NATIONAL POLICE WEEK: May 11 - 17, 2022
PEACE OFFICERS MEMORIAL DAY: May 15, 2022
WHEREAS, the quality of life in the United States is preserved and enhanced by the diligent efforts
of our law enforcement personnel; and
WHEREAS, 800,000 men and women in the United States, including more than 11,000 Minnesota
peace officers, and 46 Fridley police officers serve their fellow citizens as law enforcement officers;
and
WHEREAS, the first recorded police officer death was in 1786; and
WHEREAS, nationally an average of 176 officers are killed in the United States each year; and
WHEREAS, on average nationally, over 50,000 officers are assaulted resulting in over 14,000
injuries; and
WHEREAS, Minnesota has lost 262 law enforcement officers in the line of duty since 1874 and the
national toll exceeds 22,000 fallen officers; and
WHEREAS, on May 15, 2022, Fridley police officers will join all U.S. peace officers and the families
of their fallen comrades to honor those officers and all others who have made the ultimate sacrifice:

WHEREAS, Public Works professionals strive to maintain and improve infrastructure, facilities and services that
are of vital importance to sustainable and resilient communities and to the public health, high quality of life and
well-being of the people who work and live in Fridley; and,
WHEREAS, such facilities and services could not be provided without the dedicated and often unheralded efforts
and skills of Public Works professionals, engineers, managers, and employees from the City of Fridley and its
Public Works partners, who are responsible for and who plan, design, build, operate, and maintain our facilities
and services; and,
WHEREAS, the safety, vibrancy, and stability of our community greatly depends on the quality and effectiveness
of these systems and the services they provide; and,
WHEREAS, the support of an understanding and informed citizenry is vital to the efficient operation and
maintenance of Public Works systems essential to serve our residents and businesses, such as water supply and

10. Resolution No. 2022-35, Approving 2022-2023 Business License Renewals
Ryan George, Police Deputy Director, provided background information on the business licensing
activities that require approval of the City Council and reviewed the license review process. He provided
additional details on Two Stooges and that additional review processes and changes that have been
implemented since the discussions with staff.

The Council commented on the great improvement in the number of police calls for Two Stooges noting
that they would prefer a follow-up on that later this year. Appreciation was also expressed to staff and
the business owners for their cooperative efforts to turn things around.
Motion made by Councilmember Ostwald to adopt Resolution No. 2022-25, Approving 2022-2023
Business License Renewals. Seconded by Councilmember Eggert.

11. Resolution No. 2022-36, Approving Park System Improvement Plan Final Report and Authorizing Staff
to Begin Implementation
Mike Maher, Director of Parks and Recreation, reviewed the purpose and background of the Park System
Improvement Plan and provided an overview of the final report and plan including the implementation
schedule. He noted that $50,000,000 in improvements were proposed within the plan, but the direction
was to fit within a budget of $30,000,000 therefore some park projects were placed on a deferred list until
additional funding can be identified such as grants.
Candace Amberg, WSB, provided additional details on the process that was followed to develop the
recommendations. She also reviewed the recommendations and noted the changes that were made
following resident input.
The Council thanked staff for their work, residents for their input, and expressed excitement to implement
this project.
Motion made by Councilmember Bolkcom to accept the Park System Improvement Plan Final Report and
adopt Resolution No. 2022-36, Authorizing Staff to Begin the Implementation of the Park System
Improvement Plan. Seconded by Councilmember Tillberry.
UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED
UNANIMOUSLY.
Wally Wysopal, City Manager, thanked all the different members of City staff who worked on this
throughout the multiple-year process.

Hazardous waste drop off event this Saturday from 9 a.m. to 1 p.m. at the Fridley Fire Department. The
community concert series is back by popular demand.

Background
On Wednesday, April27 at 9:00 a.m., bids were publicly opened online via the virtual platform available
on QuestCDN and Microsoft Teams for the 2021StreetRehabilitation Project No. ST2021-01(Project).
Sixresponsive bids were received.
This project, which is part of annual street rehabilitation program, includes
rehabilitation of select streets within the Lakeview neighborhood. The total project length is
approximately 1.7 miles.Rehabilitationof the streets will include asphalt reclaiming, asphalt paving, and
concrete curb repairs.
As noted, sixbids were received. The low bid was received from North Valley, Inc.of Nowthen, MNin
the amount of $852,441.23, which is 3.5%above823,932.00(Exhibit A).
The two lowest bids were very competitive and within $13,100of one another and the threelowest bids
were within $27,200. Ofthe sixbids, the high bid received was $999,900.30.
The City has worked with North Valley, Inc.in the paston the West Moore Lake Drive Street and Trail
Federal Aid project that was completed in 2019. Staff believes they are a knowledgeable and reputable
contractor and will deliver the project withintherequisite quality specifiedin the bid documents.
Based on the low bid received, staffanticipatesa $3,300 special assessment for a single-family home.
This is 10% higher than projected in the feasibility report at the beginning of November 2021 and
presented at the hearing on improvements. Bid prices for bituminous asphalt were18% and36% increase
in costfor the non-wearing (base lift) and wearing (final lift) asphaltfrom the prices seen in 2021.The
increase in asphalt prices have a greater bearing on the special assessments than the cost of the overall
project, as some other elements are not part of the special assessment.
The low bid is within budget for the overall projectfrom different funding sources, however it exceeds
the Street CIP project amount of $680,000 by $35,687. The Street CIP will be able to be balanced if the
project is moved forward through additional special assessment and Municipal State Aid System (MSAS)
revenue.

The low bid is higher than the project estimate, but only slightly so, and there would not be an advantage
to rebid the project as evidenced by the similarity of the bid amounts received.
Finally, the low bid would result in a special assessment approximately 10% or $300 higher than
projected for single-family residential properties. While this is disconcerting to staff, as we have been
proud of record in estimating special assessments at or above the end cost. Staff do not believe
it would be advantageous to rebid or delay this project. The cost of oil has risen 20% since
estimates and is not likely to decrease in the near-term. Staff are therefore recommending that the City
Council award the project.
Property owners will receive notification of project advancement this May presuming the City Council
awards the project at this meeting. A project information sheet will provide a tentative work schedule,
work description and contact information. During the project, staff will distribute weekly project updates
via email and the project-specific page on
Staff expect the work to begin in June with substantial completion in October of this year.
Financial Impact
Funding for this project is derived from several sources including MSAS street funding, special
assessments, and Utility CIP funds (water, sanitary sewer, and storm sewer). The low bid is within budget
for the overall project from different funding sources, however it exceeds the Street CIP project amount
of $680,000 by $35,687. The Street CIP will be able to be balanced if the project is moved forward
through additional special assessment and MSAS revenue to fund the $715,687.04 cost to the Street
CIP.
Recommendation
Staff recommends the approval of Resolution No. 2022-41.

Resolution No. 2022-41
Award of 2021 Street Rehabilitation Project No. ST2021-01
Whereas, the 2021 Street Rehabilitation Project No. ST2021-01 (Project) included as part of the
City) regular street maintenance programs under its Capital Investment Program
and includes rehabilitation of specific street segments in the Lakeview neighborhood, along with
associated roadway repairs, and other ancillary items; and
Whereas, the City has prepared a Capital Investment Program to systematically reconstruct
streets in the City regularly to maintain roadway quality and performance; and
Whereas, Resolution No. 2021-111 adopted November 8, 2021 received the Project feasibility
report and called for a public hearing on the matter of the construction of certain improvements
listed therein; and
Whereas, a public hearing regarding said improvements considered under the Project was set for
December 13, 2021 and ten days mailed notice and two weeks published notice of the hearing
was given; and
Whereas, at said hearing on improvements, the Fridley City Council (Council) heard all those
persons that desired to address the Council; and
Whereas, Resolution No. 2021-122 adopted December 13, 2021 ordered final plans, specifications
and calling for bids.
Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves
received bids per the attached bid tabulation and award the 2021 Street Rehabilitation Project
No. ST2021-01 to the lowest responsive bidder, North Valley, Inc. of Nowthen, MN in the amount
of $852,411.23.

Background
Each year, the Bureau of Justice Assistance(BJA), a division of the U.S. Department of Justice, makes
funds available to help state, local, and tribal jurisdictions reduce and prevent crime, reduce recidivism,
and promote a fair and safe criminal justice system. The City of Fridley (City) applied for and received
$63,000 from the BJA(Award #2018-BC-BX-0040)for the period of October 1, 2018 to September30,
2021 for a Body Worn Camera Policy and Implementation Program. The City also requests and receives
annual BJAfunding through the Patrick Leahy Bulletproof Vest Partnership (BVP) Program, which
reimburses the City for up to 50%of the cost of ballistic vests for sworn officers. The City has drawn
down all available funds and completed federal reporting requirements for its previous BJAawards.
The City of Coon Rapids (Coon Rapids) applied for fiscal year 2021 funds through the Edward Byrne
Memorial Justice Assistance Grant (JAG) Program, which is administered by the BJA, for the purchase of
Field Training Software and Portable Breath Test units. They wereawarded $24,048 under award
#15PBJA-21-GG-01598-JAGX for the purpose specified in the grant application. For unknown reasons,
the JAG award provided to Coon Rapids included the City as an additional party. Coon Rapids and the
Cityshare a municipal prosecutor and have several other partnerships, but the BJAwas unable to
determine why the City was listed as a sub-recipient of the funds that Coon Rapids was awarded.
TBJAor meet federal reporting
requirements because the funds were requested by Coon Rapids for a specific purpose. Coon Rapids is
unable to draw down funds from their award until the City formally declines participation in their BJA
award by means of an agreement between the City and Coon Rapids. Anoka County must also consent
to the allocation of BJA fundsbefore the Coon Rapids can draw down their funds.
A Memorandum of Understanding (Agreement) between the City, Coon Rapids, and Anoka County is
necessary for Coon Rapids to satisfy the conditions of their BJA solicitation for 2021. Anagreement was
drafted by Coon Rapidsto satisfy all requirements of their BJA solicitation. The agreementhas been
reviewed by the City Attorneyand is recommended for approval.

meet federal reporting requirements because the funds were requested by Coon Rapids for a
specific purpose; and
Whereas, Coon Rapids is unable to draw down funds from their award until the City formally

Whereas, Coon Rapids is unable to draw down funds from their award until the County of Anoka
consents to the allocation of Bureau of Justice Assistance funds; and

agreement and the Mayor and the City Manager (or their designee) are hereby authorized to

FOR THE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG)
PROGRAM FY 2021 LOCAL SOLICITATION
THIS AGREEMENT is made and entered into on the ____ day of _______________, 2022,
by and between the City of Coon Rapids, acting by and through its City Council, City of Fridley,
acting by and through its City Council and Anoka County, acting by and through its County
Commissioners, all of Anoka County, State of Minnesota witnesseth:
WHEREAS, the City of Coon Rapids and City of Fridley received notice that it is
eligible for a JAG grant in the amount of $24,048.00 for the purpose of law enforcement
equipment.
WHEREAS, JAG funding program requires Anoka County's consent to the allocation of
JAG monies even though Anoka County is not directly receiving JAG monies;
WHEREAS, City of Fridley is declining their direct allocation of the JAG monies,
therefore City of Coon Rapids is eligible for their portion.
WHEREAS, Minnesota Statute § 471.59, subd. 1 allows two or more governmental units,
by agreement entered into by their governing bodies, to jointly or cooperatively exercise any power
common to both contracting parties; and further it allows one party to act on behalf of other
participating units of government; and
WHEREAS, each governmental body, in performing governmental functions or in
paying for the performance of government functions hereunder, shall make that performance or
those payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly compensates the performing party for the services or functions under this agreement:

NOW THEREFORE, the cities of Coon Rapids and Anoka County agree as follows:
Section 1.
Anoka consents to the allocation of JAG monies and how Coon Rapids will spend the JAG
monies.
Section 2.
City of Fridley declines their direct allocation of JAG monies, consents to the allocation
of their portion of JAG monies to Coon Rapids and how Coon Rapids will spend the JAG
monies.
Section 3.
Nothing in the performance of this Agreement shall impose any liability for claims
against the City of Coon Rapids other than claims for which liability may be imposed by the
Minnesota Tort Claims Act.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims
against Anoka County other than claims for which liability may be imposed by the Minnesota
Tort Claim Act.
Section 5.
Each party to this agreement will be responsible for its own actions in providing services
under this agreement and shall be liable for any civil liability that may arise from the furnishing of
the services by the other party.
Section 6.
The parties to this agreement do not intend for any third party to obtain a right by virtue of
this agreement.
Section 7.
By entering into this agreement, the parties do not intend to create any obligations

rights in any party not a signatory hereto.
Section 8.

Approving Appointment to the Housing and Redevelopment Authority
Whereas, the City of Fridley Housing and Redevelopment Authority (HRA) was established in 1965
pursuant to Minnesota Statute (M.S) 469.003; and
Whereas, M.S 469.003 subd. 6 requires the Mayor of cities with a HRA to appoint commissioners if a
vacancy exists; and
Whereas, M.S 469.003 subd. 6 also requires the governing body of cities with a HRA to approve such
appointments; and
Whereas, the City of Fridley was notified of an upcoming a vacancy on the CHRA beginning June
3, 2022; and
Whereas, four individuals expressed an interest in being appointed to the HRA and met with the
Fridley City Council (Council) on April 11, 2022; and
Whereas, in its deliberations the Council determined Troy Brueggemeier should be appointed to the
HRA.
Now, therefore be it resolved, that the Mayor of the City of Fridley hereby appoints Troy
Brueggemeier to the HRA for a term expiring December 31, 2022.
Be it further resolved, that the City Council of the City of Fridley approves the appointment of Troy

The businesses listed in Resolution No. 2022-43have met all requirements, and paid all appropriate fees
established in Codefor their respective licenses. Staff have performed all necessary inspections and
checks to ensure all requirements have been satisfied.
The annual renewals for the 3.2% Off-Sale Liquor licenses for the three Speedway locations were not
included with the other license renewals on April 25, 2022 in Resolution No. 2022-35because the
applications werenotsubmitted to the City within the required deadline. The applications and
associated fees have since been received, and all necessary staff approvals have taken place.
The Fridley Lions Club is seeking approval of a Temporary On-Sale Intoxicating Liquor license for the
period of June 16 through June 19, 2022 for the Fridley 49ers Days festival at Commons Park, located at

551 61Ave NE. Chapters 602, 603, and 508of Fridley City Codeallow for a club, charitable, religious or
nonprofit organizationto sell and allow buyers to consume strong beer and wine at Commons Park or
Community Park during a community festival of broad community appeal and participation, such as
Fridley 49er Days.

All revenues for these licenses were anticipated as part of the 2022Budget.

Providing for the Sale of General Obligation Tax Abatement Bonds, Series 2022A
Whereas, the Fridley City Council (Council) has determined that it is necessary and expedient to issue
the City's $20,730,000 General Obligation Tax Abatement Bonds, Series 2022A (Bonds), to finance
the improvements to the park system as identified in the Park System Improvement Plan in the City;
and
Whereas, the City has retained Ehlers & Associates, Inc., in Roseville, MN (Ehlers), as its independent
municipal advisor for the Bonds in accordance with Minnesota Statutes § 475.60, subd. 2(9);
Therefore, be it resolved, that the City Council of the City of Fridley authorizes Ehlers to assist the
City for the sale of the Bonds.
Be it further resolved, that the Council shall meet at 7:00 p.m. on June 13, 2022, for the purpose of
considering proposals for and awarding the sale of the Bonds.
Be it further resolved, that in connection with said sale, the officers or employees of the City are
hereby authorized to cooperate with Ehlers and participate in the preparation of an official statement
for the Bonds and to execute and deliver it on behalf of the City upon its completion.

Calling for a Public Hearing on Proposed Property Tax Abatements
Whereas, Minnesota Statutes §§ 469.1812 through 469.1815 authorize the Fridley City Council
(Council), upon satisfaction of certain conditions, to grant an abatement of all or a part of the
taxes levied by the City of Fridley (City) on real property within its boundaries; and
Whereas, it is a legal requirement that the City hold a public hearing prior to adoption of a
resolution granting any property tax abatements; and
Whereas, a public hearing on the consideration of the property tax abatement will be held at the
time and place set forth in the Notice of Hearing attached hereto as Exhibit A and hereby made a
part hereof; and
Whereas, the City Manager is hereby authorized and directed to cause notice of said hearing in
substantially the form attached hereto as Exhibit A to be given one publication in
Publication at least 10 days but not more than 30 days before the hearing; and
Whereas, the Official Publication must be one of general interest and readership in the City, and
the notice must be published at least once.
Therefore, be it resolved, that the City Council of the City of Fridley calls for a public hearing to
be scheduled on May 23, 2022 at 7:00 p.m. to be held at Fridley City Hall, 7071 University Avenue
N.E. on the proposal that the City abate property taxes levied by the City on properties identified
in Exhibit A.

The total amount of the taxes proposed to be abated by the City on the Property for up to a 15-
year period is estimated to be not more than $20,735,255. The Council will consider the property
tax abatement to finance the Park System Improvement Plan improvements (Project) located in
the City. The City proposes to issue General Obligation Tax Abatement Bonds, Series 2022A
(Bonds) in the aggregate principal amount not to exceed $20,730,000, which will be used to
finance the Project. The City will use the property tax abatements to pay the principal of the Bonds.
All interested persons may appear at the Monday, May 23, 2022, public hearing and present their
views orally or in writing to cityclerk@fridleymn.gov.

Resolution No. 2022-48
Indicating Official Intent to Reimburse Original Expenditures from Bond Proceeds
Whereas, pursuant to Resolution No. 2022-46, the Fridley City Council (Issuer) has determined it
is necessary and expedient to issue General Obligation Tax Abatement Bonds, Series 2022A
(Bonds) to finance the improvements to the park system as identified in the Park System
Improvement Plan (Plan) in the City of Fridley (City); and
Whereas, the Internal Revenue Service has issued Section 1.150-2 of the Income Tax Regulations
(Regulations) dealing with the issuance of obligations all or a portion of the proceeds of which
are to be used to reimburse the payor for project expenditures made by such payor prior to the
date of issuance; and
Whereas, the Regulations generally require that the Issuer make a prior declaration of its official
intent to reimburse itself for such prior expenditures out of the proceeds of a subsequently issued
borrowing no later than 60 days after payment of such expenditure, that the borrowing occur and
the reimbursement allocation be made from the proceeds of such borrowing within eighteen
months of the payment of the expenditure or, if longer, within eighteen months of the date the
project is placed in service, but in no event more than three years after the date the original
expenditure was paid and that the expenditure must either be a capital expenditure, or a cost of
issuance of the obligation; and
Whereas, the Issuer desires to comply with requirements of the Regulations with respect to the
Plan in order to preserve the option of the Issuer to reimburse costs of the Project with tax-exempt
obligations System Improvement Plan; and
Whereas, the total cost of the Project is approximately $20,000,000, exclusive of financing costs
and capitalized interest, and the Issuer intends to finance all or a portion of the costs of the Project
from proceeds of a borrowing; and
Whereas, the maximum amount of debt to be issued for the Project is $20,730,000, plus costs of
issuance and capitalized interest; and
Whereas, as of the date hereof, there are no Issuer funds reserved, allocated on a long-term basis
or otherwise set aside (or reasonably expected to be reserved, allocated on a long term basis or
otherwise set aside) to provide permanent financing for the expenditures related to the Project;
and
Whereas, t

within the meaning and content of the Regulations.
