Resolution No. 2022-133 Approving Special Use PermitResolution No. 2022-133 Approving Special Use Permit, SP #22-000001 to Allow a Coffee Shop Use at 7280 Commerce Circle East Whereas, Section 205.17.01.C.3 of the Fridley City Code allows commercial retail, service uses, and Class II restaurants, provided certain code conditions are met, in the M-1, Light Industrial zoning district by a Special Use Permit; and Whereas, on November 16, 2022, the Planning Commission held a public hearing to consider a request by Wild Things Unlimited for the property located at 7280 Commerce Circle East, legally described as Lots 1-5 and 12, Block 2, Paco Industrial Park, for Special Use Permit, SP #22-000001 to allow a coffee shop within their retail and warehouse space; and Whereas, at the November 16, 2022, meeting, the Planning Commission unanimously recommended approval of Special Use Permit, SP #22-000001 with the stipulations represented in Exhibit A; and Whereas, on November 28, 2022, the Fridley City Council approved the stipulations in Exhibit A to this resolution as the conditions on Special Use Permit, SP #22-000001; and Whereas, the petitioner, Wild Things Unlimited was presented with Exhibit A, the conditions for SP #22-000001 at the November 28, 2022, City Council meeting; and Whereas, Section 205.05.5.G of the Fridley City Code states that this Special Use Permit will become null and void one year after the City Council approval date if work has not commenced or if the petitioner has not petitioned the City Council for an extension. Now, therefore be it resolved, that the City Council of the City of Fridley hereby approves Special Use Permit, SP #22-0001 and the stipulations represented in Exhibit A are hereby adopted by the City Council of the City of Fridley. Lund – Mayor Attest: Melissa Moore – City Clerk Exhibit A Stipulations 1. The petitioner shall obtain any permits needed for building alterations for the proposed use. 2. The petitioner shall pay sewer availability charge (SAC) fee if required prior to operating the coffee shop. 3. The petitioner shall obtain a food license from the City and any other licenses required by Anoka County or the State of Minnesota to sell food and beverages. 4. The petitioner or property owner shall complete a traffic study, if staff determines that excess traffic in the area has been created by the proposed use. 5. The property owner or management company is responsible for informing prospective tenants that the property is zoned for industrial use only. Any other commercial uses currently in the building may need to apply for a special use permit or vacate the property when their lease expires. 6. There shall be no outdoor storage or outdoor display of merchandise on the property unless a permit has been applied for and issued by the City. 7. Per Section 205 of the Fridley City Code, this Special Use Permit will become null and void one year after the City Council approval date if work has not commenced or if the Petitioner has not petitioned the City Council for an extension.
