MINUTES CALL TO ORDER Mayor Lund called the City Council Meeting of October 10, 2022, to order at 7:00 p.m. PRESENT Mayor Scott Lund Councilmember Dave Ostwald Councilmember Tom Tillberry Councilmember Stephen Eggert Councilmember Ann Bolkcom Walter Wysopal, City Manager Joe Starks, Finance Director Brandon Brodhag, Assistant Director of Public Works Dan Cahill, Neighborhood Preservation Specialist Mary Dooher, Rental Housing Manager Scott Hickok, Community Development Director Sarah Sonsalla, City Attorney PLEDGE OF ALLEGIANCE PROCLAMATIONS/PRESENTATIONS APPROVAL OF PROPOSED CONSENT AGENDA Motion made by Councilmember Tillberry to adopt the proposed Consent Agenda. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. APPROVAL OF MINUTES 1. Approve the Minutes from the City Council Meeting of September 26, 2022. 2. Receive the Minutes from the City Council Conference Meeting of September 26, 2022. 3. Receive the Minutes from the Planning Commission Meeting of September 21, 2022. City Council Meeting 10/10/2022 Minutes Page 2 NEW BUSINESS 4. Resolution No. 2022-113, Adopting the Assessment for 2022 Utility Lateral Repair Projects. 5. Resolution No 2022-114, Accepting and Confirming Statutory Tort Limits. 6. Resolution No. 2022-115, Approving 2023 Agreement for Residential Recycling Program Grant with Anoka County. 7. Resolution No. 2022-116, Certifying Certain Delinquent Utility Services and Other Unpaid Charges for Collection with 2023 Property Taxes. CLAIMS 8. Resolution No. 2022-117 Approving Claims for the Period Ending October 5, 2022. OPEN FORUM, VISITORS: Consideration of Items not on Agenda – 15 minutes. rd A resident commented that he believed the 53 Avenue sidewalk was going to be discussed tonight. Staff replied that is anticipated to be on a future agenda in late November or early December. ADOPTION OF REGULAR AGENDA Wally Wysopal, City Manager, said staff recommends that Item 11 be removed from the agenda, as there is information that the project may not be fully completed this year. He stated that the practice of the City is to wait for the project to be more complete prior to holding the public hearing, which would most likely be next June. He highlighted some of the delays the project has experienced. Brandon Brodhag, Assistant Director of Public Works, reviewed the work that is currently underway for that project and the potential timeline for additional work. A resident asked if the delayed assessment could potentially raise the interest rate that would be charged. Joe Starks, Finance Director explained how the interest rate is calculated and stated that for this case he would cap the interest rate at what has been communicated to residents. Motion made by Councilmember Ostwald to adopt the regular agenda as amended. Seconded by Councilmember Eggert. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. Public Hearing and Resolution No. 2022-110, Adopting the Assessment for 2022 Nuisance Abatements and 2022 Rental Reinspection Fees Motion made by Councilmember Ostwald to open the public hearing. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY, AND THE PUBLIC HEARING OPENED AT 7:18 P.M. Joe Starks reviewed the proposed resolution which would adopt the assessment for 2022 nuisance abatements and 2022 rental reinspection fees. He provided a revised assessment roll which removed properties that have paid and those that cannot be assessed. Motion made by Councilmember Bolkcom to accept the revised assessment roll into the record. Seconded by Councilmember Tillberry. Multiple residents spoke in opposition of the proposed assessments they received for nuisance abatements and rental reinspection fees. Dan Cahill, Neighborhood Preservation Specialist, and Mary Dooher, Rental Housing Manager, provided additional details on the incidents that occurred and notices that were sent. Joe Starks provided additional details on the assessment process and the last date that residents are able to make payments before certification occurs. Motion made by Councilmember Eggert to close the public hearing. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY, AND THE PUBLIC HEARING CLOSED AT 8:05 P.M. Motion made by Councilmember Bolkcom to adopt Resolution No. 2022-110, Adopting the Assessment for 2022 Nuisance Abatements and 2022 Rental Reinspection Fees. Seconded by Councilmember Ostwald. Council said they recognized the difficulties of COVID and stressed the importance of communication with staff to address these issues and prevent them from reaching this step. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 10. Public Hearing and Resolution No. 2022-111, Adopting the Assessment for 2022 Street Rehabilitation Project No. ST-2021-01 City Council Meeting 10/10/2022 Minutes Page 4 Motion made by Councilmember Tillberry to open the public hearing. Seconded by Councilmember Bolkcom. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING OPENED AT 8:12 P.M. Joe Stark provided an overview of the project, its timeline and explained the special assessment process and the appeal process. He stated the City Clerk has not received any written objections to the assessment prior to this hearing. He provided details on the City’s pavement management plan. He reviewed the proposed assessment roll and explained the difference from $3,000 to $3,200 is due to an increase in asphalt pricing which is within the assessed portion of the project. He also reviewed details on options for payment of the assessment. The Council asked for details on the watermain replacement and other utility work. Brandon Brodhag, Assistant Public Works Director, provided details on the utility work that was completed and how that is funded. A resident asked why the elimination of the watermain work did not reduce the assessment. The resident also noted other conflicting information related to the assessment roll and expressed concern with the proposed interest rate. Brandon Brodhag noted that only the street work was assessed and therefore utility work is not included in the assessment. Joe Starks addressed the other assessment-related questions and concerns of the resident. Motion made by Councilmember Tillberry to close the public hearing, Seconded by Councilmember Ostwald. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 8:36 P.M. Motion made by Councilmember Eggert to adopt Resolution No. 2022-111, Adopting the Assessment for 2022 Street Rehabilitation Project No. ST-2021-01. Seconded by Councilmember Ostwald. UPON A VOICE VOTE, ALL VOTING AYE, MAYOR LUND DECLARED THE MOTION CARRIED UNANIMOUSLY. 11. Public Hearing and Resolution No. 2022-112, Adopting the Assessment for 2022 Street Rehabilitation Project No. ST-2022-01 This item was removed from the agenda.
