikeway/walkway, street, drainage, and utility easements against the new plat. The original plat did not include the old Shorewood Shopping Center; however, that property is included in the revised plat request. Ms. McPherson stated that as part of the revised shorewood Plaza Plat, several lots and blocks are being created by this plat request, including a lot line which appears to split the Racquet Club lot into portions. The purpose for the location of this lot line is that the property changes from Torrens property to Abstract property at that location, and separate lots must be created in order to allow the recording of the appropriate property titles. The lots as created do meet the minimum requirements of the C-3, General Shopping Center District, regulations. Ms. McPherson stated that due to the realignment of the road design, additional right-of-way needs to be dedicated in order to allow the street to exist within the appropriate right-of-way. The following road curvatures must be corrected: 1. The north edge of East Moore Lake Drive in front of the old shopping center. 2 . The south edge of East Moore Lake Drive in front of East Moore Lake Commons Ms. McPherson stated the bikeway/walkways easements which need to be recorded include easements for the existing bikeway/walkway along the south edge of East Moore Lake Drive, as well as an easement for future bikeway construction south along the service r y PLANNING COMMISSION MEETING, JULY 14, 1993 PAGE 3 road adjacent to Sears Outlet and around the detention facilities of the Moore Lake Racquet, Swim & Health Club. Ms. McPherson stated there are street, drainage, and utility easements which were unable to be recorded against the original plat. The original Shorewood Plaza Plat had several dedicated utility easements. However, the utilities as constructed for the development do not fall within those originally dedicated easements. The previously dedicated easements will need to be vacated by a blanket vacation ordinance which will come before the Planning Commission in August and will be recorded prior to the City recording the revised plat. The easements depicted on the map entitled "Water, Sewer, Drainage Easements" must be dedicated in order to allow the City to access these utilities. Ms. McPherson stated that as a side item to this plat request is the proposed booster station that the City will construct as part of the joint powers agreement with the City of New Brighton to receive the water from the Twin City Army Ammunitions Plant. At the time the staff report was written, staff anticipated that the City would be acquiring the entire parcel and proposing a split. The City will be acquiring the parcel; however, they will not be pursuing a split of the property at this time. Ms. McPherson stated staff recommends that the Planning Commission recommend approval of the plat request, P.S. #93-02, by the City of Fridley as proposed. Mr. Kondrick asked if the City anticipates any costs to be borne by property owners in the area other than the City of Fridley. Ms. McPherson stated that while the City of Fridley is shepherding this particular request through the process, it is somewhat of a joint application in which the City has come to an agreement with adjacent property owners to pay for the surveying costs. All the legal and title fees will be the responsibility of the adjacent property owners. The property owners are aware of this and are willing to correct the legal land problems. Mr. Leonard Juster stated a lot of errors were made when East Moore Lake Drive was designed. This proposal by the City to clear up the legal land problems is welcomed by the adjoining property owners, and all the costs will be covered by the adjoining property owners. Mr. George Applebaum stated he is in agreement with Mr. Juster's statement. MOTION by Mr. Kondrick, seconded by Mr. Saba, to close the public hearing. REVIEW OF HOUSING PROGRAMS BY GRANT FERNELIUS, HOUSING COORDINATOR: Mr. Fernelius stated that he was asked to come before the Planning Commission and review the status of the City's housing rehabilitation program. He stated that he started as the Housing Coordinator in the middle of April 1993 . Since that time, he has been working on establishing various programs that the Housing & Redevelopment wanted to implement in the City. He stated he will be administering these programs. He stated he has prepared a matrix which describes the programs. Three programs will be offered for the single family rehab, plus one program for rental rehab. Mr. Fernelius presented the components of the following housing rehab programs: 1. Home Improvement Grant Program 2. Home Improvement Loan Program 3 . Home Mortgage Assistance Program 3. Rental Rehab Mr. Kondrick stated that under the income limits for the Home Improvement Grant Program, how many people qualify for that program? Mr. Fernelius distributed a copy of the data from the 1990 census which shows the income for various categories. As the Commission members could see, there are quite a few people who fall within the income limits, based on household size. There are people who are eligible for this program. He currently has about 40 applications on file for each of the three single family rehab programs, and there are about 20 people who have applied for the grant program. Based on his brief review of these applications, they appear to be eligible. Mr. Kondrick asked how many of the numbers reflected in the census data are actually homeowners in the City of Fridley. These numbers could reflect a lot of renters. Ms. McPherson stated staff has not done an analysis on how many of these people are actually homeowners. The problem is the income information generated by the Census Bureau is not dwelling specific. It is done on a block level and tract level and is more of a general estimate of a general area of a community. She stated y PLANNING COMMISSION MEETING, JULY 14, 1993 PAGE 6 staff could review the census sheets to try to get some correlation figures for the Commission for a later meeting. Mr. Saba stated the Home Improvement Grant Program appears to be a nice program, but he believes it is missing a prime target which are the homeowners who own a home, cannot afford to improve it, have children, the home is deteriorating, but yet they fall out of these income categories. What is being done to fill in those kinds of gaps? Mr. Fernelius stated the County established the rules for the Home Improvement Grant Program. The County has found that there is a significant demand for these types of programs. Because these are federal dollars, the County wanted to prioritize the dollars to the lowest income households, and that is why the limits are so low. Mr. Kondrick stated that is fine, but if the numbers of dollars that are available to people who live in Fridley are based upon pure income levels as opposed to income levels of people who actually own homes, do they have the right numbers? Mr. Oquist stated that for people whose income limits are above those established for the Home Improvement Grant Program, then they qualify for the Home Improvement Loan Program which features low interest rate loans. There is only a limited amount of CDBG money available, so only a certain number of people are going to get the money anyway. Mr. Newman stated that a few of the Commission members seem to feel that the income levels for the Home Improvement Grant Program are too low. What is Mr. Fernelius' opinion? Mr. Fernelius stated he believed the income levels are fine. He believed if they raise the income limits, they are just going to be expanding the number of individuals who can apply, thereby making it even more difficult to go through the prescreening process to select candidates. These funds are really geared toward those people who have very, very low incomes. Mr. Newman stated he is disappointed that the City is missing the boat by not providing opportunities for other income areas to allow more people to expand and improve their homes. These programs are a good start, but they are not addressing the middle class people who want to fix up their homes and stay in Fridley versus selling their homes and moving to nicer homes farther out. Mr. Fernelius stated he agreed with Mr. Newman. Hopefully, as they get farther along in the process, they can revise these programs to meet a larger segment of the population. But, for this initial effort, it was the decision of the HRA to set certain income limits. Mr. Kondrick stated he also agreed with Mr. Newman. It should be of major concern to the City to see people of higher income PLANNING COMMISSION MEETING JULY 14 1993 PAGE 7 brackets leaving Fridley and moving out to the next ring suburb and then the next, etc. This creates a serious problem in terms of housing. He hoped that this concern will be expressed to the HRA and the City Council. Mr. Fernelius stated applications will be taken through July 16, 1993. After July 16, he will prescreen the applications. The HRA was very insistent that they did not want a first-come, first-serve process; they wanted to be able to prioritize funds for most in need. The HRA established four c iter ahe to be used asepart of the prescreening process: part 1. Age of the property 2. Location 3. Type of improvements 4. Applicant's income Mr. Fernelius stated he will set the applications into three different piles, one for each the acations using these criteria. Those with ro the highestram, andank scores willlreceive priority for the available funds. Mr. Fernelius stated that once the ranking property inspections will be made to determine the minimum improve- ments that would have to be included in the financing package to make sure that code violation type improvements are covered as part of the financing. Mr. Fernelius stated that once the completed, the applicants will have 30 daysotorgoty inspections the bakare the loan program and mortgage assisance g program and under application. Hopefully, these between mid to late September 1993, the banks will start processing these applications and, assuming the applications are approved, rehab work would start shortly thereafter. Page 2 Request The petitioner requests that a special use permit be granted to allow the establishment of a veterinary clinic. The request is for Lots 5-8, Block 3, Bennet-Palmer Addition, and Lot 17, Block 4, Bennet-Palmer Addition, generally located at 5895 University Avenue N.E. Site Located on the property is a single story building of masonry and brick construction. The building was previously home to Mr. Steak, Arnold's, and the Straight Arrow restaurants. The property is zoned C-2, General Business, as are the properties to the north and south. The property to the east is zoned R-2, Two Family Dwelling. Analysis The petitioner proposes to use the building as a veterinary hospital. In addition, grooming and boarding services will be offered. The maximum daily animal capacity as indicated by the petitioner will be 34 dogs and cats combined. Section 205. 14.01.C. (10) of the Fridley City Code permits animal clinics, veterinary clinics, and animal hospitals, public kennels, obedience schools, and training services with a special use permit, provided the following conditions are met: 1. All windows in the area of the building housing animals shall be double-glazed with a fixed sash. 2 . Any ventilation system shall be designed so that no odors or organism will spread between wards or to the outside air. 3 . There are no outside pens or holding areas. The petitioner has submitted extensive plans regarding compliance with these three conditions of the zoning code. The petitioner is proposing to provide the windows as required. There are no plans to construct an outdoor kennel. The petitioner proposes to have the dog/cat ward and surgery suites on a single air conditioning and heating unit. Each individual ward is proposed to have a separate air exhaust with a charcoal filter. There will be in excess of 12 air exchanges per hour for each separate ward. The petitioner has on file an infectious waste management plan with the Minnesota Department of Health. The petitioner is also Staff Report SP #93-12, by Doug LeMay Home Veterinary Service, Inc. Page 3 currently licensed and has submitted a copy of his license. As the property has been vacant intermittently for a number of years, general property maintenance has not been maintained. General clean-up of the site needs to be performed: 1. Repair fence. 2. Remove weeds in the shrub beds in the area adjacent to the fence and in the parking lot. 3. Prune trees and shrubs. 4. Add new rock to the shrub beds. Completion of these items should be stipulated as a condition of approval of the special use permit. Recommendation Staff recommends that the Planning Commission recommend approval of the special use permit request by Doug LeMay of Home Veterinary Services, Inc. , to allow establishment of a veterinary clinic, with the following stipulation: 1. General site clean-up, including repairing the fence, removing weeds located in the shrub beds, in the area adjacent to the fence and in the parking lot, addition of new rock to the shrub beds, and the pruning of trees and shrubs, shall be completed by June 1, 1995. The plan will be for the animal wards and isolation room to be able to create a negative pressure in the room when needed, if possible the surgery room will be - in positive pressure when in use. The present system is capable of supplying air to these areas at a rate in excess of 12 exchanges per hour . Other Considerations 1 . Infectious Waste Management. Under the current State and Federal Law the only infectious waste that will be generated is "sharps" . Sharps are defined as needles and scalpel blades. A management plan is currently on file with the Minnesota Department of Health and is subject to their review and approval . 2. X-Ray Machine The X-ray machine, room, and operating personal will conform to the rules set forth by the Minnesota, Department of Health in Chapter 4730. Analysis The petitioner is Friendly Chevrolet Geo, representing itself and three other dealerships. The dealerships are proposing to conduct a Labor Day sale of used vehicles. The event is scheduled for September 3, 4, and 6, 1993. The automobiles are proposed to be located in the north parking lot of the site. Customer parking will be in front of the Arena in the west parking lot. The area for the vehicle display is proposed to be blocked off and traffic re-routed within the site. A staff person will direct traffic on site. A tent will also be erected and portable toilets provided. As the public will not have access to the Arena, the portable toilets will have to be handicap accessible. The petitioner is proposing to have 24 hour security. All of the vehicles offered for sale would be late model used vehicles. There will be no new vehicles for sale. 2) All sale vehicles would be moved to the site on Friday morning with the sale starting at 5:00p.m. until 9:00p.m. on Friday. Saturday and Monday Sale hours will be from 9 :00a.m. to 5:00p.m. 3) We would provide security at the site during the sales promotion. The legal requirement is that this be mailed to all property owners within 250 feet of the site. The Fridley City staff has already done the required legal notice to that area. Since this will be for Columbia Arena, and I know that the entrance and exit to your neighborhood is limited to 69th, I thought that you would be interested in knowing what is proposed. Friendly Chevrolet and two or three other car dealers have requested that Anoka County rent them the Columbia Arena parking lot for a special three day auto sale over the Labor Day weekend. I shouldn't think that the traffic will be much different than some of the craft fairs and such that have been held at the Arena. Since the sale of automobiles requires a license in Fridley, and since the license is issued normally for one specific site, and since Columbia Arena does not normally have auto sales, we are requiring them to get approval from the Planning Commission. I this way, we can place some requirements on them. Also, if this causes problems for the neighbors, we can look at ways to change and/or prevent future events of this nature. The City of Fridley recently approved a similar proposal for Sam's Club. We set requirements on that request for parking, sanitary facilities, and a provision for staff review. I would assume that we would act in a similar manner on this. By way of this letter, I do not want to imply that there is a need to attend the Planning Commission meeting, or to be overly concerned. However, I have heard many times, "Why didn't someone tell me this was happening?" This is my way of informing you of what may be happening in your neighborhood. If you feel that you would like to be at the Planning Commission meeting, you are certainly welcome to attend, to listen, to speak, and to provide input to the decision of the Planning Commission. The Engineering Department has designed a 31 space parking lot with a pad for parking the Showmobile (see site plan) . The parking lot is proposed to be located north of the existing parking lot between the two park picnic shelters located north of the softball diamond. The location of the proposed parking lot is heavily treed and the Engineering Department has attempted to avoid as many trees as possible. However, three trees will be impacted; two three-inch Maples need to be relocated; one ten-inch Ash tree needs to be removed. Prior to removal of any tree located on City-owned land, City Code section 510 entitled "Tree Preservation" requires approval by the Parks and Recreation Commission, the Planning Commission, and the City Council. Jack Kirk, Director of Recreation and Natural Resources has polled the Parks and Recreation Commission members. A memo indicating their response is attached for the Planning Commission's review. Staff recommends that the Planning Commission recommend approval to the City Council removal of the ten inch Ash tree to allow construction of the Moore Lake Beach parking lot. Chapter 510 of the Fridley City Code requires approval of the Park & Recreation Commission, Planning Commission, and the City Council before a tree can be removed from our park land. Since the next Park & Recreation Comniission meeting is not until August 9th, I've been asked to poll the Park & Recreation Commission members regarding removal of the Ash tree. As of this morning, July 23, 1993 at 10:00 a.m., I have been able to talk with two of the five Park & Recreation Commission members. Both of these commission members stated that they are still not in favor of putting in a parking lot, however, if a parking lot is going in they do not object to the taking out of the tree. • I should be able to contact the rest of the Park & Recreation Commission members before the Planning Commission meeting next Wednesday, July 28th. DESTRUCTION OF LIVING TREES DESTRUCTION No person or corporation, public or private, including but not OF LIVING limited to the City of Fridley, its officers, employees or agents, TREES shall order or cause the injury or destruction of any living tree on City-owned land except under any of the following conditions: 1. For control of verified cases of Oak Wilt or Dutch Elm disease as provided in Chapter 104 of the Fridley City Code; 2. For purposes of woodland management, the removal of up to three (3) trees per acre per year may be permitted, but only after a management plan justifying such removals has been approved by the Fridley Parks and Recreation Subcommittee, the Fridley Planning Commission and the Fridley City Council. No tree removal shall be allowed under the provisions of this Paragraph which is not defined in the plan; or, 3. For purposes of necessary public utility construction, but only after the preparation of a detailed plan and approval by the authorities named in 510.01.2. No such plan shall be approved which does not provide for reforestation and the restoration of the land to its original condition. 510.02. EXEMPTION EXEMPTION Trees measuring less than three (3) inches in diameter at a point four (4) feet above ground are exempt from the provisions of this Chapter. 510.03. TRIMMING TRIMMING Nothing in this Chapter shall be construed to prevent the routine trimming of trees in street right-of-ways. 510.04. VIOLATION VIOLATION Any person who violates this Chapter shall be guilty of a misdemeanor and is subject to all penalties provided for such violations under the provisions of Chapter 901 of this Code.
